SUBJECT: 110 West Midway Drive -Request for modification of a nonconfominguse
(Tracking 1Vo. MIS 2004-00090}
At a scheduled Zoning Administrator meeting on November 24, 2004, Annika M. Santalahti,
Zoning Administrator, considered your request for approval to modify an existing nonconforming
use to establish an office and retail variety/convenience store at 110 West Midway Drive as an
accessory use to the existing adjacent Anaheim Resort RV Park, under authority of subsections
18.56.030.030 (Modification of Use) and 18.60.020.040 (Modifications Related to
Nonconfonnities) of the Anaheim Municipal Code.
The applicant, Paul Bostwick, spoke at the meeting. No one else indicated their presence
regarding this request.
The Zoning Administrator made the following findings:
1. That the underlying property is developed with a 5,227 sq.ft. building in the
I (SABC) "Industrial -South Anaheim Boulevard Corridor Overlay" zone. The adjacent.6.6-acre
RV Park, for which this office and retail variety/convenience store is proposed, contains.189 RV
rental spaces. Except for the RV Park and an adjacent mobile home park, the nearby land uses
are non-residential (commercial, industrial and school-related).
2. That the applicant submitted a letter dated September 9, 2004, describing the
proposal, plans (a site plan labeled Exhibit No. I and a floor plan labeled Exhibit No. 2)
illustrating the proposed 576 sq.ft. retail market/convenience store, and photographs of the
building showing the north and east elevations facing Midway Drive and Anaheim Boulevard
(labeled Exhibit Nos. 3 and 4).
3. That the Staff Report to the Zoning Administrator dated November 24, 2004, further
describes the proposal, including the hours of operation (7:30 am to 8 p.m. daily) and that the
store will provide convenience items and services for the Anaheim Resort RV Park customers
only and is not intended to serve the general public.
4. That the proposed retail variety/convenience store will be accessory to the existing
RV Park and is intended to serve the RV park customers only and not the general public.
5. 'That the proposal to modify the~existing legal nonconforming 576 sq.ft. club
room/office (as shown on the submitted site plan) to an office and retail variety/convenience
store, which will be accessory to the existing RV Park, is similar in nature, but lesser or equal in
intensity and impact including required number of parking spaces, to the existing use.
