Communication dated August 28, 1957 from Walter H. Young, Attorney,

Lots 4 to 13, inclusive, was submitted and read, requesting information as to
the status of the contracts and bonds which were entered into with the City to
insure the installation of off~site improvements within Tract No~ 1647, and
the possible effect this action could have on the matter with reference to
relieving the bonding company of their liability~
The Mayor asked if anyone wished to address the Councilo
Mru Nerenbaum, Engineer representing the developer, addressed the
Council and advised, with reference to the bonds, that at the present time
arrangements have been made with the bonding company for the commencement of
con~truction.of the improvements wi.thin the next two weeks, not later than 30
daysj that funds have been posted and they are ready to proceed with these

referred to a letter filed by Mro Paul Sogg, with reference to Tentative Tract

Communication from Mro Paul D0 Sogg, dated August 27, 1957, regarding
Tentative Tract No, 3278, was submitted and read, wherein Mr. Sogg stated that
in the event apor6val of the tentative map should adversely affect the status d
the existing bonds for the improvements in this tract, he agreed to accept the
obligations for the construction of the off-site improvements in Walnut Avenue,
adjacent to this tract, upon the completion of his purchase of the propertyo
Those addressing the Council in opposition to the Reclassification
and calling attention to the added cars in the area and the safety of the
children, were: Mro John Herrmann, 1314 Laster Avenue, and Hector Magnani,

Mro Nerenbaum stated that the property was already zoned R~3 from
Cerritos Avenue south to the Southern California Edison Company power lines
and along Audrey and parallel with Ninth Street, and that this area was pre-
viously approved for a motel use, which was contemplated to accommodate 1500
peoplec This use would accommodate approximately 400 people. In his
opinion, from a good zoning standpoint, this was the best use in fairness to all,
for the property, having a natural buffer zone of the Southern California
Edison Company right-of=wayo
Councilman Pearson advise that when the previous action was taken
regarding the motel use, that definite plans were presented and it was known
to all what exactly was intended for this location~
Councilman Wisser moved that the hearing be continued to October 1,

Mayor Pearson advised the meeting was now open for discussion~
Those addressing the Council in opposition were: Mro Chappell, 618 Gilmar,
and Eidwin Kiehler, 649 Wilde Place, who referred to the excessive traffic created
by thi zoning and the increased danger to their children. He did not feel the
map, as proposed by the City Dlanning Commission, would alleviate the problem.
Mra Robert Wo Quast, 1536 Brande, addressed the Council with reference
to the CityVs overall zonjng plan, and asked if the overall zoning plan establishe-d
light industry at this location, or if this proposed map of the City Planning
Commission was a compromise~
Mr. Pearson stated that ordinarily railroad property is considered suitable
fOT =ndustry, there is light industry on the north and east, and seems reasonable
tha igh industry, of the proper kind, would not be out of placeo
Mro Quast admitted it was true there was light industry north of BroadWay,
however, they wanted industry at least stopped at Broadwayo
With reference to a compromise, the Mayor advised that this was the first
time the map, as prepared by the City Planning Commission, had been presented,
either to the applicant or the City Council.

Mro John Bernbranch, 628 Gilmar Drive, addressed the Council and
advised that this was the fourth tentative study of the area and read from a
copy of Mr& BergerUs application, the reasons for which the request was made.
He also read the statement from the City Planning Commission, with reference
to their reasons for recommending denial of said reclassifications Reference
was made to the protest petition as presented to the City Planning Commission
containing 268 signatures of property owners in the area, who objected to the
extension of streets into their tract and the proposed rezoning. It was his
opinion that there wassuffi.cient industrial property in Anaheim without Con-
sidering this area, and referred to the recent annexations to the City of
Anaheim which were earmarked for M-l zoning~ He stated that approximately
151 people were present at this meeting opposing this zoning and also that the
Union Press Steel Company formerly owned property adjacent this area but did nd
build because they did not feel it was profitablet
Mr~ Berger addressed the Council and stated, that with reference to
the Union Press Steel Company not building there, he agreed that this was not
the proper location for this type of industry as this would require M-2 or
heavy manufacturing zoneG Further, that they were not interested in bringing
in a foundry as they wanted small, clean, smokeless, noiseless industries, such
as electronic plantss He stated that after the City Planning Commission meeting
and the objections of the people in the area were known, that a revised map
was prepared~ Mr. Berger presented the revised map and explained that ~hey
planned to completely isolate this area from the tracts to the south and have
only one ingress and egress which would be from Broadway. Their plan lnd~cated
M-l zoning adjacent the railroad tracks, R-l zoning immediately north crf the
existing R-l tracts, extending westerly R-3, and one row of R-3 on the east
side of Loara Street, extending northerly to Broadway.
Vera Key, 8762 Dahlia Drive, addressed the Council and referred to
the Beckman Industry an~ the disadvantages of having manufacturing near re-
sidents 0

zoned when annexed to the Citys
Mr. R. Wa Mun9all advised that the master plan in this area was never
adopted by the Ci ty Coul!lci 1 as i t was referred back to the Ci ty Plannin-g

Mr. Charlie Merchant, representing the Lincoln Park Civic Association,
addressed the Council advising that their group concurred with the Home Fair
group and are against the proposed rezoninga

Mrs E@ D~ Conden, 622 Gilmar, advised that the majority of the people
in this area worked out of Anaheim and have come to Anaheim to get away from

The problem of drainage was discussed.
Don Butler, 603 Adrea, referred to the number of people present
objecting to the rezoning, the number of people living in the tract, dnd the
number of prospective purchasers in the tract, and compared the number ~f
increased attendance to the Loara School for the past three ~ars.
A lady in the audience from 611 South Loara Street, stated ~he was
opposed to R~3 zoning8
Councilman Coons moved the hearing be closed. Councilman ~~s~er

It was the feeling of the City Council that the matter should be re-
ferred back to the City Planning Commission for study and recommendation with
reference to the zoning of the-entire area from Lincoln Avenue south to Cerritos

Mrsa John McElroy asked how long the study would take, and was advised
that considerable study must be made and would probably take a few months.
Councilman Coons moved that this application for Reclassification be
referred back to the City Dlanning Commission, and that the whole area from Lincoln
Avenue south to Cerritos Avenue, and from the railroad tracks westerly to Euclid
Avenue, be also referred to the City Planning Commission for study and recommendation

presented plans of the proposed development and explained to the City Council, their
operations, and that dry cleaning plants using perchlorethylene do not give out

A gentlemen from the Sherwood Forest Tract addressed the Council
objecting to the Variance, and stated that in his opinion there were no dry
cleaning plants that do not give off odors
There being no further discussion, the Mayor declared the hearing closed.

Petition of opposition received at open meeting, was submitted and

Mr. Ray Rho~ds, representing Mr. Finley, addressed the Council and
presented a plot plan of the proposed development, showing change to the
original plan, by having the entrance from Ball Road rather than Western
Avenue, and that the Western Avenue side of this property will be blocked
off by a concrete blodk wall or hedge. There will be no advertising signs
along Western Avenue. The building originally faced Western Avenue, and the
revised plan has been changed to face the building towards Ball Road. There
will be no body or fender work or painting done, further, this will be for
repair of automobiles only and there will not be more than five cars for re-
pairs on the property at anyone time.
It was noted that this use would normally require C-3 or M-l zoning.
Mr. Donovan, 9861 Western Avenue, addressed the Council, stating that
those interested in commercial ventures in this area did not intend to live
here"
Mr. Don Fuquay advised he had no intentions of moving and further,
he approved the Varianceo

Discussion was held relative to what other uses the property could be
put to, as it was appaTent this particular business was objectionable.
Mr. Rhoads asked how the people felt about a service station going
in there, and it was learned that major oil companies seldom build on a corner
of less than 150 feet square.

Dear Sir:
It is our u~derstanding that on August 27th, the Anaheim City Council
approved our request for a variance to construct a motel on the above mentioned
property with additi00al improvements of living quarters, restaurant, gift shop,
and cocktail bar with the following stipulations:

Each motel unit is to be a minimum of 300 sq. ft.
Building structure is not to exceed two stories in height.
Applicant will, upon acceptance by building department of complete
plans and issuance of a building permit on the motel and other
improvements, dedicate an additional ten feet on the east side of the
property for widening Harbor Boulevard.
Our plans ar1e incomplete because of the limi ted time allowed to close
the escrows on the property, which were all subject to approval of a proper
variance for construction of a motel, with other improvements. As the cost offue
land is $40,000000 per acre, we will have to utilize the ground to its maximum
usage in order to create a sound investmento Because of the excessive cost
paid for the land, any improvement we make will necessarily be an asset to
Disneyland, Harbor Boulevard, and Anaheim.
The following are our thoughts on the above stipulations:
Item (1) Restriction as to the square foot area of each unit is a very un-
expected limitationo Our completed plans will include motel units ranging from
approximately 225 sq~ fto up to approximately 400 sq. ft. This variation is
necessary to allow for price accommodations to suit the means of our expected
tenants, from salesman and worker to bank executive and financier. Restriction
to a minimum of 300 sqo fto per unit would involve too great a handicap for
us from the time of securing mortgage money to the actual building and
operational stageso This restriction, based on inquiries to mortgage sources,
and motel and hotel operators, could very easily delay mortgage committments am
construction, and cause complete failure of an otherwise sound business.
Item (2) During the Planning and Zoning meeting of August 19th, we explained
that our complete plans would include a three story portion with elevator
facilities toward the rear of the propertyo We feel the aforementioned is
necessary to make a more attractive project and to allow more room for parking,
landscaping, gardens, and pool areaa It is our desire to build a motel
really worthy of its l~cation& We cannot do this if you restrict us to the
requirements of an ordinary motelo We have been told by the Planning and Zoning
Commission that the motel zoning allows up to eight stories. It has been some
shock to know you have restricted the project to two stories, which would end
up as "just another moteL."

Item (3) A dedication of ten feet to widen Harbor Boulevard is to our interest
and the good of the areao
Summation of Acceptance
We accept the stipulations limiting each unit to 300 sqo ft. and limiting
the height to two stories with reluctance, as detailed in this letter. Our reason
for acceptance is because of the time element of our escrows and the fact that
we understand the above limitations were imposed because of our lack of detailed
plans We wish to go on record that our complete plans will contain some three
story and units ranging possibly as small as 225 Sq8 ft~ and as large as 400 sq.
ft, Your planning and zoning co~mission would be doing us a favor in denying th~
variance i.f they feel our maxim~ heiqht and square foot plans are not possible
and reasonableo
We accept the stipulation on dedication of ten feet for Harbor Boulevard
as outlined above, and we consider that it will be an asset to the property being
acquired
In closing we wish to thank you and your department for working with us
on the variance with incomplete plans and giving special consideration to us because
of the time element of our escrows It is our understanding that this letter of
acceptance of the stipulations as outlined above is the final requirement for
granting of the variance by the City Council on September 3, 1957. As our escrow
is September 5, 1957, any further delay would void our escrows because the investments
are too great to speculate on what use may be made of the land.

Police reported on reqoest made for the extension of one hour parking limits
on the south side of West Cypress Street, easterly to Lemon Street, and
recommended that the requested extra spaces be provided with the regular
markings of one-hour parking.
Discussion was held, and Councilman Coons moved that the said
request be denied. Councilman Fry seconded the motion.
Councilman Coons amended his motion, granting said request,
subject to the installation of parking meters on the spaces, otherwise there
be no change~to the present arrangement. Councilman Fry seconded the motion.

COTTAGE PET HOSPITAL - 704 East Sycamore Street: Chief of Police reported on
investigation made regarding the petition received August 19, 1957, relative
to the noise from the dogs at the Cottage Pet Hospital. He reported that as
far as the zoning or licensing laws were concerned, there were no violations
regarding the operation of this business at this location, and that further
investigation is to be made by Officer Eggleston to determine if the animals
are housed within the building at night.
