submitted and read, requesting that the following provisions be made, should
the rezoning be allowed by the City Council;
10 A suitable street outlet be provided to their tract boundary

2~ All necessary utilities be provided to their tract boundary~
3" That they be reimbursed for the cost of re-engineering their
tract map and improvement plans to join the mentioned street outleto

The Mayor asked if anyone wished to address the Councilo
A gentlemen representing the HeftIer Construction Company addressed
the Council and advised that they had contacted Mro Barnes aDd are willing to
give him property, however, in any event, he would not be landlocked as he has
frontsge on Romneya Drive; that approximately seven acres had been sold for a
school site~ Reference was made to the buffer zone that surrounded the pro-
posed multiple family development" Reference was further made to the proposed
deed restrictions prohibiting the construction of more than four units on one
building lot and limiting said units to 2-storyo Renderings of the proposed
apartment buildings were presented to the City Counci16
A large number of people purporting to be residents in the area were
present at the meeting and objected to the proposed reclassificationo
Mrs. J.. R" Wilson, 1219 Ralston Street, voiced her opposition and
called attention to the traffic problems that would be createdo
Mr~ Blackford, resident on Lombard Street, addressed the Council
in opposi tion and commend'ed the Ci ty Planning Commission on securing services
of a qualified consultant regarding this mattere
In discussing the size of the lots with the possibility of redesigning
these tracts to include lots of a larger size, it was noted that these were
recorded tract maps and that the improvements, such as sewers, had already been
installedo
Unidentified persons addressed the Council, calling attention to the
following:
10 The recent reduction of the speed limit on Romneya Drivee
2u The Eisner report with reference to the size of lots being below
minimum requirements"
30 The large amount of apartment houses now available in the immediate
vi ci ni ty 0
40 The previous times this request had been denied by the City Council.
A gentlemen, resident and purchaser of one of the homes in the
Spadrom Estates, was of ,the opinion that this rezoning would increase the value
of the entire area and increase the business to Anaheim0 Further, he believed
that the majority of the people in the area were not represented by the attendance
at the meeting.
Glenn Boyles, 831 West Romneya Drive, stated that there would be ten
lots of two-story buildings adjacent to his property, looking down into his
back yard, and therefore, objected to the reclassification~
When the subdivider was asked to consider increasing the lot sizes,
he advised that the units they proposed to build will be somewhat smaller
(1,000 sq. fte per unit) however, there would be a maximum of four units to a
lot, which will provide for larger side yards and greater set-backs than re-
quired0 That each unit will be furnished an off-street parking space and there
would be no construction of garages at this time as they intend to put all
available funds into the construction of a better unito

When questioned as to why they did not build single family homes, the
gentlemen advised it was because of the great need at this time for multiple uni~
and that these units would be kept and maintained by them as an investmento
Mro Raymond Ao Barnes, addressed the Council, and outlined on the map
his propertyo He stated he did not feel he should have to purchase the property
in order to get a street that hat already been dedicated$
Mr~ George Easton of the Anaheim Elementary School Board, addressed
the Council stating the Elementary School Board has no objections to the proposed
rezoning, however, it is their policy to take no active part in matters such as
these, and, therefore, did not wish to influence the Council one way or the othero
When Mayor Pearson asked if there was any area for compromise, he was
informed that it was the feeling of the majority of those present that there was
ample R=3 area directly south and there was R=3 tracts on both sides of this
location
There being no further discussion, the Mayor declared the hearing closed~
~SOLUTION NO. 4065: Councilman Coons offered Resolution Noo 4065 and moved for
its passage and adoption, authorizing the preparation of necessary Ordinance
changing the zone as requested, subject to the following conditions:

description as published, which did contain an acturate description of the property
under consideration, however, for clarification purposes there was added a sentence,
"further described asu which contained an erroro It was apparent that none of the
people were misled as this error wasnDt noted until approximately two-thirds through
the hearing, and in his opinion~ the City Council had sufficient grounds on which

questing M=l zoning on property comprising approximately 25 acres described as that
triangular portion east of Placentia Avenue, south of the Houston Freeway and west
of Sunkist Avenue~
First public hearing was held May 21, 1957, at which time the City
Council denied without prejudice said Reclassification9 again considered July 16,
1957, at which time the City Council reiterated action previously taken; and
presented tonight for further considerationo
The Mayor asked if anyone wished to address the CouncilG
Attorney Faust~ representing the Applicant, introduced Mro Swartz,
proposed developer of the propertyo
Mro Swartz addressed the Council, identifying himself as the head of a
small syndicate of local investors, and advised that it was an impossibility to
name a specific plant for this area, as, by experience, he has found that prospective
plant sites cannot be offered to industrial firms until proper zoning has taken
place~ Their intention is to develop this area for major plants by intergradlng
the development into an industrial parko He advised the Council of his past
experience in this field and of their interests in Huntington parkt El Monte,
Puente, and the New Hall Saugus area, the latter being a 600 acre site~ Renderings
of the intended development of the 600 acre site was shown as an indication, on a
larger scale, of what they were endeavoring to accomplish. He further advised
that the original planning map as prepared by the City, indicated this area as a
proposed industrial area, and due to the physical terrain would be an ideal
location for their type of developmentu
A map of the area was presented and Mr~ Swartz outlined the boundary
adjacent to the subdivisionG He stated it was his understanding that Prudential
and Gibraltar Homes had planned a park site for these subdivisions and he was
prepared to grant a 20 foot strip across the rear of the property where it abuts
theirs, free of charge, if they would but accept it and maintain it as a parko
Comments of W~ L@ Rogers, Assistant General Manager of Aero Jet
Corporation, were read, with reference to what industrialists seek in selecting
a community location~
John Kent, Attorney representing Gibraltar Homes, addressed the Council
and contended that there was nothing to be considered, as the situation has re-

since no particular plan or plant has been offered, they reiterated their
previous stand in opposing a general rezoning for industrial purposeso

rezoni ng and referred to the render-"1 ng as presented by Mro ~artz, being located
in an undeve~oped area.
Mr, Swa~tz advised that the rendering was only for the purpose of
showing the quality of the project they intended to build, being, highly
re$trictive, and referred to Orangethorpe Avenue and the modern trend for
industr1al plants
Reference was made to the deed restrictions as previously presented to

Gentlemen, resident of Prudential Homes, referred to increase of
traffic and heavy trucks
Gentlemen, resident at 2203 Sycamore Street, opposed the reclassification
and felt the hearing should be concludedc
Mr Bill Purdy, 7641 Placentia Avenue, addressed the Council, stating
his property was directly across the street from the proposed development and
that six families on that side of the street had no objections to a good factory
going n there, that would be nice looking, quiet, and have a parking area~
John Kent, Attorney, read the letter that was sent to each of the
property owners and reiterated their offer of purchasee
Mr. Charles Frank, owner of property on the north side of Placentia
Avenue facing a portion of th~s property in question, addressed the Council
and asked if the Prudent~a~ Homes intended to build homes on this truck
hi ghway.,
He was advised that the Prudential offer to buy the property was for
the sole purpose of protecting ~he home owners in this area"

Mr~ Fdust, Attorney, referred to a specific industr~ being, the Cannon
Industry, who, on two previous o~caslons wanted this location and referred to the
offer that was previously handled through the T. T. Westgate Firm on which the
option was never exercised, He~tated that this particular property was in escrtiw
and that all were aware of the real estate laws, therefore, this offer to purchase
was unethicalo When Mr. Westgate was contacted, after some difficulty in locating
him, he advised that he would not have made the offer had he known of the exclusive
listing, that he did not know the terms or conditions as outlined in the letter
sent to the property ownerso Mro Faust referred to the 300 foot radius and asked
that it be considered$
Mr. Swartz advised he had a major interest in this area, however, if
the owners of the property would consent to extending the escrow 15 days and
Gibraltar Homes pay him the price he has in the land, including his escrow and
out of pocket costs, he will be willing to step out, however~ if they do not
close escrow at the end of 15 days, he will take his chances on the zoning$
There being no further discussion and with the consent of the City Couqcil
the Mayor declared the hearing closed.

that the Reclassif~oation be denied without prejudice, to be reconsidered by the
Council if and when the applicant can present a specific use that is not detrimental

cast at a special election held August 20, 1957, for the annexation of territury
to the City of Anaheim known and designated as Northeast Annexation Noo 2-A, and
also for the purpose of canvassing the returns of absent voter ballot5~
The tally list was compared to the semi-official returns, as filed by
the election officers, and found to be reported correctly.
The Canvassing Board then proceeded to canvass the absent voter ballots~
The City Clerk reported that five absentee ballots had been issued; that
the signatures on the applications for said absentee ballots were checked and
found to compare with the signatures of the original affidavits of registration
as contained in the Grand Register of Voters on file in the office of the County
Clerk~
As a further check, the Grand Register containing the original affidavits,
was presented to the Canvassing Board, who in turn, compared and agreed that the
signatures on the original affidavits of registration and those on the applications
for absentee ballots and identification envelopes of said ballots, compared 0
The public was invited to observe the canvass and the canvass proceeded
according to lawo
The names on the identification envelopes were audibly announced, the
ballets removed from the identification envelopes, and deposited in the ballot

A PUBLIC IMPROVEMENT, TO WIT: T~ WEST STREET SEWER_IMPROVEMENT, FROM APPROXIMATELY
1200 FEET NORTH OF KATELLA AVENUE TO KAT~LLA AVENUE, JOB NO. 1103, AND APPROVING
THE DESIGNS, PLANS, PROFILES, DRAWINGS AND SPECIFICATIONS FOR THE CONSTRUCTION
THEREOF; AUTHORIZING THE CONSTRUCTION OF SAID PUBLIC IMPROVEMENT IN ACCORDANCE WITH
SAID PLANS, SPECIFICATIONS, ETC.; AND AUTHORIZING AND DIRECTING THE CITY CLERK TO
PUBLISH A NOTICE INVITING SEALED PROPOSALS FOR THE CONSTRUCTION THEREOF. (Bids

CANCELLATION OF COUNTY TAXES; It was moved by Councilman Wisser, seconded by
Councilman Coons, that the Orange County Board of Supervisors be requested to
cancel County taxes on property purchased by the City of Anaheim, pursuant to
Resolution No. 3985 for public purposeso MOTION CARRIED.
~}\NCELL~A IION OF COUNTY TAXES: I t was moved by Counci Iman Wi sser, seconded by
Councilman SChutte, that the Orange County Board of Supervisors be requested to
cancel County Taxes on property purchased by the City of Anaheim, pursuant to

parking limit on West Cypres6 St~eet, east to Lemon Street, was referred to the
Chief of Police for recommendations with reference to the extension of the
present one-hour limit (green zone) or the installation of parking meters in this
location, on motion by Councilman Coons, seconded by Councilman Fry. MOTION
CARRIED.

endorsed by the Anaheim Employees Association, for additional life insurance
coverage, the premium to be fully paid by the City employees, was referred to the

Connie Yo and Raymond Au Masciel for Mascielus Grocery, 1034 Pa~t Street, was
