A RESOLUTION OF THE ANAHEIM ZONING ADMINISTRATOR
APPROVING A CEQA CATEGORICAL EXEMPTION CLASS 1 I AND
APPROVING SPECIAL CIRCUMSTANCES WAIVER NO. 2008-00038 "
(1515 EAST KATELLA AVENUE)
WHEREAS, the Anaheim Zoning Administrator did receive an application for
Special Circumstances Waiver No. 200&00038 to permit four metal banners for a period of five
years to advertise the rental of new apartrnent units for certain real property situated in the City of
Anaheim, County of Orange, State of California shown on Exhibit "A", attached hereto and
incorporated herein by this reference; and
WHEREAS, the Zoning Adminisfrator did hold a publio meeting at the Civic
Center in the City of Anaheim on September 4, 2008, at 930 a.m., notice of said public meeting
having been duly given as required by law and in accordance with the provisions of the Anaheim
Municipal Code to consider evidence for and against said proposed special circumstances waiver
and to investigate and make findings and recommendations in connection therewith; and
WIIEREAS, said Zoning Administrator, after due inspection, investigation and
study made by itself and in its behalf, and after due consideration of all evidence and reports
offered at said heazing, does find and determine the following facts:
1. That the proposed four (4) temporazy metal banner signs, in conjunction with the
existing freestanding sign, aze appropriate to advertise a large aparhnent development in The
Platinum Triangle.
2. That the design of the metal banner signs is attractive and compatible with the
azchitechire of the apartment building.
3. That no one indicated their presence at the public meeting in opposition; and that no
correspoudence was received in opposition to the subject request.
WHEREAS, the proposed project falls within the definition of Categorical
Exemptions, Section 15311, Class 11 (Accessory Structures), as defined in the State CEQA
Guidelines and is, therefore, exempt from the requirement to prepare additional environmental
documentation.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim Zoning
Administrator does hereby approve Special Circumstances Waiver No. 2008-00038 subject to
the conditions of approval described in Exhibit "B" attached hereto and incorporated by this
reference which are hereby found to be a necessary prerequisite to the proposed use of the
subject property in order to preserve the heath, safety and general welfare of the Citizens of the
City of Anaheim:
BE IT FURTHER RESOLVED that the Anaheim Zoning Administrator does
hereby find and determine that adoption of this Resolutlon is expressly predicated upon

applicant's compliance with each and all of the conditions hereinabove set Porth. Should any
such condition, or any part thereof, be declared invalid or unenPorceable by the final judgment of
any court of eompetentjurisdictioiz, then this Resolution, and auy appravals herein contained,
shall be deeined nul! and void.
BE IT FURTHER RE50LVED that ihe applicant is responsible for paying all
charges related to the processing of this discretionazy case application within 15 days of the
issuance of the final invoice. Failure to pay all charges shall result in delays in the issuance of
required permits or the revocation of the approval of this application.
THE FOREGOING RESOLUTION was adopted at the Zoning Administrator
meetiiig of September 4, 2008. Said resolution is subject to the appeal provisions set forth in
Chapter 18.60 "Procedures" of tl~e Anaheim Municipal Code pertaining to appeal procedures and
may be replaced by a City Council Resolution in the event of an appeal.

1 That plans submitted for-building permits shall indicate a Planning
maximum of four (4) metal banners.
2 That the applicant shall obtain a Special Event Permit. Planning
GENERAL GONDITIONS
3 That this Special Circumstances Waiver shall expire on Planning
September 4, 2013, upon which time all signs shall comply
with Code in effect at that time.
4 That the banners shall be kept clean, neatly maintained, with Code
no missing sign copy, or dented or faded material. An un- Enforcement
maintained or damaged portion of the banners shall be repaired
or replaced immediately. Noncompliance shall constitute a
public nuisance and shall be subject to termination of this
permit.
5 That subject property shall be developed substantially in Planning
accordance with plans and specifications submitted to the City
of Anaheim by the applicant and which plans aze on file with
the Planning Department marked Exhibit Nos. 1 through 3, and
as conditioned herein.
6 That the timing for compliance with conditions of approval Planning
may be amended by the Planning Director upon a showing of
good cause provided (i) equivalent timing is established that
satisfies the original intent and purpose of the condition(s), (iij
the modification complies with the Anaheim Municipal Code
and (iii) the applicant has demonstrated significant progress
towazd establishment of the use or approved development.
7 That extension for further time to complete conditions of Planning
approval may be granted in accordance with Section 18.60.170
of the Anaheim Munici al Code.
8 That approval of this application constiriztes approval of the Planning
proposed request only to the extent that it complies with the
Anaheim Municipal Zoning Code and any other applicable
City State and Federal regulations. Approval does not include
any action or findings as to compliance or approval of the
request regazding any other applicable ordinance, regulation or
requirement.
