PRELIMINARY PLANS - CENTRAL LIBR~Y& Mro Joe Jordan, Architect, presented and
explained in detail colored renderings of the proposed Central Library
building, and complete preliminary plans which indicate two full stories and
a full basement, which includes a fall-out shelter; that said preliminary
plans have been approved by the Library Board of Trustees.

Discussion pertaining to the plans, basement use and fall-out
shelter was held by the City Council, the City Manager and Mro Jordano
Myo Jordan requested that the following consulting engineers
which they propose to use for the Anaheim Central Library project be
approved by the City Council, in accordance with terms of the contracto

CONDITIONAL USE PERMIT NOo 107 ~~ EXTENSION OF TIME: Request of Howard Gilmore,
Chairman~ Board of Trustees, Zion Lutheran Church, for six months extension
of time to Conditional Use Permit Noo 107 was submitted 0
A gentleman representing the church addressed the Council and
further explained the activities of the church relative to the construction
of a complete church plant under Conditional Use Permit Noo 1070
Discussion was held by the City Council, and it was felt the
church has worked diligently toward the completion of the conditions of
said Conditional Use Permit, and thereupon, Councilman Chandler moved that
the extension of time be granted to Conditional Use Permit Noo 107, and
that the sixty day time limit within which to file a letter or agreement
Indicating acceptance by the church of the conditions imposed (Section 180640040
AoMoCo) also be extended, as it appears the construction of this church will be

RECLASSIFICATION~~61~~: Request of Robert MacMahon, Attorney on behalf of
Mro and Mrso Russ Boorey, for reconsideration of Council action approving
revlsed plans on August 1, 1961 (M-l Zoning, northwest corner of Orangewood
and Manchester Avenues, Ordinance Noo 1546) was submitted 0
Mro MacMahon addressed the Council explaining the circumstances upon
which an agreement was reached between the opposition and the applicant in
connection with the granting of Reclassification Noo 60-61-32, and advised
that the original plans indicated a 13 foot setback from the north property
line, which was the basis of said agreement, that the revised plans approved
by the City Coune 1 on August 1, 1961, allow the construction of a building
on the property line with no setbacko Mro MacMahon further advised that they
had no objection to the reclassification of the property, and they are will-
ing to accept the original plans; however, they do object to the revised
plans that were approved in August, and therefore requested that said approval
be I'econsidered by the City Counc il and that a publ ic hearing be held
regarding the revised plans~ and further9 that any construction under Reclass-
ification Noo 60=61 32 Ordinance Noo 1546 be held in abeyance at this timeo
The Mayor asked if the applicant was presento There being no
response, the City Council requested that the applicant and Mro MacMahon
meet with the City Attorney in an effort to resolve this problem, and that
if said matter can not be satisfactorily resolved, their request will be

located at the northwest corner of Haster Street and Orangewood Avenue

determined to be necessary by the Director of Public
Utilities to adequately serve the subject property and other

Series 1961-62, denied said Conditional Use Permit.
Appeal from action taken by theCity Planning Commission was filed

Correswondence from Orange County Planning Commission dated
October 24, 1961, calling attention to Master Plan of Arterial Highways
for Orange County and recommending adequate right-of-way for the proposed
highway was submitted, together with two letters of protest signed by
William Re Hadley and Vera B. Officere
The Mayor asked if anyone wished to address the Councilo
Mro Albert Brandt, 4440 Ambrose Avenue, Los Angeles 27, California,
addressed the Council advising that approximately 200 feet from this location
property is presently being considered for C-l Zoninge Regarding the
proposed highway, Mr. Brandt stated they would be willing to dedicate
property to the State in the vicinity of where the large mound of earth
is presently located; however they had never been contacted by the State
and do not know what their requirements will beo
Propos~d new right-of-way noted and read on the plot plan by the
City Engineering Department as taken from a preliminary plan received from
the State was submitted and reviewed by the City Council. Mr. Brandt was
invited to the Council Table where discussion resumed. Mr. Ro W. Hadley,
owner of 21 acres adjoining subject property to the West, addressed the
Council objecting to the proposed use, and stated he would lose the sale of
his property as the prospective purchasers would not complete the escrow
if the trailer park use is approvedo
Mr. Bill Jones, 657 North Tustin Avenue, Orange, California,
representing two property owners, one adjacent to subject property on the
East and the fifteen acres on the east side of the Freeway adjacent to the
Freeway, addressed the Council stating the owners he represented favored
the trailer park useo
The Mayor asked if anyone else wished to address the Council,
there being no response declared the hearing closed.
Mr. Martin Kreidt of the City Planning Department presented a map
indicating the proposed secondary road and also a Tentative Map approved by
the City of Orangeo He advised that the Planning Commission received cor-
respondence from the City of Orange reporting that they had adopted a
General Plan indicating this area as single family residential useo
Councilman Chandler suggested this hearing be continued to give
the applicant an opportunity to revise the plot plan to more nearly conform
with City of Anaheim proposed standards; and in the meantime definite

southeast corner of Knott and Orange Avenues.
The C1ty Planning Commission, pursuant to their Resolution Noo 82,

Mr. Carey, 303 North Siesta Street, recalled that the reason why
the Conditional Use Permit application for a motel on the adjacent property
to the East had been denied two-story development was on the basis of
incompatibility, abutting a residential area, and felt that the same problem
is evident in this caseo
Mro Louis Dragicevich, owner of adjacent property to the North of
subject property, advised that he was still opposed to the motel on the
adjacent property being two-story, and on that basis believes it is unfair
to allow this applicant to erect a two-story commercial structure 120 feet
from the R-l areao He questioned if this structure was proposed for two-
stage development, single story now, and the second story added in the
future 0
Mr. Pastel advised that it is contemplated that the entire
development be erected at once, further, that the second floor is for
business and professional offices, and will not be used at night or on
weekends, therefore in his opinion there will be considerably less invasion
of privacy than a two-story motelo
Mro Dragicevich stated on the basis of Mro Pastel's statement, he
would not be opposed to this development providing that the six foot masonry
wall along the north property line be a mandatory condition of the reclassi-
ficatIon, and that the rear of the building be at least 120 feet from the
wallo
Mayor Schutte suggested planting adjacent to the wall to further
screen the commercial project from the residential areao
The interested parties were invited to the Council Table to review
the proposed plansc
Mro Carey, 303 Noc Siesta, felt to approve this reclassification
was spot zoning, and to allow a two-story commercial development next to
a one<~story motel development was discriminatory, and contrary to good
planning" He felt the precedent was established inasmuch as the motel was
approved for single-story construction, and that the requirements of the
rezoning could not be met on the basis of incompatibilityo
Councilman Thompson explained the provisions of the C-I Zone,
wherein a building 150 feet from the adjoining residential property to the
North could be constructed to a height of 35 feeto In his opinion, the
20 foot structure within 120 feet of the residential property would be
the better development for the adjacent residential area"
Ila Dragicevlch, 2264 Wo Polk, addressed the Council advising
that she was opposed to the motel because it was an invasion of their
privacy; however, she approved of this proposed development with the
requirement for screen planting.
Mro Pastel felt a good precedent would be established by this
project inasmuch as C-l property requires only a twenty-foot setback, and
they are establishing a 120-foot setback precento
Mr. Pastel agreed to reasonable planting along the north wallo

RESOLUTION NOo 7305: Councilman Thompson offered Resolution Noo 7305 for
passage and adoption, authorizing the preparation of necessary Ordinance

to provide for a four foot planting area against the north wall; further,
that thick shrubbery be planted in this four-foot strip to grow to a

The City Planning Commission pursuant to their Resolution No. 93,
Series 1961-62, recommended said reclassification be denied.
Mayor Schutte asked if anyone wished to address the Councilo
Mro Joe Lemons, 429 South Euclid Avenue, requested the reason why
the City Planning Commission denied the applicantVs request for a real
estate office in the existing house, as he also owns property in this
immediate areao
Mro Martin Kreidt, of the City Planning Department, advised that
from the evidence submitted at the City Planning Commission hearing, it
was felt that the joint use of residential and commercial in the existing
structure might remain for a long period of time, and would tend to lower
development standards in the area instead of upgrading the area by erection
of new structureso
The Mayor asked if the applicant or his agent was present to
address the Councilo There was no response.
Mro Fred Schubert, 630 So. Euclid Avenue, advised the owner of
the property was Mro Wiley, who also owns other property in the area, and
that the man who is requesting to establish the real estate office is Mr.
Ed Picassoo Mro Schubert was of the opinion that Euclid Avenue should be
developed commercially as it was undesirable for residential use because
of the noiseo
Mr. Niel Braidwood, 412 Falcon Street, felt that Euclid Avenue
will eventually become entirely commercial, inasmuch as it is an arterial
highway and undesirable for residential purposes.
Plans from the file were reviewed by the Council, and discussion
was held regarding the parking requirements.

Mr0 Jack Kinney, 1441 SOo Los Angeles Street, Agent, addressed
the Council requesting further consideration of the conditions imposed by
the City Planning Commission, as Condition Noo 1 is presently being
processed under Reclassification No. 59-60-67. Further, that Item No. 2
pertaining to the additional dedication on Zeyn Street seems to be
unreasonable because the street is only 300 feet long and dead-ends on
t.he North in Midway Drive, across which is located a permanent school,
and which dead-ends on the South against a trailer park; that the lots
610ng Zeyn Street are only 11308 feet deep; also, that he understands that
the City Planning Commission has initiated a zone change on the additional
Jots on Zeyn Street and in this zoning are requesting not only the additional
widening of the street but a ten-foot parkway setback. This reduction in
lot depth in his opinion would make the lots useless for M-l utilization..
Mr. Kinney called attention to the 12 foot wide unimproved alley
at the rear of subject lot, and suggested that the City might wish to
abandon the alley at the south end, as he owns the property on both sides..
Discussion was held regarding the proposed abandonment, and Mr.
Murdoch advised that if there would be any advantage to closing the south
50 feet of the alley, the request could be processed to carry out such an
abandonment..
Mr. Kinney further advised that if the 50 foot section of the
alley was abandoned, this would tie the property which is presently
used for a yard area, in with the lot in question, so that entrance could
be from Zeyn Street and exit out the east alley, thereby tying the two lots
togethero

further he did npt believe that the present or future use on Zeyn Street
would require adttitional widening.
Mr. Kinney advised that he would be willing to work out any

in question, and if consideration to extension of the fence across the
alley and along the south boundary of the other lot was desired, he would
be happy to discuss the possibility of joint fence construction on that
area also with Mr. Bostwick.

a seventeen and a half foo~ half width street, which is not enough for one
travel lane and parking.

John Rothman, 223 South Claudina Ave., representing Mr. Pettingill as his
Agent, addressed the Council explaining the relationship between Reclassi-
fication No. 61-62-26 and Variance No.. 1406, that the contiguous parcels
of property are to be improved as one development. He advised that the
reclassification being the front portion approximately 100 wide by 200 feet
in depth, after street widening, had been planned for business and pro-
fessional offices and designed to contribute to development in the area;
that the architecture is residential in character, and there will be a
generous landscape setback on Buena Vista Avenue; that because off-street
parking for the offices is provided for at the rear of the building, and
by providing access from Euclid Avenue only, the development will not
interfere with residential traffic on Buena Vista Avenue, and the building
in effect will look like ,a large residence on the corner.
Mr. Rothman further advised that the balance of the property has
been planned for division into three residential lots for high quality
homes of fifteen hundred to seventeen hundred square feet, to be erected
immediately; that to guarantee the home owners in the area that high
quality homes will be erected on these three lots, plot, floor, and Buena
Vista elevation plans were submitted to them at a meeting, and they seem
to be in agreement providing that the developer did the following:
1. Read the escrow instructions into the record so that they would be

20 Requested that deed restrictions be placed on the proposed commercial
lot stating that a concrete block wall will be constructed at the rear

Mro Rothman submitted said plans to the Council for review and
requested that if said applications were granted that the plans submitted
and the afore-mentioned conditions be included as conditions of approval;
that the escrow is No. 1701906 at the United California Bank, dated
October 27, 1961, and lists Mr. Lloyd R. Pettingill as seller, and Mr.
Ronald D. Doan as the buyer, and is scheduled to run for a period of
thirty days or lesso
Mr. Rothman felt that all the objections issued against their
proposed plan have now been answered, and that with these proposals
listed, they have given the property owners in the area adequate
guarantee that their property values will be protected by good quality
homes? and respectfully urged approval of their reclassification and
variance application as requested..
The Mayor asked if anyone else wished to address the Council.
Mr. W. Fo Tate, 1636 West Buena Vista Avenue, questioned if the
proposed building would front on Buena Vista or on Euclid Avenue.
Mr. Rothman advised the address would be on Euclid Avenue,
however there would be offices with doors on the Buena Vista side; that
they propose five or six offices with eighteen parking spaces.
Mr. Tate stated that in his opinion offices with doors coming out
onto Buena Vista Avenue would cause considerable amount of parking on that
street by the professional people, thereby causing commercial and extra
traffic in an area which cannot accomodate it, because such traffic
already exists on the other side of the street.
Mr. Rothman advised that they would remove the doors from the
Buena Vista side.
Mro Duane Dawson, 1664 Buena Vista Avenue, addressed the Council
advising that he was one of the gentlemen who met with Mr. Rothman 0 He
stated that these plans would be acceptable if Mr. Rothman would write
into the record that the through walk-way entrances onto Buena Vista
Avenue would also be closed.
Mro Rothman stated that they would be willing to work the
matter out and restrict the parking and the entrances to these offices
to the parking area, that it was not their intention to use Buena Vista
Avenue as a commercial street.
Myry Dawson further asked what could be done to guarantee immediate
completion of the homes and not merely the clearing of the ground.
Mr. Rothman advised that the escrow is contingent upon the
approval of the land plan as submitted, and that they planned immediate
constructiono

Mro Mervin Danforth, 1426 Adria, addressed the Council advising
that basically their main objection was that these lots are quite small
and should they not be developed before the C-I and then fail to be
developed as home sites, it would be quite difficult to sell this property
for homes because of the size. He stated that if the C-l Zoning could
be tied to the building of the residential property, they would not have
any objections to the development; that if the property is not going to be
developed, the variance from 70 foot to 60 foot lots should not be allowedo

and referred to the plot plan that accompanied the application setting
forth plans for landscaping, parking and building site (copies of plot
plan were presented to each Councilman for review). He called attention
to the proposed ~ize of the parking stalls, Bt feet by 20 feet, and
requested that Condition No. I of the City Planning Commission's
recommendations be amended to allow parking stalls of this size rather
than IO feet by 20 feet, which, in his opinion, would be an excessive
waste of land. He noted many substantial business developments as well
as many of the City-owned parking lots that were developed less than the
minimum requirements of the Anaheim Municipal Code (10 feet by 20 feet)o
Upon reviewing the plot plan, it was noted that parking was
not in excess of the minimum two-thirds requirements for this zone..
Discussion was also held regarding plans for landscaping, and
Mro Halvorsen stated that he planned to continue landscaping presently
developed on the commercial property to the West of subject property.
The Mayor asked if anyone else wished to address the Council,
there being no response, declared the hearing closed.

speaking on behalf of Mr. Clasen, stated in his opinion this is the highest
and best use of the land, and requested Council approval of the reclassifi-
cation and Conditional Use Permit.
Mro Joseph Riley, 1516 Hedgewood, Anaheim, California, speaking
for himself and other residents in the East Anaheim area, referred to
previous request in this area and Council indication that this section
should be reserved for low density developmento He related the close
proximity of schools and further advised that through a Conditional Use
Permit an apartment development was establishedo He explained their
confusion and asked how the apartment development obtained approval without
their knowledgeo
In answer to Mro Riley's inquiry, Mr. Murdoch stated the property
referred to was a garden type apartment project developed under Conditional
Use Permit Noo 132, that public hearing was held by the City Planning
Commission but not by the City Council, as the City Council did not elect
to review the action taken by the City Planning Commissiono
Mro Riley stated the balance of the area is R-I, and to approve
this apartment development did not seem reasonable with the General Plan,
and thereupon requested the petition be denied9 and in support of his

After hearing read in full the title of Ordinance No. 1642 and
having knowledge of the contents therein, Councilman Chandler moved the
reading in full of said Ordinance be waived. Councilman Fry seconded the
motiono MOTION UNANIMOUSLY CARRIED.
COMMUNICATION - HALLOWEENs Mr. Keith Murdoch, City Manager, submitted and read
correspondence received from Mrs. Martha K. Schumacher regarding the success
of the past 38th Halloween Festival. Said correspondence was ordered
received and filed on motion by Councilman Thompson, seconded by Councilman
Fry. MOTION CARRIED.
MAGNOLIA SCHOOL DISTRICT - FALL~OUT SHELTERS: Mr. Murdoch reported on verbal
request from the Magnolia School District Board requesting that the City
consider the possibility of building fall-out shelters on school-owned
property if the School District would make such property available.
Councilman Chandler moved that the School Board be informed that
the City Council is willing to listen to any reasonable proposition from
any political body or any citizen, and that their offer has been received
and will be given consideration. Councilman Fry seconded the motion.

RESOLUTION NO. 7328: Resulting from report of Assistant City Attorney John
Dawson, Councilman Fry offered Resolution No. 7328 for passage and adoption.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE
CONSTRUCTION OF CERTAIN ACCESS ROADS AS "EXTRA WORK" UNDER THE EXISTING
CONTRACT FOR THE CONSTRUCTION OF RESERVOIR NO. I.
On roll call the foregoing resolution was duly passed and adopted

STREET NAMING COMMITTEE ~. EUCLIp-NICHOLAS AVENUE: Mayor Schutte reported on
Councilman Coons' recommendation to the Street Naming Committee that the
name of EucLid Avenue be retained instead of changing to "Nicholas Avenuet.
as the majority of the street is presently named "Euclid Avenue".
STATE COMPENSATION INSURANCE - REFUND OF PREMIUM: Mr. Keith A. Murdoch submitted
and read in full the congratulatory letter accompanying check in the amount
of $44,168.25, representing refund of 53.5% of the total premium paid on
City of Anaheim Workman's Compensation Insurance Policy.
ADJOURNMENT: Councilman Fry moved to adjourn. Councilman Schutte seconded the
motion. MOTION CARRIED~
