Recommendations of the Development Services Department were r~ad as follows: 1. It is recommended that the revised plan of the petitioner be apprOved insofar as they relate to the proposed restaurant and related parking only. All future development on subject properly will be required to meet the Site Development Standards of the C-1 Zone. 2. It is recommended that the petitioner's request to construct a masonry wall on the south property line to separate the alley from subject pro- perty be granted subject to approval of the City Engineer and that a public hearing be set for this purpose° Mr. David Do Lewis addressed the CounCil requesting that the issue be resolved without a public hearing, if possible, since time was of the essence. He referred to letter dated November 29, 1963, from the Lincoln Arms Apartments, requesting that the alley be blocked at subject property. The City Attorney advised that Condition No. 1, Resolution of Intent No? 63R-968, requires that the existing 20-foot alley to the south ~be extended northerly to Lincoln Avenue, either on sUbject property or in conjunction with property to the east; if the alley is blocked off by %he wall, it would be necessary to eliminate this condition. The City Engineer reported that dedication for the modified cul-de-sac at the northerly terminus of Bella Vista Street (Qondition No. 3) had been received in his office just today. The foregoing actions were reviewed by the City Council, and no further action taken on the above numbered conditional use permits, variance application and area development plan. ORANGE COUNTY USE VARIANCE NO. 5642: Establishment of a 140-space mobile home park between Winston Road and Cerritos Avenue, and State College Boulevard and Sunkist Street, in the Southeast Industrial, Area. Excerpt from the minutes of the City Planning Commission meeting held November 8, 1965, was submitted recommending that the Orange County Planning Commission be urged to deny Orange County Use Variance No. 5642, on the basis that the proposed residential use would be incompatible with the already established industrial development in the southeast industrial area; that the residential use could deter any further industrial develop- ment; that it would further deteriorate the southeast industrial area; and that a portion of the proposed parksite was located on the future right-of-way for the extension of Sunkist Street, as depicted on the Circulation Element of the Anaheim General Plan and the Orange County Master Plan of Arterial Highways. (Councilman Dutton entered the meeting, 2:05 P.M.) On motion by Councilman Pebley, seconded by Councilman Schutte, the City Council concurred with recommendations of the Planning Oommission~ and ordered a copy thereof forwarded to the Orange County Planning Commission. CI/Y OF FULLERTON ZONE CHANGE: Application for change of zone from M-P-200,000 to C-2, and conditional use permit, to establish a precise plan for a motel-restaurant-service station complex, was submitted; property located at the northeast corner of Raymond and Orangethorpe Avenues. Ex6erpt from the minutes of the Planning Commission meeting held November 8, 1965, was submitted for Council information, recommending that the City of Fullerton be informed that the proposed reclassification and conditional use permit and the uses proposed on the proposed zone change from M-P-200~O00 to C-2 for subject property, were compatible to the existing uses already established in close proximity thereto. No further action was taken by the City Council. CITY OF ORANGE ZONE CHANGE NO. 433: R-3, Multiple Residence, proposed by the Lusk Corporation on the east side of Villareal Drive, approximately 613 feet south 9029 City Hall. Excerpt from the minutes of the City Planning Commission Meeting held November 8, 1965, was submitted recommending the the City Council consider the followimg~ 1. That the Planning Commission in Resolution Nog 1831, Series 1965-66, re- commended approval, in part~ of Reclassification No. 65-66-51, and recom- mended disapproval of the request for R-2, Multiple Family Residential, Zone, based on the fact that the petitioner was proposing a considerably denser zoning than that presently developed to the north of subject pro- perty, namely R-E, Residential Estates, Zone of one acre sites of more. 2. That subject property was developable for single family residential sub- division or low density planned residential development° 3. Thai the Planning Commission had recommended that the portion proposed for R-2, Multiple Family Residential, Zone be reclassificed to the R-l, one Family Residential', Zone. ._ Mr. /hompson submitted a map of the area for Council review, and advised Reclassification Nog 65.66-51 will be heard before the Council in the near future. Mr. Murdoch called attention to the fact that the west end of the Nohl Ranch was planned for an average type density, due to its topography, Streets indicated on the County Master Plan of Streets and Highways in the hill and canyon area were designed to accommodate traffic generated by develop- ments of average density, with limited small areas having a density higher than the single family residential standards. The City of Orange staff, the Orange County Road Department and Traffic Engineer and the owner and the de- velopers of the Nohl Ranch, all reviewed and approved the proposed street pattern° Mr. Ronald Grudzinski addressed the Council further explaining that the Development Services Department staff has made study of the topography of the area in preparation for the hill and canyon general plan. /he arterial highway systems for this district, based on traffic volumes and standards re- sulting from said study, have been approved by the Orange County Road Depart- ment. Mr. Grudzinski reported that the Nohl Ranch developers have also indicated their thoughts concerning potential multiple family development in that district, which have been incorporated into the proposed hill and canyon general plan~ that the staff has considered multiple family zoning, allowing densities ranging from 10 to 18 dwelling units per net acre, however, no recommendations have been made regarding a multiple family zone for the hillside areas in the City of Anaheim. It is expected that said general'plan will be scheduled for public hearing before the City Planning Commission prior to the first of next year, He noted that in general, the requested R-3 in the City of Orange is in accordance with the proposed hill and canyon general planl however, he pointed out that the City Planning Commission and City Council of Anaheim have not yet determined their policy as to whether they will encourage any multiple family residential development in that area. Mr. Murdoch called attention to the fact that the approved streets will not handle traffic from a large area of multiple family developments, and he questioned whether the density could be reduced elsewhere to make compensation, should subject application be granted. The City Council concurred with the opinions expressed and quested Mr. Murdoch and Mro Grudzinski to attend the public hearing tonight before the Orange City Council to present AnaheimVs position relative to the requested R-3 zoning. ORANGE COUNTY TENTATIVE TRACT NO. 5676: Subdivider~ Nell Sprick~ tract located southeast of Buena Vista Avenue and southwest of Yorba Linda Freeway in Yorba Linda, proposed for subdivision into 15 R-1 lots. Excerpt from ~he minutes of the City Planning Commission meeting held November 8, 1965, was submitted recommending that the Orange County Planning Commission be urged to favorably consider said tentative tract. Panek requesting change of Zone from R-1 to C-1 and permission for an ambulance service sub-station in an existing single-family residential str6cture~ property located at the northeast corner of Euclid Street and Alomar Avenue (630 South Euclid Street). The City Council adopted Resolution of Intent No. 65R-520, on July 6, 1965, approving C-O zoning, subject to conditions[ and further adopted Resolution No. 65R-521, denying Conditional Use Permit No. 704. Pursuant to request of E. Richard Crane, owner of Crane Ambulance Service, and approved by the petitioner Robert L. Panek, the City COuncil on October 5~ 1965, instructed that rehearing be scheduled to consider additional evidence. Mr. Thompson noted the location of subject property and the existing uses and zoning in the immediate area, briefing the history of subject applications. Mayor K'rein asked if the applicant or his representative wished to address the City Council. Mr. Robert Panek, owner of subject property, indicated his presence in the audience. Mr. E. Richard Crane, owner of the ambulance service occupying subject property, addressed the Council advising that a national survey has shown a need for one ambulance service for every 80,000 people, and the national average for arrival time on an emergency call is 20 minutes. That Anaheim now has two ambulance companies, and the average arrival time for Crane Ambulance has been a little over 5 minutes from their 9039 City Hall. Anaheim. Mro Crane explained in detail the operation of the service, which requires living quarters for one attendant and his family, plus facilities for two other attendants. He advised of his search for a location which would be centrally located in the western section of the city, and submitted letters from two local real estate men, both reporting on unsuccessful attempts to locate a suitable property for the ambulance service. Mr..Crane also submitted a Petition in favor of the business at 630 South Euclid Street, containing 19 signatures of residents in the area. Said petition and afore mentioned letters were read by the Deputy City Clerk. The Mayor asked if anyone wished to address the City Council in opposition to the ambulance service at its present location. Mr. 3oseph A. Bradley, 707 Atvy Street, addressed the Council objecting to the commercial zoning of the property, and to the noise caused by the ambulance substation~ He was of the opinion the ambulance service has been located on subject property in violation of the City Code, and read copy of letter from the Deputy City Attorney to Mr. Crane advising that the premises were to be vacated by October 1, 1965o Mr. Bradley further advised of deed restrictions recorded on the property limiting the use to single family residential, and asked if the City Planning Commission and City Council were not bound by such restrictions. City Attorney 3oseph Geisler advised that deed restrictions are a private covenant on the land, and do not bind the City Council in the matter of zoning. In answer .to Councilman Dutton"s question, Mr. Bradley reported the noise of the siren has disturbed him, and the parking of the ambulance on Euclid Street blocks from view on-coming traffic when motorists attempt to enter Euclid Street from Alomar Avenue. Council discussion was held, and Mro Geisler reviewed zoning regulations of the Anaheim Municipal Code governing ambulance services. In answer to further questions, Mr. Crane advised that no business is conducted on the premises~ that emergency calls were received by radio in their Fullerton main office, and relayed to the Euclid location by private telephone. He stated he had been advised not to park the ambulance on subject property or on Alomar Avenue~ however, if subject permit is granted, the ambulance will be parked in the driveway. Further, the siren is only used when necessary, and in accordance with California State Law. The Mayor asked if anyone had new evidence to present. Mrs. Pauline Berry, 631 South Alvy Street, noted that the garage on subject property has been converted into a lounge for ambulance attendants., and she understood that city ordinances require a garage for each residence. Mr. Geisler explained provisions of the Anaheim Municipal Code pertaining to garage requirements. Mr. Charles Murphy, 630 Alvy Street, addressed the Council advising that he had originally opposed the request for commercial zoning, however, since the applicant was granted C-O zoning, he was of the opinion that this type of ambulance answering service was a more desirable use than some commercial businesses, and he had noticed no more disturbance from Crane"s sirens than from the traffic on Euclid Street~ He stated he would no~ object to the granting of a restrictive conditional use permit to allow the ambulance service. Mayor Krein stated that a good cross section of the evidence had been presented,, and thereupon declared the hearing closed. ~ RE, SOLUTION: Councilman Dutton was of the opi. nio.n th~.t the City Zoning Code makes it extremely difficult to find a location which would allow. the ambulance substation and also residential use of .the property, and inasmuch as ambulance service is necessary for the safety and general welfare of the citizens of Anaheim, thereupon offered a resolution amending Title 18 of the' Anaheim Municipal Code to allow ambulance service as a permissive use in the C-O Zone by restrictive conditional use permit. Further discussion was held by the City Council~ and at the conclusion thereof~ Councilman Du%ton withdrew the foregoing resolution. On the recommendations of the City Attorney, Councilman Chandler moved that this hearing be continued, for six months (residents in the area to be again notified), and further moved that six months interim permit be granted to allow the operation of an ambulance answering service on subject property, subject to: (1) The residential character of the property to be maintained. (2) No repairs to the ambulances to be made on the site. (3) Ambulance to be parked in the driveway on subject property, and not on Euclid Street or Alomar Avenue. (4) The ambulance to use Alomar Avenue in an easterly direction only when absolutely necessary. Councilman Dutton seconded the motion. MOTION CARRIED. The City Council directed a study and analysis be made, by the Planning Division and the City Manager's Office~ of zoning regulations governing ambulance services in other municipalities, recommendations to be made as to possible amendments to the Anaheim Municipal Code to properly place this use. Mr. Richard Crane and a representative from the opposition requested to be members of said study committee. ADJOURNMENT: Councilman Pebley moved to adjourn. Councilman Chandler seconded th& motion.
