POLICE FACILITIES BUIL~ING - USE AND OCCUPANCY: Mr. Murdoch advised that report
has been received from the City Engineer noting receipt of letters from the
Architects, Smith, Powell & Morgridge, and from the City's Resident Inspector,
Mr. Fred Cooper3 recommending acceptance of the Police Facility Building
for occupancy, in accordance with Section 22 of the general conditions in
the specifications, subject to the following conditions:
1. Completion of heating insulation and general painting work when strikes
in these trades are resolved.
2. Completion of items contained in final v'punch listO' as noted in Mr.
Cooper's report.
Councilman Schutte moved that the Anaheim Police Department be
authorized to use and occupy the Police Facility Building in an unfinished
state, the unfinished state being that which was reported by Mr. Cooper,
City Resident Inspector, and as disclosed by inspection of the building.
Councilman Krein seconded the motion. MOTION CARRIEDo
Chief of Police Mark Stephenson addressed the Council expressing
his appreciation to the City Council for the new Police Facilities.
WALNUT CANYON RESERVOIR FILTRATION PLANT: On report and recommendation by the
Ci ty Manager, Cou'ncilman Krein moved that recommendations of Boyle Engineering
and the City Water Superintendent of the Hardinge Automatic Backwash Filter
for the proposed Anaheim Water Treatment Plant at the Walnut Canyon Reservoir,
be accepted. Councilman Chandler seconded the motion. MOTION CARRIEDo
URBAN RENEWAL ADVISORY COMMITTEE: Request from the Urban Renewal Advisory Com-
mittee for clarification of the CommitteeOs role in cases where property
development is difficult due to narrow lots of excessive dept~ was continued
from the meeting of August 20, 1963 to this date for further report from
Mr. Dingman, Senior Planner, Urban Renewal.
On the recommendation of the City Manager, further consideration
was deferred pending receipt of final report of the Urban Renewal Advisory
Committee.

Reclassification file was reviewed by the City Council.
The City Engineer reported that a portion of the improvements
have been installed, and due to the proximity of two elementary schools, ~
recommended the balance of the improvements be completed on subject property.
On the recommendations of the City Engineer, Councilman Chandler

scaping plan be submitted to and approved by the Superintendent of Parkway

Discussion was held by the City Council, and it was noted that

Councilman Chandler moved that request of United Share Fund, Inc.
be continued for two weeks (September 10, 1963), and that the applicant be

SIDEWALK AND STREET LIGHT WAIVER ~ ALLEC STREET EXTENSION: Request of Monsanto
Chemical Company for waiver of street lights and sidewalk requirements on
the extension of Allec Street, was submitted.
Memorandum from the Electrical Division recommended street lights
be installed, as they are included in the standard requirements for street
improvement, and were not waived on the original portion of Allee Street.
On the recommendations of the City Engineer and City Electrical
Division, Councilman Chandler moved that temporary waiver of sidewalks be
granted on the extension of Allee Street, subject to no permanent planting
(trees) in the area reserved for future sidewalks; further, that street
lights be installed in conjunction with the street improvements. Councilman

REQUEST. USE OF LA PALM~ PARK - WAIVER OF LICENSE FEES~ R~quest of Mrs. Betty
Jo Quick, President, OrangG County Chapter, National Cystic Fibrosis
Research Foundation, dated August 143 1963, for permission to use La Palma
Park October 18 and 19, 1963, to conduct a Circus as a money-raising
project for the Foundation, and further requesting waiver of license fees,
was submitt~d~
Mrs. Betty Jo Quick addressed the Council advising that the
National Cystic Fibrosis Research Foundation does not raise money by door-
to~door requests9 $nd the Orange County Chapter has chosen the De Wayne
Brothers Circus to stage performancGs throughout the County, with the
Foundation to receive 25 per cent of monies received from tickets sold by
the circus, and 50 per cent of monies from tickets sold by volunteers
representing the FQundation.
MrG DeWayne addressed the Council requesting the use of La Palma
Park for three sho.s per day, October IS and 19, 1963, and reported that
the circus will provide seating for 1,000 people at each performancet He
advised that their entertainment includes clowns, acrobats, and some
animalsG Mra DeWayne further explained Gxpenses incurred in producing the
circus, including advertising and payment to performers; and advised that
they were willing to post a bond to insure clean-up of the area.
In response to Councilman ChandlerQs question~ Mrs. Quick reported
that monies received by the Orange County Chapter of the Foundation would be
distributed for drugs, hospItals and spGcial equipment, with any balance
being forwarded to s:~pport childrenis hospitals and research. She advised
that there are approximately 45 to 50 families in Orange County, with Some
ten families in Anaheim, who have one or more members afflicted with Cystic
Fibrosis.
The City Manager reported that the Park and Recreation Director
recommended use of La Palma Park be approved for the dates requested, subject
to the posting of a $50.00 deposit to insure clean=up, which would be
returnable provided no damage resulted from the performances, and further
subject to the City insurance requirements being met.
Discussion was held by the City Council and City Attorney, and at
the conclusion thereof, Councilman Chandler moved that request for the use
of La Palma Park be granted for dates specified, SJbject to the recommenda~
tions of the Director of Parks and Recreation, and that waiver of business

The City Planning Commission at their meeting of August 19, 1963,
approved Revised T~ntative Map, Tract No. 4689, sUbject to thG following
conditions:
1. That should this sUbdivision be developed as more than one sUbdivision,
each subdivislbn thereof shall be submitted in tentative form for
approval.
2. That the average lot size shall be 10,000 square feet, with no lot less
than 8,000 square fGet.
3Q That the area within the City of Anaheim contributing to the drainage
district in the City of Orange shall be responsible for the drainage
charge, which $hall be paid prior to approval of the final map. The
area shall be the net area draining into the City of Orange.
4G That the grading plan is to be rGviewed with the State Division of
Highways as to the area adjacent to the frontage road and shall be
approved by the City EngineGr prior to the approval of the fin~l map.
5. That an off-site storm drain system or other improvements may be

NOG 1598, on motion by Councilman Chandler, seconded by Councilman Krein.

PUBLIC HEARING. CONDITIONAL USE PERMIT NO@ 439: Application submitted by John
H. Kinney, Jr., requesting permission to establish an employeeVs parking
lot on R-l property located on the west side of Zeyn Street approximately
78 feet south of Midway Drive, and further described as 1443 South Zeyn
Street.
The City Planning CommIssion pursuant to their Resolution No.
852, Series 1963-64, granted Conditional Use Permit No. 439, subject to
the following conditions:
1. That the owner of subject property shall pay to the City of Anaheim the
sum of $2.00 per front foot, along Zeyn Street, for street lighting
purposes.
2. That the curbs, gutters, and paving shall be installed, where not
existing, as required by the City Engineer and in accordance with
standard plans and specifications on file in the office of the City
Engineer.
3. That Condition Nos. I and 2, above mentioned, shall be complied with
within a pGriod of l80 days from date hereof, or such further time
as the Commission may grant.
4. That subject property shall be improved for off-street parking in
accordance with all Code requirements, provided that a six (6) foot
masonry wall be constructed along the north, west and south boundaries
of subject property. Further provided, that no access be permitted to
the residential alley abutting to the west of subject property.
5. That installation of a six (6) foot strip of landscaping along the
easterly property line except for the access drives. The aforemGntionGd
landscaping materials shall be adequate to render the parking lot more
compatible to the existing residential uses to the north and south.
Said landscaping plans shall be submitted to and subject to the approval
of the Superintendent of Parkway Maintenance, prior to the utilization
of subject propGrty for paTking purposes.
Appeal from action taken by the City Planning Commission was filed
by the applicant in reference to certain conditions included in the granting
of subject conditional use permit, and public hearing scheduled this date.

Mr. Kreidt noted thF location of subject property, the existing
uses and zoning in the immediate area, advising that no One appeared before
the City Planning Commission in opposition to Conditional Use Permit No. ~39.
The Mayor asked if the applicant was present and wished to address
the City Council.
Mr. Jack Kinney, 1441 South Los Angeles Street, applicant, addressed
the Council objecting only to Conditions 4 and 5 of the City Planning Commis-
sion resolution. In his opinion, to prohibit access to the residential
alley to the Wpst would eliminate several parking spaces, as would a six
foot strip of landscaping along the east property line. Mr. Kinney failed
to see the necpssity of the width required for landscaping, and questioned
the required six foot block walls on the north and south property lines.
The Mayor asked if anyone Glse wished to address the City Council
for or against the proposed conditional use permit, there being no rGsponse,
declared the hearing closed.
Discussion was hGld by the City Counril, and it was determined
that other zoning applications for properties in the genGral area of
Conditional Use Permit No. A39 are scheduled for or pending public hearing
before the City Council. It was the consensus of Council opinion that all
applications concerning this area should be considered concurrently.
On motIon by Co~ncilman Chandler, seconded by Councilman Krein,
decision on Conditional Use Permit No. 439 was continued to September 17,
1963, 7:00 P.M., to be considered concurrently with other applications on
properties in the area. MOTION CARRIED.
CONDITIONAL USE PERMIT NO. 457: Filed in conjunction with Reclassification No.
63-6~-10 and Conditional Use Permit No. 456, Conditional Use Permit No. 457
was continued by the City Planning Commission to August 19, 1963, for
further investigation and report9 to be normally scheduled for Council
information September 10, 1963.
Mr" Kreidt reported that Conditional Use Permit No. 457 was denied
by the City Planning Commission at their meeting held August 19, 1963.
Mr. Dale Heinly, Attorney, 611 West Eighth Street, Santa Ana,
California, reprGsenting Mr. Bostwick, owner of Midway Trailer Park,
addressed the Council relative to clarification of "appeal period", and
advised that it was their intention to file an appeal on Conditional Use
Permit No. 457.
Mr, Geisler explained the provisions of the Anaheim Municipal
Code concerning Hzoning appeals", and discussion followed.
On motion by Councilman Chandler, seconded by Councilman Krein,
review of action taken by the City Planning Commission on Conditional Use
Permit No. A57 was scheduled to be held September 17, 1963, 7:00 P.M., on
condition that the applicant pay appeal fee as set forth in the Anaheim
Municipal Code. MOTION CARRIED.
Mr, Hpinly agreed to the payment of appeal costs.
PUBLIC HEARING_ RECLASSIfICATION NO. 63-64~lO AND CONDITIONAL USE PERMIT NO. 456:
Initiated by the Anaheim Planning Commission to consider a change of zone from
R-A and R-l to R-3, and the establishment of a trailer park, on property
briefly described as being eaSL of the Santa Ana Freeway, south of Winston
Road, and west of Los Angeles Street (Midway Trailer Park).
Inasmuch as Reclassification No. 63-64-10 and Conditional Use
Permit No. 456 pertain to property located in the area considered under Con-
ditional Use Permit Nos. 439 and 457, it was moved by Councilman Chandler,
seconded by Councilman Krein, that public hearing on Reclassification No.
63-64-10 and Conditional Use PermIt No. 4~6 be continued to September l7,

The City Planning Commission pursuant to Resolution NOa 847, Series
1963-64, recommended said reclassification be deniedo
Mr. Kreiot noted the location of subject property and existing
uses and zoning in the immediate area, and briefly summarized the public
hearing held by the City Planning Commission. He reported that the lack
of plans was considered, and lack of a basis for making a decision resulted in
City Planning Commission recommendation for denial, and read excerpt from
the Commission minutes setting forth findings for their recommended denial.
Mr. Kreidt further reported that a resident of the area appeared
before the City Planning Commission, requesting that plans of development
be shown prior to commercial reclassification.
The Mayor asked if anyone wished to address the Council for or
against Reclassification No. 63-,64-4, there being no response, declared the
hearing closed.
Discussion was held by the City Council, City Manager and City
Attorney, and at the conclusion thereof, Councilman Chandler moved that
public hearing on Reclassification No. 63-64-4 be re-opened and continued
to September 24, 1963, 7:00 P.Ma, for further consideration; that said
application be referred back to the City Planning Commission for considera-
tion and report on a possible limited C-l or c-o Zoning, or any other
recommendation they may make concerning subject property. Councilman Krein

Commission considering a change of zone from R-3 to c-o on two parcels of
property, Portion No.1 locatGd at the southwest corner of Broadway and
Harbor Boulevard, Portion No. 2 located at the northeast corner of Broadw~y
and Harbor Boulevard.
The City Planning Commission pursuant to Resolution No. 854,
Series 1963-64, recommended said reclassification, subject to thG following
conditions:
1. That thG owners of subject property shall deed to the City of Anaheim a
strip of land 45 feet in width, from the centGrlinG of the street, along
Harbor Boulevard, fOT street widening purposes, at the time of development.
2. That trash storage areas shall be provided in accordance with approved
plans on file in the office of the Director of Public Works, at the
time of development.
3. That subject property shall be developed in accordance with all provisions
of the C-O, Commercial-Office Zone.
Councilman Krein withdrew from discussion or action on said
reclassification, because of possible conflict of interest.
Mr. Kreidt noted the location of the property and briefly summarized
the evidence submitted to and considered by the City Planning Commission.
The Mayor asked if anyone wished to address the City Council, either
for or against the proposed reclassification, there being no response,
declared the hearing closed.
Councilman Chandler questioned the inclusion of City-owned property
in said reclassification.
Mr. Geisler reported that the City was not bound by the Zoning
Ordinance; that action of the City Council in determining that any facility
should be placed in any area superimposes upon the zoning action their
necessity for public use.
Mr. Richard Reese, Planning Director, reported that upon investi-
gating the State Planning Act relative to "Civic Districts" and reviewing
the advantages of establishing a "Civic District" under state law, it was
found that the site development standards and provisions of the C-O Zone had
integrated within it all the safeguards and protection included within a
"Civic District".
Reference was also made to the Economic Research Associates report
concerning projected Commercial-Office Zones in the Center City area.
Mr. Reese further reported that the Planning Commission was of
the opinion that the C-O Zone would more actively represent the nature of
the Civic Center devPlopment, rather than the existing R-3 Zone, and would
carry out some of the recommendation of the Economic Research Associates
report by serving to identify this area as a focal point of office activity.

described as located at the southeast Corner of Rome Avenue and Magnolia
Street (2578 West Rome Avenue).
The City Planning Commissfun pursuant to Resolution No. 855,
Series 1963-64, recommended said reclassification be denied.
Mr. Kreidt noted the location of the property, and uses and
existing zoning in the area, and further advised that the objection to the
proposed use was based upon the encroachment of commercial use into a
residential area.
Mr. Kreidt further reported that the applicant wished to expand
a cake decorating operation at this location, and it was felt that the
only way this could be accomplished, since residential use is prohibited
in a C-l Zone, was to reclassify subject property, and by a Record of
Survey split the lot, enclosing the rear area for the business activity,
and continuing the use of the residence as a non-conforming use.
The Mayor asked if the applicant was present and wished to address
the Council.
Mr. Frank S. Stevens, 2578 West Rome Avenue, applicant, submitted
a petition in favor of C-l Zoning for subject property, containing 20 signa-
tures of home owners in the area. He advised that their home has been used
for a cake decorating supplies outlet, and that due to his progressive
physical disability, he was unable to support himself or his wife at his
former occupation, that of a carpenter.
Mr. Stevens submitted into evidence letters from two physicians
concerning the extent of his disability, and also a price list of the
supplies to be sold.
Mr. Stevens further advised of the traffic and noise on Magnolia
Avenue, and was of the opinion that properties south of Rome Avenue should
be reclassified commercial. He explained the only changes in the present
operation would be to provide a larger display room, and to display a sign
identifying the business; that contrary to rumor, there would be no commer-
cial bakery on the property.
Mayor Coons asked if anyone else wished to address the Council in
support of the application.
Mrs. Agenes B. Stevens advised that during the past year, thirty
cakes were baked for sale; that because of the very small profit realized,
this service has been discontinued.
The Mayor asked if anyone wished to address the Council in opposi-
tion to the proposed reclassification.
Mrs. Dorothy Polley, 2574 West Rome Avenue, representing seventeen
home owners on the cul-de-sac section of Rome Avenue, stated her home is
adjacent to subject property. She called attention to petition of opposition
submitted to the City Planning Commission, containing signatures of sixty-
four home owners in the neighborhood.

Mrs. Po11GY requested that the residential neighborhood be
retained, and further advised that they particularly object to the request~d
sign as well as the expansion of the display room. Attention was called to
the small size of the lot in question, and the present traffic congestion on
the cul-de-sac street, which in their opinion would be aggravated by the
added traffic created by a commGrcial business.
Mr. Joe Espinoza, 2S85 West Rome Avenue, addressed the Council in
opposition to the reclassification, being of the opinion that if commercial
zoning were granted, the ownGrs of subject property could sell the property
to another, who in turn could remove the house and build a commercial
building on the property. He further noted that cake decorating is a
service furnished by many bakeries, which sGrvices are performed under
strict sanitary conditions.
Mrs. Ralfina Jahnke, 2579 West Rome Avenue, stated that they
bought their home for residential purposes, and because of the Quiet neigh-
borhood, and reque$ted the status be retained.
Mr. Stev~ns, in rebuttal, cited the numbGr of homes presently for
sale in the neighbOrhood, and again explained the nature and extent of thG
businGSs.
Mr. Paul Cosada, 808 South Ira Court, called attention to the
fact that Rome Avenue was a dead-end street, and asked how the over-flow of
traffic, generated by a commercial business, would be handled.
Mayor Coons stated that a good cross section of the evidence had
been presented, and thereupon declared the hearing closed.
Discussion was held by the City Council, and attention was called
to the lack of parking plan for subject property, and the fact that the
Anaheim Municipal Code does not make provisions for a combined residential
and commercial zonep
RESOLUTION NO. 63R-719: Councilman Chandler expressed his personal sympathy
for the applicants because of their personal problem, but further advised
that the request submitted was impossible to grant under the provisions of
the Anaheim Municipal Code, and thereupon offered Resolution No. 63R-7l9
for adoption, denying Reclassification No. 63-64-15.

Mayor Coons called the meeting to order.
MINUTES: Approval of the minutes of the Anaheim City Council meeting hGld
August 27, 1963, was deferred one week (September 10, 1963), on motion
by Councilman Schutte, ~GcondGd by Councilman KrGin. MOTION CARRIED.
PUBLIC HEARING~VACATION AND ABANDONMENT: Public hGaring was held on proposed
abandonment of an easement for street and alley purposes along the easterly
propGrty line of 517 East Sycamore Street (between Sabina and Pauline
Streets), pursuant to Resolution No. 63R-666, duly published in the Anaheim
Bulletin August 22, 1963, and notices thereof posted in accordance with law.
The Mayor asked if anyone wished to address the City Council,
there being no response, declared the hearing closed.
Mr. Maddox, City Engineer, reported that the entire easement, a
total width of 12.62 feet, was proposed for abandonment, except for a three
foot overhang easement on the east side of said easement, which the Public
Utilities Director recommended be retainedo He further reported said
abandonment has cleared all oJtside utility agencies and City departments.
RESOLUTION NOo 63R~720: Councilman Schutte offered Resolution No. 63R-720
for adoption, in accordance with the recommendations of the City Engineer
and Public Utilities Director.
