MINUTES: Minutes of the regular meeting held November 24, 1959, were approved,
on motion by Councilman Coons, seconded by Councilman Fry, with the following
addition to the last item, page 3770, with reference to City Owned Parking Lots -
All Day Parking: "That the meters shall be installed on the lot east of
the Telephone Company (north side of Chartres Street) and on, not to exceed,
one-half of the lot at the rear of the Robert Ho Boney garage, and on the lot
by the Arnheim Bulletin; the numbers of meters installed to be at the
di scretion 0 f the Ci ty Manager'1.) MOTION CARRIED.
CONTINUED PUBLIC HEARING - RECLASSIFICATION NO. F-59-60-27: Submitted by
Giacomo Lugaro (A. Ro McDaniel, Authorized Agent) requesting change of zone
from R-A to R-3, Lots 1 to 19, and change of zone from R-A to C-l, Lots 20 to
29, Tentative Map, Tract No~ 33650 Property located at the southeast corner
of Crescent and Magnolia ~venueso
The City Planning Commission, pursuant to their Resolution Noo 66,
Series 1959-60, recommended said reclassification be denied.
Public hearing was continued from the meeting of November 3, 1959, in
order to allow time for the Planning Department to prepare a detailed study of
the a rea 0
Correspondence dated November 17, 1959 from Robert Go North, protesting
said reclassification, was receivedo (Copies of said letter were furnished
each Councilman.)
The Mayor asked if anyone wished to address the Councilo
Mr. Ao R. McDaniel, authorized representative of the Applicant,
addressed the Council, asking if the land study had been made, and also
presenting Mr. Giovannoni, who submitted an artist9s rendering of the proposed
development.
Mro Giovannoni explained that professional buildings would be built
on the south end of the development; on the east end would be single story
multiples, and the ones adjoining the C-l area were planned for two story
construction"
Said rendering and tentative map were reviewed by the City Councilo
Mr" Fred Dorsch, resident in the area, addressed the Council, pre-
senting a copy of Mre North's letter, co~aining signatures of 48 other home-
owners in the area, in opposition to the reclassification"
Mr. Anderson, resident across thestreet from the proposed development,
addressed the Council, presenting a petition of approval containing 15 signatureso
Mr. John Ryan, 526 Harcourt, addressed the Council and reviewed past
action taken on this property" He advised that their tract had been occupied
approximately 6 months, and suggested that the application be deniedo
Mr. Ted Hudson, owner of R-3 development across the street from subject
property, favored the R-3 zoning, but requested more definite plans for the
commercial parcels.
Mr. Leon SaIl, 527 North Harcourt, referred to a portion of the
letter filed with the application, written to the City Council, regarding City

purchase. In his opinion, the purchase of the golf course property was the
hinge on which the request for reclassification was based.
Mr. Herbert Oberst, 515 Harcourt Street, addressed the Council in
opposition to the reclassification, and referred to the general comprehensive
master pIano
Mrs Thomas Eo Hubbard, 542 North Harcourt, addressed the Council in
opposition to any R-3 reclassification, due to the over-loading of schools and
possibility of double sessions.

Mr. A. R. McDaniel, in rebuttal, questioned whether R-3 and commercial
would add more children to the school load than an R-l development. Regarding
the comprehensive plan, he advised this plan had never been officially adopted.
Regarding remarks pertaining to the letter filed with the application, this
letter was written because if the sale was made at slightly over 50% of the
going land prices in the area, Mr. Lugaro could no longer support his family
on the balance of the land by raising flowers 0 Regarding the south portion
of the property, they were prepared to make it a condition of rezoning, that
any property south of the short stub street be developed as professional
offices only. He further advised that this request was based on their sincere
opinion that this zone offers the very best and highest use for this particular
property; that they were prepared to comply with all requirements of the new
R-3 zoning, and also prepared to sell that portion of the property to the City
at the price that was offered.
Mro Sall stated it was his intention to show that the portion of the
property that the City may be interested in for a golf course, is only a
proposal, and therefore, felt the request should be denied.
Mro Bill Atkinson, resident on Harcourt, referred to the over building
of R-3 in the City of Anaheim, and stated that if the City did purchase the
property from Mr. Lugaro, making it no longer possible to grow flowers at this
location, he could acquire additional propertyo He further advised, property
owners on Harcourt Street did not want R-3.

Mro Robert North, resident on Harcourt Street, felt there was nothing
binding the development in accordance to the renderings submitted.
It was moved by Councilman Pearson, seconded by Councilman Coons that
the hearing be closed.
The Mayor declared the hearing closed.
Mr. Murdoch outlined, briefly, the detailed study of the area as prepared
by the Planning Department.
RESOLUTION NO. 5655: Councilman Pearson offered Resolution No. 5655 and moved
for its passage andadoption, sustaining action taken by the City Planning

Mr. A. R. McDaniel requested to withdraw said tentative map,
Tract No. 3365.
Councilman Coons moved that the Applicant-~s request to withdraw
Tentative Tract No. 3365, be granted. Councilman Fry seconded the motion.
MOTION CARRIED.
PUBLIC HEARING - RECLASSIFICATION NO. F-59-60-25: Submitted by Albert Hemler,
requesting change of zone from R-A to C-l, property described as being on the
east side of Euclid Avenue, between Cerritos and Palm Lane, and further described
as 1472 South Euclid Avenue.
The City Planning Commission, pursuant to their Resolution No. 88,
Series 1959-60, forwarded said application to the City Council without re-
commendation, since a two-thirds majority vote had not been obtained within
the 40 day period as provided for in the Amheim Municipal Code.
The Mayor asked if anyone wished to address the Council.
Mr. Hemler addressed the Council, urging the granting of the re-
classification. He advised that he had an opportunity to sell the property to
people who plan to establish a beauty parlor at this locationo Due to the
grade of the street and the difficulty encountered in getting in and out of
the property, he requested the rezoning be granted so that the sale of the
property can be consummated.
The plot plan was reviewed by the City Councilo
Mr. Andrew Go Ungrath, 1460 SOo Euclid Avenue, addressed the Council,
favoring the reclassification, and also calling attention to the grade of the
street.
Mr. Piersall advised that the lowering of the street was necessary
to drain other properties in the area, and the street work, at this time, had
not been completed.
The Mayor asked if anyone else wished to address the Council, there
being no response, declared the hearing closed.
Discussion by the City Council resumed and consideration was given
to limited zoning in the immediate vicinity.
Mr. Hemler further advised that he would be willing to stipulate by
deed restrictions, that the property be used only for a beauty parloro
The procedure, placing deed restrictions on a parcel of property by
an owner, was explained in detail to Mro Hemler.
RESOLUTION NO. 5656: Councilman Coons offered Resolution No. 5656 and moved
for its passage and adoption, authorizing the preparation of necessary
ordinance, changing the zone, as requested, subject to the filing of deed
restrictions, limiting the use of the property to beauty parlor and any other
uses shown in the proposed C-7 zone, and further subject to;
1. Installation of full improvements on both streets abutting the
property.
2. The payment of $2eOO per front foot for street lighting purposeso
3. A 90 day time limit to comply with said conditions.

PUBLIC HEARING - RECLASSIFICATION. NO. F-59-60-35: Submitted by Nicholas J.
Dovalis, requesting change of zone from R-A to C-2, property located on the west
side of Knott Avenue, between Ball Road and Cerritos Avenue, ~OO feet north of
Cerritos Avenue.
The City Planning Commission, pursuant to their Resolution No. 89,
Series 1959-60, recommended said reclassification, subject to the following
conditions:
1. The plans as presented with the addition of 8 fta to be added to
access ways behind buildings.
2. Ten feet of landscaping across front of property as provided in
proposed zoning ordinance.
3. Dedicate 53 feet on Knott Avenueo
4. Prepare street improvement plans and install all improvements in
accordance with approved standard plans on file in office of City Engineer.
5. Payment of $2000 per front foot for street lighting purposes.
6. 90 day time limit.
The Mayor asked if anyone wished to address the Council.
Mr. Nicholas J. Dovalis, 9281 Harriette Lane, presented proposed plans
of development, which indicated service-type businesses. He explained that
the property located to the south was in the City of Stanton and zoned commercial.

Plot plan was reviewed by the City Council.
Mr. Murdoch explained that the property to the south, which is in the
City of Stanton, was that parcel of property retained by the owner and excluded
from the tentative map of the Standard Development Company.
Mr. Turner advised that after checking the file, there appears to
be an error in t he description of the property conta ined in the published legal
notice of hearing; that the notice did not describe the property sought to be
changedo
Councilman Coons moved this hearing be continued for a period of two
weeks to determine if the proceedings were legally advertisedo Councilman
Thompson seconded the motion. (No vote)o
Cou~ ilman Coons moved to withdraw his original motion, and moved to
refer the matter back to the City Planning Commission for proper advertising
and public hearing, and further, if the error is determined to be on the part
of the City, that an additional filing fee will not be required. Councilman
Pearson seconded the motion. MOTION CARRIED.
PUBLIC HEARING - RECLASSIFICATION NO. F-59-60-40: Submitted by Torn and Louise
Simon, requesting change of zone from R-A to R-3, property located on the south-
west corner of Romneya Drive and West Street (proposed Tentative Tract No. 3635)0
The City Planning Commission, pursuant to their Resolution NOG 92,
Series 1959-60, recommended said reclassification, subject to the following
conditions:
1. Dedicate 32 feet on Romneya and West Streets.
2. Prepare street improvement plans and install all improvements in
accordance with approved standard plans on file in office of City Engineer, on
both streets.
3. Payment of $2.00 per front foot for street lighting purposes on both
streets.

Petition of protest containing 76 signatures, and outlining their
reasons therefor, was presented.
The Mayor asked if anyone wished to address the C ouncilo
Mr. Morningstar, Attorney representing the Applicant, addressed the
Council and explained that the map referred to was a land study only, that the
tentative map will be before the City Council at a later dateo He outlined
other R-3 developments in the immediate area and advised that this same re-
classification was approved 3t years ago, known then as the Romneya West
Annexationo The previous reclassification was R-3 zoning, subject to the
property owners filing deed restrictions, and that at that time, no one had
any plans for the area, and no one filed the required R-3 deed restrictionso
He referred to each item listed on the petition of protest, and further
advised, that this was not an area that would attract nice residential homes,
but was ideal for apartment dwellings, and inasmuch as it was previously
granted R-3 zoning, requested the approval of this application.
Those addressing the Council in opposition were:
Ao David Lo Williams, 1231 West Romneya Drive, questioned the good
that apartments would do the Cityo
Bo Mrso Bob Campbell, 1303 West Romneya Drive, advised 18% of the
children at the Patrick Henry School presently came from apartment houses in
this area.
Co Kenneth Eo Athy, 1148 Lombard Drive, stated multiple dwellings
reduced property values and felt that they had more than their share of
apartmentso
Do George Gritton, 1158 Verona Street, opposed any kind of
multiple and stated the area was good for residential homeso
Eo Mrso Thomas Moore, 1227 Wo Romneya Drive, advised that the
apartment developments have no play area for children.
Mr. Morningstar further advised the Council that from information
obtained from the officials of the Patrick Henry School, 245 of their
children were from the homes in the area and 175 of the children were from
the apartments in the area, and that the areas were comparableo
Councilman Pearson moved that the hearing be closed, thereupon,
the Mayor declared the hearing closedo
RESOLUTION NOo 5657: Councilman Pearson offered Resolution Noo 5657 and
moved for its passage and adoption, denying reclassification No. F-59-60-40.

At the request of the City Attorney, public hearing was continued
one week for the purpose of further checking the description of the property
as published in the legal notice, on motion by Councilman Pearson~ seconded

Upon further check of the file, Mro Turner advised that in his
opinion, the legal as advertised, on this application was sufficient,
thereupon, Councilman Coons moved to rescind the action previously taken

safety devices, purportedly containing more than 2300 signatures, together
with a letter containing a resume of action previously taken regarding their
request for safety measures, was submittedo
Mro Avon Bo Carlson~ Principal of Brookhurst Junior High School,
addressed the Council, requesting~ first, a crossing guard before and after
school; that when the installation of the traffic signal has been completed,
the crossing guard would be releasedo Second3 requesting that the area used
as walkway for the students, be oi.led~ and, third, requesting a 25 mile speed
limit in front of the school" He referred to other businesses in the area
also interested in reduction of the speed limit fronting their locations, and
presented letters from U" So Borax Research Corporation, Beckman Systems
Division, Resistoflex Corporation and Melbourne Ao Gauer Parent Teacher

Mro Murdoch stated he did not have a complete report at this time,
3nd, therefore, could not give a firm recommendationo He advised that it has
been the policY3 however 9 both here and in most Calj.fornia cities9 not to
provide crossing guards for Junior High School or Senior High School students,
feeling that they were of an age to take care of themselveso However~ this
intersection and the high speed on Brookhurst may be good reason to revert
from that general ~01iGY0 Another problem is that none of these items have
been included in this year)s budget9 and the CityOs share of the cost of the
signal installation would be ~n the neighborhood of $10,0000000
Councilman Pearson moved that the matter be turned over to the

The City Clerk reported that a verbal request had been made for
the return of the petition, to the proponents9 in order that the same

CHEMICAL FUMIGATION: Mro Oudies, 2407 Crescent Avenue, addressed the Council,
advising that fumigation of a field at Crescent and Gilbert Avenues, which is
near their home, was being made by means of a chemical which is very annoying
and detrimental to them and their neighborsv He explained the effects of this
chemical and requested acti.on be taken to give them immediate reliefo
Councilman Pearson moved that this matter be turned over to the
City Attorney and City Manager with instructions to take care of the nuisance
if t is found there is onev Councilman Thompson seconded the motiono
Further discussion was held regarding the chemical used in this
fumigation, at the conclusion of which, it was moved by Councilman Pearson,
seconded by Councilman Coons that the Council request that the person applying
this chemical~ desist immediately until further investigation can be made, as
it Appears this chemical is highly detrimental to health of individuals living

permit from the City Council and to pay the existing li.cense fees stipulated

business or organization in the City of Arnheim9 either for promotional
advertising purposes or for a charitable or fund raising purpose, that these
permits be handled administratively and that the license fee be on a reduced
basis, possibly one-half of the fees stipulated in the Code for regular carnivalso
That rides, such as kiddy rides used in a shopping center or
charitable or fund raising promotion where no charge is made for these rides,
be licensed under the general licensing provisions of the City Codeo
That events that are purely a seasonal operation~ such as reindeer
exhibitions for Christmas time, be licensed on an annual basis or that the
exhibitor be permitted to pay a minimum fee for one appearance or showo
Mro Gene Tracy~ General Agent of the Paul Miller Wild Animal Shows,
addressed the Council, advising that they had entered into a contract to
show at the Brookhurst Shopping Centero He explalned their operations and
that the circus acts were put on several times daily and are free to the public;
that a charge is made, however, for the rideso He requested the Council to
issue necessary permit, so that business license can be obtained and their
show conunencedo
Mro Turner, City Attorney~ advised that this activity would require
a Special Use Permito
Mro Alex Tobin, Assistant City AttorneY3 advised that there was no
provlslon to deviate from Code requirements; that this request would require
City Planning Commission action as well as Council actiono In his opinion,
the only thing the City Council could do at this point, would be refuse the
permit, as he felt it could not be validly grantedo

Mro Murdoch advised that this is an Unclassified Use and requires
procedure similar to that of a Varianceo With this particular request, it
would be impossible to get the application before the City Planning Com-
mission to proceed with the showo
Mra Tracy further explained their activities, and advised that
they did not know that Council approval was required, nor that the application
had to be acted upon by the City Planning Commissiono He stated that they
were to open this date~ and didn~t, because it was called to their attention
that business licenses had to be obtainedo He appealed to the City Council
to grant the permit~ because, in his opinion, it was a promotional event for
the shopping centero
Dre William Fleischmann~ representing the Brookhurst MerchantQs
Association~ addressed the Counci19 urging the granting of the permit, and
stated that he felt this enterprise would benefit their businesseso
.BROADWAY SHOPPING CENTER ,~ A gentleman representing the Broadway
Shopping Center, addressed the Council, advising that they have taken one
of the unfinished buildings and brought in a few animals for the children
to sees at no charge to the publico
MURRAY MANOR ~ A gentleman from Murray Manor advised the Council
that they had contracted for three reindeer to be on display for the children9
also at no charge for the publicu
It was the opinion of Mru Turner and Mro Tobin, that these
animal exhibitions were not in violation of the Anaheim Municipal Code,
and would not be included in this type of licensing requiremento
A lady, advising that they were the owners of the restaurant at
Brookhurst Shopping Center9 addressed the Councilg urging the granting of
the permit to allow the Paul Miller Show~ stating that they would be moved
out by Sunday at 2~OO PoMo

that the City Council approve the animal act ShOWS9 that of the Broadway
Shopping Center and Murray Manor, as :it appears that they are in conformance

was very indefinite~ as it did not describe in exact terms~ the location of the
property proposed to be rezoned~ however~ if the Applicant wished to assume
this risk, and the Council approved the application9 it could be doneo
Mro McGaughy addressed the Council, advising he desired to assume
this risk, and presented a petition of approval containing seven signatures
