OATH OF OFFICE - COUNCILMAN THOMPSONF Pursuant to action taken by the Ci ty Council at their meeting of September 15, 1959, appointing Joe R. Thompson Councilman to fill the unexpired ter~ ending April, 1962, created by the re- signation of Robert S. Borden, City Clerk, Dene M. Williams administered the Oath of Office to Mr. Thompson. Councilman Thompson took his place on the Council rostrum and received congratulations from the Mayor and C~uncil Members. VISITING COUNCILMEN FROM OSAKA. JAPAN: Mr. Ichitaro Kato and Mr. Tatsuzo Ohtani, Members of the Osaka Municipal Assembly, were introduced and Mr. Ohtani thanked the people of the City of Anaheim for their fine hospitality, and extended a special invitation to Mayor Schutte to attend the Pacific Coast Mayoris Conference to be held in the City of Osaka this coming November. MINUTES: Minutes of the regular meeting held September 8, 1959 were approved, on motion by Councilman Fry, seconded by Councilman Coons. MOTION CARRIED. __FESOLUTION NO. 5510: Councilman Fry offered Resolution No. 5510 and moved for its passage and adoption. Refer to Resolution Book, page A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING AND DIRECTING THE PAYMENT OF DEMANDS AGAINST THE CITY AS OF SEPTEMBER 22, 1959. (Warrants No 3571 to 3714, both inclusive, totaling $402,823.85) On roll call the foregoing Resolution was duly passed and adopted by the following vote: AYES: NOES: ABSENT: COUNCILMEN: COUNCILMEN: COUNCILMEN: Coons, Fry, Pearson, Thompson and Schutte. The Mayor declared the foregoing Resolution duly passed and adopted. .PUBLIC_HEARING - SPECIAL USE PERMIT NO. 46: Submitted by Church of Jesus Christ of Latter Day Saints, requesting permission to erect a church on property described as the north side of Westmont Drive, between Loara and West Streets. The City Planning Commission, pursuant to their Resolution No. 33, Series 1959-60, granted said special use permit, subject to: 1. The erection of the building in accordance with plans submitted. 2. The dedication of 32 feet to the City of Anaheim on Westmont Driveo 3. Prepare street improvement plans and install all improvements in accordance with approved standard plans on file in the office of the City Engineer. 4. Payment of $2.00 per front foot for street lighting on Westmont Drive. Appeal from action taken by the City Planning Commission was filed, and public hearing scheduled to be held this date. Communication dated August 28, 1959 from John and Esther Kemper and W. H. and Josephine Webb, indicating their approval of said Special Use Permit, was submitted and read. Mr. Vern RaId, 1452 Westmont Drive, addressed the Council, advising that they live directly across from the property in question, and were opposed to the granting of said special use permit. ,,- Dro Neils Boege, also representing his father, Dr. John Boege, addressed the Council in opposition to said special use permit, and advised, that in his opinion, to allow the construction of the church would make it impossible for the Broadway to develop the adjacent area R-O as originally agreed to by them. The Mayor asked if anyone else wished to address the Council, there being no response, declared the hearing closede After further discussion by the City Council, Councilman Fry moved that action by the City Council be.deferred for two weeks _(October 6, 1959) to allow for further investigation. Councilman Coons seconded the motion) MOTION CARRIED. CONTINUED PUBLIC HEARING - RECLASSIFICATION NO. F-59-60-1l: Submitted by George and Dorothy Bennett, requesting change of zone from R-A to R-3, property located on the East side of Stinson Street, between Lincoln Avenue and Broadway (9072-9092 Stinson Street). The City Planning Commission, pursuant to their Resolution No. 39, Series 1959-60, recorrmended said reclassification to R-3, subject to conditions. Public hearing was held on said reclassification on September 15, 1959, and continued to this date, in order that the new R-3 Standards could be first considered. Communication dated August 24, 1959 from Mro George Bennett (copies furnished each Councilman) was submitted and read, concerning proposed street dedications. Mr. Bennett addressed the Council, advising that the plot map is again being revised in conformance with the new R-3 standards, and further advised that to require additional dedication of property for street purposes would take approximately one-third of his property and that it would not be feasible to spend a large amount of money for street improvements in order to develope the remaining smaller parcel of land; that he would like to witndraw said rezoning application if it was the Council7s feeling that further street dedication is necessary for the improvement of the property. Mr. Bennett submitted a proposed plan of development, said plan and the plans in the file being reviewed by the City Council, and discussion was held. The Mayor asked if anyone else wished to address the Council, there being no response, declared the hearing closed. Councilman Pearson moved that action by the City Council be deferred for two weekslQctober h 1959) to allow time for further study of street layout and ultimate plan of development for the entire area. YUBLIC _HEARING -___ VARIANCE NO. 1141: Submi tted by Russard Company, requesting permission to erect a semi-commercial swimming pool within front yard setback at 917 East Cambridge Street (north side of Cambridge Street, between Lemon and Palm Streets). The City Planning Commission, pursuant to their Resolution No. 37, Series 1959-60, granted said Variance, subject to: 1. The plans as presented. 2. Review of action taken by the City Planning Commission was ordered by the City Council and public hearing scheduled to be held this date. The Mayor asked if anyone wished to address the Council. A gentleman representing the Applicant addressed the Council, urging the granting of said variance and advised that the front yard was the only site available to place the pool. Mr. Jack Bush, 923 Cambri~ge, owner of the apartments adjacent to the Russard Company, addressed the Countil in opposition to said variance and advised that there is a parking problem in the area and it was his feeling that a semi- commercial pool, which he had been Qdvised would be used for swimming lessons, would only add to the traffic and parking problem. The Mayor asked if anyone else wished to address the Council, there being no response, declared the hearing closed. RESOLUTION NO. 55l1. Councilman Co~ns offered Resolution No. 5511 and moved for its passage and adoption, denying Variance Application No. 114l. Refer to Resolution Book, page A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING VARIANCE NO. 1141. None. The Mayor declared Resolution No. 5511 duly passed and adopted. PUBLIC HEARING - HOUSE MOVING PERMIT: Submitted by Ralph E. Herrera, requesting permission to move a dwelling from 2510 Montair, Long Beach, to 2017 Embassy, Anaheim. Public hearing was held pursuant to Legal Notice published in the A~eim Gazette September 10, 1959 and Notice mailed to property owners in the area. The Mayor asked if anyone wished to address the Council. Mr. Dick Tevlin, President of the Lincoln Park Civic Association, addressed the Council in opposition to the proposed house moving, stating that in his opinion, the dwelling to be moved did not compare in appearance, size or value with the surrounding homes in the area, and urged the permit be denied. Mrs. Florence Seiann, resident directly across the street from the location in question, addressed the Council in opposition to said house moving, and advised that her husband had gone to Long Beach to view the dwelling and that the dwelling does not come up to standards in the immediate area. Mr. Herrera, Applicant, addressed the Council, advising that the dwelling contained approximately 1231 square feet, three bedrooms and two baths, and had hardwood floors, and in his opinion, was of equal value as the homes in the areas Pictures from the file were reviewed by the City Council. Mrs. Chavos, 1903 Embassy, addressed the Council in opposition, and referred to the other vacant lots along Embassy Street, and felt that if the standards were lowered, it would set a precedent for future building on Embassy Street. The Mayor asked if anyone else wished to address the Council, there being no response, declared the hearing closed. Councilman Thompson seconded the motion. MOTION CARRIED. PUBLIC HEARING - HOUSE MOVING PERMIT: Submitted by Alfred J. and Verda V. Vincenz, requesting permission to move a dwelling from Stanton House Movers Yard, corner of Stanton and Orangethorpe, to 1222 South Dale Avenue. Public hearing was held pursuant to Legal Notice published in the Anaheim Gazette September 10, 1959, and Notice mailed to property owners in the area. The Mayor asked if anyone wished to address the Council. Mr. Vincenz, Applicant, addressed the Council, advising that the dwelling to be moved was a new house that had never been lived in, and con- tained approximately 1145 square feet. That it was his intention to place this dwelling on the front portion of hIs land, and that his present dwelling would remain on the back portion. It was noted that the Applicant had filed Variance No. 1150, re- questing permission to move second house on an R-A lot, and to waive 1225 square foot requirement, which was before the City Planning Commission September 2l, 1959, and would be before the Council for their consideration at their next meeting. The Mayor asked if anyone else wished to address the Council, there being no response, declared the hearing closed. Councilman Coons moved that action by the City Council on said matter be deferred for one week (Seotember 29, 1959) at which meeting Variance No. l150 will be before the City Council. Councilman Pearson seconded the motion. MOTION CARRIED. RECLASSIFICATION NO. F-58-59-105: Submitted by Emil A. and Louise Fischbeck -and Harold Haase, requesting change of zone from R-A to C-l, property located at 318 and 404 North Placentia Avenue (east side of Placentia Avenue~ north of Anaheim-Olive Road). The City Planning Commission, pursuant to the~r_Re$olution No. 22, Series 1959-60, recommended said reclassification, subject to conditions. Public hearing was held September 1, 1959 at which time the hearing was closed and action by the City Council deferred from the meetings of September 8th and l5th, 1959, for the presentation of revised plans on this date. Mr. Ray Spehar, Authorized Agent, presented revised plans, which plans were reviewed by the City Council and discussion was held with Mr. Spehar. At the conclusion of the discussion, Councilman Coons moved that action by the City Council be again~eferred for one week. (September 29. 1959) to allow time for further study of engineering requirements relative to the proposed alley. Councilman Pearson seconded the motion. MOTION CARRIED. SPECIAL USE PERMIT NO. 47: Submitted by Charles B. Frank, Authorized Agent, requesting permission to build adult only, deluxe trailer park on property described as located on the south end of Mountain View Street (south of Katella Avenue, east of Haster Street). The City Planning Commission, pursuant to their Resolution No. 50, Series 1959-60, granted said special use permi t, subje~t t9.;. 1. The development of the trailer park to conform to the plans presented. 2. Provide for drainage at southwesterly portion of development. 3. Prepare street improvement plans and install all improvements in accordance with approved standard plans in the office of the City Engineer, on Manchester Avenue. 4. Action was deferred by the City Council at their meeting of September 15, 1959, to this date, for the presentation of plans, indicating the proposed landscaping. Mr. Char les Frank, Authoriized Agent, presented plans showing the proposed landscaping, which plans were revie~d by the City Council and discussion held with Mr. Frank. Pursuant to the verbal agreement by Mr. Frank to pay to the Park and Recreation Fund the sum of $25.00 pe~ trailer space, and development and land- scaping in accordance with the plans presented, no further action was taken by the City Council, thereby sustaining the action taken by the City Planning Commission. _VARIANCE NO. 1144: Submi tted by Dew;o s Acreage, requesting permission to install two electric signs at 218 Brookhurst Street (east side of Brookhurst Street, between Lincoln Avenue and Broadway). The City Planning Commission, pursuant to their Resolution No. 47, Series 1959-60, granted said Variance, subject to conditions. Action was deferred by the City Council at their meeting of September 15, 1959, to this date, for further information regarding the proposed signs. Communication dated September 21, 19~9 from Dowis Superette was submitted and read, advising of the type of signs proposed and the locations thereof. Mr. Louis El1owitt, representing Mr. Dow, addressed the Council, ad- vIsIng that the sketch and informati9n submitted to the City Planning Commission we~ incorrect and did not place the proposed signs at the proper angle, that the signs would not be parallel to the street. Councilman Coons moved that due to the discrepancy in the plans, that said matter be scheduled for,review ~efore the City Council, October 13, 1959, 7:00 P.M. and that a full report and plans, showing size and location of said signs, be submitted. CONTINUED PUBLIC HEARING - PROPOSED ABANDONMENT: Public hearing was scheduled pursuant to Ordinance No. l371, and notices posted August 31, 1959, on the proposed vacation and abandonment of a portion of an easement for public utility purposes (Dowis Acreage). Public hearing was continued from the meetings of September 1st, 8th, and 15th, 1959. The Mayor asked if anyone wished to address the Council. Mr. Louis Ellowitt, representing DowIs Acreage, addressed the Council, advising that when the deed was submitted to them by the Title Company, they found that they would actually require an abandonment of 2 :eet 7 inches, instead of only 2 feet as it states in the ordinance and as they had been originally advised. Upon the request of Mr. Turner, Mr. Ellowitt stated he would furnish the City Attorneyis office a correct description. On the recommendations of the City Attorney, Councilman Fry moved that public hearing on said proposed abandonment be continued for one week (September 29, 1959). Councilman Pearson seconded the motion. MOTION CARRIED. PROPOSED R-3_STANDARDS - CITY PLANNING COMMISSION RECOMMENDATIONS: Excerpts of the City Planning Commission meeting held September 21, 1959, were submitted and read, advising that recommendations regarding proposed R-3 standards have been held over to the meeting of September 28, 1959, and further, pursuant to their Resolution No. 59, Series 1959-60, recommended the adoption of the Interim Ordinance establishing R-3 standards, in its present form, but that leniency be granted to those with just cause. Said recommendations of the City Planning Commission relative to R-3 standards and Interim Ordinance were ordered received and filed, on motion by Councilman Coons, seconded by Councilman Fry. Discussion was held between the City Council and the City Attorney, and it was determined that rather than stipulate any certain date in the ordinance establishing whether or not R-3 developments would come under the provision of the new ordinance or the old ordinance, that each case will be referred to the City Attorney for his determination whether or not a substantial change in their position has been made that would entitle them to proceed under the provisions of the old ordinance. Councilman Coons moved that the Building Inspector be authorized to issue permits under the provisions of the old ordinance in all cases where he is so advised by the City Attorney. Councilman Pearson seconded the motion. MOTION CARRIED. Councilman Coons offered Ordinance No. 1390 and moved for its passage and adoption. Refer to Ordinance Book, page AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING ARTICLE IX, CHAPTER 2, SECTION 9200.7 OF THE ANAHEIM MUNICIPAL CODE, AND DECLARING THE URGENCY THEREOF. The effective date of urgency Ordinance No. 1390 being September 15, REOUEST - TOWING SERVICE: Communication dated September 17, 1959 from Mr. Harold Jacobs, McCoy Motor Company Service Department, regarding 24-hour towing service, was submitted. Mr. Jacobs addressed the Council, offering 24-hour towing service, explaining that equipment and men are available and can be reached at all times, and further requested that calls from the Police Department for towing service be on a rotating basis. Councilman Pearson moved that the matter be referred to the City Manager for investigation and report. Councilman Fry seconded the motion. MOTION CARRIED. .RECLASSIFICATION NO. F-59-60-14: Request of Mr. Charles B. Frank for recon- sideration of Reclassification No. F-59-60-14 in accordance with new, revised plot plans, said reclassification submitted by Kathryn Zimmerman, requesting C-l and C-3 zoning on property located at 1720 West Orange Avenue, having been denied by the City Council pursuant to Resolution No. 5487, was submitted and read. Mr. Frank presented revised plans and explained said plans to the Council and discussion was held. The City Clerk reported that she had received a telephone call from Mrs. Wayne Reedstrum, requesting return of the chart showing pictures of residences and commercial developments, submitted by Mr. Reedstrum at the meeting of September 15, 1959. Councilman Fry seconded the motion. MOTION UNANIMOUSLY CARRIED. TRACT NO. 3501: Communication dated September 1, 1959 from Alex C. Horowitz, requesting the establishment of a fence for the protection of his property at 6741 Cerritos Avenue, being a portion of the st- of the SEt of the NEt, Section 22, Township 4, Range 11, and enterp~ise, being a dichondra seed farm, was submitted and read. Discussion was held and the City Council was of the oplnlon that this was a reasonable request, and thereuwon, Councilman Pearson moved that the developer of Tract No. 350l be required to erect a chain link fence, separating the portion of the Horowitz property adjacent to the tract, for the protection of the dichondra farm, this improvement to be required as a part of the tract improvements and to be included in the improvement bond. Councilman Fry seconded the motion. MOTION CARRIED. FINAL ~.~ TRACT NO. 3095: Subdivider, Charles Laraway. Tract located on the north side of Crescent Avenue, west of Euclid Avenue, and contains 32 R-3 lots. Mr. Piersall reported that the final map was substantially the same as the tentative map previously approved, that necessary fees have been paid and agreement for deposit in escrow for improvements has been executed, and subject to the approval by the City Attorney of the deeds from H. K. Wilson and Broadway Village of Anaheim, recommended the acceptance of said map. Final map, Tract No. 3095, was approved by the City Council, on the recommendations of the City Engineer, subject to the approval by the City Attorney of said deeds" on motion by Councilman Cbons, seconded by Councilman Fry. It was noted that conditions of the R-3 zoning, pursuant to Resolution of Intent No. 4569, .Reclassification No. F-57-58-49 (Tract No. 3095) have not yet been complied with. PURCHASE; Mr. Murdoch reported on informal bids received for the purchase and installation of a public address system for La Palma Park, as follows, and re- commended the acceptance of the low bid, that of California Sound ($2,736.83) with the stipulation that the Altec Company review the specifications and the bid with the supplier and the Park Director before the actual issuance of the order. AWARD OF ~ONTRACT - WORK ORDER NO. 1708: At the request of the City Engineer, Councilman Coons moved that award of contract, Work Order No. 1708, be held over for one week (September 29, 1959) due to conditions resulting from the steel strike. Councilman Fry seconded the motion. MOTION CARRIED. RESOLUTION NO. 5512: Councilman Pearson offered Resolution No. 5512 and moved for its passage and adoption. KATELLA pARK ANNEXATION - CANVASS OF ELECTION RETURNS: Mayor Schutte appointed Councilman Fry, Inspector, Councilman Pearson, Judge, and Councilman Coons and Councilman Thompson, Clerks, for the purpose of canvassing the returns of votes sast at the Special Election held September 15, 1959, for the annexation of territory to the City of Anaheim, known and designated as the Kaiella-Park Annexation, and also for the purpose of canvassing the returns of absent voters ballots. The Tally List and semi-official returns were compared by the Canvassing Board and found to have been reported correctly. The Canvassing Board then proceeded to canvass the absent voters ballots. The City Clerk reported that two absentee ballots had been issued, ~nd the canvass proceeded according to law. Anaheim, California - COUNCIL MINUTES - September 22, 1959. 7:00 PaM, _RESIGNATION :- CITY PLANNING COMMISSION: Resignation of Joe R. Thompson as Member of the City Planning Commission, was submitted. Councilman Coons moved that Mr. Thompson's resignation be accepted~ and that the Mayor write a letter of commendation to Mr. Thompson, expressing the Council's gratitude for his years of service as Member of the City Planning Commission. Councilman Pearson seconded the motion. MOTION CARRIED. RECLASSIFICATION NO. F-58-59-120; C-l zoning, south side of Broadway, between South Claudina and South Philadelphia Streets. Mr. R. L. Coons addressed the Council, requesting elimination of Items 2 and 4 of the standard C-l deed restrictions required to be filed in Reclassification No. F-58-59-120 pursuant to Resolution of Intent No. 54l7, and explained his reasons therefor. On the recommendations of the City Manager, Councilman Pearson moved that Item No.2 and Item No.4 of the standard C-l deed restrictions required to be filed in Reclassification No. F-58-59-120, be eliminated. Councilman Fry seconded the motion. MOTION CARRIED. (Councilman Coons abstained from voting in the foregoing action.) VARIANCE NO. 630 - LINBROOK HARDWARE: Several members of the Lincoln Park Civi.c Association were present, objecting to the buildings presently being constructed by LinBrook Hardware, pursuant to Variance No. 630, and Mrs. Chavos addressed the Council requesting public review of said buildings to assure good con- struction and architecture, and further requesting the construction of a wall~ Discussion was held by the City Council and the City Attorney, and it was their opinion that the building permits issued were within the provisions of Variance No. 630, and no further action was taken.
