ZONING COORDINATOR: Martin Kreidt. Mayor Schutte called the meeting to order. MINUTES: Minutes of -I:he Anaheim City Council meeting held November 28, 1961, were approved on motion by Councilman Coons, seconded by Councilman Chandler. MOTION CARRIED. CONTINUED PUBLIC HEARING~ RECLASSIFICATION NO. 61-62-41: Submitted by Nell Olsen, requesting change of zone from R-l to C-l, property located at the southwest corner of Katella Avenue and Tiara Street (1793 Tiara Street). Public h~aring was continued from the meeting of November 28, 1961, to allow the applicant an opportunity to contact neighbors and show revised plans of development. The Mayor asked if anyone wished to address the Council. Mrs. Nell Olsen, applIcant, addressed the Council advising that she and MrG Tom, Architect, had contacted the neighbors presenting plans and explaining the proposed developmentG In her opinion, she felt they did not necessarily object to the offices, but did object to other commercial busi- nesses and any change in the buildingo Those contacted were: Mr. Carlson, 1787 So. Tiara Street9 Mrs. Olson, 1792 So. Tiara Street, Mr. Bray, 1786 South Tiara Street. Mr. Freeman Olson, 1792 Tiara Street, presented petition of opposition to the granting of the reclassification, containing signatures of five residents on Tiara Street. Mr. Carlson, owner of property adjacent to subject property, addressed the Council objecting to the requested use of the property and further stating that the proposed location of the building would completely cut from view his front yard~ thereby lowering the value of his property and creating a hardship to himG He preferred the building to be repaired and remain as it is& Mr. Richard Tom, Architect, asked if it would be acceptable to the neighbors if the plan was reversed and parking arranged on Tiara Street side with a six-foot setbacks In his opinion, he felt the proposed office building would be in keeping with the commercial on Katella Avenue, and that the new bllilding, rather than remodeling an existing dwelling, would enhance the are a o. The Mayor asked if anyone else wished to address the Counci19 there being no response9 declared the hearing closed. Council consideration was given to the possibility of reversing the location of the building as suggested by Mr. Tom, and standards of parking requirements were reviewed. Also noted was the existing zoning in the immediate area, RESOLUTION NO. 7409: Councilman Thompson offered Resolution No. 7409 for adoption, authorizing preparation of necessary Ordinance changing the zone 5 requested, subject to the following: Revised plans of development to be presented to and approved by the City Council, showing the building to be located on the west property 1ne. Dedication of sixty feet from the monumented centerline of Katella Avenue (forty feet existing). 3. Preparation of street improvement plans and installation of all improve- ments for Katella Avenue, and portion of Tiara Street, in accordance with approved standard plans on file in the office of the City Engineer. 4. Payment of $2.00 per front foot for street lighting purposes on Katella Avenue and Tiara Street. 5. Any landscaping in the parkway be subject to the approval of the Parkway Maintenance Superintendent. 6~ Time limitation of ninety (90) days for the accomplishment of Items Nos. 2, 3 and 4 G Refer to Resolution Book. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETER- MINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED (61-62-4l - C-l). The Mayor declared Resolution No. 7409 duly passed and adopted. Mr. Tom, Architect, was requested to present revised plans for Council consideration December 12, 1961, 3:00 OIClock P.M. EXTENSION OF TIME - SIGN: Request of Mr. W. C. Higdon,for extension of time to sign located at 227 North Beach Boulevard, was held over from the meeting of November 28, 1961, for further information and to determine which sign the request referred to~ inasmuch as more than one sign was erected on the property. Mr. Davis, Assistant City Manager, reported that there was an error in the address, and the sign in question is located at 315 North Beach Boulevard, and advertising the Rossmore Development. Reference was made to a Council policy wherein no approval is granted for signs advertising subdivision tracts outside the Anaheim City Limits. Mr. William D. Forbes, employee of the lessee, addressed the City Council on behalf of Mr. Higdon~ applicant, stating two reasons for their request: One, that the property is currently zoned commercial, which under the Uniform Building Code allows advertising structures. Two, that the property to the North and South is presently vacant with the exception of advertising signs. Attention was also called to the signs directly south of thIs location advertising Forest Lawn. Discussion was held, at the conclusion of which Councilman Thomp- son moved a one year extension of time to said sign be granted. Councilman Fry seconded the motion. To this motion~ Councilmen Coons and Chandler voted "No". MOTION CARRIED. CONDITIONAL U5E PERMIT NO. 152: Correspondence from Mrs. Charles Bush, President of Assistance League of Anaheim, for permission to substitute masonry fence requirement of the City Planning Commission Resolution No. 71 with existing wood fence. Councilman Chandler reported results of an inspection made by him of the wooden fence~ which appeared to him to be in good condition. ~ r 5298 City Hall. Anaheim. California - COUNCIL MINUTES - December 5. 1961. 3:00 P.M. Mrs. Charles Bush reported the wooden fence was constructed as a requirement when the building was built in 1954. Councilman Chandler moved to waive the requirement of a masonry fence until such time as the same is demanded by the City of Anaheim~ Councilman Coons seconded the motion. MOTION CARRIED. RECLASSIFICATION NO. 60-61-86: Request from Ray Mercado for clarification of Condition No. 1 and Condition No~ 5 of Resolution No. 7001 pertaining to Tract No. 4107, was submitted. MrG Leonard Schneider, 4006 Long Ridge Avenue, Sherman Oaks, California, representing Ardmore Development Company and prospective pur- chasers of the property, requested a one-year extension of time to Resolution No. 70013 subject to the presentation and approval of new Tract Maps of this area, as the existing Tentative Map will not be satis- factory for their proposed development of cooperative apartments. Mr. Michael Lotery, 555 Radcliff Avenue, Pacific Palisades, California, stated that their request for one year was for both the reclassificatlon and the filing of a new Tract Map or a series of maps to be from this date, rather than from the June 20, 1961 date, as they wish to develop the property in sectionso RESOLUTION NO. 7410: Discussion was held; at the conclusion thereof, Councilman Chandler offered Resolution Noo 74109 amending Resolution No. 70013 Condition No.5, by deleting therefrom all reference to Condition NOG 1 (the proposed purchasers were informed that requirement number 3B would be expected to be complied with within the original time limit). Refer to Resolution Book. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING RESOLUTION NO. 7001 IN RECLASSIFICATION PROCEEDINGS 60-61-86. SIDEWALK WAIVER: Request of James Emmi for waiver of sidewalk requirements on the west side of Raymond Avenue between the Bryan Industrial development and the Santa Fe Railroad Spur, was submitted~ On recommendations of the City Engineer, temporary waiver of side- walk requirement was granted on motIon by Councilman Coons, seconded by Councilman Thompsono MOTION CARRIED. REQUEST~ USE OF LA PALMA PARK: Request of Elbert Weist, Assistant District Commissioner, Anaheim Dis-trict Boy Scouts of America, for permission to use La Palma Park, January 5, 6 and 7, 1962, for an overnight camporee, was submitted. Subject to the rules and regulations recommended by the Recreation Superintendent, said request was granted on motion by Councilman FTY~ seconded by CouncIlman Coons. MOTION CARRIED. REQUEST - PARK FACILITIES: Request of "Sons of Norway" Solbakken Lodge 6-64 (Sterling S. Osmundson, President), for permission to have park facilities for a picnic June 109 1962, to be held in conjunction with their Biennial onvention, was s0bmitted. Mr. Robert Davis reported that the La Palma Park facilIties, WhlCh according to Mr. Osmundson, would meet their needs, s available on this date. Permission to use La Palma Park facilities June 10, 1962, subject to scheduling by the Park and Recreation Department was granted the "Sons of Norway" Solbakken Lodge 6-64 on motion by Councilman Thompson, seconded by Councilman Fry. MOTION CARRIED. APPOINTMENT. CITIZENS~ CIVIL DEFENSE COMMITTEE: On the recommendations of Charles E. Griffith, Civil Defense Coordinator, Joseph W. Verho1tz was appointed member at large of Citizens v Civil Defense Committee on motion by Councilman Coonsj seconded by Councilman Fry. MOTION CARRIED. ORANGE COUNTY AND CITIES CIVIL DEFENSE PLANNING BOARD; Resolution No. 61-1207 establishing Orange County and Cities Civil Defense Planning Board was submitted and ordered received and filed on motion by Councilman Coons, seconded by Councilman Fry. MOTION CARRIED. CORRESPONDENCE. MAGNOLIA SCHOOL DISTRICT: Correspondence dated November 27, 1961, regarding availability of school resources for fall-out shelter construction program was submitted and ordered received and filed on motion by Councilman frY9 seconded by Councilman Coons. PURCHASE - CHASSIS-WINDSHIELD ONLY: Mr. Robert Davis reported on the following informal bids received for the purchase of a Chassis-Windshield only, and recommended the acceptance of the McCoy Motor Company bid, as the modification necessary to the International Harvester to attach the body would more than exceed the dIfference between the two bids~ McCoy Motor Company International Harvester $ 3,132a2l $ 3,035050 Councilman Thompson moved the purchase be made from McCoy Motor Company ($3,132.21), the lowest and best bid for the City of Anaheim, and in accordance with the recommendations of the Assistant City Manager. PURCHASE - ARIEL PLATFORM CAB AND BODY: Mr. Robert Davis reported on the follow- ing informal bids received for the purchase of one Aerial Platform cab and body~ and recommended the acceptance of the low bid. Standard Auto Body Metalco Auto Body $ l4,420.89 $ 14,622.03 On the recommendations of the Assistant City Manager, the purchase was authorized from Standard Auto Body ($14~420.89) on motion by Councilman Coons, seconded by Councilman Thompson. CITY PLANNING COMMISSION RESOLUTION NO. 147_ SERIES 1961-62: City Planning Commission Resolutlon NOa 147, Series 1961-62, recommending an amendment to the Anaheim Municipal Code by the addition of Section 18.68.060, pertaining to conditions and regulations, was submitted, and the City Attorney was requested to prepare necessary Ordinance in accordance with said recommenda- tions on motion by Councilman Fry, seconded by Councilman Chandler. CITY PLANNING COMMISSION PRECISE PLAN STUDY 29-94-2: Mr. Martin Kreidt reported on stl1dy made by ttAe Ci vi Planning Commi55ion of the area located at the northeast corner of East and South Streets, presenting area maps indicating present zonIng and further explalnlng Precise Plan Studies Nos. 1, 2 and 3. DiScussIon was held by the City Council, at the conclusion thereof it was determined that the planned unit development (Study No.2) on all or any portIon thereof be the optimum development of the area. MOCK: Claim originally denied by the City Council September 19, 1961, and referred to the City Attorney, and reopened October 10, 1961, in accordance with new State law for the pur- pose of finding said claim insufficient, was submitted. Mr. Joseph Geisler, Assistant City Attorney, reported that there has been no further claim or amendment to the claim filed since a letter was written by our office dated October 20, 1961, specifying the areas in which the claim was insufficient, and for a failure to file any additional claim, recommended denial of claim as previously filed. On motion by Councilman Chandler, seconded by Councilman Coons, claim of Mrs. Walter G. Mock previously filed was denied and referred to the City Attorney and insurance carrier. MOTION CARRIED. JOSHUA WI--IITE: Mayor Schutte asked Mr. White the nature of his presentation, and stated that according to his letter the subject of inequities in housing for persons of various ethnic backgrounds was a subject over which the CIty Council had no authority. Mr. White replied that his prepared presentation was on human relations and thereupon submitted to each member of the Council a copy of the prepared statement. Councilman Coons requested it be specifically understood that the statements presented ~re presented to them as individuals and not as Councilmen. Mr. Joseph Geisler, Assistant City Attorney, stated it was the opinIon of their office that the City Council does not have any jurisdic- tion in this area as it is not a municipal affair; it is an affair which deals with other things than ordinances, rules and regulations for the conductIon of City business. At the conclusion of the discussIon, an invitation was extended by The CouncIlmen for Mr. Joshua White to dISCUSS these problems at a luncheon or dinner with them. At the invltation of Mayor Schutte, Mr. White introduced Mr. DaVId Deshler, Pastor of the West AnaheIm Methodist Church, and Mr. Bill Hazen~ Pastor of the FIrst Presbyterian Church. Pastor Deshler stated he felt the matter to be presented by Mr. White, the problem of housing in Anaheim, indirectly affects property values and the things that the City Council are concerned with now and wIll be in the future. COUNCIL REQUEST TO CITY PLANNING COMMISSION - ZONE INITIATION AND STUDY: On motion by Councilman Chandler, seconded by Councilman Coons, the City Planning Commission was directed to initiate an action for M-l Zoning of the land in the northeast area, east of Placentia Avenue and north of the Riverside Freeway, and in conjunction with the initiation of the rezoning, to initiate a Study concerning exactly what land in that area should be rezoned, and what, under th~ M-l classification, should be rezoned. Also requesting a Study be made of County territory in the same area in view to making a recommendation to the County concerning the disposition of County territory. MOTION CARRIED. STATE EMPLOYEES RETIREMENT SYSTEM - SURVIVORS BENEFITS: In accordance with Council request for additional information, Roy Heissner, Assistant Per- sonnel Director, reported that the approximate cost to the City for the addition of Social Security benefits to the present retirement system, based on 3~8 per cent rate, would be $126,790~OO per year, and would exclude Police and Fire personnel, as compared to approximately $50,000.00 per year for addltion of the 1957-1959 Survivor Benefits. He further reported that basically the benefits are the same, and in his opinion approximately 85 per cent of the City employees would elect to take this coverage. Discussion was held regarding this program. At the conclusion thereof, Councilman Coons moved that the recommendations of the Personnel Department be accepted, and that the City Attorney be authorized to prepare necessary Resolu~ion of Intention to approve an amendment to the contract between the Board of Administration of the State Employees Retirement System and the City Council, by the adoption of the 1957 and 1959 Survivor Benefit program, thereby making available to the City employees if they so elect to accept It~ Councilman Thompson seconded the motion.
