1963/03/19 h558 City Hall_ Anaheim_ California - COUNCIL MINUTES - March 19. 1963. 3:00 P.M. The City Council of the City of Anaheim met in regular session. PRESENT: ABSENT: PRESENT : COUNCILMEN: Dutton, Chandler, Schutte, Krein and Coons. COUNCILMEN: None. CITY MANAGER: Keith A. Murdoch. CITY ATTORNEY: Joseph Geisler. CITY CLERK: Dene M. Williams. CITY ENGINEER: James p. Maddox. TRAFFIC ENGINEER: Edward Granzow. ZONING COORDINATOR: Martin Kreidt. Mayor Coons called the meeting to order. ANAHEIM ROTARY CLUB - PRESENTAfION: Mr. Lee Luskey, President of the Anaheim Rotary Club, presented to the City a perpetual trophy awarded to them by District 532. He advised that District 532 comprises fifty-three Rotary Clubs in Southern California; that this is the first time since the inception of the Anaheim Rotary Club in 1921 that the club has received such an honor. He further advised that the trophy is awarded in recognition of their work in community service and in recognition of the City of Anaheim for their fine organizations such as Y.M.C.A., Scouting, etc., and the efforts of these organizations making the help of the Rotary Club to them possible. Mr. Luskey stated that the trophy is awarded for a period of one year, and if received by them three consecutive years, it will remain permanently in our custody. Mayor Coons thanked Mr. Luskey and the Rotary Club on behalf of the City of Anaheim, and advised that the trophy will be properly displayed in the trophy case in the lobby of City Hall. MINUTES: Councilman Dutton moved that minutes of the Anaheim City Council meetings held March 5 and 12, 1963, be approved. Councilman Krein seconded the motion. MOTION CARRIED. PUBLIC HEARING - HOUSE MOVING PERMIT: Application was submitted by Charles E. Luksich, requesting permission to move a dwelling from 807 Nebraska Avenue, Placentla, California to 3350 West Thornton Avenue, Anaheim. Application file and plot plan were reviewed by the City Council together with recommendations of the Building Department. The Mayor asked if the applicant was present. There was no response. The Mayor asked if anyone wished to address the Council, there being no response, declared the hearing closed. RESOLUTION NO. 63R-l91: Councilman Schutte offered Resolution No. 63R-19l for adoption, granting house moving permit, subject to the requirement that the proposed garage be constructed to City minimum standards; and further, installation of sidewalk requirements be temporarily waived, subject to the provision that there be no permanent planting (trees) in the area reserved for future sidewalks. At the conclusion of the discussion~ Councilman Chandler moved that it be the finding of the City Council that the applicant has pursued the performance of conditions under Conditional Use Permit No. 193 as diligently as within his means, and further find that because of such diligent pursuit the conditional use permit is still in full force and effect; further, said permit to be again scheduled for review in six months to determine their continued diligence. Councilman Schutte seconded the motion. MOTION CARRIED. SIDEWALK WAIVER. 516 EAST SANfA ANA STREET: Request of Kwikset Division, The American Hardware Corporatioh, for waiver of sidewalk requirement at 516 East Santa Ana Street, was continued from the meeting held March 12, 1963 to this date to complete investigation of the Engineering Division. - The City Manager read the recommendation of the Engineering Department that temporary sidewalk waiver be granted, subject to the following conditions: 1. Removal of existing partial curb return and installation of standard curb on Santa Ana Street (approximately 121 lineal feet at the east end of the property). ' 2. Remova of four (4) existing unused curb depressions and installation of standard curb on Santa Ana Street and on Olive Street. (Approxi- mately 140 lineal feet) 3. Grade existing dirt parkway to standard grade on Santa Ana Street and on Olive Street. 4. Repair hazardous portions of existing asphaltic COflcrete sidewalk. The City Engineer advised that they also recommend that cost of paving the roadway be borne by the Ci , in accordance with City policy. On the recommendations of the City Engineer, Councilman Krein moved waiver of sidewalk requirements be granted, subject to the conditions set forth by the City Engineer. Councilman Schutte seconded the motion. MOTION CARRIED. SIGN REQUEST: Application submitted by Southland and Bates, Inc., for sign at 621 South Manchester Boulevard, was held in abeyance from the meeting of February 19, 1963 until proof of sufficient parking facilities was pro- vided by the applicant. Mr. John Prins, representing Hanover Homes, owner of the property, addressed the Council explaining that construction of the addi- tional building and parking facIlities has been delayed oecause of the vacancy factor experienced in the present building; however, it was their ~nderstanding that the present parking provided IS sufficient for the commercial development as it now exists. He explained their plans for fu~ure development. Mr. Robert Powell, Powell Neon Sign CO'9 Santa Ana, addressed the Council concerning the design of the two face, plastic, non-flashing sign. Sign application and plans were reviewed by the City Council. Discussion was held by the City Counci13 the City Manager and Mr. Prins relative to the low fence which separates the bulk of the parking area from the Southland and Bates Company location. Mr. Prins was invited to the Council Table and plot plan was reviewed; and it was determined if the unpaved portion of the area south of s~bject building, designated for future parking, could be paved at this time, it would accomplish the purpose. On motion by Councilman Sch~tte, seconded by Councilman Krein, sign permit was granted, subject to the ins~allation of the additional thirteen space park ing lot, marked VIA'" on the drawing, or some other suitable parking, and a walk-way connecting said off-street parking area with the Southland and Bates Company building (plot plan dated and signed this date by Mayor Coons), further, the bottom of said sign shall not be more than two feet above ~he parapet line of the b~ilding. MOTION CARRIED. 6561 City Hall_ Anaheim. California - COUNCIL MINUTES - March 19. 1963. 3:00 P.M. SIGN REQUEST: Application submitted by the Islander Motel, 424 West Katella Avenue, requesting permission to install a sign with three foot projection. Plans were reviewed by the City Council and report from the Building Department noted. Mr. Agnew, Santa Ana Neon Company, advised that the sign ddjacent to subject property is sixty-five feet in height. On motion by Councilman Krein, seconded by Councilman Schutte, said sign request was granted, sUbject to no projection over the property line. MOTION CARRIED. SIGN REQUEST - RECONSIDERATION: Application submitted by Beach Motors, 1125 South Los Angeles Street, for permission to replace an existing sign wi~ sign having a four foot projection, was granted by the City Council dt their meeting held March 5, 1963, with provision that there be no projec- tion over the property line. Communication dated March 6, 1963, from Mr. E. C. Agn~w, Santa Ana Neon Company, r~questing reconsideration of said request, was submitted. Mr. Thomas Miller, applicant, addressed the City Council advising that the adjacent property to the North (Tamasha Club) contains large trees planted in such a manner as to block his sign from view of southbound traffic on Los Angeles Street. He submitt~d photos of the area, and called attention to the a0tomobile dealer across the street from his location, whose sign rotates as well as projects over the property line. Mr. Miller stated they were definitely handicapped by these trees and that in his opinion the dealer directly across the street had an unfair advantage over him in respect to merchandising automobiles. With reference to the slight projection of the sign of the Mobil Gas Station (directly south of subject property), it was noted that sdid station was built, and sign erected, prior to the adoption of present street standards which increased the street width from 100 feet to 106 feet; that at the time the sign was erpcted there was no projection over the property line. CONDITIONAL USE PERMIT NO" 236: Communication dated March 8, 1963, from Mr. Phillip R. McGraw, Attorney for Alban and Bernadine Holtz, requesting temporary waiver of block wall construction required as condition of Resolution No. 62R-687 granting Conditional Use Permit No. 236, was sub- mItted. Mr. McGraw addressed the Council stating that when the balance of subject property is ultimately developed, a six foot masonry wall will be constructed across the entire southerly boundary. He felt that within one year plans for development would be formulated, and requested favorable consideration of their request in order to avoid possible construction of two walls. Discussion was held by the City Council and plans again reviewed. Councilman Krein seconded the motion. MOTION CARRIED. INTERIM BUSINESS LICENSE ~ NORTH ~OS ANGELES STREET: Mr. L. J. Holt addressed the City Council advising that application has been filed to reclassify property between 950 and 946 North Los Angeles Street, from C-2 to C-3 to permit automobile sales, and requesting an interim business license pending the outcome of said zoning application. It was moved by Councilman Schutte that the City Business License Collector be authorized to issue a temporary business license, pending the ou~come of said reclassification request, it being understood that the applicant would have no recourse on the basis of hardship, should said zoning application be denied. Councilman Krein seconded the motion. MOTION CARRIED. BUENA PARK TENTATIVE MAP_ TRACT NQQ 5075: Excerpt from the minutes of the City Planning Commission meeting held March 18, 1963, regarding Buena Park Tentative Map, Tract No. 5075, located in the City of Buena Park on the east side of Western Avenue, approximately 663 fee~ south of Filmore Drive, containing eight R-2 lots, was sJbmitted. Mr. Kreidt adVIsed the City Planning Commission recommended to the City of Buena Park that said tentative map be approved. No ac~ion was taken by the City Council. ORANGE COUNTY USE VARIANCE NO. 49~7: Excerpt from the minutes of the City Planning Commission meeting held March 18. 1963, regarding Orange County Use Variance No. 4957, proposing modificat on of Condition No.2 concerning the Douglas Street improvement as a condition prerequisite to the approval of use of property at 10680 Douglas Road for truck storage and repair, was submitted. Mr. Kreidt advised that sGbject property is within the southeast industrial area, and that: the City Planning Commission recommended the posting of a bond to insure installation of street improvements when required by the County of Orange or City of Anaheim, If subject area is annexed in tne future. No action was taken on the above matter by the City Council. ORANGE COUNTY TENT ATl VE MAP _ TRACT NO.. 4958 ('REVISION NO.1): Excerpt from the minutes of the City Planning Commission meeting held March 18, 1963, regard- ing County Tentative Map, Tract No. 4958, located on the north side of Santa Ana Canyon Road, approximately 623 feet westerly of Imperial Highway, con- taining 180 proposed R-I lots, was submitted. Mr. Kreidt stated that the subject property is located within the Vorba Annexation to the City of Anaheim, and the tract is being processed through both the County of Orange and the C of Anaheim, and approved by the City Planning Commission yesterday (March 18, 1963) subject to conditions. Mr. KTeidt outlIned tne five conditions under which said tract would be recommended approved, and further advised official City Planning Commission action will be forwarded to the City Council for their next meeting. No further actIon was taken on subject tract map. COUNTY TRACT NO. 4427: Discussion was held concerning pending subdivisions in the Vorba Annexation area, and Mr. Kreidt reported that County Tract No. 4427 was formerly approved by City of Anaheim, and was in accordance with Anaheim standards; however said tract was finally approved by the County of Orange and is in accordance to County standards, due to the fact that the Yorba Annexation to the City of Anaheim has not yet been finalized. 6563 City Hall_ Anaheim_ California - COUNCIL MINUTES - March 19. 1963. 3:00 P.M. Anaheim Chamber of Commerce, resolution requesting retailers to volun- tarily post a notice, "We do not knowingly sell communist made merchandise, if found on our shelves, please bring to our attention and it will be withdrawn from sale". Upon receipt of a request to enact an ordinance for a special license fee for commercial establishments selling goods produced in communist controlled countries and at the request of the Chamber of Com- merce, legal opinion of the City Attorney was deferred pending investiga- tion by the Chamber of Commerce Committee. Mr. Geisler advised that his basic research on the matter indicated that this would be a matter of imposing a license, regulation or a tariff upon goods which are in interstate commerce as well as in foreign commerce, and the constitution of the United States prohibits any license or regulation or tariff upon any goods which travel in inter- state commerce or foreign commerce. In summary, his opinion was that any such provISIon imposed by the City Council would be adverse to the constitution of the United States of America. b.
