Councilman Coons moved that it be the finding of the City Council
that the total assessed valuation of the property protesting the annexation
does not exceed 50% of the ~otal assessed valuation of the area proposed for
annexation. Councilman Fry seconded the motion. MOTION CARRIED.
Mrs. Duane Duncan, 8101 Siesta Street; Mr.. Gillett~ 8082 Moraga
Street; and Mr. Henry Grask~, 8101 Ventura Street, addressed the Council,
requesting information regal, ding the original petition requesting annexation$
the protests filed; city services in the area, and possible tax increase.
Mr. Davis, AdminiStrative Assistant, explained the annexation
procedure and answered thei~ questions concerning city services and taxes.
Discussion was held by the City Council., and Councilman Coons moved
that any further action on ~his annexation be deferred to allow sufficient
time for the City 5ngineer~ City Manager and City Clerk to spot on the map
the protesting properties~ ~nd that this public hearing be continued for
one week, May 17, 19600 Coqncilman Chandler seconded the motion. MOTION
CARRIED.
CONTINUED PUBLIC HEARING - VARIANCE NO. 12111 Submitted by Alpha Beta Food
Markets, Inc., requesting permission to erect a free-standing 6"ll""x 15'0"
sign on property presently Zoned C-l, located at 915 South Brookhurst Street
(west side of Brookhurst Street, north of Ball Road)°
The City Planning Commission, pursuant to their Resolution No. 184,
Series 1959-60, denied said variance.
Public hearing was continued from the meetings of March 29, 1960
and April 5, 1960, for further investigation and consideration of the proposed
sign ordinance°
The Mayor asked if anyone wished to address the Coum il.
Mr. Edwin Markson~ representing Alpha Beta, was present to answer
any further questions regar4ing their sign request.
The Mayor asked if anyone else wished to address the Council, there
being no response, declared ~ the hearing closed.
Discussion was held by the City Council and the plans reviewed.
The Council indicated that this particular application was a special

Mro Norman Ho Smedegaard advised the Council that the manufacturing
company has been on the property for t~en years and that the applicant wished to
move in the small warehouse building ~o extend his operations. Further, that
there was no opposition at the hearing for M-1 zoning before the City Planning
Commission° He questioned Condition No° 2 of the City Planning Commission's
resolution, calling for a 45 foot dedication from the center line of Miller
Street, when the agreement with the FLood Control District calls for the erection
of a bridge, 64 feet in width° He also called attention to an error in the
description contained in City Planning Commission Resolution No. 219, advising
that line one of the description was omitted, and should read, "The northerly
65 feet of the following .... "

Mro Murdoch advised that the 45 foot half width dedication is for a
standard secondary street and allows ~or a four lane street, which includes a
parkln9 lane on each side of the street and an area behind the curb for sidewalks,
utility services, and for parkway purposes, which makes a_64 foot street from
curb to curb. That if this area is being considered for industrial development,
perhaps a complete study of the street pattern should be made, and suggested
that the public hearing be continued to allow for possible visitation of the .-
area,~ including the building to be moved°
Councilman Thompson moved that the hearingson the house moving
application submitted by Robert Angle and application No° F-59-60-90, be con-
tinued for one week (May 17, 1960)o ~ouncilman Fry seconded the motion.

Mro Jim Kerwin, one of the APplicants, advised of their plans for a
small neighborhood shopping center, an¢] offered to answer any questions regarding

Mro Dan Sanford, 1802 Eo Verde Place, asked what type of uses were allowed
in the C-1 zone°
Mro Dick Reese read the allowable uses in the present C-1 zone, and the
uses in the proposed C-7 zone.
Mro Bob Kevorkian addressed %he Council and submitted an aerial photograph
of the area, and a petition signed by residents within 300 feet of the p~oposed
development, objecting to the granting of an unlimited C-1 zoning, and also a tract
map showing in color the properties re~)resented by the petition° That in his
opinion, the community at this time~ iS unable to support the type of community
stores proposed° Further, he believed the proposed parking area inadequate~ that
the development would create a traffic hazard, become a noise nuisance to the
surrounding residents, and would devaluate their property, not from a financial
standpoint but from a liveable standpoint, some of the homes being within 8 feet
of the .property lineo He further advised that there would be certain types of
commercial uses, such as a medical unit with sufficient off-street parking, that
the residents would not be opposed %o, however, they definitely were opposed to
unlimited C-1 zoning° That they would prefer the new proposed C-7 uses to the
present C-1 uses.
Mr. Joe Brower, 1838 Diana Avenue, addressed the Council, asking for
controlled zoning of the area°

Mrs Leo Jo ?riis~ Attorney representing the Masonic Building
Association, briefly outlined their previous requests and actions pertaining
to Reclassification Nco F-59-60-18, and advised that as yet, they have no
final buitdin9 plans, however~ if their request to eliminate Condition No° 5
of Resolution Nco 5596 is granted, they were ready to comply with the remainder
of the conditions to obtain their zonings Me urged that amendment to the
resolution of intent to rezone be granted, as requested°
Mrs° Clementine Roberts) one of the own.ers of the property immediately
south of the subject property, addressed the Council) advising that when their
family applied for rezoning of their property, a 60 foot dedication for a future
street was imposed~ and if Condition Nco 5 of Resolution No° 5596 was set aside~
they would also ask for relief from the dedication requirement° However, they
would be agreeable to try and work out a solution to the street problem with
Mrs ~riis, if he so desired.o

requesting R-3 zoning on property described, briefly, as located on the east
side of Nutwood Street, north of Ball Road~ between Ball Road and Beacon Avenue°

Series 1959-60~ recommended said reclassification be denied.
Public hearing was held by %he City Council April 5, 1960~ at which
time the hearin9 was closed and action deferred to this date to allow time
for further study°
On motion by Councilman Fry~ seconded by Councilman Schutte, public
hearing was reopened° MOTION CARRIED'
Mr. Richard Reese, Acting Planning Director, reported on the meetin9
held between the owners of the proper~y, residents in the area, planning staff
and traffic engineer° That the residents in the area felt that this high
density use of the property would increase the traffic at'Nutwo~d'and'Bai1 Road°
Mr° DeVote presented plot plans to each Councilman, indicating how
the traffic problem is proposed to be resolved° He explained that the entire
parcel would be completed and developed as one subdivision° That it was their
intention to request additional R-3 a~d C-1 zoning for the balance of the parcel
of property, and if the area noted "N~o 1" on the plan is approved for R-3 at
this time, it will allow them to proceed with financing~ and they will then
follow through with the other necessary applications for zoning and subdivision
map°
It was determined that the area noted "NCo 1" which is requested to
be developed at this time with 72 R-3!units, has a net area of 3o64 acres~ or
2188 square foot ~round area for eachlapartmento It was further determined
and agreed by the developer, that the street widening and engineering
improvements at the corner of Nutwood and Ball Road would be installed with
the initial R-3 development°
Those addressing the Council in opposition were~ N[rSo Calvin Jo
Andrews, 927 Nutwood Street~ and Mr. Nodney Henslero Their reasons being:
(1) The present condition of the corner of Nutwood and Ball Road; (2) objection
to the alley; (3) objection to the density of use; (4) car~)orts in lieu of
garages; (5) close proximity to school°
Mrs. Linke, 943 Nutwood Street, stated that they, and the owners of
the six houses next to her approved of this reclassification as requested.
Mro DeVote further explained that a request for variance would be
made for 80 carports ih lieu of required 90 9arages~ ard that an R-3 reclassi-
fication would be requested for that Property to the east, a C-1 request made
for the Ball Road frontage~ and the entire 10 acre parcel would be developed
completely with off-site improvements prior to any occupancyo~
The Mayor asked if anyone else wishedto address the Council, there
being no response~ declared the hearing closed.
RHSOLUTION NO. 6002~ Councilman Fry offered Resolution No~ 6002 and moved
for its passage and adoption, authorizing the preparation of necessary

1473 was ordered held over for one week (May 17, 1960). MOTION CARRIED.

MINUTES~ Minutes of the regular meeting~held May 3, 1960 and May 10, 1960,
were approved on motion by Councilman Coons, seconded by Councilman Chandler°

CONTINU~-D PUBLIC HEARING - BROADWAY-LA PALN~ ANNEXATION~ Action by the Clty
Council regarding Broadway-La Palma Annexation was deferred from the meeting
of May 10, 1960, to determine the location of properties protesting inclusion°
The map of the area indicating those properties protesting the
annexation was presented to the City Council and explained by Mr. Nklrdocho
It was noted that the only a'.rea that could be excluded and not create a county
area, was two parcels of property located at the southeast section of the
proposed annexation, immediately east of the subdivision at the northeast
corner of Broadway and Gilbert Street, comprising approximately 6 3/4 acres.
It was also noted that these two parcels would be a{fected by annexation now
pending (Broadway-Gilbert).
Councilman Chandlelr moved that reauest for exclusion be denied°
Councilman Coons seconded t~e motion° MOTION UNANIMOUSLY CARRIED.
There being no fu~her discussion regarding exclusion of property,
the Mayor declared the hearing closed°
