Mayor Schutte called the meeting to order.
MINUTES; Minutes of the regular meetings held September 12 and September 19,
1961, were approved on motion by Councilman Coons, seconded by Councilman
Chandler, with the following amendment clarifying the policy of the Council
on page 5126 of the September 19, 1961, minutes:
"That the City Planning Commission and the Planning Department be
directed that it shall be the policy of the City Council to consider appli-
cations for Variances and Conditional Use Permits filed by lessees of the
property or owners of the property, and that where the application is filed
by a lessee, satisfactory evidence in the form of an acknowledged authori-
zation from the fee owner authorizing the lessee to make said application,
shall be presentedo" MOTION CARRIED.
RESOLUTION NO. 7204: Councilman Chandler offered Resolution No. 7204 for
passage and adoption.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING AND
DIRECTING THE PAYMENT OF DEMANDS AGAINST THE CITY AS OF SEPTEMBER 26, 1961.
(Warrants Nos. 14210 to 14411, both inclusive, totaling $642,181.44.)

Mayor Schutte declared Resolution No. 7204 duly passed and
TRACT NO. 3941 - EXTENSION OF TIME: Request of Bill W. Tietz, President, Tietz
Construction Co., for six-month extension of time to Tentative Tract Map No.
3941, was submitted.
Councilman Chandler moved that one year extension of time be
granted Tentative Tract No. 3941. Councilman Coons seconded the motion.
MOTION CARRIED.
RECLASSIFICATION NO. 58-59-99 - EXTENSION OF TIME: Request of Marjan Development
Inc. for a one-year extension of time for compliance with conditions of
Reclassification No. F-58-59-99 was submitted.
On the recommendations of the City Manager, Councilman Thompson
moved said request be granted. Councilman Fry seconded the motion. MOTION
CARRIED.
REQUEST - ENCROACHMENT PERMIT. TRACT NO. 3694; Request of Mr. Russell Jay for
encroachment permit into two ten-foot utility easements within Tract No. 369~
and also requesting permission to proceed with the development as said
permits are being processed, was submitted.

Mr. Ben Rochelle, developer of Tract No. 3694, addressed the
Council explaining the requested permit was for an overhang encroachment
two and one-half feet in a ten foot utility easement on the east side of
lot 13 and the west side of lot 9 in Tract Noo 3694, and advised that in
discussing said permit, he had encountered no objections with the utility
Department, and therefore requested temporary approval at this time to
allow construction to proceeda
Mr. Maddox, City Engineer, advised that his office had not com-
pleted full investigation of the request, nor obtained necessary written
clearanceso

Further discussion was held by the City Council, and at the
conclusion thereof, Councilman Chandler moved that said Encroachment Permit
be granted, subject to the approval of the City Manager and clearances from
all departments and agencies involvedo Councilman Thompson seconded the

RESOLUTION NO. 7205: Councilman Chandler offered Resolution No. 7205 for
passage and adoption, authorizing the Mayor and City Clerk to execute all
Encroachment Permits which have been approved by the City Manager and
cleared through all departments and agencies involved.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE

REQUEST - COMMUNITY FAIR: Request of Mro R. Ro Harris, Anaheim Junior Chamber
of Commerce, for permission to conduct their Annual Community Fair in con-
junction with the Downtown Merchants v Association on October 26, 27 and 28,
1961, from 10:00 AoMo to 10;00 PaM. on Lincoln (Center) Street, between
Los Angeles Street and Clementine Street, and further requesting the waiver
of fees and licenses connected therewith, was submitted and read by the
City Managero
Councilman Coons moved that permission to conduct this Annual
Community Fair be authorized on the dates requested, provided that they
comply with all requirements of the Fire Chief and Police Chief; further,
that permit fees for the operation of concessions be waived; and that
concessionaires be local service organizations, and that funds and profits
derived from said concessions be used for charitable purposes; and in

CENTRAL LIBRARY - BUILDING PROGRAM: Mr. Jordan, Architect, addressed ~he .
Council, submitting cost information relative to basement usage and more
intensive land utilization in connection with the proposed new Central
Library building, and discussion was held between the City Council, City
Manager and Mro Jordano
(Mayor Schutte returned to the meeting, 4.00 P.M.)
Consideration was given to the additional cost and method of
financing the construction of full basement facilities, which costs were
not included in the bond issueo
At the conclusion of the discussion it was the feeling of the
Council that future growth of the City would require expansion of this
facility at a later date, and therefore would warrant the expenditure of
funds at this time resulting in a saving to the City, considering the
ultimate land utilization and initial cost of construction.
Councilman Coons moved that the City Council authorize the
City Attorney to prepare an amendment to the existing contract for
architectural services, authorizing the Architect to design the Central
Library Building with a full basement under the main structure, incor-
porating therein facilities that would normally be placed in the basement
if one is provided; that the balance of the basement be designed as a
fall-out shelter as a large unfinished areao Councilman Chandler seconded

APPOINTMENTS - CIVIL DEfENSE CITIZENS' COMMITTEE: Mr. Charles Griffith,
Coordinator of Civil Defense~ City of Anaheim, reported the resignation
of member-at-large Henry Ruskin from the Citizens' Committee for Civil
Defense, and advised of the acceptance by the Citizens' Committee of the
following members: Mro Joseph Wo Shelley, member-at-largef Mr. David W.
McMillan~ member-at-Iarge; and Mrso Gail Messenger, Secretary-Recorder.
Said appointments to the Citizens' Committee for Civil Defense
were ratified by the City Council as recommended by the Coordinator of
Civil Defense~on motion by Councilman Coons, seconded by Councilman Fry.

TAX RELIEF - FALLOUT S~LTERS: City of La Mirada Resolution No. 61-150
urging establishment of such practices as would grant a tax benefit to
persons constructing fallout shelters on their property, was submitted.
RESOLUTION NOo 7206: Councilman Coons offered Resolution No. 7206 for
passage and adoption, urging tax relief as to fallout shelters, copies of
said Resolution to be forwarded to the appropriate legislative bodies and
boards, including the state Legislature, Congress of the United States,
state Board of Equalization, County Assessor and Internal Revenue Service.

CONDITIONAL USE PERMIT NO. 152: Submitted by the Assistance League of Anaheim,
requesting permission to expand existing gift shop and add rest room
facilities at 1341 West La Palma Avenueo
The City Planning Commission pursuant to their Resolution No. 71,
Series 1961-62, granted said Conditional Use Permit, subject to the follow-
ing conditions:
I. Installation of a six (6) foot masonry wall along the west,
north and east boundaries of subject property.
2. Provision of parking in accordance with Code requirements.
3. Development substantially in accordance with Exhibit Nos.. 1,
2 and 3.
4. Payment of $2.00 per front foot for street lighting purposes
on La Palma Avenue.
5. Time limitation of one hundred eighty (180) days for the
accomplishment of Item No.4.
Action was deferred by the City Council at their meeting of
September 19, 1961, for further investigation regarding dedication and
parking requirements.
Mr. Murdoch reported that upon investigation, dedication and
improvement requirements have been met, and that parking requirements can
be met provided the land area is used as indicated on the plans.
No further action was taken by the City Council.
RESOLUTION NO. 7207: On the recommendations of the City Engineer, Councilman
Coons offered Resolution Noo 7207 for passage and adoption, accepting the
bid of Ro Jo Noble Company for the improvement of Durst street from Lemon
Street to approximately 1350 feet east of Lemon Street, Job No. 501, in the
amount of $8,871.70, as the lowest responsible bid.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ACCEPTING A SEALED
PROPOSAL AND AWARDING A CONTRACT TO THE LOWEST RESPONSIBLE BIDDER FOR THE

damage to property caused by a broken water main.

PUBLIC HEARING - VARIANCE NO. 1392: Submitted by Edward L. and Iris Elliott,
(Vera Eo Oster, Agent), requesting permission to establish legal office
in existing residence and provide four (4) parking spaces on property
presently zoned R-2, located at 525 West Broadway (north side of Broadway
between Harbor Boulevard and Citron Street).
The City Planning Commission pursuant to their Resolution No.
45, Series 1961-62, denied said Variance.
Appeal from action taken by the City Planning Commission was
filed by the Authorized Agent and Public Hearing scheduled.
Petition of approval containing signatures of twenty-four (24)
land owners in the immediate area was submitted and read.
The Mayor asked if anyone wished to address the Council.
Vera Oster, Authorized Agent, addressed the Council relating the
history of this request, stating that an application for reclassification
(61-62-2) had been filed and withdrawn when they were advised to file for
an application for Variance, as this action affected only one lot. She
urged favorable consideration and stated further delay would probably
necessitate renting the dwelling, which would be difficult on such a tem-
porary basis..
Mro Marc Andrews, Agent for the prospective purchasers, addressed
the Council, explaining the intended use of the property.
Councilman Chandler stated that in his opinion this area is in a
transition stage, and thereupon moved that the Planning Department be
instructed to make a study of the residential and P-l area between Citron
Street and Harbor Boulevard on the north side of Broadway (excluding the
church property) and on both sides of the 500 block on Chestnut Street;
further, that the City Planning Commission hold a public hearing on said

Mr~ Harry Knisely, Attorney representing the applicants, addressed
the Council, advising that the only objection to the zoning was to their
request for waiver of wall requiremento As a result, their plans have been
amended to include the construction of the wall..
Revised plans showing greater detail of development were submitted
and reviewed by the City Councilo
Mra Robert Haneline, 3421 West Ball Road, advised that in his
opinion, this probably was the best use of the land; however, requested that
the wall be made a requirementa
Mr. George Torres, 3435 West Ball Road, addressed the Council,
stating in his opinion the wall was of great importance.
Mra Knisely again advised of their agreement to the construction
of the wall..
Mrso Do Ho McConnell, 910 South Knott Avenue, addressed the
Council stating she had no objection to the apartment development, however
they operated a chicken ranch and would continue to do so until some
arrangements are made to develop the rear portion of their property, and
requested information on obtaining a road through their property so that
new development can materialize..
Mro Martin Kreidt, member of the Planning Staff, reported on a
Study made by the Planning Department of this area, and stated a connecting
street would require cooperation of the adjoining land owners.
Mro Knisely reported on the meeting regarding this problem, at
which no solution was reached as property owners could not agree.
Mr. Murdoch stated that it appears any development would take the
cooperation of the neighbors who have the same problem, that no plan can be
developed involving only one parcel..
The Mayor asked if anyone else wished to address the Council,
there being no response~ declared the hearing closed..
RESOLUTION NO.. 7212: Councilman Thompson offered Resolution No. 7212 for
passage and adoption9 authorizing preparation of necessary Ordinance
changing the zone as requested, subject to the recommendations of the City
Planning Commission9 deleting therefrom Condition Noo 2, and amending
Condition Noo 8 to read one hundred and eighty (180) days.

RECLASSIFICATION NO. 61-62-9: Submitted by Unity Church of Truth and Reli-
gious Educational Center (Harold L. Weirich, Authorized Agent), requesting
change of zone from R-l to R-3, property located on the east side of Bush
street approximately 141 feet north of Broadway (204 South Bush Street).
The City Planning Commission, pursuant to their Resolution No. 41,
Series 1961-62, recommended said Reclassification subject to the following

owner, and that a portion of his property contiguous to this annexation

SIGN APPLICATION - ORANGE COUNTY TRACTOR COMPANY: Application for permission to
erect a non-conforming sign (oversize) at 101 Manchester Avenue together
with plans was submitted and reviewed by the City Council. Councilman
Thompson moved said sign application be approved. Councilman Fry seconded
the motion. MOTION CARR1ED.
SIGN APPLICATION - TEXACO OIL COMPANY: Application for permission to erect a
non~conforming sign (oversize and overheight) at the southeast corner of
Lemon Street and Orangethorpe Avenue, together with plans, was submitted
and reviewed by the City Counci 1. Counci Iman Chard ler moved sa id sign
