PUBLIC HEARING VARIANCE NOS. 765, 766, 767 AND 768: Submitted by Bonded Homes,
Inc., requesting permission to erect temporary directional signs advertising the
sale of houses and lots within Tract No. 3099 (41 lots). Signs to be located
as follows:
VARIANCE NO. 765 Northeast corner of Lincoln Avenue and Highway 39.
VARIANCE NO. 766 North side of Lincoln Avenue, 520 feet east of
Magnolia Avenue.
VARIANCE NO. 767 North side of Lincoln Avenue, 664 feet west of Dale
Avenue.

The City Planning Commission, pursuant to their Resolution No. 261,
granted said Variances, subject to the nine conditions imposed by the City Council

Mr. Smith of the Kunz Sign Company, addressed the Council and proposed
locations of the signs were discussed.
No one present objected to the granting of the Variances, and no written
protests were received in the office of the City Clerk, thereupon, the Mayor de—

RESOLUTION NO. 4012: Councilman Coons offered Resolution No. 4012 and moved for
its passage and adoption, approving the granting of Variance Nos. 765, 766 and 768,
reducing the sign requested in Variance No. 766 to 10' x 12', and denying Variance
No. 767.

Mr° Raymond Spehar, addressed the Council, stating he had no objections
to the granting of the Variance, however, he felt that a uniform set -back line
should be established that would conform to the set -back of the service station
at the corner.
Councilman Schutte moved that the hearing be continued for two weeks
(August 13, 1957) and at that time a hearing also be held on the set -back re-
quirements for this area. Councilman Wisser seconded the motion. MOTION CARRIED.
PUBLIC HEARING RECLASSIFICATION NO F- 7 Submitted by Ross and Alma
Rader and Alta Sandeman (Robert L. Wetzler, Agent), requesting C -3 zoning on
property described as the southwest corner of Magnolia Avenue and Broadway.
The City Planning Commission, pursuant to their Resolution No. 269,
recommended said Reclassification, subject to the following:
1. The filing of deed restrictions limiting the C -3 use to a service
station only.
2. The deeding to the City of Anaheim of 50 feet from the centerline
of Magnolia Avenue for street widening.
3. The deeding to the City of Anaheim of 40 feet from the centerline
of Broadway for street widening.
4. Engineering requirements.

No one present objected to the reclassification, however, the drainage
problem in this area was discussed with reference to the easement granted the
City of Anaheim from the Magnolia School District, and Mr. Holyoke, City Engineer,
advised that this easement was obtained from the School District to take care
of the drainage problem and allow development of this area, however, all
improvements will be at the expense of the developer.
There being no further discussion, the Mayor declared the hearing

George E. Holyoke, City Engineer, reported that the three bids re—
ceived were identical in every manner, however, in analysing the bids and taking
into consideration past services, he recommended the contract be awarded to
Tops Chemical Company.

MIDWOOD MANOR ANNEXATION CANVASS OF ELECTION RETURNS: Mayor Pearson
appointed Councilman Wisser and Councilman Schutte, Inspectors, and Councilman
Fry and Councilman Coons, Judges, for the purpose of canvassing the returns
of votes cast at the Special Election held July 23, 1957, for the annexation
of territory to the City of Anaheim, known and designated as the Midwood Manor
Annexation, and also for the purpose of canvassing the returns of absent voters
ballots.
The Tally List and semi official returns were compared by the
Canvassing Board and found to be reported correctly. The Canvassing Board
then proceeded to canvass the absent voters ballots.
The City Clerk reported that four absentee ballots had been issued;
that the signatures on the application for said absentee ballots were checked
and found to compare with the original affidavits of registration as contained
in the Grand Register of Voters on file in the office of the County Clerk. As
a further check, the Grand Registers containing the original affidavits of
registration were presented to the Canvassing Board, who, in turn, compared and
agreed that the signatures on the original affidavits of registration and those
on the application and identification envelopes, compared. The canvass proceeded
according to law, the names on the identification envelopes audibly announced,
the ballots removed from the identification envelopes and deposited in the ballot
box, the ballots removed one by one and the votes tallied.
Councilman Schutte moved that it be the findings of the Canvassing
Board that a total of 269 votes were cast at the special Midwood Manor Annexatio n
election, 156 in favor, and 113 against. Councilman Wisser seconded the motion.
MOTION CARRIED.

The City Council of the City of Anaheim hereby makes a record of canvass
of returns of special annexation election.
Said special annexation election was held on the 23rd day of July, 1957,
in the manner provided by law.
That for said election, said City Council duly established two voting
precincts which were designated as the Midwood Manor Annexation Voting Precinct
No. 1 and the Midwood Manor Annexation Voting Precinct No. 2.
That the polling place for the Midwood Manor Annexation Voting Precinct
No. 1. was established and maintained at O. M. Halvorsen's Real Estate Office,

ORDINANCE NO. 1164: Councilman Coons offered Ordinance No. 1164 for first reading
and moved for its passage and adoption.
AN ORDINANCE OF THE CITY OF ANAHEIM APPROVING THE ANNEXATION TO SAID CITY OF ANAHEIM
OF CERTAIN INHABITED TERRITORY KNOWN AS "MIDWOOD MANOR ANNEXATION
After hearing read in full the title of Ordinance No 1164 and having
knowledge of the contents therein, Councilman Coons moved the reading in full of
said Ordinance be waived. Councilman Wisser seconded the motion. MOTION UNANIMOUSLY
CARRIED.

ELECTION PAYROLL; The City Clerk reported the compensation paid to election
officers and for polling places, by the County of Orange, to be $18,.00, Inspectors,
and $15.00, Judges, and $9.00 rental for polling places, and requested authorization
to pay the same for City of Anaheim elections.
Payroll for the special annexation election was approved by the City
Council and payment in the amounts as paid by the County of Orange was authorized
on motion by Councilman Fry, seconded by Councilman Coons. MOTION CARRIED.
DYKE WATER COMPANY INCIDENT TRACT NO. 3029; A group present at the meeting
addressed the Council regarding the recent water incident between the City of
Anaheim and the Dyke Water Company, and asked what authority the City had to
disconnect the Dyke Water Company system and connect this tract to the City water
system.
They advised that when they purchased their homes from the Tietz
Construction Company, they were informed that service would be by the Dyke Water
Company at a flat rate of $3000 per month, and that this was a recorded fact
in their deeds.
Mr. Turner, City Attorney, advised that when a tract is approved by
the City of Anaheim, according to the Anaheim Municipal Code, it shall be
connected to the City water system. Further, the Anaheim Municipal Code requires
tracts to be connected to the City water system when annexed to the City in
order to provide adequate fire protection. A request was delivered to the City
Water Department to connect the water system to this particular area; the
connection was made, which connection was later broken and the Dyke Water
Company line connected. Regarding this particular incident, all the City of
Anaheim did was to reconnect the water to a distribution system owned by them,
which was originally serving this area
George F. Oelkers, Public Utilities Director, read an excerpt from
the City Planning Commission minutes of April 4, 1956, approving the tentative
map of Tract No. 3029, subject, first, to the furnishing of City water.
Mr. Turner explained the procedure in approving tract maps, and the
City's pbligation to provide fire protection. That the connection to the City
water system is to assure adequate water and water pressure to perform that
duty. He further advised that the City system was connected to this tract before
the houses were sold and that the City was not aware of this disconnection for
approximately 2 months due to our bimonthly billing method.
Mayor Pearson referred to an inspection now being made of the City
of Anaheim by the Fire Underwriters in an effort to secure lower fire insurance
rates for all residents of Anaheim, and as this could affect the entire City,
it was his opinion, in fairness to all residents of Anaheim, this area should
be served by the City„
Albert Hair, Assistant Administrative Officer, explained the City's
metering system, being, that each house pays what they individually use. That
the average commercial and residential area combined pays $2.90 per month,
however, this is not a fact in newly developed areas where new lawns are being
taken care of, or where swimming pools are installed. He estimated billings
in this area would average between $3.50 and $3.75 per month.
Petition dated July 23, 1957 and signed by 30 residents of the area,
protesting the interruption of the Dyke Water Company service, was submitted
and read in full.
Mro Turner, City Attorney, further advised, that these water lines
within the tract are publicly owned property belonging to the City of Anaheim,
and it was unlawful for a private concern to use publicly owned properties for
private gain. That this connection was made without any permit to do so.
Eugene Meng, 743 Orangewood Avenue, addressed the Council and asked
why his home and the others on Orangewood Avenue were being served by the Dyke
Water Company, and how did this effect their fire protection.

It was explained to Mr. Meng that five or six houses were built on
Orangewood Avenue for show purposes prior to this area coming into the City, and
that these homes were connected with the Dyke Water Company system. Further,
these homes were built prior to the installation of the water mains within the
tract and a verbal agreement was made between the City of Anaheim and the Dyke
Water Company to serve them and the Thriftimart project. As for fire protection
the City has fire hydrants on Orangewood for the protection of these homes.
It was again noted that the particular lines under dispute are the lines within
the tract only, which were put in by the City of Anaheim, That both the City of

PETITION LANDSCAPING ANAHEIM -OLIVE SERVICE ROAD: Petition of residents adjacent
Anaheim -Olive service road requesting a strip of land between Anaheim -Olive Road
and the service road be landscaped, was submitted and read.
Albert Hair, Assistant Administrative Officer, advised the Council that
the Public Works Department have planned for this strip of land the planting of
oleanders,
This concluded the discussion.
The City Clerk was requested to write to the first name appearing on the
petition, thanking them for their interest and advising that the matter is being
attended to, and request that they so advise the other signers of the petition.
TRACT NO. 2903& Request dated July 24, 1957 from the Hintz Construction Company,
requesting waiver of water meter charge at this time, was submitted and read.
George E„ Holyoke, City Engineer, advised that the water meter charge
for this tract is $3,180.00 and to grant this request would be a departure from
normal procedures and recommended the waiver be denied and that the subdivider
be requested to file all required fees.
Councilman Coons moved that according to the established procedure,
the request for waiver be denied. Councilman Wisser seconded the motion. MOTION
CARRIED.
FINAL MAP TRACT NO. 2903: City Engineer, George E. Holyoke, recommended approval
of final map, Tract No 2903, subject to certain engineering requirements found on
the map which is presently being worked out, and further subject to the payment in
full of the meter charge as billed.
Final Map, Tract No. 2903 was approved by the City Council, subject to
the recommendations of the City Engineer, on motion by Councilman Fry, seconded by
Councilman Wisser. MOTION CARRIED.
EXTENSION OF TIME TRACT NO. 2571: Request of A. R. McDaniel, Engineer, for six
months extension of time from August 12, 1957, to tentative tract map No. 2571,
was granted by the City Council on motion by Councilman Schutte, seconded by
Councilman Fry. MOTION CARRIED.
FINAL MAP TRACT NO. 3251; Located, at the southwest corner of East Santa Ana
Street and North East Street.
George E. Holyoke, City Engineer, reported that the final map was substantially
the same as the tentative map, that bonds have been filed and all necessary fees paid
and recommended approval of said final map,
Discussion was held regarding set -back requirements for those lots facing
Rose Street and also for the M -1 lot on Santa Ana Street.
Councilman Coons moved that the final map of Tract No. 3251 be approved
subject to engineering requirements and provided that the owner would place a deed
restriction on Lots 19 and 25 of 15 feet for landscaping on Santa Ana Street, and
a minimum of 20 feet buiding set -back for all lots facing Rose Street. Councilman
Wisser seconded the motion, MOTION CARRIED.
CLAIM AGAINST THE CITY: Claim for damages filed on behalf of Jeri. Kidd for injuries
sustained April 9, 1957 in the amount of $2,007„00 was denied by the City Council

WAIVER OF BUILDING CODE REQUIREMENTS: Communication from Harvey Hiers dated July 29,
1957, was submitted and read, requesting waiver of the roofing requirement pursuant
to the 1955 Uniform Building Code to allow the installation of cedar shakes for
roof on the Dinnerhorn Restaurant and Motel, which is to be constructed directly
opposite the employees entrance to Disneyland on South Harbor Boulevard.
Councilman Coons moved that the waiver be granted Mr. Hiers and Mr. Dukes
to deviate from the Building Code to allow construction of the Adventure Inn and
Adventure Motel with shake roofs because of the fact that the plans and engineering
had been completed prior to the adoption of the Uniform 1955 Building Code, and
he had submitted the plans for plan check and further, because the distance between
the buildings i. s in excess to normal fire safety requirements. Councilman Schutte

The City Planning Commission, pursuant to their Resolution No. 11,
Series 195758, granted said Variance, subject to the submission of plans to the
City Council for approval.
Plans of houses constructed in another area which are to be similar
to those plans of this tract were submitted.
Councilman Schutte moved to defer action of the City Council for one
week, August 6, 1957, to allow for further investigation. Councilman Wisser

VARIANCE NO. 788: Submitted by Ivan Wells Sons, requesting permission to
continue a directional sign advertising the sale of houses and lots in Tract
No 2659 (45 lots), sign located on the northeast corner of La Palma Avenue
and the Santa Ana Freeway.
The City Planning Commission, pursuant to their Resolution No 12,
Series 195758, granted said Variance, subject to the nine conditions
established by the City Council for such signs.

VARIANCE NO. 789, 790 AND �9�• Submitted by Bonded Homes, Inca requesting
permission to erect three temporary directional signs advertising the sale
of houses and lots within Tract No. 3099 (41 lots).
The City Planning Commission, pursuant to their Resolution No 13,
Series 195758, granted Variances 789 to 791 inclusive, subject to the nine
conditions established by the City Council for such signs.
The City Council approved the granting of Variance No. 791 and
disapproved the granting of Variance No. 789 and 790.
VARIANCE NO, 792: Submitted by Tietz Construction Company, requesting
permission to erect a temporary directional sign advertising the sale of

VARIANCE NO. 603 Submitted by Helen Porter, for a real estate office on Euclid

extension of one year by the City Planning Commission.

JUDKINS AMBULANCE SERVICE: Mr, Judkins, of the Judkins Ambulance Service, addressed
the Council, thanking the City for extending him the right to answer alternate
police calls and expressing his sincere appreciation.
RECLASSIFICATION NO F- 56- 57-44: Mr. Turner, City Attorney, advised that three
of the property owners, Stanley G. Chase, James A. Allen, Jack L. Kissel, which
are included in Reclassification No. F- 56- 57 -44, did not want to meet the conditions
as established by the Council regarding this reclassification.
Councilman Coons moved that the parcels of property owned by the three
owners be excluded from the proposed reclassification; that the City Engineering
Department be requested to prepare new description, and the City Attorney be
requested to prepare necessary Resolution of exclusion. Councilman Fry seconded
the motion, MOTION CARRIED.
,,PURCHASE OF LAW BOOKS: Mr. Turner reported that he had received from the National
Institution of Municipal Law Officers, a notice of publication relating to Municipal
Law Office, copies of which are available to members at the price of $15.75.
Purchase of said publication was authorized by the Council on motion by
Councilman Fry, seconded by Councilman Coons. MOTION CARRIED.

Councilman Coons moved that said Variance No. 786, as requested by
the Cunningham Development Company, be approved, subject to the approval of
the design and plan by the Architectural Committee prior to securing a building
permit, and further subject to engineering requirements. Councilman Schutte
seconded the motion. MOTION CARRIED.
RECLASSIFICATION NO. F -56- 57-73: Communication from Robert V. Faust, Attorney
for Rhea M. Todd, dated July 31, 1957 was submitted and read, requesting hearing

TEMPORARY WAIVER OF CURBS AND GUTTER REQUIREMENTS: Communication from Robert C.
Stearns, 9924 Dale Avenue, was submitted and read, requesting waiver of curbs
and gutter requirements until such time as the City can establish the grade and
align the streets.
City Engineer, George E. Holyoke, recommended temporary waiver as re—
quested and reported that they were now in the process of developing grades for
the reconstruction of Dale Avenue.
Temporary waiver or deferment of installation of curbs and gutters
was granted until such time as required by the City Engineer, on motion by
Councilman Fry, seconded by Councilman Wisser. MOTION CARRIED.
ORDINANCE N0. 1167: Councilman Wisser offered Ordinance No. 1167 for first
reading and moved for its passage and adoption.
AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING ARTICLE VIII OF THE ANAHEIM MUNICIPAL
CODE BY ADDING A NEW CHAPTER THERETO TO BE NUMBERED "CHAPTER 7 REGULATING
GRADING, EXCAVATION, FILLS AND WATER COURSES.
After hearing read in full the title of Ordinance No. 1167 and having
knowledge of the contents therein, each Councilman being supplied copies of said
Ordinance, Councilman Schutte moved the reading in full of said Ordinance be
waived. Councilman Wisser seconded the motion. MOTION UNANIMOUSLY CARRIED.
VARIANCE NO. 793: Submitted by Robert L. Clark, Authorized Agent, requesting
permission to erect a two story building containing sales and administrative
offices, sales and service training classrooms, auditorium and cafeteria, on
property located, briefly, north of La Palma Avenue, west of Brookhurst Avenue.
The City Planning Commission, pursuant to their Resolution No. 17,
Series 1957 -58, granted said Variance, subject to the erection of the building
in conformity with rendering and plot plans presented and with suitable land
scaping, also with fences as shown on the north and west sides.
Mr. Fred Kling, Attorney representing the Chrysler Corporation,
addressed the Council and presented renderings of the proposed development,
and advised that it was not known at this time whether the building would be
a one or two story structure, as this fact will be determined by their Eastern
Office resulting from bid proposals being received on both one and two story
construction.
No action was taken by the City Council.
RECLASSIFICATION NO. F- 56- 57 -88: Submitted by Heftier Construction Company,
(M. S. Bernard, Agent) requesting R -2 zoning on Lots 26 -46 of Tract No. 2624
and R 3 zoning on Lots 1 to 91 of Tract No. 2242. These tracts are located
south of the proposed freeway, north of Romneya Drive, between Rustic Lane and
Lombard Lane.
Public hearing was ordered held August 27, 1957, 7:00 o'clock P.M.,
on motion by Councilman Coons, seconded by Councilman Wisser. MOTION CARRIED.
CLAIM AGAINST THE CITY: Claim against the City filed by Howard H. Campbell
in the amount of $50.00 for injuries sustained by George H. Campbell (broken
finger) was submitted and read. Said claim was denied by the City Council
and ordered referred to the City Attorney, on motion by Councilman Fry,
seconded by Councilman Coons. MOTION CARRIED.
COMPLETION OF JOB NO. 1089: George E. Holyoke, City Engineer, certified that
the J. P. S. Contracting Company have completed the construction of the sewer
in North Frontage Road, Job No. 1089, in accordance with plans and specifications
and recommended the work be officially accepted,
