MOTION CARRIED. PROXY - AMERICAN TELEPHONE AND TELEGRAPH COMPANY: On motion by Councilman Schutte, seconded by Councilman Pearson, City Manager, Keith A. Murdoch, was authorized to sign proxy for and on behalf of the City of Anaheim, Stockholder's meeting on April 15, 1959, American Telephone and Telegraph Company. MOTION CARRIED. TRANSFER OF FUNDS: On motion by Councilman Pearson, seconded by Councilman Coons, the 1958-1959 Budget Appraisal including a transfer of $10,250. from the Contingency Account was approved and authorized; and transfers from the Contingency Account to the Sub-station, Light & Power Division in the amount of $240,OOO~ and to Parksite, Parks & Recreation Account in the amount of $104,030$ was authorized. MOTION CARRIED. APPOINTMENT - PARK AND RECREATION COMMISSION: On the recommendations of the City Planning Commission, Mayor Schutte appointed Clarence Mauerhan, Member of the Park and Recreation Commission, as representative of the City Planning Commission. Said appointment was ratified by the City Council on motion by Councilman Coons, seconded by Councilman Fry. MOTION CARRIED. Councilman Pearson moved to adjourn to March 25, 1959, 7:00 P.M. The City Council of the City of Anaheim met in adjourned regular PRESENT: COUNCILMEN: Borden (entered meeting 7:20 P.M.), Coons, Fry (left meeting 7:30 P.M., returned 8:45 P.M.), and Schutte. COUNCILMEN: Pearson. CITY MANAGER: Keith A. Murdoch. CITY ATTORNEY: Preston Turner. CITY CLERK: Dene M. Williams. CITY ENGINEER: Thornton Piersall. CITY PLANNING DIRECTOR: Robert W. Mungall. ABSENT: PRESENT: Mayor Schutte called the meeting to order and announced that this meeting was for the purpose of conducting the first work session on the pro- posed new comprehensive zoninq ordinance. to consider statements made and communications received pursuant to public hearings held March 4th, 11th and 18th, 1959.. Mr. Turner advised the City Council regarding the legality of the ordinance and stated that a determination would have to be made whether the City Council intends to adopt the ordinance at this time or if the City Council intends to proceed, as did the City Planning Commission, by first zoning the entire City. He further explained necessary procedure if the Council chose the latter course9 that is, first rezoning the City, that it would be necessary to hold hearings and give adequate notices thereof. It was his understanding, and he felt, generally understood, that the first action would be the adoption of the ordinance, not the rezoning. Mr. Turner further stated that in his opinion, adequate notices had been given regarding the proposed adoption of the ordinance; but that not '-<"~>~':""',",~"~"""'~'~:4"~~;"";~~'_'_'___~,.;..;,o.;;~~ 3264 City Hall. Anaheim. California - March 25. 1959 - 7:00 P.M. sufficient notices had been given for the rezoning of any definite area. Attention was called to th~ fact that in the proposed new ordinance, not only had new zones been added, which was recognized by everyone as needed, but it also abolishes zones which have already been established, for example, the R-O and R-l zones. Mr. Turner felt it importamt to continue the zone, not necessarily the continuation of the name, but that sQme further identification be made in the new ordinance of the present zone name and the former zone name. As a specific example, the C-l zone was considered, wherein it was noted that the proposed C-l zone only contains 10 of the 27 uses now authorized in the C-l zone of the new ordinance. The Council considered that the use to which property has heretofore been developed should continue; that in a new section there should be added the identifications of existing zones as they will be known in the new zoning ordinance. To accomplish this, it was first considered that instead of changing the names of the zones, perhaps an easier solution to the problem would be to call the zone most nearly fitting the uses intended therein, the present zone name. This suggestion was disregarded when it became apparent that the entire new proposed zoning map would have to be redrawn as the zones suggested therein are noted by color. Mayor Schutte declared a five minute recess. (8:40 P.M.) AFTER RECESS: (8:45 PQMo) After recess the meeting resumed, Councilmen Borden, Coons, Fry and Schutte being present. Mr. Hardy, Assistant City Attorney, suggested that the ordinance be re- viewed and put in final form for adoption, and that the City Council adopt a resolution of intention to adopt the map, then proceed to hold the hearings as soon as possible on the map itselfo It was decided that at the next work session, an effort would be made to resolve the wording or rewording of a paragraph that would make possible the adoption of the ordinance prior to the adoption of the map. Mr. Turner called further attention to some other provisions in the text of the ordinance itself on which further study should be given. Mr. Murdoch felt that serious consideration should be given to the zone placement of service stations in connection with shopping centers. Councilman Coons brought up the requirement of dedication of right-of-way for future street widening in conjunction with rezoning, and with the rezoning of the entire City, questioned whether or not the City could legally require the dedication for street purposes before the issuance of a building permit. Mr. Murdoch asked, when the use is made of the property that would engender the increase of the traffic, would this justify the requirement of street dedication. Mr. H~rdy advised that the developer of the property would have to measure his setback line back from the planned right-of-way line of the street, and it would be to no advantage to setback a like distance with other buildings without having the street improved. It was determined that at the next work session an effort would be made to complete the legal problems of the ordinance and proceed with the individual sections thereof. Councilman Coons moved to adjourn to March 31, 1959, 7:00 P.M. Council- man Borden seconded the motion. MOTION CARRIED. ADJOURNED: (9:45 P.M.)
