MINUTES: Approval of the MinUtes of the Anaheim City Council Meeting held 'August 3, 1965, was deferred one week (August 17, 1965). WAIVER OF READING - ORDINANCES AND RESOLUTIONS: Councilman Dutton moved to waive the~reading in full of all ordinances and resolutions~ and that consent to the waiver of reading, is hereby given by all Councilman, unless after reading of the title~ specific request is made by a Councilman for the reading of such ordinance or resolution. Councilman Pebley seconded the motion°. MOTION UNANIMOUSLY CARRIED. DEMANDS AGAINST THE CITY: On motion by CounCilman Dutton, seconded by Councilman Pebley, payment of demands against the City, in accordance with 1965-66 Budget, in the amount of $1,240,707o76, was authorized. PUBLIC HEARING - RECLASSIFICATION NO. 65-66-2: Initiated by the Anaheim Planning Commission for change of. zone from C-3 to C-2; property located at the southeast corner of Broadway and Manchester Avenue~ having frontages of approximately 151 feet on Broadway, and approximately 155 feet on Manchester Avenue. C-2 Zoning recommended for approval by the City Planning Com- mission~ unconditionally, pursuant to Resolution No. 1686, Series 1965-66. RECLASSIFICATION NO. 64-65-97: Action was taken by the City Council August 3, 1965, directing the scheduling of a public hearing to consider additional condition to Reclassification No° 64-65-97, to require a 6-foot block wall along Rose Street, unless the petitioners agreed to install said wall. Mr. Mickelson reported that the principals were contacted and verbally agreed to construct said wall along the westerly boundary of subject pro- perry, and to amend their plot plans accordingly for submission to the Building Department in a few days. In answer to Mayor Krein~s question, a proposed 4 to 5-foot opening through the west wall for pedestrian access from Rose Street, would not logically be used for trash pick-up on Rose Street, because the traffic pattern established for accessways around the market, will be of sufficient width to allow trash pick-up behind fihe market building. The City Council indicated it was their understanding that the City Clerk would continue to withhold the scheduling of a public hearing, pending receipt of the revised plot plans from the petitioners. RECLASSIFICATION NO. 56-57-39: Communication dated August 4, 1965, from Mr. Michael Heuer~ Attorney representing the applicants, was read by the Deputy City Clerk, requesting that the shopping center portion (approximately the southerly 480 feet of the property) be zoned separately. Enclosed with said letter was check in the amount of $2,185.54, for street lighting fees on the shopping center portion of the property, together with legal des- cription thereof. (Hemmerling property - West Side of Euclid between Lincoln and Broadway) 8845 City Hail, Anaheim. California - COUNCIL MINUTES - Auqust 10, 1965, 1:30 P.M. 'I~ was noted that first reading of the ordinance zoning the entire property to C-1 was held November 24, 1964, however final reading was with- held by order of the City Council, pending receipt of street lighting fees. Mr. Mickelson noted that at one time a complete master plan of development for subject property included high-rise office structures, a theater, a hotel, service stations and a shopping center. During a meeting of the Planning Staff with the applicants, they had been advised that It was possible to develop the property in stages, and to complete the zoning in the same manner. Discussion was held by the City Council, and Mr. Mickelson further noted that the applicants computations have not been checked by the Develop- ment Services Department for accurancy. It was determined that the matter be continued one week, pending further report and recommendations from the Development Services Department. CONDITIONAL USE .PERMIT NOS. 522 AND 548 - CENTRAL BAPTIST CHURCH: At the direction of the City Council August 3, 1965, request, of Central Baptist Church to utilize temporary metal structures to meet fall enrollment needs at their private school, was ordered scheduled for public hearing, on receipt of $50°00 fee from the appl.~cants. Attention of the Council was called to letter dated August 5, 1965, from Paul Liefeld, Educational Coordinator of the School, explaining in detail the modular steel buildings proposed for use on the property, and advising that they have received a permit from the Orange County Flood Control District to construct a bridge over the Flood Control Channel (copies of said letter furnished each Councilman). Also submitted was a brochure illustrating the proposed buildings and their basic construction. Mr.o Paul Liefeld submitted for Council review a book containing photographs of the modular steel b'oildings. He advised that the opening date of the school was not far beyond the three week period allowed for erecting the buildings~ therefor they request that the matter be resolved without a public hearing. In answer to Councilman Chandler~s question, Mr. Liefeld advised that the brtdge~ or walkway across the flood control channel would be constructed in conjunction with the buildings, however said construction Would require a longer period of time° On motion by Councilman Chandler~ seconded by Councilman Dutton~ Central Baptist Church was granted permission to erect temporary modular steel buildings as described in communication dated August 5~ 1965, and as requested, subject to construction of the walkway across the flood control channel within 60 days thereafter. ANAHEIM STADIUM ESCALATORS: The City Manager read letter dated August 10, 1965, from the Del E. Webb Corporation, advising the Anaheim Stadium Non-Profit Corporation that the contractor agrees to install the proposed escalators at the stadium, while guaranteeing that the maximum contract of $16,000,000.00 will not be exceeded° Further, it was suggested by the corporation that the $16,000,000o00 maximum figure be established as a contract sum. Mr. Murdoch reported it has been suggested that further con- sideration be given to the specifications for the escalators, which were drawn on the basis of stainless steel for the interior portions, a material which could be considerably more costly 'than others which are . equally, i satisfactory° Should the escalators be approved, he recommended an amendment to the agreement with the tenants (Angels) to provide for maintenance costs of the escalators to he included as a part of the tenant's costs. Foster, 1680 Tonia.Place. The Mayor asked if the applicants or their representative wished to address the City Council. Mr. Stephen Gallagher, Attorney representing the petitioners, submitted to the City Council a request to grant subject reclassification, signed by the owners of the property, officers of the Anaheim-Huclid Con- valescent Hospital Corporation, and the owners of propertyilocated on the southeast-corner of Orangewood Avenue and'Euclid Street. He further sub- mitted five photographs of the area, and a copy of the Assessor's map thereof, with an attached list of the names of property owners within 300 feet of subject property°' Mr. Gallagher was of the opinion that to deny the reclassifica- tion would create a hardship to the owners of the property,, since an alternative residential development would require that a cul-de-sac street be extended north from Orangewood Avenue, dividing the property into approxi- mately ten lotso He felt such a development would be impractical, since people would hesitate to purchase a lot backing up to Euclid Street because of the traffic volume. Attention of the Council was called to letter dated July 6, 1965, submitted to the City Planning Commission from the Mayor of Garden Grove, which stated that the subject property is of a nature that it may easily be subdivided for residential use. In Mr. Gallagher's opinion, said pro- perty would be suitable only for commercial development, and thereupon requested the reclassification be approved. Mr. Larry Klang, 13666 Redhill, Tustin, addressed the Council on behalf of Albertson's All American Markets, advising of their desire to do everything possible to eliminate any anticipated problems. Conditions of zoning could require installation of screen plantings, non-glare lighting on low standards in the parking lot, and Controlled delivery hours. He was of the opinion that the market'need not be a noisy operation~ and further ad- vised that all air-conditioning facilities would be contained within the building, and with adequate curb openings, the traffic would be no problem. " Mr. Klang further advised of an economic survey made of the area, the results of which showed a need for the proposed food market. In answer to Council questioning, Mr. Klang stated that hours of operation would be from 9:00 A. M. to 9:00 P. M., and that compressors which Would operate the refrigeration systems, etc., could be placed inside the building to alleviate any noise° The Mayor asked if anyone wished .to address the Council in Opposition to the reclassification° Mr. Richard L. Rowen, 2057 Lida Lane, immediately adjacent to subject property, stated that the proposed reclassification would be an invasion of the privacy of nearby residents, and he expressed opposition to the construction of a market immediately adjacent to his property. Mr. Devon E, Biggs, 167~ Tonia Place, addressed the Council objecting to the noise and increased traffic which would result from the location of the market on subject property. He noted there are existing commercial facilities at the Euclid Street and Katella Avenue intersection, and he objected the location of a market 30 feet from his property line. Concerning the petition submitted to the City Planning Commission, Mro Biggs advised that with the exception of those away on vacation~ every family contacted except 0n% signed the petition in opposition to the reclassification° He felt that the super-market would devaluate the re- sidential properties. In his opinion~ the approximately One Million Dollar development now proposed was the most logical and suitable use for the property~ and ~he owners thereof should not be denied the right to develop said property for its highest and best use. Councilman Chandler recalled that'in considering the convalescent hospital, much thought was given to the problem of the development of properties on busy streets~ as well as to owners of the residential pro- perties nearby; the City Council indicated'that light commercial businesses without noisy.machinery would be appropriate for these properties fronting Euclid Avenue. In his opinion, the propOsed market would be beyond the principle expressed for subject area. Councilman Pebley asked what would be the feeling of the residen- tial area~would be if~.the:deve]~opment of properties frOnting on Euclid. Street, was in the nature of ~'commercial-offices". Mr. Rowen advised that the convalescent hospital was accepted, but the residents were definitely opposed to a super-market. Mro Jerry Huff~ 2045 Lida Lane, addressed the Council advising that he did not consider a super-market to be light commercial. He noted that one of the main objections to the hospita'l was the two story factor, which was eliminated; and he felt that a light commercial use for subject property would be acceptable. INC.: %he City Attorney..briefed the contents of communica- tion dated August 3, 1965, from Baker, Ancet and Redmond, .Attorneys representing Web Service.Company~ Inc.., requesting that the City Council again consider the matter concerning license fees for'coin operated laundry machines~ and advising that a new action has been filed in Superior Court, which the Attorneys feel can be rapidly disposed of by the City Council, if the Council will reverse its position formerly taken on the matter. On motion by Councilman Chandler, seconded by Councilman Dutton, the City Council re-affirmed its former position in the matter of coin operated laundry machines, further, the City Attorney was authorized to inform the Attorneys for Web Service Company, Inc., that in connection with this or other pending litigation, the City Council does not intend to directly take up the matter; all'matters relating to litigation are to be handled by the Attorney for the City Council, who will report any discussions or recommendations for settlement. MOTION CARRIED. PUBLIC UTILITIES COMMISSION - APPLICATION NO. 46574: On motion by Couucilman Chandler, seconded by Councilman Schutte, the City Attorney was instructed to answer in the matter of application of the City of Anaheim to widen a city street across the right-of-way of the Southern Pacific Company, and the apportionment of future maintenance costs (Crossing No. BK-512.4).
