submitted and reviewed by the City Councilo Councilman Coons moved said
sign application be grantedd Councilman Fry seconded the motion. MOTION

REQUEST - SIDEWALK WAIVER: Request of Kenneth W. Holt, the Fairmont School, for
a waiver of sidewalk requirement fronting the school at 1557 West Mable
Street, was submitted 0 On the recommendations of the City Engineer, Council-
man Chandler moved that temporary waiver of sidewalks be granted until such
time as required by the Cityo Councilman Coons seconded the motion. MOTION
CARRIED..
REQUEST - SIDEWALK WAIVER: Request of Bert and Ruby Harris for waiver of side-
walk requirement at 2068 Della Lane, was submitted. On the recommendations
of the City Engineer, Councilman Chandler moved that temporary waiver of
sidewalks be granted until such time as required by the City. Councilman
Coons seconded the motiono MOTION CARRIED.
WRECKER SERVICE - McCOY MOTOR COMPANY; Communication from Eo Ro McCoy, McCoy
Motor Company, 320 North Los Angeles Street, regarding wrecker service
available to the City of Anaheim, was submitted, copies having been fur-
nished each Councilmano
Mr.. Murdoch reported on the present method of alternating night
wrecker service calls used by the Police Departmento
Mro McCoy addressed the Council and presented an additional
letter to each Councilman regarding wrecker services available. He advised
that they presently have two tow trucks available, which are taken home at
5:30 P.M. by their employees, who then receive all wrecker calls directed
to the garage at their home; that arrangements have been made for installa-
tion of phones in the wreckers after the first of the yearo

At the request of the City Council, the Chief of Police further
explained their method of handling wrecker service calls and answered
questions of the Councilo
Discussion was held regarding the location of the wreckers in the
residential area, and Mra Geisler advised that the R-I Zoning Code does not
allow the parking of tow trucks in an R-l Residential areaa
MIa Hankins, McCoy Motor Company, advised that they were only
requesting every third wrecker call, and were prepared to handle calls
properly and efficiently and with the best of equipmenta
After further discussion by the City Council, Councilman Coons
moved that the Police Department be authorized to call McCoy Motor Company
at their business numbe~ as well as the other two tow firms, for their share
of the business to which they would be entitled, providing that the
vehicles are stored at the garage; further, that the Police Chief report to
the Council in ninety (90) days on the relative value of the services of
McCoy Motor Companyo Councilman Chandler seconded the motiono MOTION

ALCOHOLIC BEVERAGE APPLICATION - l777-A LINCOLN AVENUE: Mr. Harry Fa Kime,
owner of property at 1777-A Lincoln Avenue addressed the Council explaining
the circumstances regarding the application before the Alcoholic Beverage
Control Board for new off-sale general license at this location, filed by
Dominic and Edith Mo Giglia, which application was protested by the City
of Anaheim because of improper zoning, this commercial development being in
an M-I Zoneo
Mro Kime was of the oplnlon that this being an established build-
ing, majority portions of which are presently used for commercial purposes,
that they would not come under the provisions of the Emergency M-l Ordin-
ance, and on that basis proceeded with negotiations for the lease of the
building for an off-sale liquor store, and therefore requested that the
City withdraw their protest to said application with Alcoholic Beverage
Control Boardo
Discussion was held by the City Council, and the Assistant City
Attorney, and it was suggested to Mr4 Kime that a proper zoning application
be filed with the Ci ty Planning Commission.
Councilman Chandler moved that the Alcoholic Beverage Control
Board be informed that the applicant intends to file a proper zoning appli-
cation to allow this use as the property is being used as commercial
property under a former Ordinance, and that if said zoning application is
granted, there will be no objection by the City to the granting of the
licenseo Councilman Thompson seconded the motion6 MOTION CARRIED.
REQUEST TO USE LA PALMA PARK STADIUM: Request of Anaheim Junior Chamber of
Commerce, Mro Lo Ao Francis, State Director, Anaheim Jaycees, for permis-
sion to use La Palma Park Stadium October 19, 1961, at 8:00 O'Clock P.M.
for a program on Americanism and Anti-Communism, and advising of their
plans to have a $1000 donation to the event, the profit therefrom to be
used either to start an Americanism and Anti-Communism library in the City
of Anaheim, or as a donation to the City Library for this purpose; and
further requesting that the rental fee be waived in view of the purpose
for which the stadium will be used, was submitted..
Mr. Murdoch reported on the cost involved in furnishing stadium
lighting, clean up, and attendan ts.
After further discussion by the City Council, Councilman Coons
moved that the request of the Anaheim Jaycees for use of La Palma Park
Stadium on October 19, 1961, be authorized, and that the fee be waived on
condition that all of the profits be used for either of the two purposes
set forth in their letter of August 29, 19610 Councilman Thompson seconded

COMMUNICATION - WATER SERVICE: Copy of letter received September 5, 1961, from
Mr. Aa Bepristis? 1547 Edithia Avenue, Anaheim, and directed to the Orange
County Board of Supervisors~ the Anaheim City Council, and Robert Romo,
Water Petition, requesting that the Dyke Water Company of Garden Grove be
contracted to supply water to the City of Anaheim at the present rate, and
discontinuance of the Anaheim Water District, was submitted (copies of said
letter furnished each Councilman) a
Councilman Chandler moved that it be the sense of the Council
that they are talking about water conservation, and they are talking about
a public utility~ which is of great importance to the City of Anaheim,
that they do not feel that any private organization should have it within
its power to serve such a life~giving force as water; that it should be
within the direct control of the people and not a private interest, and
that they should so inform the writer of this letter and any other inquirer.
Councilman Coons seconded the motion~ adding that the City maintains a
system which has adequate pressure to serve the customer and his household
needs, and also maintains a pressure in their mains to provide adequate

license filed by George Patrick Sullivan, 3616 Main Street, Riverside,
California, doing business as Sullivan's Security Patrol and Guard Service,

Mro Murdoch reported that the City AttorneyUs Office and the

CONDITIONAL USE PERMIT NOo l36~ Request of Dra Ro Eo Hook~ Pastor of Grace
Baptist Church~ for review of certain conditions set forth in the granting
of Conditional Use Permit Noo 136, for construction of a church, was
submittedo Dro Hook was present and submitted a chart setting forth the
position of the church with reference to Conditions Numbers 5, 6, 8 and
lO~ of City Planning Commission's Resolution Noo 6, Series 1961-629 per-
taining to the dedication and extension of Haron Street, and the
installation of a six foot masonry wall along the east~ west and south
boundary lineso He advised that he had contacted the Free Methodist
Church~ purchaser of the property to the East~ and extending to Mayflower
street, and that they are of the opinion that a wall along the East
boundary of subject property would be detrimental to both church proper-
tiesa Further, that pending development plans of the adjacent church
may provide ingress and egress on Mayflower Street~ and therefore
extension and improvements of Haron Street to provide access to said
adjacent property would not be necessary; however, they would be willing
to provide a turn-around or cul-de~sac where the street dead-endso He
further noted that the property to the West is presently zoned C-l and
requested waiver of this wall requirement pending actual development
with the thought of possible joint participationo

Council~ referring to petition of protest being circulated and filed, con-
taining twenty~three signatureso He advised that their main objection was
that a statement was made by the applicants that the only reason for the
installation of the kitchen was to meet the City regulations. To them,
this would appear that the applicant did not intend to serve a great
quantity of foodo He explained that there are five similar establishments
in the immediate vicinity~ and called attention to the many children in the
area crossing this property going to and from the stores across the streetG
He reported his disapproval of any use that would tend to degrade the area.
Mro Vaughan9 applicant9 addressed the Council urging the granting
of his requesto With reference to his statement regarding kitchen facili-
ties~ he stated he misunderstood the question of the City Planning
Commission, and advised that he does intend to serve food, and that
originally he wanted a steak house on the propertyo

Mr~ Charles Frank, Authorized Agent, addressed the Council,
explaining that request to reconsider Condition No.2 was made in order
that they be allowed to install a chain link fence instead of a solid wall,
thereby enabling them to keap the eucalyptus trees on the north and east
boundaries of the propertyo Their plans were to trim them to an approximate
height of fifteen to twenty feet; however, after considering the cost of
topping the trees and the cost of future maintenance, requested their
request for reconsideration be withdrawn, and agreed to the improvements
of the property in accordanCe with the City Planning Commission9s recommen-
dationso

The Mayor asked if anyone wished to address the Council.
Mrj Donald Gittelson~ representing Lighthouse Construction and
Development Company~ addressed the Council relating their plans of
development and presenting an artist9s rendering of the nine story building
proposed for this two acre siteo He advised that at the present time, they
did not have tenants for the high rise structure; however planned to proceed
immediately with the smaller section of the developmento
Mro James DaY9 Executive Vice President of the B~zza-Cardoza Com-
pany, addressed the Council stating that they had no objections to the
development~ ~nd thought this would be a beautiful building; however,
they were concerned with the reduction of the Code requirements pertaining
to parking0 He explained that Los Angeles Street was a very busy street
and street parking could be dangerous, considering the many people working
in this area going to and from worko Mro Day related the experience of
their company with ~simildr 5J.tuation at their Beverly Hills establishment,
where overflow parking onto their parking lot had been a constant concern..
He felt this could happen here if a real shortage of parking occurred. He
further stated his appearance here was not to voice an objection, but to
learn more about the parking situationo
MIo Glttel'5on referred to the plot plan and explained that the
proposed devel~pment would be considerably south of the Buzza-Cardoza
location~ and that +ccess to the property would be from the Frontage Road"
He doubted if off,-street parking would occur, as it would be quite a
walking distance to their buildingo He stated that parking variation was
required because of the peculiar design of the propertyo
Plans were reviewed9 ~nd it was noted this development being a
total of 639103 square feet would require 420 parking spaces. The Council
considered thqt 3 reduction to 154 parking spaces would be a substantial
deviation from Code req~iTementso

Department and presumed that eventually the Frontage Road will revert back

advised that the Frontage Road provides access to property other than the

POLICE FACILITIES: Councilman Chandler suggested that in designing the new

of a Gym and facilities for instruction and training of the officers in
the art of self defense~
DISASTER SHELTERS: Councilman Chandler suggested that study be given regard-
ing the placement of disaster shelters in the front yard areas, as he
understands the County is proposing an amendment to their Ordinance along
these lineso

Mayor Schutte called the meeting to order.
ALCOHOLIC BEVERAGE APPLICATION - 1777-A LINCOLN AVENUE: Mr. Philip McGraw,
Attorney representing Mr. Harry F. Kime., owner of the property at l777-A
Lincoln Avenue, and also representing Bryan Industries, addressed the
Council requesting reconsideration by the Council of their action taken
relative to the application of Dominic and Edith Giglia for a new off-sale
general license at 1777-A Lincoln Avenue, and withdrawal of the protest
filed by the City with the Alcoholic Beverage Control Board, and further
requesting clarification of the City's position with regard to similar
situations where completed commercial buildings lie within industrial
zones. He advised that Mr. Kime has filed an application for Reclassifi-
cation of the property to C-l; however, because of the delay he has lost
his prospective tenant because of the action taken by the City Council; that
there is a possibility that the tenant. will reconsider if the Council
withdraws their protest in this matter. He outlined the history of the
development of this property, and advised that two-thirds of the commercial
buildings were occupied prior to the adoption of the Urgency M-I Ordinance
and were allowable uses and development under the old M-l CodeJ that
negotiations for the proposed liquor store use were pending at the time
the Urgency M-l Ordinance was adopted.
Mr. McGraw referred to the !Jon-conforming Use portion of the
Anaheim Municipal Code and again to the Urgency M-l Ordinance, and was of
the opinion that there was no use light enough allowable under the new
M-l Ordinance to which these commercial buildings could be adapted without
substantial changes in the buildings, and felt that Mr. Kime was being
denied the right to use his property for the legitimate purpose for which
it was developed.
