to the Variance, 1) the two-.story structure; (2) set-back requirements; (3) a

A gentlemen addressed the Council on behalf of Mr. Maler and stated that
the o'ans h.ave been submi.tted for consideration and show the set-back which has
been determined on proper investigation by the City Planning Commission. The original
Var5ance was for one-story buildings, and due to the land values along Lincoln
Avenue, i t was considered economically wise to build two-story structurese Further,

VARIANCE NO. 848: Submitted by Francis W. Elliot requesting permission to use
Lot 4 of Tract N00 2481 for parking facilities (1425 Eo Center Street)~
The City Planning Commission, pursuant to their Resolution No. 88,
Series 1957'~58, considered Variance No~ 848, and found that the Applicant
meets the requirements of the Anaheim Municipal Code and that no Variance is
required and recommends to the City Council that the filing fee paid by the
Applicant be refunded~
Communication from residents on Birch Street requesting a public
hearing regarding Variance No. 848 was submitted and read in part.
Mr. Murdoch, City Administrative Officer, explained to the City
Council the history regarding the rezoning of this property; that the most
easterly lot was to be zoned R-33 That the contention here was that the most
easterly lot would have triplexes built upon it, and further, that following
this reported compromise between the applicant and residents in the area, a
Resolution of intention was adopted by the City Council, rezoning to C-l,
three lots, and R-3 on the fourth lot~ At a later date, Ordinance No. 963
was introduced. All of the conditions of the Ordinance had not been met until
just recently, therefor, the zoning has never actually been completed, technically,
he should have applied for a Variance. Now, since all of the conditions have
been met, final reading of Ordinance No. 963 is in order and if a public hearing
~s held at the same time the Ordinance becomes effective, it would serve no
purposec

SALVATION ARMY: A gentlemen from the Salvation Army addressed the Ci ty Council
requesting the City sell or lease to them the City owned property on Chartres
Street (Boy Scout House) as this location would meet their needs better than
the location that is available and being considered by them.
The request was denied by the City Council and the gentlemen in-
formed that many similar requests have also been refused as the lot will be
developed very soon for a much needed parking area.
REQUEST FOR INGRESS AND EGRESS AND REDUCTION OF SETBACK REQUIREMENTS:
Communication dated October 24, 1957, from Harry L. Knisely, Attorney for the
Eo D~ Johnson & Company, was submitted and read, wherein it was requested
that the Eu D. Johnson & Company be granted right of ingress and egress to
property on South East Street between Santa Ana and South Streets, and also
requesting that present requirements of 60 foot setback be reduced to 50 feet$
City Attorney, Preston Turner, sUffiarized the action previously taken
by the City Council in rezoning this property, which was, at that time, under
one ownership and rezoned pursuant to Ordinance No" 878. The condi tions of
rezoning were as follows: That the easterly 60 feet of said parcel be changed
to a P-L zone, provided that not less than the easterly 25 feet thereof be
landscaped and provided that a driveway not less than 16 feet in width be
established between said landscaped area and the balance of said property,
with entrances on South Street and Water Street, and one entrance on East Street;
and provided further, that a fence or other barrier be erected on said driveway
so that it does not become a through driveway from South Street to Water Street~

does not have access from the street because his property is not the lot specified
in the Ordinance for the one entrance from East Street.
