At the conclusion of the questioning, the City Attorney explained the
necessary legal procedure that must be taken on an inhabited annexation action,
with referenee to the findings of the City Council, the provisions regulating the
five percent exclusion and the calling of the Special Election.
Councilman Schutte moved that the findings of the City Council be,
that the written protests filed do not constitute fifty percent ($0.%) of the total
assessed valuation of the area proposed to be annexed, according to the last equal-
ized a~sessment roll of the County of Orange, State of California. Councilman
Coons seconded the motion. MOTION CARRIED.
Discussion resumed with reference to the exclusion of property within
the proposed annexationo Councilman Schutte stated he had received a request
for the exclusion of certain property, which property is situated on the outside
boundaries and appears to be thoee parcels numbered 5, 6, 7, 9, 11, 14 and 15. He
was of the opinion that the City Council should consider excluding this area.
Councilman Coons, on checking the Assessor Parcel Map, stated that the
area referred to by Councilman Schutte comprises approximately 27.82 acres, the
entire annexation area comprises approximately 1,06305B acres.
Mr. Gentry addressed the Council and stated that several people have
signed the petition against this annexation, he being one of thQm, and asked-
that his property, Parcel Noo ll, be lert in the proposed annexation, so that
he would be elegible to vote$
Councilman Coons stated, protests have been filed by th~ owners of these
parcels, which are located along the westerly line of the annexation, on 5. Dowling
Avenue, and which parcels of property can be omitted from the annexation without
creating any problems, with reference to access and maintenance. The~eupon,
Councilman Coons moved that Parcel Nos. 5, 6, 7, 9, 14 and 15 as indicated in Book
74, Page 20, be omitted from the proposed annexation, leaving in the annexation
Parcel Noo 11 (Mr. Gentry's), comprising an area of approximately 18.14 acres to
be omittedo Councilman Fry seconded the motion. MOTION CARRIED.
Councilman Coons further s ta ted, with referenc.e to the possibili ty of
further omission, he was unable to find any that could be omitted withoutcreatinQ
a problemo
Mr. Turner advised that, now that the City Council had taken action to
exclude certain territory, it will be necessary to redraft the description of the
boundaries of the territory proposed to be annexed and suggested they continue the
matter of fixing a date for election $0 that an accurate description can be prepared
to be included in the resolution.
Councilman Schutte moved that the matter be held over to the next meeting
(June 18, 1957) $0 that the description of the property can be revised. Councilman
Fry seconded the motion. MOTION CARRIED.
PUBLIC HEARING: RECLASSIFICATION NO. F-56-57-65: (As revised) Reclassification
submitted by Albert Peter, Jr.. et aI, reque-sting C-l zoning on property located
on the east side of Euclid Avenue, north of Gerritos Avenue and south of Chantfcleer

The City Council, pursuant to their Resolution No. 3864, referred this
reclassification back to the City Planning Commission for consideration at this
time of re-zoning additional adjacent property, extending south to Cerrltos Avenue
and 100 feet north of the Peter's property.
The City Planning Comm~ssion, pursuant to their Resolution No. 238,
reconunended said reclassification, subject to the following conditions:
L. The filing of the Standard C-l deed restrictions of the Ci ty of Anaheim.
2" The deeding to the Ci ty of Anaheim of 20 feet along Euclid Avenue for
street widening.
3. The deeding to the City of Anaheim of 10 feet along Cerrito& Avenue
for street widenin,.
4. Engineering requirements.

informal discussion was held with the City Council, regarding the propoaed
reclassificatione
MrG Don Baggott felt that commercial areas on Cerrito5 Avenue

Mro John Kent, Attorney, :r~pre~enting Mr.. Peter~ addx-.essed the Council
advising that this matter was tabled on action of the Council and that the
original application, that of Mro Peter, contained only two parcels, which were
located somewhat north of the corner of'Cerritos and Euclid Avenuna Further!
that the Council indicated that if the entire parcel was consid$red they would
act favorably on the reclasslficationo
Different ways of protecting the homeowners on Cerrltos Avenue were
considered, such as lixniting the access to Euclid Avenue, how~ve:r, in view of
the number of parcels of property involved, it was believed that limiting the
access rights would be unworkableo
There being no further discussion, the Mayor Pro Tem. declared the
hearing closedG
RESOLUTION NO. 3918: Councilman Coons offered Resolution NO. 3918 and moved
for its passage and adoption, authorizing the Ordinance changIng the zone
as requested, subject to the conditions as outlined in City Planning Commission

The City Planning Commission, pursuant to their Resolution No. 226,
recommended said reclassification, subject to the following conditions;

Mro Dickenson requested that the lots all be zoned R-3 or all renaain
Mr.. Cameron was of the opinion that the R-3 use would be the best possible
use for this property, being located adjacent to the Santa Fe Railway Right-of-
Way. However, he did feel that the dwellings should be limited to one story units.
Mro Arnold advised that in the evant th~re was no a.ccess lrom East Strecet,
there would be a right-of-way of entry,by an easement he holds, between the
Cameron and Wlehardt property.. This was originally a 50 i easement, however, .25
feet has been deeded back to Mro Cameron 0

Mro Thomas Gardner, Land Appraiser,addressed the Council and stated
that the property is not going to change its use or purpose as it will still be
used for residential purposes. He referred to the Greenbriar in Garden Grove
and also the fact that this 80unty has 35,000 people beyond the age of 65 years.
Dre Walker addressed the Council and advised that the State Department
of Social Welfare required that these people be protected by a fence and that
their many activi ties will keep them from wandering about the neighb.orhood. He
stated he was advised by the County Office of the need of this type of home and
of the many homes in this County, none had been built specifica11y for this
purpose, resulting, in some cases, of inadequate sanitary facilities or hazardous
fire conditions.
A gentlemen resident of 714 No Geneve Street advised of an experience
they had, living next to a rest home, where there had been two attempted suicides.
Councilman Schutte stated that from his many years experience on the
Board of Trustees of the Lutheran Home, a charitable institution, it was his
opinion that these homes are not to desirable located in residential areas, and
when the Lutheran Horne; was established on their 16 acres, they were out in the
country and that now, they are completely surrounded by homes~

It was pointed out that the matter before the Council was the

SET-BACKS - WINSTON ROAD: Discussion was held between the City Council, Mr.
Raymond Riebel and Mr. Clarence-Bargston, regarding the set-back requirements
along Winston Road.
Mr. Riebel reviewed action previously taken regarding this area, with
reference to the City Planning Commission's recommended 26 foot set-back, the
original tentative map, as approved, containing a l5 foot set-back and their
request for Vdriance to allow a 5 foot set-back.
