LOCATION: 1371 North Miller Street: This rectangularly-shaped, 4.69-acre property has a
frontage of 315 feet on the west side of Miller Street, a maximum depth of 615 feet
and is located 800 feet north of the centerline of Miraloma Avenue

HEARING DATE: November 9, 2006
OPPOSITION: That nobody indicated their presence at the public hearing in opposition and no
correspondence in opposition was received.
REQUEST: Approval of a tentative parcel map under authority of 18.60.020.030 (Tentative Parcel
Maps) of the Anaheim Municipal Code to establish a 2-lot industrial subdivision for an
existing industrial complex.
Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal
Code Section 18.60.020 (Establishment of Zoning Administrator Position), to decide the above-
referenced petition and a public hearing having been duly noticed for and held on the date set forth
above, I do hereby find:
1. That the proposed map is consistent with the applicable General Specific Plan;
2. That the design of the subdivision or the proposed improvements are not likely to cause
substantial environmental damage or substantially and avoidably injure fish or wildlife or their
habitat;
3. That the design of the subdivision or the type of improvements are not likely to cause serious
public health problems; and
4. That the design of the subdivision or the type of improvements will not conflict with easements,
acquired by the public at large, for access through or use of the property within the proposed
subdivision.

CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS: That the Planning Director or her
authorized representative has determined that the proposed project is Categorically Exempt -Class 15,
under Section of the State of California Environmental Quality Act Guidelines.
Based on the evidence and testimony presented to me, I do hereby determine to approve Tentative
Parcel Map No. 2006-179, subject to the following conditions:
1. That prior to final map approval, a maintenance covenant and reciprocal access agreement, shall
be submitted to the Subdivision Section and approved by the City Attorney's office. The covenant
shall include provisions for maintenance of private facilities and a maintenance exhibit. The
covenant shall be recorded concurrently with the final map.
2. That an unsubordinated restricted covenant providing reciprocal access and parking approved by
Planning Services Division and in a form satisfactory to the City Attorney shall be recorded with the Office
of the Orange County Recorder. A copy of the recorded covenant shall then be submitted to the
Development Services Division. In addition, provisions shall be made in the covenant to guarantee that
the entire complex shall be managed and maintained as one (1) integral parcel for purposes of parking,
vehicular circulation, signage, maintenance, land usage and architectural control, and that the covenant
shall be referenced in all deeds transferring all or any part of the interest in the property.
3. That there shall be a recorded use agreement satisfactory to the City Attorney's office for all parcels
sharing fire protection equipment and associated appurtenances.
4. That prior to final map approval, the final map shall be submitted to and approved by the City of
Anaheim and the Orange County Surveyor and then shall be recorded in the Office of the Orange
County Recorder (Subdivision Map Act, Section 66499.40).
That the developer shall submit street improvement plans prepared by a licensed Civil Engineer to
the Public Works Department, Subdivision Section to improve North Miller Street. A 5-foot wide
sidewalk and 8-foot wide landscaped parkways shall be constructed in conformance with Public
Works Standard Details 110 and 160-A. Parkway irrigation shall be connected to the on-site
irrigation system and maintained by the property owner. A Right-of-Way Construction Permit shall
be obtained from the Subdivision Section for all work performed in the right-of-way. The
improvements shall be constructed prior to final map approval.
6. That prior to final map approval, all parcels shall be assigned street addressed by the Building
Division.
7. That each parcel shall provide a separate double trash enclosure for each building.
8. That approval of this parcel map is granted subject to the approval of Administrative Adjustment No.
2006-00294 now pending.
That prior to final parcel map approval, Condition Nos. 1, 2, 3, 5, 6, 7, and 8, herein-mentioned, shall
be complied with.
10. That approval of this application constitutes approval of the proposed request only to the extent that
it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and
Federal regulations. Approval does not include any action or findings as to compliance or approval
of the request regarding any other applicable ordinance, regulation or requirement.

NOTICE: This decision shall become final unless an appeal to the City Council, in writing, accompanied
by an appeal fee, is filed with the City Clerk within ten (10) days of the date of the signing of this decision
or unless members of the City Council shall request to review this decision within said 7 days.
