Councilman Fry moved the reclaissification be denied~ There was no second to the motion. Mr. F-wald, representing the oWners of the property, addressed the Council and further discussion was held oh the proposed improvement and the fact that the owners of this property were minors and the improvement would not be purely speculative. He requested the Council to personally check the area before ruling on this matter. There being no further discusslon~ the Mayor declared the hearing closed° He stated that the Council would try to reach a decision at the next meeting and advised that Mr. Vaughan would be notified. CONS/RUCTION OF STEEL=DECK GRAND STAND~ %A PALMA PARK: The Administrative Officer reported that the Pittsburgh-Des Moines $'teel Company would not proceed with the construction of the bleachers under the terms included in their bid proposal with reference to the payment thereof~ but that they would proceed with the construction of 7,084 seats if the City would put up $108,449.00 by the time o£ completion of the bleachers which would be on or before September 1, 1956. They agreed to carry the balance of $30,111.00 on a 4=year basis at a 5 per cent rental. They asked the City to follow the normal construction p~ocedure; that is~ the payment of 60 per cent at the time of shipment of the materials; 20 per cent upon the delivery of the materials~ and the balance on the completion of the job. Councilman Schutte moved that the Council approve the newly requested procedure of payment when it is determined by the City Attorney that the City can enter into such an agreement. Mr. Rex Coons addressed the COuncil and asked if the City Attorney was to approve the proper fund from which the necessary payment can be borrowed. He re~ minded the Council that the Pittsburgh-Des Moines Steel Company had to be advised before March i~ 1956. Mr. Turner advised the Council that he had been checking into this matter and at this time had not found where the City could legally enter into such a contract. HARBOR BOULEVARD: Mr. Preston Turner, City Attorney~ recommended that the City adopt a resolution authorizing the dismissal of a portion of the Hughes~ property in the action that the City of Anaheim filed for condemnation of property for the widening of Harbor Boulevard. He advised the City Council that the State Highway has action pending that was filed before the action of the City. He further stated that the City Fngineer has checked into ~his matter, and the dismissal of the action insofar as it affects the portion sought by the State Highway Departmen't will not jeopardize the City in any way and the S'%ate will improve this portion.
