DATE NOTICES MAILED: January 6, 2006 REQUEST: Waiver of the minimum required rear setback to construct a balcony and enclosed patio to the rear of a single family home in the RS-3 (SC) (Single-Family Residential; Scenic Corridor Overlay) Zone under authority of Code Section No. 18.62.040.020.0201: SECTION NO. 18.04.100.010.0101 - Minimum rear vard setback 15 feet required; 12 feet proposed) DETERMINATION OF THE ZONING ADMINISTRATOR Having been appointed Zoning Administrator by the Planning Director to decide the above-referenced administrative adjustment, and subject petition having been duly noticed and no written objections having been received, I do hereby find, pursuant to Section 18.62.040.060 (Findings) of the Anaheim Municipal Code: That the request is hereby granted in accordance with Subsection 18.62.040.010 of the Anaheim Municipal Code which permits waiver of minimum rear yard setback in connection with administrative adjustments; 2. That no written opposition was received during the required 10-day notification period which ended on January 18, 2006; Findin s If written opposition is received during the 10-day notification period, the petitioner may either (a) withdraw the request (in which case no further action will be taken regarding the proposal) or (b) request that a public hearing be scheduled (in which case notice of the public hearing including the time and place will be given pursuant to Chapter 18.60 and subsection 18.62.040.050 of the Anaheim Municipal Code). That no written opposition regarding the proposed waiver was received during the required 10- day notification period, which ended on January 18, 2006 at 5:00 p.m. Based on the evidence presented to me, I do hereby determine to grant Administrative Adjustment No. 2005-00284, subject to the following conditions: ZA\decision\adj2005-00284.doc - 1 of 2 - ZA2006-2 • 1. That the applicant shall install trees to the rear of the balcony so as to provide privacy screening at the northwest corner of the subject property. Said trees shall be a minimum 15-gallon in size, have a maximum canopy height of thirty (30) feet, and shall be shown on plans submitted for building permits. 2. That subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit Nos. 1 (Site Plan) and 2 (Structural Plan). 3. That within a period of one (1) year from the date of this decision, the appropriate permit(s) shall be obtained from the City of Anaheim for the approved single-family dwelling. Extensions for further time to complete this condition may be granted in accordance with Section 18.60.170 (Extension of Time to Comply with Conditions of Approval) of the Anaheim Municipal Code. 4. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement.
