Resolution-ZA 2006-08 DECISION NO. ZA 2006-8 • A DECISION OF THE ZONING ADMINISTRATOR APPROVING TENTATIVE PARCEL MAP NO. 2006-129 OWNER: Robert and Anita Zantos 10002 Deerhaven Drive Santa Ana, CA 92705 AGENT: JP KAPP Civil Engineers 19652 Highridge Way Trabuco Canyon, CA 92678 LOCATION: 1200-1230 North Kraemer Boulevard: Property is approximately 2.5 acres, located at the northeast corner of Coronado Street and Kraemer Boulevard. CEQA STATUS: CEQA Categorical Exemption -Class 15 PUBLIC HEARING DATE: May 11, 2006 OPPOSITION: No one indicated their presence at the public hearing in opposition and no correspondence in opposition was received. REQUEST: Approval of a tentative parcel map under authority of substance 18.60.020.030 (Tentative Parcel Maps) of the Anaheim Municipal Code to establish a 2-lot industrial subdivision for an existing industrial complex. Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code Section 18.60.020 (Establishment of Zoning Administrator Position), to decide the above- referenced petition and a public hearing having been duly noticed for and held on the date set forth above, I do hereby find: i . That the proposed map is consistent with the applicable General Specific Plan; 2. That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat; 3. That the design of the subdivision or the type of improvements are not likely to cause serious public health problems; and 4. That the design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of the property within the proposed subdivision. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS: That the Planning Director or her authorized representative has determined that the proposed project is Categorically Exempt -Class 15, under Section of the State of California Environmental Quality Act Guidelines. SUBTPM No. 2006-129.doc - 1 of 2 - ZA2006-08 • Based on the evidence and testimony presented to me, I do hereby determine to approve Tentative Parcel Map No. 2006-129, subject to the following conditions: 1. That the legal property owner shall execute an unsubordinated restricted covenant concerning the proposed shared driveway. The a~eerx-er~t unsubordinated restricted covenant shall include provisions for the maintenance of the driveway and recordation of an ingress/egress easement for the benefit of Parcels 1 and 2. The a~ree~eni unsubordinated restricted covenant shall be in a form approved by the City Attorney's Office and shall be recorded concurrently with the Parcel Map. 2. That an unsubordinated restricted covenant providing reciprocal access and parking approved by Planning Services Division and in a form satisfactory to the City Attorney shall be recorded with the Office of the Orange County Recorder. A copy of the recorded covenant shall then be submitted to the Development Services Division. In addition, provisions shall be made in the covenant to guarantee that the entire complex shall be managed and maintained as one (1) integral parcel for purposes of parking, vehicular circulation, signage, maintenance, land usage and architectural control, and that the covenant shall be referenced in all deeds transferring all or any part of the interest in the property. 3. That prior to final map approval, a maintenance covenant shall be submitted to the Subdivision Section and approved by the City Attorney's Office. The covenant shall include provisions for maintenance of private facilities, t~lar~ and a maintenance exhibit. The covenant shall also include provisions for regular landscape maintenance, removal of trash and debris, and removal of graffiti within twenty-four (24) hours from time of occurrence. This covenant shall be recorded concurrently with the final map. 4. (Deleted at the public hearing) > > 5. That prior to final map approval, the final map shall be submitted to and approved by the City of Anaheim and the Orange County Surveyor and then shall be recorded in the Office of the Orange County Recorder (Subdivision Map Act, Section 66499.40). 6. That prior to final parcel map approval, Condition Nos. 1, 2, and 3, herein-mentioned, shall be complied with. 7. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement. This decision is made, signed, and entered into the file this 15th day of May, 2006.
