CONS/RUCTION OF STEEL-DECK GRAND STAND, ~A PALMA PARK: Discussion was held on the revised proposal submitted by the PittsbUrgh-Des Moines Steel Company for the con- struction of the steel-deck grand stand ~t the La Palina Park site. Mr. Preston Turner, City A%torney~ read a transcript of a letter from the Pittsburgh-Des Moines Steel Company, taken by his secretary, o~ the proposed revision which read in sub- stance as follows: (Communication not yet received by the City of Anaheim). "Based on the large grand stand~ at a total contract price of $138,560, we would accept payments as follow~ Payment of 60~ of $108,449 on shipment of steel from our plant. Payment of 20~ of $108,449 on delivery of steel at grand stand site in Anaheim, California. Payment of 20°~ of $108,449 thirty-five days after completion and acceptance by the City of Anaheim~ California. $7,527.75 plus $1,505.55 interest one year from date of signed contract; $7,527.75 plus $1,129.17 interest two years from date of signed contract~ $7,527.75 plus $752.79 interest three yea~s from date of signed contract~ $7,527.75 plus $376.38 interest four years from date of signed contract. The above payments are to receive first priority each year from the City of Anaheim Park and Recreation Fund. In the event of default of any due payment~ that amount~ plus tnterest~ must become first priority from the Park and Recreation Fund following your revenue, plus the payment and interest due that year. Pittsburgh-Des Moines Steel Company is to retain title to the steel grand stand until paid for in full." The City Attorney stated that he wanted to secure further info~mation relative to the extension o£ title provision and also to check with their attorneys as to the approval of the new contract form as presented. Until the communication is received and confirmation can be made between the attorneys as to the extensio~ of title provision and the approval of this new proposal, the matter was held over until tomorrow. MAGNOLIA-CRESCENT ANNEXATION NO. 2~ Orange County Boundary Commission's report dated February 20, 1956 finding and detem~ining that the boundaries of the pro- posed Magnolia-Crescent AnnexatiOn No. 2 are reasonably definite and cer2ain was received and ordered filed~ on motion by Councilman Van Wagoner, seconded by Councilman Fry. MOTION CARRIED. RESOLUTION NO. 3165~ Councilman Wisser offered Resolution No. 3165 and moved for its passage and adoption. PAYMENT OF ELECTION OFFICER$~ It was moved by Councilman Fry, seconded by Council- man Wisser thai the City of ~naheim pay City election officers (for all types of elections called by the City) the same rate as paid by the County of Orange: Inspectors, $15.00; all others, $12.00. CONSTRUCTION OF STEEL-DECK GR6ND $TAND~ LA PALMA PARK: Mr. Turner~ City Attorney~ advised the Council of the in~ormation he had obtained from the Bank of America relative to ibis contract. Telegram from the Pittsburgh-Des Moines Steel Company~ signed by ~. DeKlotz, was submitted and read, revising the nexl to the last para- graph o£ the letter dated February 28~ 1956 wherein the company would retain title to the unpaid portion of the grand stand. Mr. Turner £urther advised %hat he doubted whether the City could legally enter into a contract under these conditions. Further discussion was held as to the amount of interest saved by cash payment by the City for the construction of this project. It was determined that approximately $4~000.00 could be saved if the City could advance the entire con- tract price at this time and that the schools' proportionate share would be paid back to the City wi thin the next few years. Mr. Turner advised that there were two things the City could do on this matter: First, they could rescind this resolution accepting the bid and reject all bids and readvertise for new bids. Second, they could rescind this resolution and reject the bid and find tha~t it would be to the best interest of the City to buy on the open market. The Administrative Officer, Keith A. Murdoch, advised that a cash payment was available only if property to be purchased adjacent to school sites could be purchased from the General Fund. The Mayor asked the representative of the Pittsburgh-Des Moines Steel Company if his company would be willing to go along on the contract as originally advertised if the Bank of America would underwrite the project. The representa- tive assured the City that the company would approve of this; however, the matter should be determined as quickly as possible as the steel for this project had been already scheduled. After further discussion, the Council had to first determine if the Bank of America could negotiate wi!h the Pittsburgh-Des Moines Steel Company, and, if not, then the Council should rescind their action and buy on the open market.
