A RESOLUTION OF THE ANAHEIM ZONING ADMINISTRATOR
THAT PETITION FOR VARIANCE NO. 2006-04706 BE GRANTED
(5735 EAST LA PALMA AVENUE)
WHEREAS, the Anaheim Zoning Administrator did receive a verified Petition for Variance for
certain real property situated in the City of Anaheim, County of Orange, State of California described as:
LOT 1 OF PARCEL MAPS RECORDED IN BOOK 85, PAGE 20 OF MAPS IN
THE OFFICE OF THE ORANGE COUNTY RECORDER
WHEREAS, the Zoning Administrator did continue said item from the April 26 and May 10, 2007
meetings and did hold a public hearing at the Civic Center in the City of Anaheim on May 24, 2007 at 9:30 a.m.,
notice of said public hearing having been duly given as required by law and in accordance with the provisions of
the Anaheim Municipal Code, Chapter 18.60 "Procedures", to hear and consider evidence for and against said
proposed variance and to investigate and make findings and recommendations in connection therewith; and
WHEREAS, said Zoning Administrator, after due inspection, investigation and study made by
itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find
and determine the following facts:
1. That the petitioner requests a waiver of the following to permit a new wall sign on an
existing retail building:

2. That given the substantial distance of the building to the public right-of-way, and the minimal
visibility of the building due to the building setback, that there are special circumstances applicable to the
property such as size, shape, topography, location or surroundings, which do not apply to other identically
zoned properties in the vicinity to justify the requested waiver of maximum letter height for wall signage.
3. That nobody indicated their presence at said public hearing in opposition, and that no
correspondence was received in opposition to subject petition.
CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: The Planning Director's authorized
representative has determined that the proposed project falls within the definition of Categorical Exemptions,
Section 15311, Class 11 (Accessory Structures), as defined in the State CEQA Guidelines and is, therefore,
exempt from the requirement to prepare additional environmental documentation.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim Zoning Administrator does hereby
grant subject Petition for Variance, upon the following conditions which are hereby found to be a necessary
prerequisite to the proposed use of the subject property in order to preserve the safety and general welfare of
the Citizens of the City of Anaheim:
1. That all on-site signage shall be maintained in "like-new" condition at all times.

2. That forty (40) inch high signs shall be permitted for all tenant spaces in the commercial center
with a minimum floor area of 10,000 square feet. All tenant spaces with a floor area of less than 10,000 square
feet shall comply with Zoning Code requirements pertaining to wall signage.
3. That the subject property shall be developed substantially in accordance with plans and
specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning
Department marked Exhibit Nos. 1 and 2, as conditioned herein.
4. That prior to issuance of a building permit, or within a period of one (1) year from the date of this
resolution, whichever occurs first, Condition Nos. 1,above-mentioned, shall be complied with. Extensions for
further time to complete said conditions may be granted in accordance with Code Section No. 18.03.090 of the
Anaheim Municipal Code.
5. That approval of this application constitutes approval of the proposed request only to the extent
that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State, and Federal
regulations. Approval does not include any action or findings as to compliance or approval of the request
regarding any other applicable ordinance, regulation or requirement.
BE IT FURTHER RESOLVED that the Anaheim Zoning Administrator does hereby find and
determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all
of the conditions hereinabove set forth. Should any such condition, or any part thereof, be declared invalid or
unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any
approvals herein contained, shall be deemed null and void.
BE IT FURTHER RESOLVED that the applicant is responsible for paying all charges related to
the processing of this discretionary case application within 15 days of the issuance of the final invoice or prior to
the issuance of building permits for this project, whichever occurs first. Failure to pay all charges shall result in
delays in the issuance of required permits or the revocation of the approval of this application.
THE FOREGOING RESOLUTION was adopted at the Zoning Administrator meeting of May 24,
2007. Said resolution is subject to the appeal provisions set forth in Chapter 18.60, "Procedures" of the
Anaheim Municipal Code pertaining to appeal procedures and may be replaced by a City Council Resolution in
the event of an appeal.

of June 21, 2007.

LOCATION: 3340 West Ball Road: This rectangularly-shaped, 0.55 acre
property has a frontage of 170 feet on the south side of Ball Road, a
maximum depth of 140 feet and is located approximately 169 feet
west of Oakhaven Drive.
Tentative Parcel Map No. 2007-140 -The applicant requests to establish a 1-lot, 10-
unit airspace commercial office subdivision.
ACTION: The Anaheim Zoning Administrator has reviewed the proposal to establish a
1-lot, 10-unit airspace commercial office subdivision and does hereby approve a CEQA
Categorical Exemption, Section 15315, Class 15 (Minor Land Divisions), as defined in
the State CEQA (California Environmental Quality Act) Guidelines.
The Anaheim Zoning Administrator does hereby determine that the proposed tentative
map, including its design and improvements, is consistent with the Anaheim General
Plan, and does therefore approve Tentative Parcel Map No. 2007-140, to establish a 1-
lot, 10-unit commercial office subdivision subject to the following conditions:
1. That an unsubordinated restricted covenant providing reciprocal access and parking
approved by Planning Services Department and in a form satisfactory to the City
Attorney shall be recorded with the Office of the Orange County Recorder. A copy of
the recorded covenant shall then be submitted to the Development Services Division. In
addition, provisions shall be made in the covenant to guarantee that the entire complex
shall be managed and maintained as one (1) integral parcel for purposes of parking,
vehicular circulation, signage, maintenance, land usage and architectural control, and
that the covenant shall be referenced in all deeds transferring all or any part of the
interest in the property.
2. That prior to final map approval, a maintenance covenant shall be submitted to the
Subdivision Section and approved by the City Attorney's Office. The covenant shall
include provisions for maintenance of private facilities, and a maintenance exhibit.
The covenant shall also include provisions for regular landscape maintenance,

removal of trash and debris, and removal of graffiti within twenty-four (24) hours from
time of occurrence. This covenant shall be recorded concurrently with the final map.
3. That prior to the earlier of either the conveyance of the first commercial airspace
attached condominium unit {"Units") or the issuance of the temporary or
permanent "Certificate of Occupancy" for the first unit approved in connection with
Parcel Map 2007-140, applicant shall execute and record with the Orange County
Recorder a declaration of covenants, conditions and restrictions ("CC&Rs"}
satisfactory to the California Department of Real Estate creating maintenance
obligations, including compliance with the approved Water Quality Management
Plan, and to establish a financial mechanism or financial mechanisms to maintain
all of the building exteriors and improvements located on the property except for (i)
the Units which are owned by the individual owners and (ii) any exclusive use
easements or other areas designated for maintenance by the individual owner of
the Unit as specified in the CC&Rs.
4. That the developer shall construct sidewalk and public parkway landscape
improvements on Ball Road in conformance to Public Works Standard Detail Nos.
160 and 110-B. The sidewalk and landscaping shall conform to the Bal! Road
Corridor Master Plan. The developer shall submit plans to the Department of
Public Works, Development Services Division for review and approval and then
obtain a Right of Way Construction Permit. Prior to final map approval, a faithful
performance bond in a form approved by the City Attorney and in an amount to be
determined by the City Engineer, shall be posted to guarantee construction of the
required improvements and furthermore, that the required improvements shall be
constructed within ninety (90} days of the approval of the final map.

6. That the legal owner of subject property shall provide the City of Anaheim with a
public utilities easement (dimensions will vary with electrical deign), alonglacross high
voltage lines, low voltage lines crossing private property and around aA pad mounted
transformers, switches capacitors, etc. said easement shall be submitted to the City
of Anaheim prior to connection of electrical service.
7. That prior to final map approval, the final map shall be submitted to and approved by
the City of Anaheim and the Orange County Surveyor and then shall be recorded in
the Office of the Orange County Recorder.
8. That prior to final parcel map approval, Condition Nos. 1 through 6, herein-
mentioned, shall be complied with.
9. That approval of this application constitutes approval of the proposed request only
to the extent that it complies with the Anaheim Municipal Zoning Code and any
