APPROVING A CEQA CAT~GORICAL EXEMPTION CLASS 15 AND
APf'ROVING TENTATiV~ PAKCF.I.. MAP NO. 2008-131
(1600 - 1650 NORTH KRAEMER AVENUE)
WEI~REAS, the Anaheim Zoning Administrator did receive an application for
7'entative Parcel Map No. 2008-1;1 for certain real property situated in the City of Anaheim,
County of Orange, State of California shown on Exltibit A, attached hereto and incorporated
herein by this reference; and
WHEREAS, the Zoning Administrator did hold a public hearing at the Civic Center
in the City of rlnaheim on June 5, 2008, at 9:30 a.m., notice of said public hearing having been
duly given as required by law and in accordance with the provisions of the Anaheim Municipal
Code, Chapter 18.60 "Procedures", to hear and consider evidence for and against said proposed
centative parcel map and to investigate and make findings and recominendations in connection
tlterewith; and that said public l~earing was continued to June 12, 2008; and
WHEREAS; said Zoning Adminisuator, after due inspection, investigation and
study made by itself and in its behalf, and after dt~e consideration of all evidence a~d reports
offered at said hearing, does find and determine the following facts:
That [he proposed subdivision, including its design and intprovemcnts, is consistent
with the General Plan and the Northeast Area Specific Ylu~, Development Area 1
(Industrial Area) designation far the properiy.
2. That the site is pliysically suitable for fhe Type and density of the existii~g
development, as proposed for subdivision.
3. That the design of the subdivision is not likely to cause substantial envuonmental
damage or subskantially and avoidably injure fsh or wildlife or their habitat as the
site is currently developed and no fiirther development is proposed as part of this
suUdivision.
4. That the design of the sabdivision or the type of improvements is not lilcely to
cause serious public health problems; as tl~e site is currently developed and no
further development is proposed as part of ttiis subdivision.
5. That the design of tlie subdivision or the type of improvements will not conflict
with easements, acquired by the public at large, for access throu~h or use of
property ~vitltin tlie proposed subdivision.

6. That no one indicated their presence at the pu6lic hearing in opposition; and that uo
coi~respondence ~ras received in opposition to tl~e subject request.
WHEREAS, the proposed project falls wifliin the definition of Categorical
Exe~nptions, Section 15315, Class 15 (Minor Land Divisions), as defined in the State CEQA
Guidelines and is, therefore, exempt from the requirement to prepare additional environniental
documentation.
NOW, TH~REFORE, BG IT RESOLVED that the Anaheim Zoning Administrator
does hereby approve Tentative Parcel Map No. 2008-131, upon the following conditions which
aze hereby found to be a necessary prerequisite to the proposed use of tlie subject property in
order to preserve the heath, safety and general welfare of the Citizens of tlie City of Matieim:

1 An unsubordinated restrictive cov~nant approved by the Planning
Planning Services Division of the Planning Deparhnent and

shall be recorded witl~ the Office of the Orange County Public Works -
Recorder to (a) provide reciprocal access; (b) allow~ the use Devclopment

guarantee that the property shall be managed and maintaiued

maintenance of shared facilities and common signage; and

4 There shall be a recorded use agreement satisfactory to the Fire

5 That a final map sliall be submitted to and approved by ttie Planning
Ciry of Anaheim and the Orange Couuty Surveyor. Following
approval, Uze final parcel map shall be recorded in flte Offiee Public Works -

6 That the subject property shall be developed substantially in Pla~ming
accorda~ice ~vith plans and specifications submitted to the
City of Anaheim by the applicant and wluch plans aze on tile
with the Planning Depaztment marked Exhibit No. 1.
7 That approval of this application constitutes approval of the Pla~v~ing
proposed request only to the extent that it complies with the
Anal~eim Municipal Zoning Code and any other applicable
City, State and Federal regulations. Approval does ~ot
include any acrion or findings as to compliance or approval
of the request regarding any other applicable ordinance,
regulaiion or requirement.
8 That timing for compliauce with conditions oi' approval may Planning

(ii) the modification complies with the Anaheim Municipal

BE IT FURTHER RESOLVED that the Anaheim Zoning Administrator does
hereby find and deterniine that adoption of this Resolution is expressly predicated upon
applicant's compliance with each and all of the conditions hereinabove set forth. Should a~ry
such condition, or any part thereof, be declared invalid or uneuforceable by the final judgment of
~ny court of competent jurisdiction, then this Resolution, and any approvals lierein contained,
shall be deemed null and void.
BE IT FURTHER RESOLVED that the applicant is respoixsible for paying all
charges related to the processing of this discretionary case application within 15 days of the
issuance oP the final invoice. Failure to pay all charges shall result in delays in thc issuance of
required permits or flie revocation of the approval of fhis application.
THE FOREGOING RESOLUTION was adopted at the Zoning Administrator
meeting of June 12, ?008. Said resolution is subject to the appeal pravisions set forth in Chapter
13.60 "Procedures" of the Anaheim Municipal Code pertaining to appeal procedures and may be
replaced by a City Council Resolution in the event of an appeal.
