Councilman Coons moved that action on the matter by the City Council
be held over for one week (November 14, 1961) to allow time for Mro
MacMahon to secure the signature of the developer indicating consent to
the terms of agreement pertaining to the plan, as noted in the letter.
Councilman Fry seconded the motion. MOTION CARRIEDo
Mr. MacMahon retained the letter for the purpose of securing
the developer's signature 0
ACE, Mr. Murdoch reported on petition received
requesting pe~ission to bock off Florida Place November 19, 1961, from
4100 PoM. to 8100 PoMo for the purpose of having a Block Party, and advised
that Florida Place is not a cul-de-sac street, but a one-block long street,
however signatures approving the block party have been obtained from all
the home owners in the block.
Councilman Fry moved the request to hold a block party on Florida
Place be granted, subject to the recommendations of the City Manager.
Councilman Thompson seconded the motion. MOTION CARRIED.
POLICY OF THE COUNCIL - BLOCK P~TIESI Councilman Coons moved that it be the
policy of the City Oouncilthat the City Manager be authorized to grant
requests for the temporary closing of streets for the purpose of holding
Block Parties when the pet1tions therefor contain the signatures of all
affected persons. Councilman Fry seconded the motion. MOTION CARRrED.
EXTENSION OF TIME - IMPROVEMENTijONDI Request for one year extension of time
for street improvement bond filed by Homer Jo and Betty Bo Dunn, in con-
nection with House Moving Permit at 119 South Magnolia Avenue, was
submittedo
Mro Ben Brock, representing Mro and Mrso Dunn, addressed the
Council further explaining their requested extensiono
On the recommendations of the City Engineer and the City Manager,
Councilman Thompson moved that one-year extension of time to street improve-
ment bond for 119 South Magnolia Avenue be grantedo Councilman Coons

RECLASSIFICATION NOe 59-60-85 -EXTENSION OF TIME. IMPROVEMENT BOND, On the
recommendations of the City Engineer, Councilman Thompson moved that six-
month extension of time be granted street improvement bond filed by
Henry Hass pursuant to Ordinance Noo 1496 in Reclassification Proceedings
NOe F-59-60-85. Councilman Fry seconded the motion. Councilman Chandler

TENTATIVE TRACTS NOS. 3987 and ~988 - EXTENSION OF TIMEI On the recommendations
of the City Manager, Councilman Coons moved that request of McDaniel
Engineering Company, Agent, for one-year extension of time to Tentative
Tracts Nose 3987 and 3988 be grantedo Councilman Chandler seconded the

RECLASSIFICATION NO. F-54-55-l2 (FRANCIS w. ELLIOTT), Request of Mro and Mrso
Howard Stanton for the City to take immediate action to enforce the pro-
visions of Ordinance Noo 963, in Reclassification Proceedings 54-55-12,
pertaining to the erection of a fence prohibiting ingress and egress to
Cemetary Road, and also requesting information as to the status of Cemetary
Road and the placement of barriers thereon, was submitted.
Mro Murdoch, City Manager, reported that no final inspection has
been made, nor will be made, of the Elliott Building until it is in
accordance with the Ordinance granted, or unless the City Council sees fit
to change the Ordinanceo One of the requirements of the Ordinance was
that access to the Cemetary Road be deniedo This provision has not been
complied with, and as a result the building cannot be used and has not
been usedo There isn~t any action that the City can take as there has
been no violation.

Mrse Stanton stated that their property was directly across from
the parking lot area and that cars race down the alley -going through the
parking lot, made possible by the ingress and egress onto Cemetary Road,
in violation of ~he Ordinance. She felt legislation should be passed to
enforce this Ord1nanc€'o
Mro Joseph Geisler, Assistant City Attorney, explained that the
Zoning Ordinance pertains to the use of the land~ and if the property is
used without complying with the conditions of zoning, a probable penal
violation would occur~ as the conditions rendered are conditions of use,
and use of the property has not been madeQ
Discussion was held relative to the ownership of Cemetary Road~
and the jurisdiction thereofo
Mayor Schutte, also being a member of the Cemetary District
Board, reported that the road was deeded in fee, without charge~ to the
Cemetary District by the Elliott family, and has been used by the Elliotts
to maintain their citrus groveo He further advised that the Cemetary
District Board was reluctant to prohibit the Elliotts from using the roado
Mrso Stanton stated that the Assessor~s records indicate the
road and the cemetaIY as one parcel, and that everyone in this district is
taxed for ito It was her contention that if the public at large is taxed
for this district that no one individual should be allowed to go in and
out of their property onto Cemetary Roado
Taxation of this District was explained by Mro Murdocho
Road.
Discussion was also held regarding the status of the Cemetary
Mro Robert MacMahon, appearing on behalf of Mro Leo Friis,
Counsel for Mr. Elliott, advised that it was their feeling that the closing
of access to him from this alley would be in the nature of a discriminatory
action, if the alley on the east side is permitted to remain openo Further,
it was theIr opinion that the City had no jurisdiction in passing an
Ordinance requiring the placement of barriers prohibiting the use of the
road, when the use thereof is agreeable by the Cemetary Districte He
stated in al probability Mro Elliott will file a formal request to
amend the Ordinance by the removal of this conditione
Mro Ira Richard, 1497 Birch Street, Anaheim, owner of property
in the area north of the Elliott property, advised that at the meeting of
property owners when the agreement was reached for three C-l lots and one
R-3 lot, it was Mr. Elliott1s idea to erect the fence; and it appeared to
him that Mro Elliott was receiving preferential treatment 0 He further
advised that if Mro Elliott is allowed to use this road, that he intends
to remove his fence and aJso utilLze the road, thereby increasing the value
of his propertyu

Mr, Stanton advised that Myo Elliott agreed to these conditions
when the Ordinance wa adopted~ and questIoned his right to request an

MrsQ Stanton reported that a request was made through Supervisor
Phillips to have Mr. George HoLden, County Counsel, give them the information
over hIS sIgnature what the title search of this property reveals, and
further asked if anything is to be done about the posts installed on
Cemetary Drive" Mrs Stanton was advised that the City did not install
the posts and had no right to take them down; that thlS question should
be directed to the AnaheIm Cemetary Board

REQUEST - REMOVAL OF DIVIDER ST~IP: Communication dated August 17, 1961, from
Orange County Property Owners Association on behalf of tenants and property
owners on Manchester Avenue, south of Lincoln Avenue and north of Broadway,
was submitted, requesting the removal of the center raised divider on
Manchester Avenue in this area, as it was felt the removal thereof would
increase the accessabillty to their buslnesses, and would not create any
hazard to motorists or pedestrians (copies to edch rouncllman).

tendent, and they find lt in excellent condition and have agreed that the

Mro Martin Kreidt, City Planning Department, explained the City
Planning Commission is action and referred to three plans prepared by the
Planning Department which were placed on the bulletin board for all to
reviewo
Staff recommendations, should approval be granted in accordance
with Exhibits 5, 6 or 7, were revlewedG
Mr. Kenneth Harris advised that the rezoning was requested in
order to establish his accounting office on the propertyo He related the
professional uses intended for the other parcels included in this appli-
cation, and further stated that in his opinion and in view of the City
Planning Commission's vote on the matter, being four to four, it was as
much favored as opposedo Regarding the protest filed by Mr. Edward
COlling, President of the Anaheim-Sunkist Civic Association, he felt
protests of this association represented only a few and was not the
general position of the East Anaheim communityo Also, in his opinion,
the increase in traffic would not create any additional burdeno
Mro George Reish reported on the survey made by him regarding
the possibility of rezoning this area~ From the many people contacted,
all but two people thought that Placentia Avenue was already commercially
zoned" He commended the Planning Staff on the preparation of their
recommendations and the three maps, and stated in his opinion Exhibit Noo
5 was the most reasonable and economically acceptable pIano
Two photographs of residential property converted into pro-
fessional offices were presented9 one being the corner of Ball Road and
West Street, the other 903 West Lincoln Avenue, He felt that these con-
versions were a credit to the communityo Reference was made to the last
traffic count on Placentia Avenue, which substantiated that this is no
longer a residential streeto
Mro Ed Collings, President of the Anaheim-Sunkist Civic
Association, read letter which was previously presented to the City Plan-
ning Commission, setting out in fulltheir objections to the rezoning" He
stated that they were not opposed to C-l zoning on Placentia Avenue, but
were interested in the preservation of the best quality possible for the
neighborhoodo He further advised that the Association membership was made
up of residents in the Prudential Homes Tract.
MrD W. Ao Mills, 226 North Placentia Avenue, was certaiA that
f the residential tract was constructed at the present time, there never
would have been residences on Placentia Avenue In his opinion, the
change in zone would be an asset to the property, street and communityo
He further advised that they proposed to blacktop the rear portion of
these lots for parking and build a SIX foot wall at the rear of the
adjoining property owners, the expense of this had been agreed to by all
the property ownerso He called attention to the many commercial estab-
lishments already in the ~rea and requested the rezoning be grantedo
Mro Richard Ingram, 316 Tower Place, member of the Anaheim-
Sunkist Civic ASSocIation, stated he was the person that formerly
withdrew the Assoclationis protest; however, that was when it applied
to only one lot (Reish); however at that time their fear of future
encroachment down Underhill Street was voiced
Mro Reish advised that it was on the recommendation of the
Plannlng Staff that the second house on Underhill had been added to the
application in order for better alignmento As far as the Underhill address
s concerned, it was his desire to change the address to 116 - 132 North
Placentia Avenueo
The Mayor asked if anyone else had anything new to offer in this

MrQ Joseph Geisler reported that Exhibit Noo 5 meets the Anaheim
Municipal Code parking requirementso
Mro Murdoch suggested that the recommendations of the Planning
Staff for Exhibit Noo 5 be given further study to bring them into such
wording that they will accomplish the legal requirements, however to do
this, additional time would be necessaryo

substantially in accordance with Exhibits 1, 2 and 30
Review of action taken by the City Planning Commission was ordered
by the City Council because of a possible conflict with the development of a
freeway overpass and the proposed swimming pool, as it appeared that the
location of the swimming pool would be in the area to be occupied by the
Stateo

Mro Simpson came forward to the Council Table and explained that
this property has been an existing 58-space trailer park since 1949, opera-
ting under the provisions of a County Variance; that the request for a
Conditional Use Permit was necessary in order for them to be permitted to
build a 17 foot by 40 foot swimming pool, which they have been requested to
build by their tenantso He felt their trailer park business would be in
jeopardy without the swimming poolo
State Division of Highway Preliminary Design Study was submitted
and reviewed by the City Council and Mro Simpsono
Mrs Simpson reported that his attorney, Mro Otto Jacobs of Santa
Ana advised that he had contacted the Highway Engineering Office in Los
Angeles and learned that this was just a plan or study, that no specific
engineering work has been done, and no specific date established as to when
this will take placeo Inasmuch as it could be five years, he felt that they
should not be deprived of present use of the property, pending possible
future improvements by the Stateo
Mr. James Maddox, City Engineer, reported on conversation with
Mr. Rockford of the Division of Highway Office regarding their timing for
acquisition of Right-of-Way for this projecto He was informed that there
are several problems that would have to be resolved before they could
acquire Right-of-Way, however, Right-of-Way may be acquired within the
next six monthso The development may take two yearso

JOB NO. 1229: Request of Orange County Sewers, Inc., for a thirty-day extension
of time to complete Job No. 1229 was submitted, together with recommenda-
tions of the City Engineer.
Mr. James Maddox, City Engineer, reported that his written
recpmmendations were based on the fact that a power pole had not been moved
by the Edison Company; however, on the day that the letter was written, the
pole was moved and thereupon recommended the time be extended to December 8,
1961.
In accordance with the City Engineer's report and recommendation,
extension of time was granted to Orange County Sewers, Inc., for the com-
pletion of Job Noc 1229 to December 8, 1961, on motion by Councilman Coons,
seconded by Councilman Thompsono MOTION CARRIED.
JOB NO. 1224: Request of Orange County Sewers, Inc., for thirty-day extension
of time to complete Job No. 1224 was submitted together with recommenda-
tions of the City Engineer.
On the recommendations of the City Engineer, a thirty-day
extension of time was granted to Orange County Sewers, Inc., for the com-
pletion of Job No. 1224 on motion by Councilman Thompson, seconded by
