Mayor Schutte called the meeting to order.
_MINUTES: Minutes of the adjourned regular meeting held October 20, 1959 were
approved on motion by Councilman Coons, seconded by Councilman Fry. MOTION
CARRIED.
CONTINUED PUBLIC HEARING - RECLASSIFICATION NO. F-59-60-l8; Submitted by
Keystone Savings and Loan Association (Arthur H. Shipkey, Sr., Authorized
Agent), requesting C-l zoning on property located on the west side of Palm
Street, between South and Vermont Streets.
Public hearing was continued from the meetings held October 13, 1959
and October 27, 1959, to this date.
The City Planning Commission, pursuant to their Resolution No. 53,
Series 1959-60, recommended said reclassification, subject to the following
conditions:
1. That standard C-l deed restrictions of the City of Anaheim approved
by the City Attorney, limiting the uses to a Masonic Temple and Business and
Professional Offices.
2. That plans for development, more complete, be submitted to the
City Council for review.
3. Install sidewalks on Palm Street.
4. That there be a payment of $2.00 per front foot for street lighting.
5. That a 90-day time limit be set for accomplishment of the above
conditions.
The Mavor asked if anyone wished to address the Council.
Mr. Arthur Shipkey addressed the Council and presented two proposed
plans of developmento One showing the street of the tract to the west ending
in a cul-de-sac, the other showing a joint street extending easterly to the
proposed commercial property to Palm Street.
Both plans were reviewed and discussed by the City Council, Mr. Jim
Morris, member of the Masonic Temple Association, Mr. Shipkey,and others who
were present and interested in this matter.
Traffic problems and parking regulations were considered and it was
determined that for the proposed 30,000 square foot building, 63,000 square foot
parking area would be adequate, and that the plan indicating the joint street
to be dedicated and improved by the Masonic Temple Association and the Mattis
Estate, extending easterly to Palm Street, would be of mutual benefit considering
the parking requirements for the Masonic Temple and the saving to the Mattis
Estate of a half street, in addition to the possible development of their property
as one unit.
It was further determined that the street would be dedicated at this
time and improvements deferred until time of development.
Terms of the street agreement entered into by the Mattis Estate
were explained by Mr. Turner.
Considerable discussion was held regarding this application for
rezoning, the proposed R-3 tract to the west,,~ the other R-3 developments
presently in the area and proposed for future development, at the conclusion
of which, the Mayor declared the hearing closed,

Councilman Coons moved that Revised Tentative Map, Tract Noo 3492, be
approved, with the stipulation that the north-south street shown on the revised
tentative map, &hall run southerly from "Aft instead of northerly, and further
subject to the following:
lo That sufficient dedi~ation be provided from the easterly boundary
of Tract No~ 3492 to the easterly boundary of Tract Noo 1886, to provide for a
full street, and from the easterly boundary of Tract Noo l886 to Palm Street, be
dedicated to provide for a half width street.
20 That lots Nos" 10 and II be considered interior lots, necessitating
minimum of 72 foot frontages and normal side yard setback requirementso

Resolution No. 5596 and moved for its passage and adoption, authorizing the
preparation of necessary Ordinance, changing the zone as requested, subject to
the recommendations of the City Planning Commission, and further subject to the
following:
10 Dedication of 34075 feet from the centerline of Palm Street for
future street wideningo
20 Sufficient dedication be provided from the easterly boundary of
Tract No. 3492 to the easterly bouodary of Tract Noo 1886 to provide for a full
street, and from the easterly boundary of Tract No. 1886 to Palm Street to be
dedicated to provide for a half width street.
30 That street improvement plans and street improvements, in accordance
with Plan No. 1000, be applicable at the time of development of the property.

perty located at 1590 West Ball Road (south side of Ball Road, between Euclid
Avenue and Walnut Street)o
The Ci ty Planning Commission, pursuant to their Reso lution No. 27,
Series 1959-60, granted said Special Use Permit, subject to the following
conditions:
1. That the City Council set this Special Use Permit No. 45 for review
in order that the Church present plans and elevations of proposed additions.
2. That a dedication to the City of Anaheim of 53 feet be made from
the centerline of Ball Road.
30 Prepare street improvement plans and install all improvements in
accordance with standard approved plans on file in the office of the City Engineero
4. The payment of $2.00 a front foot far street lighting purposes.

Mro McDaniel addressed the Council, urging the granting of the
reclassification and advising, that in his opinion, this was the highest and best
use of the propertyo
Mro Leon Saul addressed the Council in opposition to the rezoning, be-
cause of increased traffic and decreased property valueso
Mro Ted Hudson, owner of apartment project across from the property
under consideration, addressed the Council, advising he had no objection to the
R-3 nor the R-I, however, felt that too much area was designated for C-l use,
and requested to see plans of the commercial developmento
Mro John Anderson~ owner of property directly across from the subject
property on Crescent Avenue, addressed the Council, favoring the rezoning as
long as the structures are kept to single storyo
Mro Herbert Oberst, 519 Harcourt Street, addressed the Council in
opposition to the reclassificationo
Mro Marvin Witt, 2571 Crescent Avenue, addressed the Council, favoring
the rezoningo In his opinion, if the golf course was established at this location,
it would off-set anything that might be constructedo He also felt that a
commercial area would be advantageous to the territoryo
Mro Peter Giovannoni, representing Mro Lugaro, explained the proposed
C-l, and advised that no definite plans were prepared at this timeo

Mro Fred Dorsch. resident to the east of the subject property, felt
there was no assurance that the units would be one story units and without
definite plans requested a buffer R-l zone between them and the R-3 and C-l
developmento
Mro Hugh Miller9 515 Harcourt, questioned whether the commercial
property would increase the value of their residential property, and was of
the qpinion that after a few years~ apartment areas become run down and
unsightlyo
Mro McDaniel called attention to the architectural control of the
City of Anaheim and necessary deed restrictions that would be a protection to
the adjacent areas" He also advised that a considerable hardship would result
if a complete set of development plans was made mandatory, especially when
the owner proposes to sell the unimproved lots to other builders to developo
He explained that Mro Lugaro proposes to improve certain commercial lots with
his own funds in order to establish h~s children in businesso

The Mayor declared Resolution Noo 5599 duly passed and adopteda
RECLASSIFICATION NOo F~59'-60-20: Submitted by Clearbrook Lane Corporationo Said
reclassification was brought before the City Council due to the fact that plans
submitted to the Building Department did not correspond with plans approved by
the City Council, and also, the Resolution of Intention Noo 5555 prohibits
vehicular access to the four lots from Colony Streeto
Mro Worthen, representing Clearbrook Lane Corporation, presented the
new plans, which were compared by the City Council with the original plans filed.
He advised that the Architectural Control Committee recommended the erection of
an ornamental wall at the property line, with possibly four gates for the
screening of the store trash, etco, from the apartment projecto
Mr~ George Buccola advised that they propose to build apartments in
matching pairs facing onto a courtsite; that none of the buildings were planned

request for waiver of $2000 per front foot street lighting charge be denied.

REFUND: Refund in the amount of $250000 to Clarence Mauerhan, 810 West Katella
Avenue, Anaheim, Celifornia, representing fees paid for street trees for
Tract Noo 3290, was authorized on the recommendations of the City Manager, on
motion by Councilman Fry, seconded by Councilman Coonso MOTION CARRIED.
BEQUEST - BUS SERVICE: Request of Anaheim Chamber of Commerce to retain the
services of Mro William Farrel to make survey relative to the establishment of
an adequate bus system for Anaheim, was submitted and read.
Councilman Coons moved that the City Manager be authorized and re-
quested to contact Mro Farrel for further negotiations. Councilman Schutte

CORRESPONDENCE - ANAHEIM CHAMBER OF COMMERCE - PROPERTY FOR PUBLIC PURPOSES:
Correspondence from the Anaheim Chamber of Commerce, dated October 21, 1959,
was submitted and read, recommending that the City Council take necessary steps
to proceed with condemnation proceedings on such land that is necessary for
public purposes in the area north of Los Angeles Street, west of Lemon Street,
in the area of the Anaheim-Fullerton Municipal Courto
It was moved by Councilman Fry, seconded by Councilman Pearson,
that said correspondence be received and filed9 and that action continue along

YARIANCE NOo 1151: Submitted by Robertson Investment Corporation, requesting
less than 70 foot frontages, Lots 8 and 9, minimum of 7000 square foot lot areas

LA PALMA PARK - CHARGES - SERVIITE HIGH SCHOOL! Mro Muroo ch reported that
Servite High School has schedu]ed a football game this Thursday afternoon,
November 5, 1959, at La Palma Bark, and has requ8sted a reduction in fees
charged for use of the facilitieso He further outlined the minimum direct
labor costs to the City in providing these facilities, being between $103
and $l12, which amount does not include use of equipment or maintenance of
the field, and does not include Workmanus Compensation Insurance nor
administrative costso
Based on the in formaition g1 ven by the City Manager regarding the
direct labor costs involved, Councilman Fry moved that a charge of $125000
per day-light game be made to Servite High School, this charge to be made
retroactive to previous day games played, and further, in the event said games
run into overtime and lights are required, a charge for the lights and also
overtime labor after 5:00 PoMo, will be made in addition to the $125000.
Councilman Thompson seconded the motiono To this motion Councilman Coons
voted "no"" MOTION CARRIED.
