AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING
CHAPTER 3.32 OF TITLE 3 AND CHAPTER 4.52 OF TITLE 4 OF
THE ANAHEIM MUNICIPAL CODE RELATING TO PEDDLERS
AND SOLICITORS
WHEREAS, Chapter 3.32 of Title 3 of the Anaheim Municipal Code requires peddlers to
obtain a business license from the City of Anaheim to conduct such business within the City; and
WHEREAS, Chapter 4.52 of Title 4 of the Anaheim Municipal Code requires peddlers and
solicitors to obtain a regulatory permit to engage in peddling or soliciting the sale of commercial
goods and services either door to door or on public property; and
WHEREAS, the present definition of peddler or solicitor as used in the aforesaid provisions
does not clearly identify those persons engaged in commercial solicitation who are subject to those
provisions; and
WHEREAS, the City Council desires to amend said provisions to clarify and identify those
persons to whom the provisions of Chapter 3.32 and Chapter 4.52 apply.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES
ORDAIN AS FOLLOWS:
SECTION 1.
That subsection .010 of Section 3.32.060 of Chapter 3.32 of Title 3 of the Anaheim
Municipal is hereby amended in its entirety to read as follows:
".010 Every person, whether or not a resident of the City of Anaheim, traveling by foot,
vehicle, or other type of conveyance, from place to place or from door to door or at any temporary,
stationary location on public property, and carrying, displaying, conveying, transporting or offering
for sale any goods, wares, merchandise, fresh or frozen food products, fruit, farm produce or any
services, or making sales and delivering articles thus sold to a purchaser thereof shall pay the
following license taxes:
(1) Fifty dollars per year unless the person or persons, firm or corporation for whom he or
she is peddling has a valid principal's, solicitor's or peddler's license as hereinafter provided in this
Chapter.
(2) Ten dollars per year if the person or persons, firm or corporation for whom he or she
is peddling has a valid principal's, solicitor's, or peddler's license as provided in this Chapter."
SECTION 2.
That Section 4.52.0 10 of Chapter 4.52 of Title 4 of the Anaheim Municipal Code is hereby
amended in its entirety to read as follows:
"4.52.010 SOLICITOR'S PERMIT REQUIRED
Every person, whether or not a resident of the City of Anaheim, traveling by foot,
vehicle, or other type of conveyance, from place to place or from door to door or at any temporary,
stationary location on public property, and carrying, displaying, conveying, transporting or offering
for sale any goods, wares, merchandise, fresh or frozen food products, fruit, farm produce or any
services, or making sales and delivering articles thus sold to a purchaser thereof, is a solicitor. No
person not otherwise excepted by law shall engage in the business of being a solicitor without first
obtaining a permit therefor."
SECTION 3. EFFECTIVE DATE
This ordinance shall take effect thirty (30) days from and after the date of its adoption.
SECTION 4. SEVERABILITY
The City Council of the City of Anaheim hereby declares that should any section,
paragraph, sentence or word of this ordinance or of the Code hereby adopted be declared for any
reason to be invalid, it is the intent of the Council that it would have passed all other portions of the
ordinance independent of the elimination of any such portion as may be declared to be invalid.
THE FOREGOING ORDINANCE is approved and adopted by the City Council of
the City of Anaheim this 16tliday of November , 2004, by the following roll -call vote:

ucts, fruit, farm produce or any, or making sales and deliv-
ering articles thus sold to a purchaser thereof, is a solicitor.
No parson not otherwise excepted by law shall engage in
the business of being a solicitor without first obtaining a per-
mit therefor.
SECTION 3: EFFECTIVE DATE
