MINUTES: The Minutes of the re~ular meeting held October 22, 1957 and adjourned

PUBLIC HEARING - RECLASSIFICATIqN NO. F-57-58-l2: Submitted by Bob's Super Market
requesting C-3 zoning on the co~ner of the property located at the southeast corner
of Ball Road and Knott Avenue to be used for a service station.
The City Planning Commission, pursuant to their Resolution NO. 84,
Series 1957-58, recommended said reclassification subject to engineering re-
quirements.
The Mayor asked if anyone wished to address the Council.
Mr. K. E. Johnson, Agent for Bob's Super Market, addressed the Council
advising that necessary dedication for street widening has already been made to
the City of Anaheim.
George E. Holyoke, City Engineer, stated there was a drainage problem
in this area, however, it was his belief that it could be worked out.
There being no further discussion, the Mayor declared the hearing closed.
.RESOLUTION NO. 4211: Councilman Schutte offered Resolution No. 4211 and moved for
its passage and adoption authorizing the City Attorney to prepare necessary
Ordinance changing the zone as requested subject to engineering requirements, it
being understood that engineering requirements include street lighting, construction
of curbs, gutters, sidewalks, pavement and drainage structures.

PUBLIC HEARING - RECLASSIFICATION NO. F-57-58-l3: Submitted by F. C. Beckett,
et aI, requesting ~3 zoning on property located on the west side of Lewis
Street, south of Orangewood, running from Orangewood to Simmons Street.
The City Planning Commission, pursuant to Resolution No. 85, Series
1957-58, recommended said reclassification, subject to the deeding to the
City of Anaheim of 32 feet from the centerline of Lewis Street for street
widening.
The Mayor asked if anyone wished to address the Council.
Mr. Kasky, 11591 Spinnaker Street, requested deferment of action on
this application to allow for the residents in the area to get together re-
garding the matter. He advised that he had not been notified and was sure a
great many of the residents were opposed to anything of a two-story nature.
A gentlemen residing at 11601 Spinnaker Street advised that he had
not received notice of the publiC hearing.
A list of those (71) to whom notices were mailed was presented,
which included residents on Spinnaker Street and Mr. R. W. Mungall advised
that all notices sent were by first class mail and that none had been returned.
Mrs. Beckett stated she had received her notice and that the property
was well posted.
Councilman Wisser moved that the hearing be continued to November 26.
1957 as requested. Councilman Schutte seconded the motion. MOTION CARRIED.
PUBLIC HEARING - RECLASSIFICATION NO. F-57-58-l4: Submitted by N. J. Dovalis
and James Gantes, requesting C-l zoning on property described as 2563 and 2555
Ball Road.
The City Planning Commission, pursuant to Resolution No. 86, Series
1957-58, recommended said reclassification subject to the following:
1. The deeding to the City of Anaheim of 50 feet from the centerline
of Ball Road for street widening.
2. The filing of C-l, Standard Deed Restrictions of the City of
Anaheim.
3. The erection of a 6 foot concrete block wall along the north
and east sides.
4. Engineering requirements.
The Mayor asked if anyone wished to address the Council.
Mr. Kenneth Nagel, 9922 Ira Court, addressed the Council, asking if
this reclassification was filed prior to the filing for a Variance.
He was advised that the reclassification had been filed first.
The Mayor asked if any others wished to address the Council and those
interested were invited to the front to see the plans of the proposed development.

changing the zone as requested, subject to the recommendations of the City
Planning Commission with the exception that the deeding to the City of Anaheim
be 57 feet from the centerline of Ball Road for future street widening to meet
the new street standards.

pUBLIC HEARING - RECLASSIFICATIO~ NO. F-57-58-15: Submitted by Clarence A. Carlson,
requesting C-2 zoning on property located on the south side of Orangewood Avenue,
west of Harbor Boulevard.
The City Planning Commission, pursuant to their Resolution No. 87,
Series 1957-58, recommended a C-1 zoning, subject to the following:
1. The deeding to the City of Anaheim of 10 feet along Orangewood Avenue
for street widening.
2. The filing of the standard C-l deed restrictions of the City of Anaheim.
3. Engineering requirements.
The Mayor asked if anyone wished to address the Council, and those
interested came forward and discussion was held.
It was noted that this was a small parcel of property that was omitted
in error from a former application on which rezoning was granted.
City Engineer, George B. Holyoke, recommended the matter be held up
at this time as there was a d~screpancy of 22 feet between the boundary line of
the City of Anaheim and the City of Garden Grove. That due to this fact, a
portion of the subdivision has never been recorded.
Councilman Schutte moved that the hearing be .continued to November 26.

NOTICE AND ORDER TO SHOW CAUSE - NUTWOOD PROPERTIES NO.3. INC.: Notice and order
to Nutwood Properties No.3, Inc. to appear before the City Council this date, to
show cause, if any they have, why permits heretofore issued to them for R-3 con-
struction upon Lot 1 in Tract No. 2537 should not be revoked as it violates
Ordinance No. 1045.
Present were Miss Bette Hewitt, Attorney, representing Nutwood Properties
No.3, Inc., and Mr. Richard Lower, representing Sherwood Forest Civic Association.
Mr. Lower advised the Council that the true owner of the property was
Nutwood Properties No.3, Inc. and not No.4, Inc., and that an agreement has been
reached between the developers and the Sherwood Forest residents. A map was pre-
sented showing the four existing structures on Ball Road and that along Ball Road:
there is to to be two story units. That those on South Juneau Avenue be also
two story apartments, subject to the building of these units so situated that they
will block the view into Sherwood Forest Tract. The lots outlined in red, being
the north side of Juneau Avenue and immediately south of Tract No. 2537, be single
story structures. Further, that Nutwood Properties No.3, Inc. are prepared to
record an amendment to their Declaration of Restrictions which will establish the
limi tations.
Mr. Lower then requested, on behalf of the Sherwood Forest Association,
to withdraw their letter of protest dated October 21, 1957.
Discussion was held regarding the interpretation that could be placed
on subsection 5 of the Declaration of Restrictions!

residential purposes.
2. Mr. Mungall's interpretation, that is, limitation be to only those
buildings erected for commercial purposes.
Miss. Betty Hewitt referred to the Anaheim Municipal Code which pro-
vides that a lower use is allowed; that the people she represents acted in true
belief that they had the right to construct R-3. Since all of the people around
this area are in agreement, it would seem to her that the reasonable solution ~
the problem would be to interpret it that residential uses were prohibited to
any commercial building.
Mr. Turner advised that since the previous meeting, when this matter
was before the Council, he had examined the restrictiQns that were filed by the
property owners and they were the Standard C-l Deed Restrictions of th~Gity,
however, they were not the Standard C-l Deed Restrictions that are now used.
He was of the opinion that the better interpretation would be, that the
restriction of residential use be limited to commercial buildings, otherwise,
there would be a conflict between the deed restrictions and the Anaheim Municipal
Code.
The Council was further advised that there will be a tentative map
filed for this area.
Miss Hewitt advised that they were filing additional restrictions as
to height, etc., in accordance with the Agreement. A signed copy of the
Agreement was then presented to the City.
Mr. Turner stated he had read the Agreement, which was briefed by
Mr. Lower, and the Agreement does provide that the construction will be in the
manner satisfactory to the property owners of the Sherwood Forest Tract and
subject to the provisions of the Anaheim Building Code.
It was moved by Councilman Schutte, seconded by Councilman Wisser,
that the request to have the protest withdrawn be granted upon condition that
the property owners of Sherwood Forest and Nutwood Properties No.3, Inc. have
entered into a satisfactory agreement as to the completion of the buildings
already commenced, and that the condition in the Ordinance be limited to C-l
construction, and that the plans for any other R-2 or R-3 building, not already
commenced, be submitted to the City Council for inspection, and that the property
owners file amended deed restrictions. MOTION CARRIED.
VARIANCE NO. 781: Submitted by Triple "A" Mortgage Company, requesting pennission
to erect a 12 story hotel with 2,000 rooms on property located 660 feet, more
or less, north of Katella Avenue, on the East side of West Street.
On August 20, 1957, the City Council continued said hearing for a
period of 90 days for the purpose of allowing the Triple "A" Mortgage Company
to produce commitments showing adequate financial responsibility for the con-
struction of the proposed hotel, and commitments for the lease or ownership of
the hotel by some recognized or established hotel management association, and
that upon such commitments and showing by the Triple "A" Mortgage Company, on
or before 90 days from August 20th, the Council will, by Resolution, grant said
Variance.
This matter was brought before the Council as the 90 day period will
expire November 18, 1957.
Communication dated November 9, 1957, from the Tt~ple"AIt Mortgage
Company regarding said Variance and notifying the City that the parcel of land
in question had been sold to Disneyland, Inc., therefore the use of the property
will be determined by Disneyland, was submitted and read.
Action by the City Council was deferred to the meeting of November 19,
1957 at wh~ch time the 90 day period will have expired.
,REVISED TENTATIVE MAP - TRACT NO. 3300: Subdivider, Thomas Smith. Tract
located on the south side of West Broadway, 200 feet west of Magnolia Avenue
and contains 30, R-l lots.
Action on tentative map, Tract No. 3300 was withheld from the meeting

that the size of the houses be increased to conform with the minimum standards of

TENTATIVE MAP, TRACT NO. 2317 ANp VARIANCE NO. 862: Variance No. 862, submitted
by Chelsea Park Estates, requesting permission to waive the lot frontage requirement
on Lots 1 to 7, both incluSive, in Tract No. 2317, which Tract is located south cr
Anaheim-Olive Road and east of Placentia Avenue.
The City Planning Commission, pursuant to their Resolution No. 108,
Series 1957-58, granted said Variance for a waiver of lot frontage requirements
of 70 feet on Lots 1 to 7, incluSive of Tract No. 2317.
No action was taken by the City Council on Variance No. 862.
Tentative Map, Tract No. 2317: Located on the north side of East South
Street, approximately 660 feet east of South Placentia Avenue, containing 44, R-l
lots.
The City Planning Commission approved said tentative map subject to the
following conditions:

Plans of the proposed houses were submitted and studied by the City Council.
Councilman Schutte moved that Tentative Map, of Tract No. 2317, be approved

will conform with new street standards. Councilman Wisser seconded the motion.

TENTATIVE MAP. TRACT NO. 3330: Submitted by Leo Freedman, tract located on the
north side of Katella Avenue apprOXimately 724 feet west of Haster Street, containing
4 commercial lots along Katella Avenue and 6 manufacturing lots at the rear.
The City Planning Commission approved said tentative map subject to the
following conditions:
1. The making of Clementine Street an industrial street.
2. That the building $etback line is to be 25 feet from the property line.
3. Engineering requirements.

at the northwest corner of Nutwood Street and Cerritos Avenue and contains

The City Planning Commission disapproved said Tentative Map because
no proof of ownership had been submitted by the tract engineers~
The City Council, on motion by Councilman Fry, seconded by Councilman
Coons, denied t~ntative map, Tract No. 3325, without prejudice in accordance
with the recommendations of the City Planning Commission~ MOTION CARRIED.
TENTATIVE MAP~ TRACT NO. 3278: Subdivider, Subdivision Finance Corporation,
tract located at the southwest corner of Cerritos Avenue and Walnut Street
and contains 66, R-3 lotso
The Engineering Committee made the following changes for consideration;
1. Audrey Drive to be made a 54 foot street with the curb on the
south side two feet off the southerly tract line. This will give a forty foot
driving area and the tract is bounded on the South by the Southern California
Edison Company right-of-way.
2. That Walnut Street be made 45 feet from the centerline.
The City Planning Commission approved said tentative map, subject
to the following conditions:
1. The payment of $25.00 per lot for the acquisition of Park and
Recreation sites.
2. Engineering requirements.
On motion by Councilman Schutte, seconded by Councilman Fry, the
City Council approved said tentative map, Tract No. 3278, subject to the
recommendations of the Engineering Committee and the City Planning Commission
and further subject to the streets coming up to. standard requirements, that
is, Walnut Street to be 45 feet from centerline and Michelle Street run
completely through the tract as a 54 foot street, and that all interior
streets come up to the .89 foot standard requirement. MOTION CARRIED.
.TENTATlVE MAP~ TRACT NO. 3301: Subdivider, C. C. Phillips Company, tract
located at the west of Tract Noo 3278 and contains 35, R-3 lots.
The Engineering Committee suggested the following changes:
1. Audrey Drive to be widened to 54 feet, requiring 29 feet from
the southerly side of Lot 7.
2. The East-West alley north of Audrey Drive to open to the East.
3. That there be a street opening off Audrey Drive south of the
first alley south of Cerritos.
4. That the North-South street now designated as Audrey Drive be
renamed as Hampstead Street&
The City Planning Commission approved said Tentative Map, sUbject
to the following:
1. The payment of $25.00 per lot for the acquisition of Park and
Recreation sites.
2. Engineering requirements.
It was reported that this tract was a resubdivision of a portion
of an area on which a map had been previously filed. That improvements on
the streets have already been started.
On the recommendations of the City Administrative Officer, the City
Council approved said Tent~tive Map, Tract No. 3301, subject to the recommendations
of the Engineering Committee and City Planning Commission, on motion by
Councilman Wisser, seconded by Councilman Fry. MOTION CARRIED.

FINAL MAP. TRACT NO. 3290: Tract located on Katella Avenue and West Street.
George E. Holyoke, City Engineer, reported that the final map was
substantially the same as the tentative map previously apDroved; that all fees
have been paid and agreement ent~red into for the installation of off-site im-
provements, and recommended the acceptance of said tract.
Final map of Tract No. 3290 was approved by the City Council on motion
by Councilman Schutte, seconded by Councilman Fry, subject to engineering re-
quirements. MOTION CARRIED.
TRACT NO. 2903: Communication from Hintz Construction Company, dated November 7,
1957, was submitted and read in full, requesting acceptance of a performance bond
for the protection of the City in the event Variance requested for the waiver of
setback requirements for six lots facing Nutwood Street, be denied.
Mr. Turner, City Attorney, briefed the City Council as to the contents
of the bond and was of the opinion that the City would be fully protected in the
event the City Council allowed the developer to continue construction pending the
outcome of the public hearing with reference to the new Variance application.
Councilman Coons moved that on the recommendations of the City Attorney,
the City Council accept the bond of Hintz Construction Company as issued by the
Pacific Employeeqs Insurance Company, Bond NOe 01-B-60989 in the amount of
$12,000.00, and also that permission be granted for them to continue with the
construction of the houses pending the decision of the public hearing on their
Variance application. Councilman Schutte se~onded the motion. MOTION CARRIED.
VARIANCE NO. 850: Submitted by Louise M. Earll, requesting permission to use
her property at 825 North Palm Street, for an office.
The City Planning Commission, pursuant to their Resolution No. 101,
Series 1957-58, granted Variance No. 850 to rent house at 825 North Palm Street
for professional and business offices, subject to:
1. The removal of existing garage on the rear of the property.
2. The improvement of the rear of the property with a black-topped
parking area.
Mrs. Earll addressed the Council, stating that she wanted to rent the
house for a home occupation and not remove the garage building.
A full explanation of home occupation was given which included the

This being fully understood, Mrs. Earll reques~d that the application
be withdrawn and that a refund of the filing fee be au\h~rized.
Councilman Schutte moved that the request to withdraw Variance No. 850
be granted, due to a misunderstanding, and that the filing fee in the amount of
$25.00 be refunded to Mrs. Earll. Councilman Fry seconded the motion. MOTION
CARRIED.
VARIANCE NO. 856: Submitted by W. F0 OVDonnell, requesting permission to erect
and operate a 29 unit motel on property described as 2145 Harbor Boulevard (west
side of Harbor Boulevard, south of Orangewood)~
The City Planning Commission, pursuant to their Resolution No. 102,
Series 1957-58, granted Variance No. 856 for a 29 unit motel, SUbject to:
1. The erection of the buildings in conformity with the plans submitted.
2. Engiheering requirements.
Plans of the proposed development were presented and discussed and the
City Engineer advised, with reference to engineering requirements, that Harbor
Boulevard calls for a 120 foot street or a 60 foot dedication from the centerline
for future street wideninge

permission to remove existing 10 foot by 25 foot advertising structure and erect

Highway 101 (north side of Highway 101 between Katella Avenue and Orangewood
Street)
The City Planning Commission, pursuant to their Resolution Nos 103,
Series 1957-58, granted Variance Noo 857 to remove existing sign and erect a
10 foot by 40 foot sign in its place~
A gentlemen representing the United Outdoor Advertising Company
addressed the Council and advised that this would be a PQrmanQnt sign, leased
by Disneyland, and used by them as a directional sign only. It would be con-
structed 15 feet from the ground and in that way, thQ area beneath the sign can
be used for parking by the Zero Cold Building~

VARIANCE NO. 859: Submitted by Luskey Brothers and Company, requesting per-
mission to use existing building for offices on property at 608 East Broadway.
The City Planning Commission, pursuant to Resolution No. 105,

to perform for The Calamar Company for the completion of off-si,te improvements
within Tract No. 2117 and Tract No. 2326, on motion by Councilman Schutte,

SCHOOL CROSSING GUARD: As signals are in operation at the intersection of
Crescent and Euclid Avenue, the Chief of Police recommended that the crossing
guards at this intersection be removed after the school principal has worked
out a program where the children are properly instructed and the removal of
the guard can be made in safety.
On the recommendations of the Chief of Police, removal of the
school crossing guard was authorized on motion by Councilman Coons, seconded
by Councilman Wisser. MOTION CARRIED.
SALE OF OBSOLETE EQUIPMENT: Sale of obsolete equipment, noted below, to the
highest bidder was authorized by the City Council on motion by Councilman

The City Council of the City of Anaheim met in Adjourned Regular Session.
PRESENT: COUNCILMEN: Pearson, Coons, Fry, Schutte and Wisser.
ABSENT: COUNCILMEN: None.

CITY ADMINISTRATIVE OFFICER: Keith A. Murdoch, Present.
.CONTINUED PUBLIC HEARING - VARIANCE NO. 827: Submitted by Walter M. Carter, re-
questing permission to construct a 32 unit motel on property located, briefly, on
the south side of Lincoln Avenue, between Magnolia and Dale Avenues.
The City Planning Commission, pursuant to their Resolution No. 59, Series
1957-58, granted said Variance, subject to the following conditions:
1. The location of the buildings to be as shown on plot plan.
2. The preparation of a more complete rendering of the elevation of
the building at the time the City Council considers the Variance.
3. Engineering requirements.
Review of action taken by the City Planning Commission was ordered by the
City Council and public hearing held October 27, 1957 and continued to this date
for the submission of more detailed plans of the proposed motel.
The Mayor asked if anyone wished to address the Council.
Mr. Carter presented detailed plans of the proposed motel, which plans
were reviewed and discussed by the City Council.
No one present objected to the proposed Variance and no written protests
were received in the office of the City Clerk, thereupon, the Mayor declared the
hearing closed.
fiESOLUTION NO. 4219: Councilman Coons offered Resolution No. 4219 and moved for
its passage and adoption, granting Variance No. 827, subject to the recommendations
of the City Planning Commission.
