PUBLIC HEARING~ WEST ANAHEIM ANNEXAT ON: Pursuant to Resolution Noo 3285, duly
published in' the .Anaheim Bulletin, J ,e 12 and 19, 1956, Public Hearing was held
on the proposed annexation of inhabit~d territo~ to the City of Anaheim~ known
and designated as the West Anaheim Amiexationqj

Mrso B.A.. Swanwick, Recordert was sworn in and requested to take down
in shorthand the proceedings and tran~cribe them into longhand and file a
transcription thereof with the City C~erk to be made a part of the record~
The City Clerk was sworn in as a witness and testified on action
taken in connection with the annexatiqn proceedings.
Mr. James E. Walker, AttornEV', requested permission to file
certain petitions for the withdrawal qf names of persona who signed the
original petition for annexation.
After discussion between Mr., Walker the City Council and the City
Attorney, it was moved by Councilman aoons, that the City Council find that
the request to withdraw naJles from th~ original petition requesting annexation
should be denied, Councilman Wisser s~conded the motion. MOTION CARRIED.
After further discussion anc1 in view of the many signatures filed
protesting the inclusion of their pro~rty within the proposed annexation the
Mayor declared the Hearirut continued -qo Julv 2k.~ 19156, 7~OO P"Mn. to allow
necessary time for the cheCKing of signatures of protest against the last
eqaalized county assessment roleo
CONTINUED PUBLIC HEARING. BA.LL-D.A.1E ~TION: In the matter of Hearing, upon
the protests filed against the Ball-D~e Annexation the City Clerk reported
that she had not completed checking t~ names against the last equalized
assessment role, and was unabled to gtve a report as to the number of protests
and the value of the property owned by the protestants at this time.

A gentleman in the audience asked if the petitions requesting
withdrawal of names from the petition lprotesting the annexation would be
honored. It was det,3rmined that the ~ of 7:00 PflM. June 12, 1956, was
the date and time for the filing of p~otests and that no further protests would
be considered after that date and hO~J until the sufficiency of the protests
are determined, however petitions re~sting withdrawal of names previously
filed protesting the annexation would be considered, rurthe~ it was determined
that should the protests filed be insufficient ,an additional" ten days would "be allowed

The Mayor announceq to the people interested that the matter would have
to be continued further to give the City Clerk suficient time to complete the

to erect a service station at the Southwest corner of Palm Street and West
La Palma Avenue()
Public Hearing was iheld on this matter June 12, 1956, and descision
of the Council to be rende~d at this date. Councilman Coons, stated that
after checking the location 10f the proposed service station noting the traffic
and other conditions result~ng from the growth and development of the western!
area of the City, he felt that this was the best and possibly the o~ use
for the property and thereupon moved that the request for the Variance be
granted~ Councilman Wisser seconded the motiono

SPECIAL USE PERMIT~ Special Use Permit, requested by Donald D. Wells for
permission to construct a swimming pool and community club house for use by
occupants of the Hawaiian Village Subdivision, was referred to the City
Engineer to work out engineering problems at the meeting held June 12, 19560
A gentleman representing the applicant advised the City Council that
the Engineering problems had been investigated by planning engineer, H.W.
Mungall~ who had drawn a plot plan of the area showing a fQur foot setback
line from the sidewalk to the front property line.
Further discussion was held regarding the type of corporation this
would be with reference to a established bU5ine58 and the applicant advised
that membership would be offered only to residence property owners in Tract
Nos" 1795, 1897, 2201, 2287, 2288, 2098. 2197. 1721. 1802, 1803, 2258, 2082
2396 and 2659 and that upon sale of their of their properties their memberships
would either be sold or forfeited, that no charge would be made for the use
of the facilities, and only residents in these tracts would participate with
the possible execption of Boy Scout Clubs or other similar organizations~

which represents one=fifth of the total insurance on City owned properties,
he further advised that the rate was lowered this year allowing a credit to

Mr. Walker also stated that the fire insurance on the Library Books were

City Council on motion by Councilman Fry, seconded by Councilman Wisser. MOTION

The City Council of the City of Anaheim met in Adjourned Regular
PRESENT~ COUNCILMEN: Pearson, Fry, Schutte and Wlssere
ABSENT: COUNCILMEN: Coons.
CITY ATTORNEY: Preston Turner, Present.
CITY ADMINISTRATIVE OFFICER~ Keith Ao Murdoch, Present.
PUBLIC HEARING. WAGNER ANNEXATION: Public Hearing was ordered pursuant to
Resolution No. 3300, duly published in the Anaheim Bulletin and the Placentia
Courier, May 31, 1956 and June 7, 1956, and written notices to owners of property
mailed June 8y 1956, on the matter of annexation to the City of Anaheim of
uninhabited territory known and designated as the Wagner Annexation~

The Mayor asked the City Clerk if any written protests had been
filed. The City Clerk advised the Council that no written protests had been
fi lIed in her office.
The Mayor asked if anyone wished to address the Council on the
matter. No one present objected to the proposed annexation and thereupon the
Mayor declared the Hearing closed.
ORDINANCE NO. 1079: Councilman Schutte offered Ordinance No. 1079 for first
reading and moved fer its passage and adoption.
AN ORDINANCE OF THE#CITY OF ANAHEIM APPROVING THE ANNEXATION TO THE CITY OF ANAHEIM
OF THE TERRITORY KNOWN AND DESIGNATED AS THE WAGNER ANNEXATION.
After hearing read in full the title of Ordinance No. 1079 and
having knowledge of the contents therein, Councilman Schutte moved the reading
in full of said Ordinance be waived, Councilman Wisser, seconded the motion.
Motion unanimously carried.
PUBLIC HEARING. REVISED RECLASSIFICATION NO. F-55~5~2(; Submitted by Wagner
Reality Company et aI, requesting C-2 and P=l zoning on property within the
proposed Wagner Annexationa

The City Planning Co~ission pursuant to their Resolution No. 177
recommended said reclassification subject to engineering requirements with
reference to street widening, curbs, gutters, sidewalks and roadway improvements
as required by the City of Anaheim.
The Mayor asked if anyone wished to address the Council on the
matter. No one present objected to the proposed reclassification and no
written protests were received in the office of the City Clerk. Thereupon
the Mayor declared the hearing closedo
