Public hearing was continued from the meeting of December 1, 1959,
to allow for further checking of the description of the property, as advertised ~
Mro Turner advised that the description of the property, as published,
was very indefinite~ as it did not describe in exact terms, the location of the
property proposed to be rezoned~ however~ if the Applicant wished to assume
this risk, and the Council approved the application~ it could be doneo
Mro McGaughy addressed the Council, advising he desired to assume
this risk, and presented a petition of approval containing seven signatures
of people to the north of the property under considerationo
The Mayor asked if anyone else wished to address the Council, there
being no response, declared the hearing closedo
After further discussion, it was moved by Councilman Fry, seconded
by Councilman Thompson, that action on this request be deferred two weeks,

Mro Turner advised that this was the same situation as the previous
application just acted upon (F-59-60-4l) with reference to the description of
the property as published9 that the descriptlon of the property did not9 in
definite terms, describe the locationu
Mru Russell JaY9 12835 Burbank Boulevard, North Hollywood, Applicant,
addressed the Council, presenting preliminary plot plans that were previously
considered0 He advised that they still intend to place four units (2 bedrooms
to each) on the lot 9 but in order to meet the new R=.o3 standards 9 it would be
necessary to revise these plans to go two=story constructiono He stated that
the preliminary plans were drawn prior to the enactment of the new ordinance
regulating R~3 development, and also advised that they did not wish to be held
to four units on every lot in the tract~ as some of the lots are much largero

The Mayor asked if anyone wished to address the Councilo
Mro Jo Edward Smith, representinQ the Pacific Telephone and Telegraph
Company, advised that, in his opinion, the letter sent to the City set forth
their intentionso
Mro Murdoch advised that the copies of the two letters referred to
from his office, outlined the parking requirements of the existing buildings
now occupied by the Telephone Company, and the parking requirements that
would be necessary for the propffied additiono
Dro Schutz, owner of property at the northeast corner of Clementine
and Cypress Streets, asked what assurance they would have that the proposed
alley running east and west, would not some day be abandonedo
Mayor Schutte replied. that an alley would not be closed without
a public hearing and justificationo
Dro Schutz stated the question of additional parking has been
clarified through the communicationo He asked if the Telephone Company had
presented plans showing what setbacks they would abide by and what landscaping
would be providedu In his opinion, to build to the sidewalk would place the
remainder of the property owners in this vicinity at a disadvantageo
Mro Murdoch answered that the plans submitted by the Telephone
Company are plot plans only, showing the proposed location of the building
in relation to the two other existing buildingso He advised that in commercial
zones, building out to the property line is allowableo He further advised
that the proposed building is indicated as taking place ~n two unitso
First, the south portion extends to the Chartres Street property line, allowing
for two lanes of parking between the west side of the building and Clementine
Street" Second, immediately north of the Chartres Street addition, would
extend the same alignment, still allowing for the parking of two rows of cars
(approximately 60 feet from Clementine Street~ taken from the property line)o
Mr,) Murdoch also advised that in discussion with the Telephone
Company, they were in favor of erecting a wall along the west side of the
parking area, which would be right along Clementine Street, and would be
a maximum of 42 inches in heighto That the plans do not indicate a wall,
and if one is required, it would neeessarily be an additional condition
imposed by the City Councilo
Dro Schutz asked how many employees would be in the new addition at
anyone timeo
Mro Smith answered, 73, and further explained that Building "AU
has 113 employees, and across the street there are 368 employees nowo With
the addition of 73, their total employees will number 5540 In answer to
Dro Schutzt inquiry with reference to parking, Mro Smith stated the five lots
would provide 61 spaces, and additional parking will be provided at other
locations, in accordance with their commitmento
Mro Gauer addressed the Council~ advising, he hoped that the area
would remain R~3o In his opinion, the additional building will increase
traffic on Clementine and Chartres Streetso He felt most careful consideration
should be given this, as this is the entrance to the City Parka He also felt
that specific plans of development should be submitted; that they should
protect the R-3 territory by meeting the R~3 setback requirement and the
construction of a wallo He referred to the Telephone Company~s communication
dated November 20, 1959, and felt these specific proposals should be a part
of the applicationo
Mro Bill Troutman, 251 Noo Lemon Street, addressed the Council,
objecting to the use of R-3 property for commercial purposes 0 He objected
to the turning of the alley as it affects deliveries to his establishment
by semi~trucks and trailerso He referred to the parking survey made and
submitted by them at the November 24, 1959 meeting, and presented photos

showing the parking situation in the areao He could not see the reason for
abandoning the alley for the pu~pose of building an additional building, and
wondered why the wires could not be placed underground or archedo
Mro Smith advised that precise plans have not yet been developed, as
construction is not proposed immediately, and further, money cannot be expended
on plans until assurance is obtained that they can build at this locationo
In answer to Mro TroutmanUs inquiry, he explained why the building had to be
continuous to install this long distance direct dialing system. He made
reference to the eommunications sent by the Telephone Company in an effort to
clarify their position and set out definite stipulations regarding developmento

Mro David Glassman, owner of property located at 149 Noo Lemon Street,
addressed the Council, objecting to the use of residential property for com=
mercial purposes and the establishment of a precedent in this areao He referred
to the proposed downtown parking district, which all owners in this area have
been requested by the Chamber of Commerce to participate ino He did not feel
it was fair to assess their property for a parking district that the Telephone
Company would be taking advantage ofo In his opinion, plans should have been
submitted before this project began, and the Telephone Company should locate
on commercial property where they could build as they pleaseo
The Mayor asked if anyone else wished to address the Council, there
being no response, declared the hearing closedo
Discussion resumed, and Mre Murdoch advised that the Telephone
Company agrees to and must meet the requirements of the zoning ordinance
relative to parking, for all three buildings before the new building is
utilizedo
Councilman Pearson stated that the primary problem in this particular
case was that of parking, more necessary, in his opinion, than a setback or
wall requirement, and wondered if a portion of the alley to be dedicated could
not also be utilized for parking purposes9 inasmuch as the existing alley is
15! feet wide and the proposed alley is to be 30 feet widee
This proposal met opposition from Dre Schutz who felt the alley
should be maintained for public useo
RESOLUTION NOo 5671: Councilman Pearson offered Resolution Noo 5671 and moved
for its passage and adoption, granting Variance Noo 1170, subject to the recom-
mendations of the City Planning Commission, and further subject to the followinga
10 Erection of a wall on the property line a maximum of 42 inches
in height, except for a stepdown adjacent to driveway and other openingso
20 Time limit of two years in which to commence development.
30 That the stipulations as set forth in the Pacific Telephone and
Telegraph Company letter dated December 3, 1959, regarding off-street parking,

Plot plan was presented and reviewed by the City Councilo
Mr@ Dave Collins questioned this request for a 10 foot planting
area, as adjacent property owners could not see below the wall, and
nothing would be added to the aesthetic values by thissrequiremento
Mro James Do Watters, 1464 Birchmont Drive, advised that the
principal of the 10 foot area would be to provide a sound barrier, as
against the parking of cars right up next to the fenceo He referred to
the adjacent building where this requirement was made a part of the
rezoning and stated that this has worked out satisfactorily, and in his
opinion, is a requirement that SDuld be imposed on the adjacent propertieso
Mro Bob Schafer, Applicant, addressed the Council advising that
with reference to the other building, he was of the opinion that the 10
foot planting requirement was because of their proposed location of the
buildingo As he remembered it~ they wished to place the building nearer
the fenceo

that he had talked to the people whose names appeared upon the petition of
protest filed at the time of the hearing by the City Planning Commission, and
to the best of his knowledge, they no longer were in oppositiono He felt
that the persons who had signed this petition had not been completely
familiar with their intentionsu
Mro Ro Wo Mungall advised that this is proposed to be an all day
parking loto

to the possibility of the removal of the two existing houses on the propertyo

SAFETY DEVICES - BROADWAY AND DALE: Mra Wynne Silver, Principal of the
Dro Albert Schweitzer School, addressed the Council, urging crosswalks and
crossing guards at the corner of Broadway and Dale; school pedestrian signs
at the corners of Orange and Dale, Academy and Dale, and Broadway and Dale;
boulevard stop signs at the corners of Benwood and Academy, and BelAir and
AcademYa Mra Silver presented a map, noting the corners in question in red,
and also designating the attendance areao He advised that there were no
sidewalks south of the school on Dale Avenue, or east of the school on
Broadwayo He called attention to the heavy traffic conditions and the
width of Dale Avenue at this locationo
Mro Silver]s request was referred to the City Manager and City
Engineer for further investigation and recommendationo
TRACT NOe 3396: Communication dated December 2, 1959 from Mr and Mrso
Ho Ro Hollywood, was submitted, requesting that provisions of Ordinance Noo
1390, Section 920007 of the Anaheim Municipal Code, be enforced, regarding
the requirement of a fence when R~3 use abuts single family residential
zoneo
Mro and Mrso Hollywood presented diagrams of the area, showing
the location of the proposed garages and driveways in relation to their
single family areao Mro Hollywood stated he felt Mro Turner, City Attorney,
did not have all the_facts when he authorized the removal of the fence

Mro Swentek, the developer, addressed the Council, advising it
was his understanding that the tract had been recorded under the provision
of the old R-3 requirements, and as he had made substantial financial
changes in his position, he would be allowed to develop under the former
provisions regulating R-3 developmentso
At the suggestion of Mro Murdoch, this matter was referred
back to Mro Turner for further investigation to determine if his ruling
should be changed, in view of evidence receivedo

1959 in Book 4695, page 37, and also property acquired pursuant to Resolution

changing the zone, as requested, subject to the recommendations of the City
Planning Commission, and further subject to limiting the C-3 use of the pro-
perty to a motel only, or any C-l use, when plans therefor are submitted to, and
approved by the City Council.
