tion by the appropriate City Department Head.

CONTINUED PUBLIC HEARING - VARIANCE NO. 1377; Submitted by Heirs of Carl
Fluegge, requesting permission to construct a storage garage on property
located at 1532 Orangewood Avenueo
City Planning Commission, pursuant to Resolution Noo 4, Series
1961-62, denied said Varianceo Appeal from action taken by the City
P15nning Commission was filed, and Public Hearing held August 8, 1961, and
continued to this date, in order that additional evidence may be submitted
supporting the prior non-conforming use of the lando
(City Planning Commission Resolution Noo 5, Series 1961-62 per-
taining to non-conforming use of the land)
Letter of Jo Po Ralls, verifying statements made by Mrs. Ralls at
the meeting of August 8, 1961, was received, and copies thereof submitted
to each Councilmano Letter of Ao Co Schlinger, received at open meeting,
was submitted and read, opposing said Variance and requesting, should said
Variance be granted, suitable screening be provided along the rear property
lineo
The Mayor asked if anyone wished to address the Council.
Mro Robert Wo MacMahon, Attorney representing the applicant,
addressed the Council, advising that he had conducted an investigation in
accordance with the request of the Councilo Tax returns for the years prior
to the time the property was annexed to the City do not disclose the sale
of items built on the property by Mro Flueggeo The returns only disclose
the spray business which has been conducted from this location. He further
advised an attempt to effect a compromise with the representative of the
residents in opposition was made, and they had offered protective screen
planting at the rear~ the filing of deed restrictions on the property
restricting the use of the barn to the work on the spray equipment in con-
nection with the spray business9 and for a small custom wood-turning
operation conducted by Mro Fluegge, with not more than three employees.
He further advised they were willing to stipulate that that would be the
only use of the property, and if and when the property is sold, it will
revert to residential useo He stated that the new building will be sup-
ported by steel beams, have concrete slab floor, metal roof, and either
wooden or metal sides; and in summarizing their position, advised that they
were asking for 3 variance to construct a storage garage to house the
vehicles and equipment not now under covero
Mro Herbert Licker, Attorney representing the opposition, recalled
that the Public Hearing was continued for the purpose of permitting the
applican~an opportunity to establish their right to the Variance they
seek. In referring to previous testimony, he noted a conflict regarding the
number of boats built on the property, and felt if records on this
activity were not kept3 it must be considered somewhat minimalo For this
reason he felt they were seeking something that they did not have a right
to doo To them it seemed strange that for the storage of vehicles, a
reinforced steel-type building would be neededo He called attention to the
future widening of Orangewood, and stated that the more activity of a com-
mercial or light manufacturing nature would draw people to the area,
increasing traffic and hazard to the childreno In his opinion, the
building presently on the property would adequately store the vehicles,
and the addition of another corrugated type building might gradually
exp~nd the very thing they are fearful of having in existence at all, and
which is not lawfully theirs in the first instanceo On the basis of what
is good for the community as a whole, they felt their position in opposing
this variance was the correct oneo He further reported that they had no
objection to the spray business, and agreed to recommend approval of this
variance to his clients upon the following conditions:
(1) If the use of the land was confined to that of the spray

Mro MacMahon submitted a letter from Dr. H. C. vogt, certify-
ing that Mro Fluegge had done spray work for him since 1945. Mr.
MacMahon stated that they were asking that the wood-working use and the
equipment that had been in the building prior to the time that the
Stanton Mill occupied the building, that they be permitted to operate
those with not more than three employees~ to turn out small custom
pieces of woodwork~ such as handles for maple furnitureo He called
attention to the fact that spraying was a seasonal business, and that
the woodworking had been done during the interval between the spraying
sea sons 0
At the conclusion of the discussion, Councilman Coons moved

for passage and adoption, finding that there is a non-conforming use
on the property; that the non-conforming use is that of a spray business
which includes the storage of necessary spraying equipment; that there
is no other non-conforming use of the property, either boat-building or
cabinet-making, attributable to the property other than residential;
that the variance be granted for the operation of this building for the
non-conforming use so long as the non-conforming business is not
expanded, and that said building be used for the storage of vehicles
which are presently on the propertyo

Nunemann, requesting permission to construct single and two-story garden
apartments on property presently zoned R-A, located on the north side of
Orangewood Avenue between Haster Street and the Santa Ana Freeway. (419

Public Hearing was continued from the meeting of August 22,
1961~ at the request of Mr. Philip Ju Reilly, Attorney, for the purpose
of endeavoring to reach a compromise regarding the street improvements
fronting the Nunemann residence.
Mr, Murdoch reported on a meeting he and Mayor Schutte had with
Mr, Nunemann. He stated there are two small lots in the immediate vicinity,
one to the East, and one to the West of this property, which presently jut
out into the right of way of Orangewood Avenue and present the possibility
of Orangewood Avenue becoming a four lane streeto He further reported if
the dedication and improvement immediately in front of the Nunemann house
were not made at this time, perhaps there would not be any great harm done
until the property immediately to the East of subject property was
developedc At the time the property to the East is developed, the property
immediately in front of the Nunemann house would become another obstacle
n the way of providing an additional traffic lane on Orangewood Avenue,
and would seriously interfere with the drainage on Orangewood running from
the East to the Northo For these rea50ns~ he stated, it would appear
that the dedication of the property for the ultimate width of Orangewood
Avenue should be made a part of this action, requiring the improvement of
one additional traffic lane at this time~ and with some type of encroach-
ment, ~o that until the property to the East is developed, the balance of
the improvements including sidewalks and curbs can be postponed by the
posting of a bond to insure their installation.
Mro Reilly, Attorney representing the purchaser of the property,
stated if that portion of the unimproved right of way from the asphalt to
just in front of the hedge was improved, it would give an additional eight
feet of roadwayo He advised that he had tried to secure the dedication
from Mro Nunemann, and he had declined; that without this Conditional Use
Permit, the property could not be developed, therefore the property will
not be purchased, or if purchased, will not be developedo He called atten-
tIon to the present situation, stating that if and when the property to the
East is developed, and if Mr. Nunemann has not yet sold his property, the
City will have the same problem. He explained how improvements could be

THE METROPOLITAN WATER DISTRICT OF SOUTHERN CALIFORNIA - TAX 1961-62: The
Metropolitan Water District's Resolution Noo 5969, dated August 22, 1961,
levying taxes for the fiscal year commencing July 1, 1961, and ending
June 30, 1962, was submittedo Also submitted was a tabulation showing
assessed valuation percentage participation and vote entitlement of the
Member-areaso
Councilman Coons moved that said Resolution No. 5969 be received,
said tax to be extended to the assessment rolls by the County Auditor, and
to be collected by him in the same manner as all other property tax.
Councilman Chandler seconded the motion. MOTION CARRIED.
SIDEWALK WAIVER - 1617 EAST BALL ROAD: Request of Eo He Sargent Company for a
waiver of sidewalks fronting their warehouse and office building located
on the northerly side of Ball Road, approximately 1400 feet east of East
street, (l617 Eo Ball Road) until such time that pedestrian traffic
necessitates such installation, was submitted 0
This being an industrial area, and on the recommendations of
the City Manager and the City Engineer, Councilman Chandler moved the
request for waiver of sidewalks, 1617 Eo Ball Road, be granted.

Councilman Coons moved that the City Attorney's Office be
authorized to protest said application on the grounds that there
presently exists a similar establishment in the close proximity of
La Palma Park~ further that a copy of said protest be forwarded to
the presiding Judge of the Anaheim-Fullerton Municipal Courto

Request of Wo Co Nichols9 President, Anaheim Pop Warner Football Asso-
cation, for waiver of the $100000 rental fee for the use of La Palma
Park Stadium for the Pee Wee Milk Bowl Tournament on September 9, .1961,
was submitted and redd Memorandum from Lloyd Jo Trapp, Superintendent
of Recreation, was submitted recommending th3t the fee not be waived,
and that the group be charged the minimum fee outlined in Resolution No.

It was report.ed that the Anaheim bOYs will not be selling
tlckets for this event~ 2nd there will be no charge at the gate; however
some of the other city Pee Wee teams are selling tickets to raise funds

The Assistant City Attorney reported that this is a private

on a proposed plan suggested by the EngineerIng Department to alleviate some
of the problems in connection with the Johnson and Jewett properties on South
East Street, this proposed plan making provision for an eleven (11) foot
parkway strip and a twenty-nine (29) foot access drivewaYa That if the
Council desired to consider this proposal, the matter should be referred to
the City Planning Department for hearing before the City Planning Commissiono
The Council requested to review the proposed plan, thereupon
the Director of Public Works recorded that said proposed plan could be
available for review at the next meetingo
