property from R-A to R-l has been considered by the City Planning Commission
and is scheduled for public hearing before the City Council on November 7,
1961.
Discussion was held by the City Council, and it was agreed that
the applicant could move the dwelling onto the property, but not affix it
thereto nor ask for service connectionso
RESOLUTION NO. 7280t Councilman Fry offered Resolution No. 7280 for passage
and adoption, granting application of Mr. Donald Ko Pullman for permission to
move a dwelling as requested, subject to reclassification of, the property.

Councilman Coons moved that said Dinner-Dancing Place Permit be granted in
accordance with the recommendations of the Chief of Police. Councilman
Chandler seconded the motion. MOTION CARRIEDo
ENTERTAINMENT PERMIT: Application filed by Doyle Jo Vanderlip to allow a piano
bar at Ninos, 2916 West Lincoln Avenue, was submitted. Councilman Thompson
moved said Entertainment Permit be granted9 in accordance with the recommend-
ations of the Chief of Policeo Councilman Fry seconded the motion. MOTION
CARRIED.
REQUEST FOR REFill~D - LICENSE TO ENCROACH: The City Attorney's Office reported
that verbal request had been received from Ben Rochelle and Russell Jay for
a refund of Ten Dollars permit fee for license to encroach previously
granted by the City Council, as the applicants did not wish to exercise said
encroachment.
Inasmuch as investigation has been made and necessary documents
prepared, said request for refund was denied on motion by Councilman
Chandler, seconded by Councilman Coons. MOTION CARRIED.
REQUEST - INTERIM BUSINESS LICENSE: Request of Mro and Mrso William Co Carr for
interim business license to allow the operation of a pony ride ring at
2947 Lincoln Avenue until proper application for said use can be processed;
subject property previo'Uslygxanted Conditional Use Permit Noo 95 for the
conduction of a Go-Kart Ville,was submittedo
Councilman Coons moved that said request be denied, as in his
oplnlon to grant said request would predetermine action on the application
to be filed. Councilman Chandler seconded the motiono MOTION CARRIED.
REQUEST - SIDEWALK WAIVER: Request of Mro and Mrs. Lester G. Jones, 2528 West
Orange Avenue; Mr. and Mrso Charles So Cox, 2518 West Orange Avenue; and
Mr. & Mrs. Charles E. Hurley, 2510 West Orange Avenue, for reconsideration
of action taken by the City Council May 23, 1961, denying request for a
waiver of curbs and sidewalks, and again requesting waiver of sidewalks
only, was submitted.

Mr, Maddox, City Engineer, recommended the street improvements
be required in this area, due to the close proximity of two schoolso
Mr. Jones addressed the Council and advised that Mro Cox, Mro
Hurley and himself had talked to the two property owners to the West,
who are not directly involved in this request, however, have agreed to
grant Easement Deeds to the City for street improvements, and expend the
funds at this time so that curbs and gutters can be installed extending
to Velare Street; that installation of sidewalks on the three lots in
question would require the removing of the present landscaping and place
sidewalks only in the middle of the residential block~ He advised that
they would be wllling to install sidewalks at such time as they were
installed in the entire blockc
Discussion was held by the City Council, and at the conclusion
thereof, Councilman Chandler moved that waiver of sidewalks only, until
required by the City, be granted on the three lots in question, subject
to the condition that Mr. Jones and his neighbors acquire an agreement
for the immediate dedi.cation to the City of sufficient property for the
installation of sidewalks, curbs and gutters for the ultimate width of
the street, and the installation at this time of curbs and gutters in
accordance with Engineering Department requirements; it being understood
that if said dedication 1S obtained, the sidewalk waiver will apply also
to the two additional lotsc Councilman Fry seconded the motion. MOT10N

JOB NO. 1216: Request of Mr A Ho Famularo for waiver of the penalty
involved because of delay ln completlon of Job Noo 1216, du~ to the
lnability to immediately secure the use of special equipment, was submitted,

Mro Famularo addressed the Council explaining the reasons why
they requested the use of special type of equipment for laying pipe, and
and advised of the conditions causing the delay in obtaining said equipment9
that he realized the Job has run considerably past the completion date, and
would cost the CIty more in inspectIon fees, etco; however, did not believe
anyone was waiting to use this line, and therefore requested that the City
relieve him of a portion of the penalty fees.
Mr. Maddox, City Engineer, reported on the contents of the
specificatIons and the contract, and advised that the liquidated damages
commenced on June 21, 1961, and that the job has not yet been completedo
Mr. Dawson, Assistant City Attorney, advised that the City
Attorney's Office was of the opinion that in this case there was no justifi-
cation for a waiver of the liquidated damage provision in the contracto
Councilman Coons, although sympathetic to the contractorOs
position, was of the opinIon that the contractor was not entitled to relief
as this was not a mechanical error, but an error in judgement on the part
of the bidder, as the type and size of the pipe was set forth in the
specifications and belIeved in all faIrness to the other bidders that the
City should adhere to the terms of the specifications and of the contractu
After further discussion by the Council, Councilman Chandler
moved that the matter be referred to the City Manager's Office and the City
Engineer's Office for performance under the contract, and if there is any
benefIt of doubt of the starting or the completion dates, that the contractor
be given that consideration If it can be done within the terms of the
contract. Councilman Thompson seconded the motion. MOTION CARRIED.,

several inquiries as to the scheduling of a public hearing on this matter,
and further continuance of this business after the expiration of the six

Mrs. Diggens addressed the Councll explaining that her business
license was issued for a six month period only and expires on October 31,
1961, that she has strictly adhered to the conditions of operation of her
beauty shop that were set forth in the City Council~s resolutiono
Councilman Thompson moved that action on said matter be continued
to the meeting of October 31, 1961, at 3~00 PoMo, and that the file be
referred to the City ManagerVs Office for a full investIgation and report;

Mrso Sun, President of the Associ.ation, addressed the Council,
outlining their program and budget for the 1961-62 Season, and explained
their request for a renewal of the contract wlth the City of Anaheim, in
the total sum of $7,500000~ that the main increase in the proposed contract
was because of the additional paid personnel as they included provision
for an Executive Director, Executive Secretary and office expense in their
Budgeto Mrso Sun further outl~ned the cultural Importance of their Assoc-
iation to the Community, and remalned at the speaker's stand to answer
questions of the Council~
Discussion was held by the Council regardIng justification for
the expenditure of public funds and the value of the program to the Commun-

through the County of Orange, that bonds had been filed with the County,
the Tract Map and plans processed to County standards, that all financing
arrangements have been made on the plans prepared, indicating a twenty foot
set-back, which is in confllct with the City of Anaheim standardso He
further advised that the Tract is now up to the point of issuance of Build-
ing Permits, and that the Marjan Development Company has requested
permission to secure Buildlng Permits and proceed under the original plan
for twenty foot set-back instead of twenty-five footo

that the developer has changed hIS position to such an extent under the
requirements of the County of Orange and the County building regulations,
that it would be inequitable to him to have him conform to City Code at

The Mayor declared Resolution Noo 7286 duly passed and adoptedo
TENTATIVE MAP ~ TRACT NOo 4261: Subdivider, Mo L8 McGaughye Tract located on
the south side of Lincoln Avenue, 332008 feet east of Stanton Avenue, and
contains 22 proposed R.,3 lots, and one proposed C-l loto (Reclassification
Noo 61-62-12)
Action of the C~ty Council was deferred from the meeting of
October 10, 1961, at the request of the developer to allow revision of
the map to Include a one foot strip marked "Lot B" on the westerly
boundary of the propertyo

Mr. James Maddox, City Engineer, reported the only change in the
map was the one foot strip on the westerly boundary of the property, that
the map now indicates a one foot Lot "A" on the easterly boundary of the
property, and a one foot Lot hB" on the westerly boundary of the property.
It was moved by Councilman Thompson, seconded by Councilman Fry,
that Revised Tentative Map of Tract No. 4261 be approved subject to the
recommendations of the Cit Panning Commissiono To this motion, Councilman
