PUBLIC HEARING - VARIANCE NO. 749: Submitted by Clarence H. Bargsten, requesting permission to use Lot No. 28 of Tract No. 3223 for light manufacturing and further requesting the elimination of the required building set-back. Property located near the northeast corner of South Placentia Avenue and Winston Road. Pursuant to Resolution No. 271, the City Planning Commission denied without prejudice Amended Variance Noo 749, pending action by the City Council on Reclassification No. F-56-57-76: Appeal from action taken by the City ~lanning Commission was filed by Clarence Bargsten and public hearing ordered held. Mr. Ribal addressed the Council urging the granting of the Variance and referred to similar zoning requirements i.n neighboring cities, and further advised that only one firm in the area objected to their request0 Mrs. Dominguez addressed the Council and stated that the Council has established a set-back for this area and she felt it should it remain and that the uniform set-back requirement will increase the value of the propertyo There being no further discussion, the Mayor declared the hearing closedo RESOLUTION NO. 4002: Councilman Schutte offered Resolution Noo 4002 and moved for its passage and adoption, granting Variance Noo 749 subject to provisions and conditions as established pursuant to Resolution NOa 3977 pertaining to Reclassification No. F-56-57-76. PUBLIC HEARING - TRACT NO. 2903: Public hearing was ordered pursuant to an appeal filed by Action Engineering Company with reference to approval of said tentative tract map and conditioning said approval on the establishment of a wall on the north and west property lineso The City Planning Commission approved Tentative Map of Tract Noo 2903 at their adjourned regular meeting held June 17, 1957, subject to the following condi ti ons: 1. The paYment of $25.00 per lot for the acquisition of Park and Recreation sites. 2. That the location of the present irrigation lines be left as at presently located with no interruption of service to the properties now being served at the west, north and southo 3~ That the subdivider erect a solid 6 foot masonry wall on the south side of Mr. Douglas's property and on the east side of Mro Vandenberg's property with a chain link fence extending northward along the west side of the flood control channel to the railroad trackso 4. Engineering requirementso The Mayor asked if anyone wished to address the Councilo Mr. Vandenberg addressed the Council and advised that he had been informed by the Action Engineering CompanyVs office that they were in the process of revising the general grade of the area and would raise the northwest corner approximately two feet next to his property, to establish a grade into Sumac Lane to drain the area. If this was a fact, he felt a retaining wall should be constructed. He further called attention to the poultry farm at the north of the subdivision and the necessity of a wall there. Mra Phillips of Action Engineering Company addressed the Council and questioned the information obtained regarding the changing of the grade and the two foot fill, and advised their appeal was filed because it was believed that the requirement of the wall was an unreasonable condition and not their responsibility. The cost of constructing a chain link fence was compared to that of constructing a block wall and Mayor Pearson suggested the installation of a block wall adjacent to the poultry ranch and the remainder to be chain link fencing, or if Mr. Vandenberg would rather have a wall adjacent to his property, perhaps arrangements could be made wi.th the developer for joint constructiono '~~~i.""~"_";.o;;;..;.~,,,",,,,,,,O!;~,<~,,," ---q- 2.152 City Hall, Anaheim, California, July 23, 1957 - 7:00 PoMo Mro Vandenberg stated he was willing to compromise on a chain link fence, provided they put up a wall where there will be fillQ City Engineer, George Eo Holyoke9 addressed the Council regarding the fill and advised that his office was informed by the Action Engineering Company that there would be 2t feet of fill and recommended this property be protected by a concrete retaining wall of six inches or more; the concrete wall could act as a footing for the wire fencing. Mre Phillips reiterated his previous statement made that the responsibility of protecting this property lies with the growerso closed. PUBLIC HEARING - HOUSE MOVING: Public hearing was held pursuant to Application filed by Ella and Gesiene Ellinghausen to move dwelling from 10162 Tustin Avenue, Olive, California, to 1425 East Santa Ana Street, Anaheim, California. Notice of said public hearing was duly published in the Anaheim Bulletin July 12, 1957 and written notices mailed to owners of property July 11, 19570 Pictures of the dwelling to be moved and the plot and elevation plans were submitted to the Councilo The Mayor asked if anyone wished to address the Council. Mro George O'Brien, 140l East Santa Ana Street, addressed the Council objecting to the moving in of this dwelling as being detrimental to adjacent property valueso Mro Collins, owner of adjoining lot, felt that with the set-back to conform to others on that street and the remodeling of the house as planned, that the house would be comparable to others in the vicinity and very desirable. MOTION CARRIED. ,AMERICAN LIBRARY OF SACRED RECORDS: Reverend Glen Harron addressed the Council requesting clarification regarding the type of business license required by them. At the request of the City Council, Mr.. Turner, City Attorney, interpr~ted the sections of the Anaheim Municipal Code relating to the licensing of retail businesses, wherein it was necessary to have an established place of business for the retail sale of their products, otherwise, a solicitors license would be requiredo Reverend Harron stated the business was located at 13~ W. Center Street; that merchandise for sale is on display at this location; and, further, the calling on prospective customers was by invitation onlyo The Council indicated no objections to this type of operation provided proper business license is obtainedo CONTINUED PUBLIC HEARING - YELLOW CAB SERVICE OF ANAHEIM: Request for meter rate increase filed by the Yellow Cab Service and City Cab to increase rate from 40~ to 50~ flag drop and first mile was continued from the meeting held July 16, 1957 for further investigationc Rate schedules of neighboring cities were reported upon by Albert Hair, Assistant Administrative Officer& The Mayor asked if anyone wished to address the CouncilB No one present objected to the increase rates as requested and no written protests were received in the office of the City Clerk, thereupon, the Mayor declared the hearing closed& Councilman Coons moved that the request of Yellow Cab Service of Anaheim and City Cab Company to increase rates from 40~ to 50~ flag drop and first mile, be approved, the remainder of the rate schedule to be unchangedo Councilman Schutte seconded the motiono MOTION CARRIED. FINAL MAP - TRACT NO. 3160: Located, north of Broadway, east of South East Street. George E.. The Assistant Administrative Officer informed the Council that the Police Department has contacted a number of those persons signing the petition and that the matter has been taken care ofo IMPROVEMENT OF ALLEYi Communication from Thomas Eo Heffernan was submitted and read, requesting the improvement of the alley lying east of the property on North Los Angeles Street to be occupied by the Snack Shop, between Alberta and Sycamore Streets, and the erection of necessary stop signs for control of anticipated traffic. City Engineer, George Ee Holyoke, stated that the alley was in poor condition, however, proper improvement to accommodate heavy traffic will involve quite an expenditure of funds and requested a policy of the Council with reference to the cost thereof to the property owners. The City Council requested the City Engineer to estimate the cost of this improvement. INSURANCE - COOK & BARLETTA: United Pacific Policy No. CLP 98733 (1 year) covering bodily injury and property damage, was ordered received and filed, when approved by the City Attorney, on motion by Councilman Coons, seconded by Councilman Fry. MOTION CARRIED. ANNUAL REPORT - ANAHEIM PUBLIC LIBRARY: Annual report of the Anaheim Public Library was ordered received and filed on motion by Councilman Fry, seconded by Councilman Wisser. DYKE WATER COMPANY .INCIDENT: Mayor Pearson asked the Director of Public Utilities to explain why the city crew was on the job so early in the morning. Director of Public Utilities, George F$ Oelkers, advised that the crew arrived at the job side between 6:15 AoMo and 6:30 AoMo and the main reason being, to take care of the disconnect of service for a 15 or 20 minute period at a time which would cause the least inconvenience to the residents in the area; this being a normal practice of the departmeoto Councilman Schutte moved the Council commend the action of the Water Department in making this installation at that time, being the time most convenient to the users of the water~ Councilman Coons seconded the motion..
