Communication dated November 30, 1965, was submitted from the
applicant requesting permission to withdraw both applications, due to a
change of plans.
On motion by Councilman Pebley, seconded by Councilman Dutton,
request to withdraw Reclassification No. 65-66-53 and Conditional Use
Permit NO. 779 was granted. MOTION CARRIED.
PROPOSED AGP~F~ENT - YORBA LINDA WATER DISTRICT. WATER AND S~ER SERVICES.: In
accordance with report Of the City Manager, and on motion by Councilman
Dutton, seconded by Councilman Pebley, the concept of the proposed agree-
ment with the Yorba Linda Water District pertaining to water and sewer
services, was approved, and the City Manager was requested to make further
investigation of the area most economically feasible for development for
the purpose of preventing a duplication of service. MOTION CARRIED.
ADJOURNMENT: Councilman Pebley moved to adjourn. Councilman Dutton seconded
the motion. MOTION CARRIED.

CONTINUED PUBLIC HEARING - CONDITIONAL USE PER~IT NO. 762: Submitted by Tierra
De Oro, requesting permission to establish an operation for the excavation,
processing, storage, wholesaling and distribution of sand and gravel,
including an accessory office a weighing station and a caretaker's residence,
and waiver of required 10 foot landscape strip; property briefly described
as located adjacent %o a parcel of land at the southwest corner of Walnut
Street and Richfield Road.
Conditional Use Permit Noo 762 was denied by the City Planning
Commission, pursuant to Resolution No. 1786, Series 1965-66. Appeal
from action taken by the Commission was filed by the Attorneys for the
petitioners, with public hearing scheduled November 2, 1965, and con-
tinued to November 23, 1965; at which time the hearing was further
continued to this date to allow field trip to the site, and to the
applicant's present operation on the corner of Miller Street and Orange-
thorpe Avenue.
AsSociate Planner Ronald Thompson referred to sectional maps,
noting the location of subject property together with existing uses and
zoning in the immediate area, and briefly reviewed the findings of the
City Planning Commission°
Mayor Krein asked if a representative of the applicant wished
to address f. he City Council°
Mr. Gordon X. Richmond, Attorney for the petitioners, referred
to his detailed presentation made during the November 23 hearing, and
advised that no official opposition to the conditional use permit has
been received from the Metropolitan Water District; that their only
official document was a letter dated November 1, 1965, indicating
certain restrictions should be imposed, should the permit be granted.
With reference to setback, Mr. Richmond was of the opinion,
should the permit be granted, %hat it would be unreasonable and arbitrary
to require his clients to stay 110 feet from the Metropolitan Water
District easement, while the Orange County Water District is permitted
a 10 foot setback for their water spreading facilities to the West; he
felt that 70 feet from the M.W.D. easement on both sides, providing
140 feet of level ground over the pipe line, would be proper and equitable.
Further, any se%back requirement should follow the pipeline easement,
not property lines.

Based on the fact that the M W.D. water line was constructed 80 feet
from the then existing Consolidated Rock sand pit, it was Mr. Richmond's
opinion that this proved there would be no hazards involved. This opinion
was~ further bas.ed~on_~.the r,esrrictions recommended by the MoW.D.~ or the 70
foot setback frOm their line as proposed by the agplicants. In addition, the

In conclusion, although it had been stated that the Orange County
Water District settling basin will conform to all City of Anaheim requirements,
Mr. Richmond noted that the Crill Pit~ is maintained by the same water
district, and there is no evidence of attempts to screen that operation.
He thereupon requested that favorable consideration be given to the applica-
tion before the City Council.
In answer to question by Councilman Dutton, Mro Richmond reported
that the existing Pharris excavation at the southeast corner of Orangethorpe
Avenue and Miller Street has reached approximately 50 feet in depth at some
points, but will be levelled to the permitted 40 feet, when operations are
concluded. He noted that there is no evident deterioration of the slopes
at that location°
The Mayor asked if anyone else wished to address the Council in
favor of the proposed project, there being no response, asked if anyone
wished to offer opposition°
Mr. John Toups, Assistant Manager of the Orange County Water
District, representing Mr. Howard Crooke, advised they have a letter from
a licensed Civil Engineer indicating that the applicant's existing ex-
cavation at Orangethorpe Avenue and Miller Street is at least 68~ feet in
depth. He called attention to the erosion and water damage to the slopes
which has occured at the Crill pit, necessitating rebuilding of the slopes;
and advised of the probability that the applicants would experience the
same problems.
Mr. Ioups briefed the history and sequence of events regarding
sand and gravel operations in the area, advising that the Orange County
Water District did not intend to violate any City of Anaheim ordinances.
They were of the opinion, however, t, ha% since the requested operation would
be the most recent in the area, they should be required to maintain a
setback sufficient distance from the M.W.D. line to allow the Orange County
Water District to proceed with their operation as originally planned.
In answer to question by Mr. Richmond, Mr. Toups was of the
opinion that when their pit was being engineered, they were not aware that
a permit had been issued for sand and gravel pit to the west of the
Consolidated Rock operation south of subject property.
Mr. George Argerus, 1621 East 17th Street, Santa Ana, representing
the owners of subject property, addressed the Council advising that the
concern is "land use", however the discussion has appeared to be limited to
the question of the applicant's qualifications to operate a sand and gravel
pit. He requested clarification of the setback from the property line and
asked if the Orange County Water District will be required to set back 50
feet in accordance to the City ordinance.
Mr° Ronald Thompson noted provisions of the Anaheim Municipal
Code governing excavation and recovery of non-fuel minerals.
Director of Development Services Alan G. Orsborn, stated that the
question before the City Council is whether the proposed land use is
acceptable from a zoning standpoint and from the vieWPoint of the Council.
He noted that the operation by the Orange County Water District is program-
med for the benefit of the entire County for the purpose of water per-
colation and conservation, and the district has indicated a cooperative
attitude towards compliance with Anaheim ordinances even though they have
the authority to operate without concern for City regulations.

Orsborn advised~ the operation proposed by the applicant would have a
dilatory effect on the industrial development of the area, as well as
on the adjacent citrus groves' and the arterial highway which will serve
the Northeast section of the City (La Palma Avenue realignment and
extension). Further, that the City has a moral obligation to the owners
of prime industrial land who at the request of the City, are holding their
property for that purpose. He thereupon recommended that the Conditional
Use Permit be denied.
Councilman Dutton questioned whether there has been any study
made to determine suitable locations for sand and gravel operations.
Mr. Orsborn advised that no study of that specific question had
been made however other studies now in process by the Development Services
Department, would seem to indicate that these operations would be most
appropriate located adjacent to the Santa Aha River.
Mayor Krein declared the hearing closed.
Discussion was held by the City Council, and Councilman Schutte
felt that the proposed operation and the, Orange Counfy Water Distr&ct project
bo,th would have a dilatory .effect on the area. ~ ..... , ',
Councilmen Dutton and Pebley expressed the opinion that the
proposed operation would be harmful to both the property owners in the
area and to the City, and could cause considerable damage to Metropolitan
Water Company'~s 78 inch diameter water line; fur±,her, this type of
operation could not be effectively screened from view.

of the Orange County Water District be scheduled to consider relocation
of their proposed settling basin.
Mr. John Toups advised of the districtVs plans for the facility,
and expressed their willingness to meet with City officials and consider
suggestions for better locations.
PUBLIC HEARING, HOUSEMOVING PERMIT: Application submitted by W. R. Hemphill
requesting permission to move a dwelling from 504 Missouri Street,
Placentia, to 945 North 'Gilbert Street, Anaheim, was reviewed by the City
Council together with recommendations of the Building Division and De-
velopment Services Department.
It was noted by the Council that Variance No. 1746, requesting
waiver of minimum lot area and width at the location to which the house
was proposed to be moved, was granted by the City Planning Commission
December 2, 1965, and will be submitted for Council information on
December 14, 1965. Conditions of the City Planning Commission Resolution
No. 1860, Series 1965-66, granting said variance, were read by the City
Clerk.

RECLASSIFICATION NO. 64-65-88 AND VARIANCE NO. 1684: Request of David W. Hook,
Sunset Builders, was submitted for deletion of Condition No. 4, Ordinance
No. 2180, requiring purchase and delivery of 8 trees, 10 feet in height,
and the payment of $200.00 for the cost of planting %,hereof along the
left slope of the seventh tee at Anaheim Golf Course, and relocating the
tee trap, or the construction of a 20-foot fence adjacent to the golf
course property.
~4r. Murdoch advised that report from the Director of Public
Works indicates that circumstances have not sufficiently altered to warrant
the requested amendment, as height of ±he proposed building has no bearing
on the necessary safety provisions.
Also noted by the City Council were recommendations from the
Development Services Department and the City Engineer, the latter re-
commending that the request be denied.
Mr. Hook advised that the original seven story apartment
building (Reclassification No. 63-64-114 and Conditional Use Permit No.
561 )'has been reduced under subject applications to a two-story office
building with approximately one fourth the previous glass window area.
The area originally proposed for recreational purposes has been changed
to an off-street parking area, which in his opinion, reduces the danger
of injuries from golf balls.
Mr. Hook reported that in the six months since work began on
the project, no golf balls have been found on the property. He advised
that the $200.00 fee for relocating the tee and trap has been paid, and
he requested that the balance of the conditions be deleted.

Discussion was held by the City Council and the City Attorney,
and at the conclusion thereof~ Councilman Dutton moved that the request
to delete Condition No. 4 of Ordinance No. 2180 be denied, and that the
relocation of the tee and trap be reanalyzed, and if found unnecessary,
payment be refunded. Councilman Pebley seconded the motion. MOTION
CARRIED.
ORANGE COUNTY TENTATIVE TRACT NO. 6066, REVISION NO. 6: Subdivider - John W.
Plough; tract located south of the Riverside Freeway at the intersection
of Cerro Vista and Peralta Hills Drive in lhe Peralla Hills area, and

Excerpt from the minutes of the Cit~ Planning Commission meeting
held December 6, 1965, was submitted recommending that the Orange County
Planning Commission be urged to approve Revision No. 6 of Tentative Tract
No. 6066, subject to development of the tract in accordance with the City
of Anaheim Street Standards for the Peralta Hills, in order to provide
greater flexibility and to retain the present rural characteristics and
esthetics of the area; said area presently being under annexation pro-
ceedings to the City.

TRANSFER OF FUNDS: On report and recommendation of the Gity Manager, Councilman
Chandler moved that the City Council authorize payment of appraisers' fees
in the matter of the Anaheim Union Water Company Case, and tr'ansfer
of funds for this purpose be authorized~ up to $23~100.00, from the Council
Contingency Account to Account No. 531-257, if it is found that sufficient.
funds for such transfer are not available from the Water Department, City
Attorney or Finance Department budget accounts. Councilman Dutton seconded

RINKER ANNEXATION: Excerpt from the Minutes of the Local Agency Commission of

the City of Anaheim, stating that the City will reqqire concurrent with
development dedication of rights of way and the construction of adequate
flood protective works in a manner meeting the approval of the City
Engineer in cooperation with the staff of the Orange County Flood Control
District.

REPORT - LOS ANGELES REGIONAL TRANSPORTATION STUDY (LARTS): Resolution to
withdraw Anaheim'~s membership from L. ARTS, because of an apparent merger
of LART$ with the Southern California Association of Governments (SCAG)
through the Transportation Association of Southern California (TASC), was
offered by Councilman Dutton November 16, 1965 (page 9048), and tabled
for further information~ action being further continued from November 30,
1965, pending a LARTS meeting December. 2.
Director of Public Works Thornton E. Piersall reported on said
meeting, attended by Mayor Krein and himself, at which time statements
and opinion were presented pertaining to the proposed new organization
designated as TASC. He advised that the Association's function would be
to assimilate and compile data as LARTS has done, the groups to also be
a subcommittee of SCAG, if and when SCAG becomes a reality, and trans-
portation information and data will be offered together with recommenda-
tions from TASC.
Mr. Piersall further advised that members of LARTS were assured
that they would not be obligated to become members of SCAG, and would not
necessarily be bound by its rules, regulations or activities. Cities
belonging to LARTS were urged to join TASC for the assimilation of in-
formation, which would be available to the State Division of Highways,
and all cities and organizations, with the intent that the organization
would not become any part of SCAG. The by-laws of TASC were so adopted
that the association would be a committee, or subcommittee, of SCAG, with
withdrawal of membership permitted at any time on 30-day notice.
In answer to Councilman Dutton, Mr. Piersall reported that
Article XII of TASC by-laws was adopted, as proposed.

Council discussion was held, COuncilman Dutton and Chandler ex-
pressing opposition to retaining the City's membership, and noting that
the City not only opposed the organization of SCAG, but urged all other
Orange County Cities to do likewise. Councilman Schu%te was opposed to any
action which might injure a movement to encourage rapid transportation in
Southern California.
In answer to Councilman Pebley~s question, Mr. Geisler stated
that he felt that any advisory committee to SCAG, subject to its by-laws,
would for all practical purposes, be a part of the SCAG organization.
RESOLUTION NO. 65R-908: At the conclusion of further discussion, roll call
was requested on the resolution offered by Councilman Dutton, withdrawing
the City of Anaheim's membership in LARTS.

The City Council of the City of Anaheim met in adjourned regular
session.
PRESENT: COUNCILMEN: Dutton, Pebley, Chandler and Krein.

CITY ATTORNEY: Joseph Geisler.

Mayor Krein called the meeting to order, and announced that the
meeting was scheduled to consider further information and facts relative
to the proposed requirement that City employees reside within the corporate
limits.
Regarding the proposed requirement, that employees residing
outside the City move into Anaheim within a reasonable length of time,
Councilman Chandler submitted and read communication dated December 13,
1965, from Russel O. Roquet, of Roquet Realty, estimating the financial
burden of a typical transaction of selling or exchanging a $25,000.00
home.
The City Council stated that they had reviewed report from the
Personnel Director, dated November 15, 1965, together with letters from
the Anaheim Municipal Employees' Association, t~he International Brotherhood
of Electrical Workers Local No. 47, and reports from Department Heads and
Non-Resident employees.
Councilman Pebley commended the Department Heads on the frankness
of their reports. In his opinion, selection of Personnel should be the
prerogative of the Department Head, with preference gigen to Anaheim
residents, qualifications being equal.
Councilman Dutton advised that the proposed resolution has been
completely misunderstood by a great number of people. The subject of
Anaheim residency arose when it was learned that several employees who
had resided within the City for a number of years sold their homes and
moved to other areas; as a result, he requested to be advised of the
reasons therefor. Subsequently, written reports have been received from
each non-resident employee, the Department Heads, and from the Personnel
