Discussion was held by the City Council, and it was determined
that until such time a5 the preliminary site plan has been reviewed by all
concerned, subject request shall be removed from the City Council agend~,
to be rescheduled at the request of the applicant.
Later in the meeting, Mr. Tom, Architect, entered the meeting,
and the City Council advised him of their action, which met with his
approval.
PUBLIC HEARING~ PROPOSED VACATION AND ABANDONMENT OF SEWER EASEMENT: Public
hearing was held pursuant to Resolution No. 63R~58, duly published in the
Anaheim Bulletin January 31, 1963 and notices thereof posted in accordance
wi th law.

City Englneer lames P. Maddox advised that the proposed abandon-
ment has cleared all CIty departments and outside agencies. He called
attention to the fact that the sewer line is used to serve property which
is owned entirely by the church, and the most westerly portion of the line
has been redesigned to extend around the basement located in the new church
structure; further, that hi s department rt?commend s approval of said vacation
and abandonment, subject to receipt of a letter of agreement from St. Boni-
face Church relieving the City of maintenance responsibility and holding the
City harmless from any future liability for malfunction or failure to remove
existing sewer from the easement, since this portion of the sewer to be
abandoned is not to be crushed or filled.
The Mayor asked if anyone wished to address the Council, there
being no response, declared the hearing closed.
Discussion was held by the City Council, and at the conclusion
thereof, it was moved by Councilman Dutton, seconded by Councilman Chandler,
that action by the CitY' Council on subject abandonment be deferred one week,
February 19, 1963, pending receipt of necessary agreement from the St.
Boniface Church. MOTION CARRIED.
PUBLIC HEARING. MOVING PERMIT: Application was submitted by Anthony F. Parra,
requesting permission to move a small office building from 908 South Beach
Boulevard to 735 South Beach Boulevard, Anaheim, California.
Application file, together with plans filed just prior to the
meetIng, were reviewed by the City Council, together with recommendations of
the Building Department.
The Mayor asked if anyone wished to address the City Council.
Mr. Anthony F. Parra, applicant, advised that new plans have
been submitted to the City PlannIng Commission with a variance application,
to permit residential use of the existing home located on the same C-l
property as the office building is proposed to be located. He further
advised that the b0ilding had to be moved by February 15, 1963.
The Mayor asked if anyone else wished to address the City Council,
there being no response, declared the hearing closed.
RESOLUTION NO. 63R-I06: Councllman Chandler offered Resolution No. 63R-I06
for adoption, granting moving permit, with the understanding that it be at
the risk of the applicant, and will in no way predetermine the action on the
variance application; further, should application for variance be denied, the
applicant will have no recourse.

Councilman Chandler moved that ninety day temporary use and
occupancy permit for residential quarters at 735 South Beach Boulevard be
granted, pending the hearing on application for variance for residential
use of the property. Councilman Krein seconded the motion. MOTION CARRIED.
PRESENTATION: Mr. Pre$ton Turner, retired City Attorney, presented to the City
Council a framed map of the original spanish ranchos of the County of
Orange.
Mayor Coons thanked Mr. Turner on behalf of the City Council, and
advised that the map will be suitably displayed.
RESOLUTION NO. 63R-107: Councilman Schutte offered Resolution No. 63R-107 for

Councilman Schutte moved said request be granted. Councilman

SIGN REQUEST - l2ll NORTH EUCLID AVENUE: Application was submitted by Martin
Luther Hospital for permission to erect non-conforming sign (2 foot pro-
jection) at l211 North Euclid Avenue, sign to be of a directional nature
for hospital and medical center.

Plans were reviewed by the City Council and report from the
Building Department noted.
Mr. Walter Stephens, of the Met? Company, Agent, addressed the
City Council advising that the projection over the right of way was
requested to conform with other signs on adjacent properties.
Discussion was held by the City Council, and at the conclusion
thereof, Councilman Krein moved said sign application be granted, with the
provision that there be no projectIon over the right of way. Councilman
Schutte seconded the motion. MOTION CARRIED.
CONDITIONAL USE PERMIT NO. 256: Request of Erwin and Ann Paulus for one year
temporary waiver of block wall, requIred under provision5 of Conditional Use
Permit No. 256, was submitted.
Mr. Paulus advised they anticipate leasing the balance of their
property for commercial uses in the near future, and offered to post bond
in lieu of the immedlate wall construction.
On motion by Councilman Dutton, seconded by Councilman Chandler,
one year temporary waiver of block wall construction was granted, subject
to the posting of a bond to the satisfaction of the City Attorney. MOTION
CARRIED.
SIDEWALK WAIVER. 899 SOUTH WEST STREET: Request of H. H. Gaines for waiver of
sidewalk requirement at 899 South West Street, was submitted.
On the recommendations of the CIty Engineer, Councilman Dutton
moved said temporary sIdewalk waiver be granted, subject to the provision
that no permanent planting be placed In the area reserved for future side-
walks. Councilman Krein seconded the motion. MOTION CARRIED.
TRAFFIC SIGNAL. BALL ROAD AND GILBUCK DRIVE: Petition dated January 30, 1963,
from Mrs. Mildred A. Campbell for installation of a traffic control signal
at the intersection of Ball Road and Gilbuck Drive, was submitted together
with petition signed by approximately seventy-three residents of the area.
Mrs. Campbell addressed the City Council and stated the Southern
Pacific Railroad track crosses Ball Road just east of the Gilbuck Street
crosswalk; said track being elevated several feet above street grade,
thereby affording west-bound trafflc very little distance to stop when the
crosswalk is occupied. She advised that children use this crosswalk to
travel back and forth to Ball Junior High School, and the limited visi-
bIlity is reduced further In foggy or rainy weather. Mrs. Campbell submitted
supplements to petition for traffic signal, signed by approximately 347
residents.
Mrs. Virginia McMann addressed the Council calling attention to
the fact that many young people stay after school for various activities,
and some use the crosswalk after dark; that ?40 children use the pedestrian
crosswalk at Gilbuck Street.
She further advised that if the crosswalk was relocated to the
middle of the block fronting the school, it would be safer for the children.
However, this would not alleviate the need for traffic signal, because
traffic on Ball Road does not slow down when approaching the cross\,valk. She
also advised that the Traffic Engineer advised that this intersection is
twenty-first on the list to be signalized.

Mrs. Campbell reported on the traffic count on Ball Road, and
further reported that 75 per cent of the motoring traffic is during the
limited time the school children are u~ing the crosswalk.
Edward Granzow, Traffic Engineer, advised that a recent count was
taken at the intersection of Ball Road and Gilbuck Drive, re~ulting in a
total of 15,480 vehicle~ u~ing the intersection in a twenty-four hour period
on an average week day, and ?40 children used the crosswalk in the morning
and ?58 children used it after school. According to the Radar Survey, the
average speed of vehicles is 34 to 36 miles per hour. Mr. Granzow advised
he originally reccmmended the crosswalk be placed westerly one-half block,
directly in front of the school, thereby allowing vehicles crossing the
crest of the railroad right-of-way an additional ?50 to 300 feet of
visibility to the crosswalk. He further advised that priority for installa-
tion of traffic signals is based on volume of motoring, and pedestrian
traffic, special features, accident history and accident potential.
Mrs. Campbell advised that accidents do occur at Hampstead Street
and Ball Road, and requested consideration be given to both intersections.
Discussion was held by the City Council, and at the conclusion
thereof, written r~ports were requested from the Police Department Traffic
Bureau, and from the Traffic Engineervs office, said reports to include

VARIANCE NO. 1480 - REQ~EST: Request of Miller Investment Company for waiver of

submitted together with plans.
Mr. Carl Templeton, representing the applicant, adv~ed that
the required block wall would be against the ~'all of the adjacent building
and, in his opinion, would serve no practical purpose.
Plans were reviewed and discussion was held by the City Council
and Assistant Planner Marvin Krieger, and it was noted that the wall was
shown on the ArchitectVs plans, and Variance No. 1480 was granted subject
to development in accordance with plans presented.
On motion by Councilman Schutte, seconded by Councilman Dutton,
waiver of concrete walls, as shown in red on plan submitted, was granted.

Councilman Chandler, seconded by Councilman Dutton, that the City Business
License Collector b~ authorized to issue a ninety day temporary business
license to Carl Hatfield, lr., to be issued at the risk of the applicant,
pending finalization of the Conditional Use Permit application filed for
permission to establish an office in the Saga Motor Hotel, 1650 South
Harbor Boulevard, it being understood the granting of said temporary lic~n~e
will in no way predetermine action of the City Planning Commission or City
Council on said Conditional Use Permit application. MOTION CARRIED.
RECLASSIFICATION NO. 61~62-30 - REVISED PLANS: Plans submitted by Mr. W. A.

Engineering Department that all requirements of Reclassification Applica-
tion No. 60-61-25 have been complied with, Councilman Chandler moved the
"Full Paid Investment Certificate No. 12623", in the amount of $5,000.,
deposited in the Anaheim Savings and Loan Association, Anaheim, be
released. Councilman Dutton seconded the motion. MOTION CARRIED.
RESOLUTION NO. 63R-118: On the recommendations of Thornton E. Piersall, Director
of Public Works, that Daniel Estrada Company has completed the construction
of the Ball Road Sewer Improvement, Job No. 1254, in accordance with plans
and specifications, Councilman Dutton offered Resolution No. 63R-118 for
adoption.

Public hearing was held lanuary Q2, 1963 and continued to this
date in accordance with the verbal request of Mr. Wilsey, representing the
authorized agent, to allow additional time for revision of plans for the
planned unit development in conformance with the City Building Code.
The City Clerk reported that Mr. Wilsey, authorized agent,
advised by telephone that the project has been abandoned, and that he
would officially so notify by letter; however as of this date said letter
has not been received in her office.
The Mayor asked if Mr. Wilsey or the applicant was present. There
was no response.
It was moved by Councilman Krein, seconded by Councilman Schutte,
that public hearing on Reclassification No. 6~-63-50 and Condition~l Use
Permit No. 330 be continued to February 26, 1963, 7:00 P.M., to allow
additional time for the receipt of letter concerning termination of pro-
ceedings. MOTION CARRIED.
PUBLIC HEARING. RECLASSfFICATION NO. 62-63-46 AND CONDITIONAL USE PERMIT NO. 324:
RECLASSIFICATION Nq. 62-63-46: Submitted by Robert S. and Anne T. Unger,
requesting a chang& of zone from R-A to R-3 on property located on the south
side of Romneya Drive, the easterly boundary being approximately 460 feet
west of the centerline of State College Boulevard, and further described as
1826 and 1830 East Romneya Drive.
The City Planning Commission pursuant to their Resolution No. 590,
Series 1962-63, recommended said reclassification, subject to the following
conditions:
1. Dedication of thirty-two (32) feet from the monumented centerline of
Romneya Drive (20 feet existing).
2. Preparation of street improvement plans and installation of all
improvements for Romneya Drive, subject to the approval of the City
Engineer and in accordance with the adopted standard plans on file in

8. Provision of a three (3) foot public utility easement and a two (2)
foot overhang easement along the easterly boundary of subject property to
adequately serve the subject property and other properties, at the time
of the installation of service facilities.
9. Subject to the approval of Conditional Use Permit No. 324.
10. Time limitation of 180 days for the accomplishment of Item Nos. 1, 2, 3
and 8.
11. Development substantially in accordance with Exhibit Nos. 1 and 2.
12. Provision that the interior walls of the proposed carports shall be

The City Planning Commission pursuant to their Resolution No. 591,
Series 1962-63, granted said conditional use permit, subject to the approval
of Reclassification No. 62-6~-46.
Mr. Martin Kreidt noted the location of subject property, the
proposed high school site, and existing uses and zoning in the immediate
area, and briefed the parkin~ study report requested by the City Planning
Commission from the City Traffic Engineer regarding time limit parking on
Romneya Drive.

Plans and the files were reviewed by the City Council, and the
Mayor asked if the applicant or his agent wished to address the Council.
Mr. Harry Knisely, Attorney representing the applicant, referred to
the previous request for zoning and a planned unit development on subject
property, and felt at that time the problems involved had to do with the
development of the adjacent long, narrow lot; however, he understands that
these matters have been worked out satisfactorily.
Mr. Kreidt further advised that plans submitted are identical to
those filed with the applicantis previous request for R-3 Zoning, Reclassi-
fication No. 61-62-100; that a meeting was held with the adjoining property
owner and they have indicated that they will make every effort to work
together for a joint development.
The Mayor asked if anyone else wished to address the City Council.
Mr. Fred Stephenson, 1713 East Romneya Drive, addressed the
Council in opposition, being of the opinion that consideration should be
given to the continued projection of the existing single family homes to
the North and South of subject property, instead of only considering the
existing R-3 developments to the East and West. He advised of the heavy
traffic congestion during peak hours in this area, and felt additional
apartments would only add to their problem; that there was no need for
further apartments, as many of the existing multiple units were now vacant.
Mr. Richard Knox, 1813 East Romneya Drive, addressed the Council
in opposition, stating his primary concern was the increase in traffic
resulting from the proposed apartments, as Romneya Drive is the main access
to their area.
The Mayor asked if anyone else wished to address the Council,
there being no respons~ declared the hearing closed on Reclassification No.
62-63-46 and Conditional Use Permit No. 324.

PUBLIC HEARING, RECLASS~FICATION NO. 62-63-53: Submitted by J. Harold Smith and
Marion Smith, requ~sting a change of zone from R-A to C-I, on property
located on the north side of Ball Road, approximately 858 feet west of the
centerline of Western Avenue, and further described as 3311 West Ball Road.
The City Planning Commission, pursuant to their Resolution No. 595,
Series 1962-63, recommended said reclassification be denied.
Mr. Martin Kreidt noted the location of subject property and the
zoning and development in the area. He referred to the identical request
of the applicant for C-l Zoning under Reclassification No. 61-62-68, at
which time the City Planning Commission recommended C-l zoning be denied,
but that R-3 zoning be approved; that following report and recommendations
under Planning Study No. 39-6-4, covering both sides of Ball Road between
Knott Avenue and Beach Boulevard, the City Council in March, 1962, denied
both C-l and R-3 zoning on subject property.

The Mayor asked if the applicant wished to address the City
Mr. l. Harold Smith, 3405 West Ball Road, applicant, addressed
the Council, being of the opinion that his application for C-l zoning was
denied by the City Planning Commission, on the basis that the requested
zoning did not conform with the proposed General Plan. He stated that at
the time the community was polled, the property owners indicated they would
prefer C-l to R-3 Zoning. He presented a petition signed by property owners
representing eleven parcels on Ball Road, between Knott and Western Avenues,
favoring his proposed development.
Mr. Smith called attention to the existing commercial at Knott
Avenue and Ball Road, approximately 800 feet from subject property, the
non-conforming commercial nursery use immediately adjacent to his property
on the West, and the proposed 100 bed hospital approximately 300 feet from
subject property, across Ball Road. In his opinion, he did not feel that
his request for commercial zoning to allow a neighborhood shopping center,
including his own electrical contracting business, would be out of line with
existing development in the area, or detrimental to the R-l properties.
Mr. Smith questioned Finding No. 6 of City Planning Commission
Resolution No. 595, wherein it states that one letter was received in
opposition.
Mayor Coons read in full the communication in question from Mr.
and Mrs. Robert A. Brunner, wherein they make request for certain condi-
tions to be placed on subject property, if C-l Zoning is granted.
The Mayor asked if anyone else wished to address the Council,
there being no response, declared the hearing closed.

PUBLIC HEARINGS~ RECLASSIFICATION NO. 62-63-54 AND CONDITIONAL USE PERMIT NO. 342:
RECLASSIFICATION NO. 62-63-54: Submitted by Stanton Nursery, Inc., request-
ing a change of zone from R-A to R-2 on property located on the south side
of Ball Road, the western boundary of said property being approximately
670 feet east of the centerline of Holder Street, and further described as
3730 West Ball Road.
The City Planning Commission pursuant to their Resolution No. 596,
Series 1962-63, recommended said reclassification be denied.
CONDITIONAL USE PERMIT NO. 342: Filed in conjunction with Reclassification
No. 62-63-54, requesting permission to construct a single story, low density
planned unit development.
The City Planning Commission pursuant to their Resolution No.
597, Series 1962-63, denied said Conditional Use Permit.
Mr. Martin Kreidt noted the location of subject property and the
development of the surrounding area, both in Buena Park and Anaheim. He
recalled that i~ September, 1962, under Reclassification No. 61-62-114,
request for R-3 Zoning to permit a planned unit development had been denied
by the City Planning Commission and the City Council, because of the
incompatibile denisty proposed for subject property. That the plans sub-
mitted are identical to those previously presented, except for a slight
reduction in units.
Mr. Kreidt further advised that in their staff studies, it was
felt the proposed plan of development was very good, and it is unfortunate
that the proposed location makes this development incompatible with exist-
ing surround residential with regard to density.
Communication of opposition received February 13, 1963, from Mr.
James Kelley, was read in full by the City Clerk.
Mayor Pro Tem Chandler asked if the applicant or his agent
wished to address the City Council.

Mr. Harry Knisely, Attorney representing the applicant, because
of laryngitis, submitted a written statement concerning the issue, which
was read in full by the City Clerk, advising that the plans submitted have
been further improved by the removal of the four-unit - two-bedroom building
immediately north of the play area, thereby reducing the density and
bringing the recreation area to a figure in excess of 100 square feet per
unit. Mr. Knisely included in his statement statistics comparing occupancy
of apartment units to that of single family residences. In his opinion, the
proposed development is most compatible in regards to density of the Sur-
rounding area, and would enhance both the appearance and land values of the
area.
The Mayor Pro Tem asked if anyone wished to speak in favor of said
application. Ther~ was no response.
The Mayo~ Pro Tern asked if anyone wished to speak in opposition.
Those addressing the Council in opposition were:
Mr. Jame$ Kelley, 1336 Oriole Street, felt that placing a multiple
development in the middle of single family would be spot zoning; that the
greatest asset is their homes, and he was of the opinion that subject prop-
erty should also be developed as R-l.
Mr. Bob Mann, 1215 Fremont, Anaheim, adjoining property owner and
one of the circulators of the petition of opposition previously submitted
containing 206 signatures, requested that the Council uphold the action of
the City Planning Commission and find that said proposed development is in
direct opposition to the General Plan. He advised that the private driveway
surrounding the proposed development would be within twenty-seven feet of
his home, and he objected to the trash pickup and traffic noises that would
be created.
Mrs. Dorothy Ochoa, resident in the area, felt that to grant this
request would be spot zoning, and advised that the entire tract has a
strong feeling of opposition against subject development; that their tract
is a fine residential area with continued improvements, not depreciating
as suggested by the proposed development at the previous hearing. She
asked that once and for all the matter of zoning on this land be settled,
and for the best interests of the community and the entire City, requested
that the Council initiate R-l zoning on subject property. Mrs. Ochoa
presented a petition of opposition representing four adjoining properties
on Blanche Circle, Buena Park.
Mr. Eddie Brock, 1219 Fremont, Anaheim, submitted letter of
protest from Mrs. Brock. He was of the opinion that development under R-2
zone would cause his property to decrease in value, as within five to
fifteen years, the apartments would be run down and not continuously
maintained such as a private home would be. He thought the General Plan
for this area was very good, and that development of subject property as
single-family would be an asset to the City of Anaheim.
In rebuttal, Mr. Knisely stated he felt his written statement
answered the questions raised; that spot zoning usually has to do with
small lots, not five-acre parcels.
Mayor Pro Tem Chandler stated he believed sufficient evidence had
been presented, and thereupon declared the hearing closed. At the request
of Councilman Schutte, Mayor Pro Tern Chandler reopened the hearing.
Those addressing the Council in opposition were:
Mr. lohn McMahon, 10090 Blanche Circle, Buena Park, referred to
a previous communication from the Buena Park City Council expressing
opposition to R-3 development of subject property. He felt that the traffic
noises would increase in volume because of the "echo chamber" created
between the block wall and the garages completely surrounding the develop-
ment.

Mr. John Simpson, 3309 Deerwood Drive, Anaheim, repre~enting
We~tridge Home Owners Association, recalled the past actions on subject
property, this being the third hearing within one hundred and twenty days.
He was of the opinion that even though this request appeared as R-2 on the
applicant's petition, it was actually an R-3 development. He requested
that the Co~ncil initiate action to zone said property R-l.
Mr. David Radcliff, 10070 Blanche Circle, Buena Park, felt
the residents would be transient, not permanent home owners as presently
reside in this area.
Mr. Joseph Kosinski, 10060 Blanche Circle, Buena Park, thanked
the City of Anaheim for sending the residents of Buena Park notices of the
hearing. He concurred with the statements made by Mr. Kelley, and requested
the application be denied.
Mr. Bob Mann, 1215 Fremont, Anaheim, questioned when it comes to
the point of hurting the neighborhood, whether dollars and cents would
over-ride peace of mind, and further stated that they in the neighborhood
have fought against this zoning, as well as money has been expended by the
developers to gain it.
Councilman Dutton answered that anyone has a right to request a
change of zone on their property, as well as anyone has a right to publicly
protest said change of zone.
Mr. James Kelley, 1336 Oriole Street, reminded the City Council
that they were elected by the majority of the people, and it was evident
to him that the majority of the people disapproved the reclassification. In
his opinion, he felt the City Council should vote in accordance with the
majority.
Mayor Pro Tem Chandler asked if anyone had anything new to offer,
there being no response, declared the hearing closed.
RESOLUTIONS: Councilman Dutton offered necessary resolutions granting
Reclassification No. 62-63-54 and Conditional Use Permit No. 342, subject
to the following conditions:
1. Installation of sidewalks and paving on Ball Road in accordance with
the adopted standard plans on file in the Office of the City Engineer.
~. Payment of $2.00 per front foot for street lighting purposes on Ball
Road.
3. Payment of a Park and Recreation Fee of $25.00 per dwelling unit to
be collected as part of the Building Permit.
4. Provision of standard trash storage areas as determined by the Depart-
ment of Public Works, Sanitation Division, prior to Final Building
Inspection.
5. Subject to the approval of Petition for Conditional Use Permit No. 342.
6. Provision of a modified cul-de-sac at the terminus of Berkley Street~
subject to the approval of the City Engineer.
7. Installation of fire hydrants, as determined to be necessary by the
City of Anaheim Fire Department to provide adequate fire protection. \
8. Time limitation of one hundred and eighty (180) days for the accomp~ I r'
lishment of Item Nos. 1, 2 and 6.
9. Development substantially in accordance with Exhibit Nos. 1 through 9.
10. Provision that the interior walls of the proposed carports shall be /
stuccoed, that the encloS8d storage cabinets shall be provided along the
