MINUTES: Minutes of the regular mee%in9 held May 24, 1960 were approved, on motion by Councilman Thompson, seconded by Councilman Chandler. MOTION CARRIED. CONTINUED PUBLIC HEARING - RECLASSIFICATION NO. F-59-60-94: Submitted by Stevens, Kerwin, Grebel, Kluthe, and McLaughlin, requesting change of zone from R-A, with one lot R-3 (variance), to C-l, property located on the west side of Placentia Avenue, between Sou%h Street and Morava Avenue. Public hearin9 was continued from the meetin9 of May 10~ 1960 in order to work out an equitable solution rggarding certain commercial uses agree- able to the applicants and the property owners within a 300 foot radius. Mr. Richard Reese reported on a meeting held in the home of Rev~ Kevorkian for the purpose of working out a list of those commercial uses that could be established with minimum objections to the adjacent residents. Mr. Gilbert Kluthe and Mr. James Kerwin, spokesnen for the Applicants, addressed the Council and presented each Council member a copy of a list of uses to which they would be willing to restrict the property. Rev. Bob Kevorkian, spokesman representing the residents, also presented to each member of the City Council~ a list of uses that they considered compatible to the existing residential area, explaining ~hattheir concern was o£ the noise factor, inasmuch as some of their.properties were right next to this area without the benefit of a buffer of any type. Mr. Kluthe stated that the uses on their list could be conIrolled by the limitation of the sizes of the buildings~ that they wished to keep this development as a neighborhood commercial zone. Each owner will develop his own property in accordance with the plot plan designed for the entire area. Mr. Gerry Schmitz, 1831 Morava~ was concerned regarding the pro- posed fence. He was advised that these matters were detailed on the over-all plan of development, Rev. Kevorkian requested the wall be along South and Morava Streets. Mr. Marv. Anderson, 849 South Reseda, was concerned with the additional amount of traffic that would be created by this development, explainin9 that their concern~ bein9 on the east side of Placentia Avenue, was that of traffic. Councilman Chandler asked Rev. Kevorkian if they would be agreeable to basic general principles pertaining to the store hours and the prohibition of liquor establishments. To these basic principles, Rev. Kevorkian agreed. Councilman Coons added that the type of service should be of a nature to serve the residential area that surrounds the property. Councilman Chandler seconded the motion. MOTION CARRIED. PUBLIC HEARING - RECLASSIFICATION NO. F-59-60-95~ Submitted by G. Howard Robertshaw, requesting change of zone from R-A to 0-3, property located on the southwest corner of Ball Road and Magnolia Avenue. The City Planning Commission, pursuant to their Resolution No. 246, Series 1959-60, recomr~ended said reclassification be denied. The Mayor asked if anyone wished to address the Council. Mr. Robertshaw addressed the Council, explaining his proposed plans of development, and stating that the property was no longer suitable for re- sidential purposes. In addition~ that although the service station is designed as a self-service station, there would be two attendahts present during all hours of operation. Plans from the file were reviewed by the City Council. Ntr. Robertshaw further advised that a number of stations similar to this~ have been developed on property smaller than this parcel. The Mayor asked if anyone else wished %o address the Council~ there being no response, declared the hearing closed. RESOLUTION NO. 6042~ Councilman Thompson offered Resolution No. 6042 and moved for' its passage and adoption, authorizing preparation of necessary ordinance, changing zone, as requested, subject to engineering committee's recommendations as follows; 1. Dedication of 53 feet from centerline on Ball Road and Magnolia Avenue. 2. Prepare street improvement plans and irstall all improvements in accordance with approved standard 'plans on file in the o£fice o{ the City Engineer. 3. Later in the meeting, it was remembered that in accordance with City policy, when a C-3 use is authorized in an area such as this, the C-3 use is limited by deed restrictions to that of a service station only. Inasmuch as the '-Applicant had already left the meetin9~ and in all fairness, it was considered that the Resolution of Intention previously adopted, be rescinded, and the Applicant requested to again appear at the next meeting (June 7, 1960) for reconsideration of said request. .- . The City Planning Commission, pursuant to their Resolution No. 247, Series 1959-60, recommended said reclassification, subject to the following~ 1o Development in accordance with plans presented. 2o Dedication of 45 feet on Los Angeles Street (exist. 40'). 3. Discussion Between the Council resumed, and it was considered that certain C-1 uses wou]dbe incompatible with the surrounding.area. Mr. Griffith advised that the property would be used for their offices. Mr. Collins was of the opinion that the Applicant would be agreeable to the placing of deed restrictions on the property, limiting the uses. The list of uses outlined in the proposed C-7 zone was read. RESOLUTION NO. 60445 Councilman Coons offered Resolution No. 6044 and moved for its passage and adoption, authorizing preparation of necessary ordinance, changing the zone as requested, subject to the recommendations of the City Planning Con%mission, and further subject to the Applicant placing standard C-1 deed restrictions, limiting the use of the property to the list of uses outlined in the proposed C-7 zone. Bair and wife, requesting change of zone from R-1 to C-l, property located at 10501 East Katella Avenue° (northeast corner of Katella and Nutwood Avenues). The City Planning Commission, pursuant tO ~heiN Resolution No. 248, Series 1959-60, recommended said reclassification, subject to the following conditions: 1. Letters from the Garden Grove City Plannin9 Commission and Garden Grove City Council were submitted and read, recommending the zone be changed to professional, instead of C-lo The Mayor asked if anyone wished to address the Council. Mrs. Geneva Bait addressed the Council, explainin9 her proposed plans for the home for the aged, which is to accommodate 6 persons. She stated that the existin9 home would be used~ and has already been inspected by the Welfare and Fire Departments° NL~. Edward Burgess, 1878 Tamara Street, addressed the Council, advising that in his opinion, the property should be subjeoted to the same conditions of rezoning as %he adjacent property to the east. He questioned the advisability of locating such a home at this location. Conditions of rezoning, referred to by Mr. Burgess, pertaining to Application No. F-59-60-72, were read in full. A 9rear deal of consideration was given to the requirement pertainin9 to the removal of the building within the three year period. It was the consensus of opinion~ that this was an exceptionally fine home and could be well adap%ed, not only £or this use, but £or business and pro f~iona 1 u~. RESOLUTION NO. 6045.- Councilman Coons offered Resolution No. 6045 and moved for its passage and adoption, authorizing the preparation of necessary ordinance, changing the zone, as requested, subject to the recommendations of the City Planning Commission, and further subject to the followingl 1o That a concrete masonry wall 6-feet in height be constructed alon9 the boundary between this property and any adjacent R-1 zoned properties. 2o Further, that the owners of subject property place of record, standard City of Anaheim C-1 deed restrictions, approved by the City Attorney, which restrictions shall provide that all exterior lighting for parking lots or other purposes shall be installed so ~at the light will not shine into any of the adjacent R-1 zoned properties; that no public address or speaker system shall be permitted on the exterior of the buildings; and that any buildings to be con- structed on subject property shall be limited to one-story~ not exceeding 20 feet in height° Refer to Resolution Book, page .... SIGN APPLICATION ~ BROADWAY DEPARTMENT STOREs Communication dated May 24, 1960 from Electrical Products Corporation~ requesting permission to install a change panel reader board on Broadway Department Store existing sign, to!leth.er.with plan, was submitted and reviewed by the City Council° On motion by Councilman Goons, seconded by Councilman Thompson, due to the fact that the requested sign would conflict with freeway sign ordinance, said sign request was denied. DANCE PERMITs Application submitted by $ociedad Progresista MeXican ~24 to hold a private dance at the Carpenteras Hall, July 24, 1960, was submitted, and granted in accordance with the recommendations of the Chief of Police, on motion by Councilman Coons, seconded by Councilman Thompson. Application of Edward Ho Carter and Arthur Wo Gruber for pool hall and card game permit at 108 North Los Angeles Street, was submitted° Councilman Coons moved action on said request be withheld one week, to check expiration date of present permit issued to Walt Rommel.
