Mayor Coon5 called the meeting to order.
INTRODUCTION: Mayor Coon5 introduced several students from St. Justin Martyr
School in Anaheim attending the City Council meeting this afternoon.
MINUTES: On motion by Councilman Krein, seconded by Councilman Schutte, minutes
of the Anaheim City Council me~ting5 held October 15 and 22, 1963, were
approved. MOTION CARRIED.
RECLASSIFICATION NO. 62-63-41 - REVISED PLANS: Revised plans submitted by Roy L~
Pina in connection with Reclassification No. 62-63-41 were reviewed by the
City Council together with recommendations of the City Planning Department.
It was noted that the parkway was included as part of the required land5caping.
Councilman Dutton moved that revised plans marked Exhibit 1-26,
Revision No.1, be approved as recommended by the Planning Staff. Councilman
Krein seconded the motion. MOTION CARRIED. (Plans dated this date and

RECLASSIFICATION NO. 63-64-30 AND CONDITIONAL USE PERMIT NO. 470: Submitted by
Frank W. and Edith Rose Sackett, requesting change of zone from R-A to C-l,
and permission for the following:
a. Establish a service station and restaurant.
b. Establish a three-story apartment complex.
c. Waiver of one-story height limitation.
d. Waiver of It space per dwelling unit in a garage.
e. Waiver of parking stall size to permit utilization of
underground parking.
Public hearing before the City Council was held October 29, 1963,
at which time the hearing was closed, and action deferred to this date for a
recommendation from the City Engineer concerning alleys and drainage.
The City Clerk reported a petition was received in her office
November 1, 1963, containing approximately 20 signatures of property owners,
requesting that public hearing be re-opened on Reclassification No. 63-64-30
and Conditional Use Permit No, 470 for the presentation of new and additional
evidence.
On motion by Councilman Dutton, seconded by Councilman Schutte,
public hearing was re-opened on Reclassification No. 63-64-30 and Conditional
Use Permit Noo 470, for presentation of new and additional evidence.
(Councilman Chandler requested the record to show that he did not vote on
this issue.) MOTION CARRIED.
The Mayor asked if a representative of the property owners was
present and wished to address the Council.
Dr. Bouchelle, 1416 Birchmoni Drive, requested that the matter be
scheduled for an evening meetIng to allow more residents an opportunity to
be present.
The City Councll denIed said request, advising that the position
of the nelghborhood has been expressed by the petitions submitted.

Dr. Bouchelle called attention to deed restrictions recorded as
a requirement of the zoning for the first commercial building constructed on
Wilshire Avenue (Reclas5ification Nos. ~8-~9-51 and 59-60-48), prohibiting
any restaurant use, and setting forth height limitations, along with other
provisions for the protection of the nearby residents.
Dr. Bouchelle advised that they realize the frontage along Wilshire
Avenue cannot develop for residential homes, but do feel that one-5tory __
development will make good use of the land, whether or not these buildings
are apartments or commercial, with provisions for adequate sound barriers
as a protection to their area.
Dr. Marshall Stonestreet, 1218 Dwyer Drive, addressed the Council
in opposition to the proposed development, being of the opinion that if the
requested use materIalized, it would become an opening wedge for multiple
.story buildings on other vacant properties in the area, contrary to the
provisions of the Anaheim Municipal Code. He called attention to the sub-
stantial property taxes assessed on the homes to the North of subject
property in relation to the probable taxes to be paid by proposed develop-
ment. Concern was expressed regarding the addition of traffic to already
congested streets, and the increase in school population that the three-
5tory apartment complex would produce.
In answer to Councilman Duttonis questIon, Dr. Stonestreet stated
that the resIdents would have less objection to the three-story buildings,
as planned, if they were placed from 500 to 600 feet from the nearest
existing home.
Dr. Smart referred to his letter sent to each individual Councilman
and noted the same type of hearing was held approximately five years ago.

The Mayor asked if che applicant was present and wished to address
the City Council.
Mr. Dick Lippincott, representing L.G.S. Corporation, developers,
advised that the traffic situation has been investigated with interested City
departments, and consideration given to adjoining properties, and the
developers are of the opinion ~hat the proposed use is the best and most
advantageous use of the land.
The Mayor asked if anyone else had any new or additional information
to add, there be~ng no response~ declared the hearing closed.
The City Engineer reported that after reviewing with the Architect
the alley and drainage SItuation with regard to traffic circulation and
Police patrolling, he recommended dedication of an easement for a twenty-
five foot alley, which would also serve for alley and drainage, from Lincoln
Avenue to the north line of the first alley north of Lincoln.
Mr. Maddox submItted a plot plan of the proposed development,
shOWIng how this would rela~to the property, and also showing how a
"hammer head" could be added to the west end of the alley north of Diamond
Street, recommending this not be done, as this wo~ld require a structural
roof over the underground garage; and further recommending the eight foot
drainage easement (Condition No. 2 of the reclassification) be reduced to
six feet.
Plans were reviewed by the City Council, and Councilman Chandler
suggested an area of compromise mIght be reached by reversing the complex.
Mayor Coons Invited Mr. Lippincott and Dr. Bouchelle to the
Council Table to review the Engineering recommendations and possible revers-
ing the plan, and further discussion was held.
In answer to CounCIl question, Mro Marko Botich, Architect,
reported that re-design of the building layout for the proposed R-3 portion
of subject property could be ready in approximately thirty days.

RESOLUTION NOa 63R-866: Councilman Du~ton offered Resolution No. 63R-866
for adopiion, authorizing preparation of necessary Ordinance, changing the
zone of Portion A only to C-l, subject to the recommendations of the City
Planning CommIssion, as determined by the City Attorney to be applicable
to the C-l portion of said application; amending Condition No.2 thereof to
read: IIThat the owner of subject property shall deed to the City of Anaheim
an alley and draInage easement, not leGs than twenty feet wide, from the
northerly boundary of the alley between Lincoln Avenue and Diamond Street to
Lincoln Avenue, and a six foot wide drainage easement from Diamond Stre~t to
the northerly boundary of the aforementioned alley, and construct such alley
improvem~nt~ and dr8108ge facilities in accordance with the requirement~ of

PUBLIC HEARING, VACATION AND ABANDONMENT: Public hearing was held on proposed
abandonment of an eas~ment for public utility purposes, on portions of Lots
3 and 4 of Tract No. 2920, property located on the ea5t side of D~lla Lane,
50uth of Orangewood Avenue, pursuant to Resolution No. 63R-828, duly pub-
lished in the Anaheim Bulletin on October 24, 1963, and notices thereof
posted in accordance with law.

RECLASSIFICATION NO. 62-63-L19: Mro Ulvestad, Attorney, representing Mr. Dorr,
owner of property east of property described in Reclassification No.
62-63-49, addressed The Co~ncil adv~sing that Reclassification No. 62-63-49
involves a plot plan whiCh appears to encroach on his clientYs property.
He further advised that, since February, they have been working
on an agreement with respect ~o the boundary line, and was bringing this
information to the Counci , as he did not want the Council record to create
a situation of determined right, or in any way encroach upon the rights of
his clientJ
Mro Ulvestad was advised that the action taken by the City Council
was a zoning action, based on a description of the property filed with the
application.

together with plans and report from the Building Department, was reviewed
by the City Council.
Mr. DedIC was present representIng the developer, and came
forward to the Council rab~e to review the plot plan regarding placement of
the SIgn.
On motlon by Co~ncllman KreIn, seconded by Councilman Schutte,
said SIgn permit was gran~ed, SUbJect to placement within the center ten

D.D.S., dated October 22, 1963, for six month extension of time to
improvement bond posted as requirement of Reclassification No. 61-62-54,

Said request was granted by the City Council, on motion by

TENTATIVE TRACT NO. 4476 - EXTENSION OF TIME: Request of C. J. Queyrel of
McDaniel Engineering Company, dated October 21, 1963, for one year
extension of time to Tentative Tract No. 4476, was submitted.
Said request was granted by the City Council, on motion by
Councilman Krein, seconded by Councilman Dutton. MOTION CARRIED.
REQUEST - MEL EVE CUSTOM FURNITURE: Communication from Mel Eve Custom
Furniture, 410 West Pico Boulevard, Los Angeles, requesting permisSion
to utilize a mObIle unit for display purposes in conjunction with sales
promotion on private parking lots of certain markets within the City of
Anaheim, was s~bmitted.
Mr. Mel Eve was present and advised that his twenty foot
mobile trailer would be placed on the parking lots of various markets in
the City of Anaheim for the purpose of displaying furniture manufactured at
his Los Angeles e5tablishment~ He explained the nature of his business,
and further adVIsed that rus firm is the only one in the country which
manufactures hIS part cGlar product, therefore he would not be in competi-
tion with local outlets for the same furniture.
Council discussion was held, and at the conclusion thereof,
Councilman KreIn moved that said request be denied. Councilman Chandler
seconded the motIon. MOTION CARRIED.

Public hearing was held October 1, 1963, and at the request of Mr.
Philip Krakover on behalf of Mr. Charles A. Hirshman, Agent for the applicant,
public hearing and Council action on Tentative Map wa5 continued to this date.
Mr. Kreidt noted the ocation of the subject property, comprising
thirty acres, and read minutes of the City Planning Commission hearing
relative to said applicatIon and tract map, recommending to the City Council
that both be denied.
Petition received November 4, 1963, urging Council approval,
setting forth their reasons therefor, containing twenty signatures, was
submitted and read by the City Clerk.

enriched program.

Mrs. Bright advised or the State requirements relative to this
activity concernIng qualifications of supervisors, and the number of
supervisors required; and fLrther advised that the play area to be located
on the adjacent vaca~t would be an improvement; the south wing would
be used for class rooms9 school kItchen, and re5~ rooms, easily acc95sible
to the playground area; the north wIng would house the administrative
office, teachersu lounge and rest rOGm~ isolation roomj and a two-bedroom
apartment; that the locat on and physical structure lend themselves well for
conversion to a n~rsery school, and wOdld be in her opinion the highe5t and
best use of the property.
A chart was submitted showing the available nursery schools in
Orange County, indicating the need in relation to the population, and
Mr5. Bright advised that according to the County population, one out of
every five people in the County would be entitled to be enrolled in a
nursery school.

Mrs. Bright related her scholastic qualifications, teaching
qualifications, and former experience in this field and the field of
education, qualifying her to be a Director of a State-licensed nur5ery
school, and also reported on the qualifications of the other members of
the staff.
Concerning ~rafflc, Mrs. BrIght advised that traffic counts reveal
that "there is 'greater traffic on Harbo~r Boulevard during the weekends, when
the school would be closed, than ~here would be during the week, and in her
opinion, approximately fifty additIonal cars twice a day during the week
would make no difference.
Mrs. Bright stated that one of the people protesting the use
advised that the majority of the people residing in this neighborhood are
mature, or older, people, and further advised that one of the oldest
residents in the neighborhood was her tenant, and the apartment presently
occupied by her will remain for her se as long as she desires, and as long
as she (Mrs. Bright) was the owner of the property. In her opinion, the
neighbors to the North would not be disturbed, as the children would rarely
be in the north wing.

families living adjacent to nursery schools, and only one advised that they
were ever disturbed.

or other appurtenant work shall be completed as required by the City
Engineer and in accordance with standard plans and specifications on
file in the office of the City Engineer, and that a bond in an amount
and form satisfactory to the City of Anaheim shall be posted with the
City to guarantee the installation of said engineering requirements.
3. That the owners of ect property shall pay to the City of Anaheim
the sum of $2~OO per front foot a ong Lincoln Avenue and Magnolia
Avenue frontage of th~ s~rvice staiion, for street lighting purposes.
4. That trash storage areas shall De provided in accordance with approved
plan5 on file in the office of the Director of Public Works, prior to
final building inspection.

within a period of 180 days from date hereof, or such further time as
the City Council may grant.
6. That treewells shal be provided at approximately 40 foot intervals in

7. That a six (6) foot strip of land shall be landscaped and said land-

PERSONNEL RULES AND REGULATIONS~ Personnel ~irector Roy Heissner briefed the
contents of proposed personnel rules and regulations~ submitted to the City
Council on October 29, 1963~ noting changes made since previous discussions
were held.
Each rule was briefly explained and discussed. Certain additional
amendments were made the City Council to the following rules:

national Brotherhood of Electrical Workers, Local Union 47, addressed the
City Council urging adoption of the proposed rules and regulationsg being
of the op nion that represent a arge step forward and will be of
great benef t to employees.

superVIsors the option of deciding whether the department can spare the
employee leave fJr compensatory time. He fel the rule was not intended to
prevent accumulation of compensatory ~me, and perhaps the rule could be
further clarified.
Mr. Anson further requested that the accumulated sick leave for the
67.2 hour employees be pro rsted9 as they wi 1 now lose sick leave at a much
greater rate than it was accJffiulJt:ed.
Mro Murdoch exp ained ttat this would be probably a one time
mechanIcal adJustment.
At the req~est of CouncIlman Schutte, action on proposed adoption of

OFFER TO PURCHASE CITY-OWNED PROPERTY: The City Manager reported on offer made
by Socony Mobil Oil Company to purchase property located at the northwest
corner of Orangethorpe and Maqnolia Avenues, fifteen per cent interest in
said property being owned by the City of Anaheim, with the balance being
owned by the City of Fullerton. He reported that the City of Fullerton has
approved sa~d offer In the amount of $20,000.00 for the entire parcel,
subject to approval by the City of Anaheim.
On motIon by Councilman Krein, seconded by Councilman Schutte,
offer made by Socony Mobil Oil Company in the total amount of $20,000.00,
was accepted, and the C1 Manager authorized to enter into escrow
on behalf of The City of Anaheim. MOTION CARRIED.

WHEREAS, the City Council has been informed of the death of
Willis Ho Warner, our esteemed friend and advocate on matters of county-
wide concern; and
WHEREAS, in WillIS Warner, affectionately known to all of us as
HMister Orange County,H we had in his career of long service a man whose
devotion ~o duty and sincere love of Orange County was equaled only by his
experience in eg slative matters; and
WHEREAS, in the vital fields of sanitation and water con5ervation,
Willis Warner, with infinite patience and knowledge born of experience, has
made great strldes towards the solution of sanitation and water conservation
problems; and
WHEREAS, through his many years of public service, Willis Warner
has contributed the rare gift of balance and wisdom to the deliberations
of the Board of Supervisors of Orange County and the other Boards and
entities with which he has been associated; and
WHEREAS, throughout his long and active career in the public
interest Willis Warner never lost the common touch and was ever and always
available to al of the citizens of Orange County for consultation, advice
or comment; and
WHEREAS, because of his experience, devotion to public service and
his ability to work with others, Orange County has advanced and grown in
stature to the metropolitan area it IS today and is itself a tribute to
Willis Warner,
