shown on the revised plans be permissible as ornamental only, and that a

Mr Harry Levin called attention to the fact that in making certain
surveys they would need the services and information from the City and that
they would cooperate fully with the City Departmentso

to the type of warning signal system to supplement the present system, which
investigation will take approximately 3 or 4 weeks to complete, and suggested
that Mr Griffith be authorized to continue this investigation in order to

for passage and adoption, granting Variance Noo 1384, subject to the
recommendations of the City Planning Commission, with the exception of
Condition Noo 20 That Condition Noo 2 be amended as follows: "Subject

and stating their reasons therefor; also a copy of a letter received by
Mro Murdoch, City Manager, from Mro Norman Ho Smedegaard, Attorney representing
Mro Floyd Loew, Authorized Agent and purchaser of subject property, stating
their position in this matter, were submittedo
Mro Philip Jo Reilly addressed the Council advising that the
situation here involved a parcel of ground that is being excepted from
the five acre purchase, which parcel is Mr. NunemannGs home, and if Conditions
Nos 1, 7 and 11 were complied with, Mr. Nunemann would be faced with moving
from his home where he has lived for 32 yearso He explained that the re-
quired sidewalk would be directly under the front bedroom windowo He also
advised that they have an agreement with Mro Nunemann to purchase this
parcel from him at such time as he desires to divest himself of the property,
and stated they were willing to dedicate the property and install the im-
provements, but requested that they not be required to do this until
Mro Nunemann divests himself from this one parcelo Therefore, they re-
quested that Items Noso 1 and 7 be amended by excepting that portion of
thg propgrty that is not going to be developed (Mro Nunemann's home site),
and also, that Condition Noo 11 be eliminatedo
Plot plan of development was submitted and reviewed by the
City Council.
Mr. Robert Rosenwald, Attorney representing Mr. Nunemann, advised
that the only way Mr. Nunemann can continue to have full use of his property
is to retain the full parcelo
Mr. Reilly felt that some arrangements could be made whereby
Mr. Nunemann would dedicate the property at this time, delaying the
actual street widening as long as he lived on the propertyo

time, with nothing beyond the curb line of the house site disturbed,
thereby perserving the right of use to Mr. Nunemann for a period of time.
Discussion was held, taking into consideration the present
circumstances of the seller, and also the safety conditions pertaining
to traffic on the streeto At the conclusion of the discussion, and
at the request of Mr. Reilly, said matter was continued to the next
meeting (August 29, 1961) on motion by Councilman Coons, seconded by

PUBLIC HEARING - CONDITIONAL USE PERMIT NO. 140: Submitted by Mr. Leo Freedman,
requesting permis$ion to operate a service station on property presently
zoned R-A, located on the east side of Harbor Boulevard, north of the

The City Planning Commission, pursuant to their Resolution

and noting the fact that the station would be of frame and stucco

PURCHASE - EDISON C~Y FACILITIES: On the recommendations of the City
Manager, it was m6ved by Councilman Coons, seconded by Councilman Fry,
that an amendment be approved and payment of $254.24 authorized, for
additional work done by Edison Company between the time of their
original estimate and previous authorization for purchase by the Cityo
Facilities located, south side of Lincoln Avenue from Magnolia to
St.inson Stree+; Lincoln Avenue to Magnolia Avenue, all customers on
north and south side of Lincoln Avenue east to Gilbert Street; and
South of Katella east of Ninth Streeto MOTION CARRIED.
SALE OF CITY OWNED PR011>ERTY: On the recommendations of the City Manager,
sale of three parcels of City owned property, located between Glencrest
and Crescent Avenues, east of Magnolia Avenue, with a minimum of
$3,750000 was authorized, on motion by Councilman Coons, seconded by
Councilman Fryo MOTION CARRIED.
