Mayor Sohutte called the meeting to order.
MINUTES: Minutes of the Anaheim City Council meeting held December 12, 1961,
were approved on motion by Councilman Coons, seconded by Councilman
Chandler. MOTION CARRIED.
PUBLIC HEARING.. HOUSE ~OVING PERMIT: Submitted by Mr. Chet Kuebler, requesting
permission to move a dwelling from Buena Park to 323 South East Street,
Anaheim.
The MaYQr asked if anyone wished to address the Council, there
being no response, declared the hearing closed.
RESOLUTION NO. 74~2: The application file and Variance No. 1410 were
reviewed by the City Council, and Councilman Coons offered Resolution No.
7452 for passage and adoption, granting said House Moving Permit as
requested.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING A HOUSE
MOVING PERMIT TO MR. CHET KUEBLER TO MOVE A DWELLING FROM BUENA PARK, CALI-
FORNIA, TO 323 SOUTH EAST STREET, ANAHEIM, CALIFORNIA.
On roll call, the foregoing resolution was duly passed and adopted

DINNER DANCING PLACE P~RMIT: Application for Dinner Dancing Place Permit filed
by William T. Samways, for the Jolly Roger Restaurant, 620 West Katella
Avenue, was submitted. Councilman Fry moved said Dinner Dancing Place
Permit be granted, subject to the recommendations of the Chief of Police.
Councilman Thompson seconded the motion. MOTION CARRIED.
ENTERTAINMENT PERMIT: Application filed by Robert E. and Frances M. Cook for
Entertainment Permit at Military Inn, 3148t West Lincoln Avenue, was sub-
mitted. Councilman Chandler moved said Entertainment Permit be granted,
subject to the recommendations of the Chief of Police. Councilman Coons
seconded the motion. MOTION CARRIED.
COUNTY OF ORANGE - OFFICE TRAILERS: Request of Mr. Courtney R. Chandler, Orange
County Purchasing Agent, for a one-year extension to the permits previously
granted allowing the placement of two office trailers on the parking lot at
the Anaheim-Fullerton Municipal Court, 1170 North Los Angeles Street, was
submitted, and granted as requested, on motion by Councilman Chandler,
seconded by Councilman Thompson. MOTION CARRIED.
SIDEWALK WAIVER~ 1941 ~AST CENTER STREET: Request of Glenn O'Neal for waiver
of sidewalk requirements as requirement of Conditional Use Permit No. 167,
inasmuch as there are presently no sidewalks adjoining subject property,
was submitted.

On the recommendations of the City Engineer, Councilman Chandler
moved that temporary waiver of sidewalk requirements at 1941 East Center
Street be granted, subject to the posting of a bond guaranteeing the con-
struction thereof upon demand by the City. Councilman Coons seconded the
motion~ MOTION CARRIED.
SIDEWALK WAIVER~ 1421 NORTH CYPRESS STREET; Request of Allied Equipment Distri-
butors, Ralph W. Cook, Owner, for waiver of sidewalk construction at 1421
North Cypress Street, being an industrial area and adjacent to the westbound
on-ramp of the Riverside Freeway, was submitted.

On the recommendation of the City Engineer, Councilman Chandler
moved that temporary waiver of sidewalk requirements at 1421 North Cypress
Street be granted. Councilman Coons seconded the motion. MOTION CARRIED.
CONDITIONAL USE PERMIT NO. 154: Request of Haldon R. Harrison, Attorney repre-
senting Wrather Hotels, Inc., for interpretation and/or waivers with
respect to certain conditions set forth in Conditional Use Permit No. 154,
together with proposed exterior elevation plans, was submitted (copies of
said communication having been furnished each Councilman).
Plans submitted were reviewed by the City Council and the City
Manager, and discussion was held regarding the request for waiver of the
height limitation, with respect to the exterior elevator shaft.
On the recommendation of Assistant City Attorney, the Council
requested that Mr. Harrison be notified that any requests for deviation
from the height limitation as established by Conditional Use Permit No.
154~ would require the filing of a complete new action to be considered
by the City Planning Commission and the City Council.
Consideration was given to the request for waiver of the sidewalk
and street lighting requjrements, and Councilman Coons moved that action on
these matters be continued for one week (December 26, 1961) to allow for
inspectIon of the area and for a report pertaining to right-of-way from the
Engineering Department. Councilman Chandler seconded the motion. MOTION
CARRIED.
VARIANCE NO. 1221: Request of Welton Becket and Associates on behalf of Broad-
way Stores, for extension of tIme to Variance No. 122l, was submitted, and
on the recommendation of the City Engineer, ninety days extension from
January ll, 1962 was granted on motion by Councilman Coons, seconded by
Councilman Thompson. To this motion, Councilman Schutte voted uNo".
MOTION CARRIED.
RECLASSIFICATION NO. 59-60-102: Request of Mr. S. C. DeWeese for approval of
revised plans of proposed development for 112l and 1125 Swan Street, was
submitted.
Mr. DeWeese came forward to the Council Table and plans were
reviewed by the City Council.
Discussion was held and it was noted that plans indicated access
to Swan Street, for which abandonment has been contemplated.
Mr. DeWeese advised that the building could be relocated so as to
have ingress and egress from Homer Street.
At the conclusion of the dIScussion, said matter was referred to
the City Manager for further investigation, recommendations and report.
RECLASSIFICATION NO. 56-57-75: Request submitted by E. L. Child, Architect, for
approval of revised plans of development proposed for the southeast corner of
Mohican and La Palma Avenues were reviewed by the City Council and compared
to revised plans approved June 28, 1960.
On motion by Councilman Coons, seconded by Councilman Fry, said
revised plans were approved and signed this date by Councilman Coons.
MOTION CARRIED.

CONDITIONAL USE PERMIT roo 170: Submitted by Craig Jewett Company, requesting
permission to establish a drive-in restaurant on property located at the
southwesterly corner of Ball Road and Knott Avenue (3500 Ball Road). The
City Planning Commission pursuant to Resolution No. l48, Series 1961-62,
granted said Conditional Use Permit subject to conditions.
Said matter was held over from the meeting of December 12, 1961,
for further investigation, and no further action was taken by the City

VARIANCE NO. 1421: Submitted by Sylba B. Marks, requesting permission to con-
vert guest house to living quarters, property located at 2612 West Lincoln
Avenue.
The City Planning Commission pursuant to Resolution No. 152,
Series 1961-62, granted said Variance, subject to conditions.
Said matter was held over from the meeting of December 12, 1961,
for further investigation, and no further action was taken by the City
Council.
VARIANCE NO. 1424: Request of Salvatore D'Antonoli for possible waiver of
street improvements on Winston Road, as required pursuant to Variance No.
1424, was verbally withdrawn by Mr. D'Antonoli. No further action was
taken by the City Council.
INTERIM BUSINESS LICENSE - ABBEY RENTS, 1651 WEST LINCOLN AVENUE (RECLASSIFI-
CATION NO. 60-6l-105): Ninety day Interim Business License was granted to
Abbey Rents, 1651 West Lincoln Avenue, from November 14, 1961, subject to
review by the City Council in thirty days.
Mr. Murdoch reported that the property owners of the two remain-
ing parcels of property who have not yet complied with the requirements of
60-61-105~ have advised that the necessary bonds will be posted with the
City of Anahelm this week.
No further action was taken by the City Council.
REQUEST: Request of Mr. Phillip McGraw for further consideration of Ordinance
No. l589 pertaining to commercial establishments in the M-l Zone, was
submitted (copies of said letter furnished each Councilman).
Councilman Chandler moved said communication be received and
filed, as the Council is already considering this Interim Ordinance
through the City Attorney~s office in the consideration of the new
Comprehensive Zoning Ordinance. Councilman Thompson seconded the motion.
MOTION CARRIED.
ORDINANCE NO. 1664: Councilman Fry offered Ordinance No. 1664 for first reading.
AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING TITLE 18 OF THE ANAHEIM
MUNICIPAL CODE RELATING TO ZONING. (59-60-l7 - M-l and P-L)
After hearing read in full the title of Ordinance No. 1664, and
having knowledge of the contents therein, Councilman Coons moved the read-
ing in full of said Ordinance be waived. Councilman Fry seconded the
motion. MOTION UNANIMOUSLY CARRIED.
CLAIM AGAINST THE CITY: Claim in the amount of $14.04 filed by Mr. R. A. Davis
was submitted. Said claim was denied and ordered referred to the City
AttorneyVs office for proper handling on motion by Councilman Coons,
seconded by Councilman Fry. MOTION CARRIED.
ORANGE COUNTY MOSQUITO ABATEMENT DISTRICT - APPOINTMENT: On motion by Council-
man Chandler, seconded by Councilman Coons, Councilman Joseph R. Thompson
was appointed the City of Anaheimis representative to the Orange County
Mosquito Abatement District for the term ending December 3l, 1963.

CANCELLATION OF COUNTY TAXES: On motion by Councilman Chandler, seconded by
Councilman Coons, the Orange County Board of Supervisors were requested to
cancel taxes on property acquired by the City of Anaheim for public purposes
from Eleanor Rivas pursuant to Resolution No. 7330, as recorded November 27,
1961, in book 5923, page 305, Official Records, Orange County, and Alphonso
F. Herrera and Pauline Torres Herrera, pursuant to Resolution No. 731&, as
recorded November 27, 1961, in book 5923, page 314, Official Records of
Orange County. MOTION CARRIED.
PERALTA HILLS ANNEXATION: The City Clerk reported that upon checking the petition
requesting annexation of the territory designated as the Peralta Hills
Annexation, it was found to be signed by owners representing not less than
one-fourth of the land by area and assessed valuation, as shown on the last
equalized assessment roll of the County of Orange.

CENTRAL LIBRARY PLAN: On motion by Councilman Fry, seconded by Councilman Coons,
fifty per cent completion of the Central Library Plans were approved. MOTION
CARRIED.
STEWART COMMISSARIES CONTRACT: Mr. Murdoch reported on a letter received by him
from Stewart Commissaries pertaining to a request for temporary waiver to
March 31, 1962, of the $300.00 per month rental fee, with further review of
the contract at that time.
Mr. Murdoch stated that there was a delay on the part of the City
in getting the facilities for the food concession in full operation prior to
November 1st, however at our request, the concessionaire operated from the
opening date, and that he and Mr. Piersall recommended the temporary waiver
of the minimum rental be granted until January 31, 1962, with review at that
time to determine if additional time should be allowed.

Councilman Chandler moved said request be granted to January 3l,
1962, not on the basis of changing the terms of the contract, but on the
principle of his conceding to our request outside the contract, the
extension amounts to only reciprocation for value received. Councilman
Coons seconded the motion. MOTION CARRIED.
LA PALMA STADIUM - THIBD ANNUAL SCOUT-O-RAMA: Mr. Murdoch reported on request
received by him ftom the Northern Orange County Council of Boy Scouts for
permission to use La Palma Stadium facilities June 1, 2 and 3, 1962 for
their Third Annual Scout-O-Rama, a~d further reported that the fees
charged last year were $350..00, or ten per cent of the gross receipts per
day and fifteen per cent of concession sales.
Councilman Coons moved that they be granted the use of the park
on the same terms and conditions as previously granted. Councilman Chandler
seconded the motion. MOTION CARRIED.
CITY SUIT AGAINST HOLL~NDAISE FAMILY RESTAURANT: On the recommendation of
Assistant City Attorney Joseph Geisler, the City Attorney was authorized
to enter into a compromise settlement on the matter pertaining to a
suit filed by the City of Anaheim against Hollandaise Family Restaurant
for non-payment of utility bills, on motion by Councilman Chandler,
seconded by Councilman Thompson. MOTION CARRIED.
