Mayor Schutte called the meeting to order.
POLICE FACILITIES - PRELIMINARY PLANS: Mr. Powell, Architect, presented pre-
liminary plans, artist's rendering, and area and cost survey for the new
Police Facility building.
Plans were placed on the Council table and explained by Mr.
Powell, and reviewed by the City Council, City Manager, Chief of POlice,
and Captain Hutton.
Discussion was held regarding the possibility of full excava-
tion of the basement area, and use of the basement as a disaster
shelter, and it was suggested that Mr. Powell prepare cost figures for
a Type 2 shelter and also the estimated cost to excavate the additional
basement area for future improvement 0 Further discussion was held
regarding the setbacks shown on the plans and the arrangement for future
expansion of the building, and at the conclusion thereof, Councilman
Coons moved that the preliminary plans of Smith, Powell and Morgridge
be received and held in abeyance until further information and a general
arrangement plan for the library are receivedo Councilman Thompson

PAYMENT, ARCHITECTURAL SERVICE - MAIN LIBRARY: Communication dated August 24,
1961, from Mrso Martha G. Raymond, Secretary, Anaheim Public Library
Board of Trustees, advising of the Library Board's action that the firm
of Smith, Powell and Morgridge be paid the sum of $3,676.20 for architec-
tural services for the main library, as per their revised statement dated
July 3, 1961, was submittedo
RESOLUTION NO. 7159: Discussion was held by the City Council, and at
the conclusion thereof, Councilman Chandler offered Resolution No. 7159
for passage and adoption, amending Resolution Noo 6846 by deleting there-
from that portion relating to the payment of $4,165.00 to the architectural
firm of Smith, Powell and Morgridgeo

P(~REQUEST -~ PAYMENT: Mro John Dawson, Assistant City Attorney, reported that
the Finance Officer had received a request from a taxpayer to withhold
payment to the firm of Smith, Powell and Morgridge, Architects, and
recommended the firm of Smith, Powell and Morgridge be so notified.
Councilman Chandler moved the payment be held up on the
immediately passed Resolution, until such time as the report is received
from the City Attorney as to the position of the City and the City Auditor
in this mattero Councilman Thompson seconded the motion~ MOTION CARRIED.
REQUEST - BUSINESS LICENSE: Request of Mr. Herbert A. Morales, a blind sales-
man, selling products made by the California Industries for the Blind, for
permission to sell, door to door, in the City of Anaheim, was submitted at
the meeting of August 29, 1961, and continued to this date for further
investigation by the City Attorney's Officeo
Mra Joseph Geisler, Assistant City Attorney, reported on conver- ~
sation with Mro Morales and investigation made pert~ining to his request for a
business license in the City of Anaheim"
Councilman Coons moved that it be the finding of the City
Council that Mro Morales is working as an authorized dealer for a state
agency, Industries for the Blind; that he is in fact a blind person being
rehabilitated and is a resident of Orange County, and is self-supporting,
and for these reasons, moved the request for business license be granted,
and waiver of license fee be authorizedo Councilman Fry seconded the
motiono MOTION CARRIED.
ALCOHOLIC BEVERAGE APPLICATION - VARIANCE NO. 1314: Mro Thomas Ro Coughlin
addressed the Council regarding the operation of an off-sale liquor store
at 401 West Katella Avenue, and explained that it had always been their
intent for the specialty gift shop granted by Variance Noo 1314 to be a
specialty gourmet shop similar to JurgensenVs, and referred to the City
Planning Commission minutes of March 6, 1961, wherein the City Planning
Commission Resolution Noo 132 was clarified to include a Gourmet Shop of
the character established in the JurgensenVs Gourmet Shops, and requested
that the protest filed by the City of Anaheim with the Alcoholic Beverage
Control Board regarding the application for new off-sale general license
at 401 West Katella (William Jo Tansey) be withdrawno
On the recommendations of the Assistant City Attorney, Council-
man Chandler moved that it be the finding of the City Council that in
granting Variance Noo 1314 for a specialty gift shop, it was the intent
by the mentioning of Jurgensen's Gourmet Shop to allow the use of the land
for the establishment of an off-sale liquor store in conjunction with the
gourmet gift shop; and further moved that the City Attorney's Office be
instructed to notify the Alcoholic Beverage Control Board that, based
upon these findings, the City of Anaheim withdraws their protest to the
application filed by William Jo Tanseyo Councilman Thompson seconded the
motion. MOTION CARRIED.

(a) Coral Roof Restaurant, 231 West Katella Avenue. It was moved by
Councilman Chandler, seconded by Councilman Thompson, that inasmuch as
further investigation shows no objection to the operators of the Coral
Roof Restaurant, nor to the operation itself, that the protest filed by
the City of Anaheim to application for new off-sale general license
filed by Crystal Springs Manufacturing Corporation (Coral Roof Restaurant),
231 West Katella Avenue, be withdrawn and the City Attorney's Office be
instructed to so notify the Alcoholic Beverage Control Board" To this
motion, Councilmen Fry and Schutte voted "No"a MOTION CARRIED..
(b) Mabel T. and Willard C. Compton, 1823 West Katella AvenueG On
report by the Assistant City Attorney, that upon further investigation
application filed by Mabel T~ and Willard C. Compton for new on-sale
liquor license at 1823 West Katella Avenue was properly zoned" Council-
man Chandler moved that the protest filed by the City of Anaheim be
withdrawn and the City Attorney9s Office be instructed to so notify the
Alcoholic Beverage Control Board" Councilman Coons seconded. the motion.

(c) Five Points Liquor, 1119 West Lincoln Avenueo On report and recom-
mendation of the Assistant City Attorney, Councilman Chandler moved that
the protest filed by the City of Anaheim to the application for off-sale
general license filed by Wayne Ao Johnson and Martha 10 MacKovic, Five
Point Liquor, 1119 West Lincoln Avenue, be withdrawn, and the City
AttorneyGs Office be instructed to so notify the Alcoholic Beverage
Control Boardo Councilman Thompson seconded the motion. MOTION CARRIED.
Councilman Chandler requested the records to show that he
neither discussed nor voted on the above matter"
(d) Aces Inn, 309 North Manchestero Application for person to person
transfer of on-sale beer license of John Ao Domanic and Joseph A" Ritter,
Aces Inn, 309 North Manchester, was submitted and reported upon by the
City Manager, and no further action was taken by the City Council.
(e) A-I Liquors, 1010 SOo Los Angeles Streeto Application for person
to person transfer of off-sale general license filed by Irma Co Borchardt,
A-I Liquors, 1010 SOo Los Angeles Street, was submitted and reported upon
by the City Manager, and no further action taken by the City Council.
FINAL MAP - TRACT NO" 4233; Subdivider, Stanley E. Bell~ Tract located west
of the stub end of Glen Avenue and south of the stub end of Lotus street,
and contains eleven (ll) R-l lots"
Final map was placed on the bulletin board, and the City Engineer
reported that the final map conforms substantially with the tentative map
previously submitted; that required fees have been paid and necessary bonds
posted, and recommended the approval of said final map.
On the recommendations of the City Engineer, Councilman Coons
moved that Final Map of Tract No" 4233 be accepted. Councilman Chandler

DEVELOPMENT PLANS - TRACT NOg 4233: Mr. A. Re McDaniel, Engineer repre-
senting the developer, submitted house plans for Tract Noo 4233. Said
plans were reviewed by the City Council and approved on motion by Council-

ing the developer, submitted house plans for Tract No~ 4248. Said plans
were reviewed by the City Council and approved on motion by Councilman Fry,

FINAL MAP - TRACT NO. 3822: Subdivider, Calah Construction Company. Tract
located on the west side of Western Avenue, 650 feet north of Ball Road,
and contains thirty-two (32) R-l lots.
Final Map was placed on the bulletin board, and the City Engineer
reported that said final map conforms substantially with the Tentative Map
previously submitted, that required fees have been paid and necessary bonds
posted, and recommended the approval of said final map, subject to the
execution of agreement pertaining to the dedication of lot "Au.
As it was reported that the agreement was being prepared for
execution, Mro McDaniel, Engineer for the tract, and Mr" Wo L" Worthen,
developer, stipulated to the signing of said agreement.
On the recommendations of the City Engineer, and with stipulation
of Mro Worthen, Councilman Thompson moved that Final Map of Tract NaG 3822
be approved, with the condition that said final map not be recorded until
the subject agreement pertaining to lot "A" is executedo Councilman Fry

RECLASSIFICATION NOo F-59-60-115 - EXTENSION OF TIMEg Mro Joseph Co Whitman,
President, Whitman Center, addressed the Council explaining their proposed
forty-two (42) story development and difficulties encountered in complying
with conditions of rezoning within the time limit establishedo He advised
of the magnitude of the project, and the estimated tax revenues the City
will derive upon its completion, and requested a meeting with the City
Council for the purpose of discussing possible compromise regarding street
dedication requirementso
After further discussion, Councilman Thompson moved the applicant
be granted a 180 day extension of timeo Councilman Fry seconded the motiono

CONTINUED PUBLIC HEARING - RECLASSIFICATION NO~ 60-61~91; Submitted by Dean
Steele, requesting a change of zone on two parcels of land located on
the south side of Lincoln Avenue~ between Beach Boulevard and Harding
Avenue and further described as 3042 Lincoln Avenueo
Public Hearing was continued from the meeting of August 15,
1961, for further study of the drainage problem and further investigation
by the City AttorneyGs office of deed restrictions filed on this propertyo
The Mayor asked if anyone wished to address the Councilo
Mro W" P.. Mason, Authorized Agent, addressed the Council urging
the granting of the reclassification, advising that the zoning would be
contingent upon proper engineering for tract drainageo
Mrso Lancaster addressed the Council requesting all the parcels
of property north of her be held for development together, and further
stated that she had not agreed to give an easement for drainage to anyone"
It appeared to her that proper drainage would be through the Pfeil propertyo
In reference to the planning study as prepared by the Planning
Department, Mrso Lancaster noted the rear of her property was designated
for housingo She stated she wanted to develop the Tear of her property
into a trailer parka
Mra John Dawson, Assistant City Attorney~ reported on his
findings in checking file number 55-56-40a Deed Restrictions have been
filed with the County Recorders office for C-l and C-3 uses, and the
applicant of Reclassification Noo 60-61-91 was a party to these restrict-
ionso The balance of the conditions which have not been met were read 0
Mro Dawson further advised that the present request would not be in
conflict with the recorded deed restrictions, inasmuch as the provisions
for C-1 Zoning also include Re'3 uses,; However, it was his recommendation
that applic8tion NOe 5~-56-40 be voided, inasmuch as two out of the three
requirements have not been meta
Mro Stephen Bradford~ Engineer3 explained that the drainage
was to the Southwest~ dnd that the tract was laid out with an alley which
will drain Mr Baker s property; however~ an easement must be obtained to
the Southo He stated it was possible to develop the C-l portion of the
property facing Lincoln Avenue, without obtaining a drainage easement at
this time; however, the solution to the problem would be to eventually
take the water south to the flood control channelo He further reported
that Mrso Lancaster s easement to the City is a sewer easement, and
perhaps when she wishes to develop her property, a possible drainage
solution might be worked outo
Mrs Pfeil, 3064 West Lincoln Avenueg reported that although
they were 3sked to join in the formal application~ Noo 55-56-40, they
withdrew their property from this application; however they were now
ready to part cipate in any property development for the entire areao
Mro John Brooksg Attorney representing Mro 00 Go Baker, owner
of property fronting on Stanton Avenueg stated he attended the City
Planning Commission meeting where denial of this rezoning was recommended..
He stated that the planningstu drawn by the Planning Department were
drawn without the consent of Mro Baker and otherso He felt that the
subject property should be developed commercially, that the only advantage
the present application would have would be to the owner of the property
to the detriment of the other owners in the area 0 He felt the City
Council should consider the benefits to the City of Anaheimo

Mr. Roy Stuhley, representing the developer of the requested R-3
zoning~ felt the Planning Study made was the highest and best use of the
land, and that more tax dollars to the City of Anaheim would be realized
if developed R-3 with C-l fronting on Lincoln Avenue than if developed
entirely commerciallyo He stated that the reason the former application
was never completed was because the many owners of the property could not
agree on price, and further, submitted an offer to sell their property
for the same price that the other owners are willing to sell theirso He
stated if the zoning on this property was completed, they would be in a
position to spend more money to try to take care of the drainage problem.

MrSD Booth, owner of property at the southeast corner of Grand
and Lincoln Avenues, addressed the Council in opposition to the requested
R-3 reclassification~ explaining that their property would be cut in two.
She felt this area was one that could be used for a bigger purpose, and
should be all one zoneo
At the conclusion of the discussion, Councilman Coons moved that
said Public Hearing be closedo Councilman Chandler seconded the motion.

Mro Murdoch, City Manager~ reported that upon further checking
file number 55-56-40, the properties of Pfeil, Booth and Lancaster are
omitted from the reclassificationo Apparently the developments already on
the property were by separate actiono
Discussion was held, and it was considered that the former
reclassification still pending would allow the applicant an R-3 development,
and the Council would be unable to require a single development including
all properties as requested by the op~nentsi thereupon the Mayor declared
the Hearing closed"

Mra Robertson, Authorized Agent addressed the Council urging
favorable consideration cl the Reclassification~ and with reference to
condition number eight (8) of City Planning Commissionvs recommendations,
stated he would like to have as many parking spaces as possible within
the limits of the lot; however, the building is to be 2176 square feet,
requiring eleven (11) parking spaces for business and professional use,
and requested this requirement be amendedo He also requested Condition
Noo 10 be amended, for, in his opinion, Euclid Avenue frontage will
eventually all be commercial, and to require him to dedicate access rights
to the alley would prevent the use of this alleyo
Mr" Busch, 617 Alvy Street9 and Mro Daniel, 602 Alvy Street,
addressed the Council requesting the use of the alley be prohibited
because of the additional traffic that would be created on Alvy Streeto

like to have a C-3 Zoning, however their operation could be accomplished in

Mro Jim Nelson, applicant9 addressed the Council, advising that

that the property was very badly needed as they are required to move from
their present locationn

Mro Louis Eo Dysinger, Authorized Agent, advised that through mis-
information the prospective purchaser, Mro Gater9 was of the opinion that he
would be responsible for the expense of installing street, curb, gutter and
sidewalk requirements fronting subject property at the time South Los Angeles
Street is widened by the City, thereby creating a financial hardship not
anticipated; and under these circumstances, the proposed purchaser registered
a protest before the City Planning Commission~ that the matter has since
been clarified and Mro Gater advised that where street improvements presently
exist, it is the CityUs responsibility in widening the street to replace
said existing improvements 0 He outlined the commercial uses presently in
the area and advised that Mro Gater intends to operate a TV sales and service
business on subject property~ and urged favorable consideration of their
rezoning applicationn
Mro Morgan lowery, representing Mro and Mrso Albert Gater, advised
that the purchase was contingent on obtaining the proper zoning to allow
the television repair shop, and urged that the Council grant the zoning
request; however, further advised that any conditions imposed in the granting
thereof required substantial outlays of cash which could not be met by Mr$

Councilman Chandler offered a resolution denying Reclassifica-
tion Noo 60-61-11. Further discussion was held by the City Council, and
Mrs. Ruth Niermann, applicant and owner of the property was asked if she
would consider a lesser zoning, such as C-l. Mrs. Niermann replied that
she would accept the C-I Zoning, and would comply with the dedication
requirements, and if the sidewalks were in hazardous condition, she would
have them repaired in accordance with the recommendations of the City
Engineering Departmento Councilman Chandler withdrew the resolution
previously offered on the grounds that the Council is considering a
lesser zoning for the propertyo
RESOLUTION NO. 7165: Councilman Chandler offered Resolution No. 7165
for passage and adoption, authorizing the preparation of necessary
Ordinance changing the zone to C-l, subject to the following conditions:

Interested parties came forward and reviewed Precise Plan Study,
and discussion was held. Mro Reisch reported that the owners of the other
nine lots had signed a petition for rezoning in accordance with the City
Planning Commission Study, and were prepared for immediate filing; however
he felt that action could be taken on his zoning application, as public
hearing had already been held on his request for C-l Zoningo
Mr. Harris, owner of one of the properties included in the
Precise Plan study, advised that there were at least three property
owners ready to develop, and requested the hearing date be set as soon as
possible4 Mro Reese, City Planning Director, advised that if the appli-
cation was filed immediately, it could be scheduled for the October 2,
1961, City Planning Commission meeting.
Discussion was held by the City Council regarding the deed res-
trictions presently on the property, and it was suggested that if the
owners of property within the tract could review the proposed plans and
the City Planning Commission recommendations prior to the hearing, that
perhaps consent to removal of the deed restrictions might be given.
Councilman Coons moved that action on Reclassification No.60-61-96
be deferred to November 7, 1961, to be considered with the application to be
filed by the other nine property owners involved along this tract frontage.
Councilman Thompson seconded the motiono MOTION CARRIED~
REQUEST - MR. A. J. BEPRISTIS: Communication dated August 24, 1961, from Mr.
A. J. Bepristis, requesting investigation and elimination of the Disneyland
fireworks, was submitted (copies having been furnished each Councilman).
The Mayor asked if Mro Bepristis was present9 and wished to speak.
Mr. Bepristis addressed the Council requesting the City Council to
ban the Disneyland fireworks now and at any time in the future as a cause
of disturbance to the residential neighborhoods surrounding Disneyland.
Mr. Murdoch reported on the dates granted Disneyland for the
fireworks displays.
Mro Dawson, Assistant City Attorney, reported that the dates for
the fireworks displays were established and the permit granted at a public
hearing, and did not believe the Council would be justified in revoking the
permit just prior to the end of the season.
Discussion was held by the City Council, and Councilman Thompson
moved that the next time a request is received from Disneyland for the display
of fireworks, that the Council announce a public hearing, and that City
notices of said public hearing be given to the general public through a
daily newspaper. Councilman Fry seconded the motion. MOTION CARRIED.
It was suggested by Councilman Thompson that notification of
such a hearing also be given to the public through the Anaheim Newsletter.
Mr. Bepristis further requested that if these fireworks can not
be stopped at this time, that a noise standard be established.
PLANS - CONDITIONAL USE PERMIT NO. 134: Mr. John Krajacic submitted preliminary
plans which were reviewed by the Council and discussion was held.
Mre Krajacic advised he would prepare another set of plans in
conformance with the Council's suggestionso
