TRACT NO. 3396: Request of Mr. and Mrs. Hollywood that provisions of Ordinance
No. 1390, Section 9200.7 be enforced to require a fence between R-l and R-3 property,
was submitted at the meeting of December 8, 1959. Action by the City Council was
deferred to this date for further investigation by Mr. Turner to determine if his
ruling should be changed in view of new evidence received.

Mre Turner reported, on the basis of previous information he had
received, he approved the issuance of the building permit, however, 'after
further investigation, checking dates on which certain actions were taken, it
appears that the only step taken prior to the adoption of the new R-3 zoning
ordinance was the signing of escrow agreement to purchase the property. All
other commi tments and matters occurred after the effective date of the ffi w
ordinanceo
Mro and Mrs. Hollywood addressed the Council, again presenting their
chart illustrating their reasons for the requested fence, and also referred to
the need of a retaining wall due to the fact that the grade of the adjoining
tract is approximately 18 inches lower than their property.
Mro McDougall, Assistant City Engineer, explained the City~s positio~
regarding this requiremento
After further discussion, it was determined by the Ci ty Courc il that
the building permit was issued on insufficient information presented by the
Applicant, and in view of the information obtained as result of further
investigation, it appeared that the Applicant had not changed his position
substantially, and that the provisions of the new R-3 Ordinance should apply,
thereupon, Councilman Pearson moved that the Builder be required to construct
a six foot wall in accordance with the present ordinancee Councilman Coons
seconded the motiono MOTION CARRIED.

VARIANCE NO. 1021: Detailed pians of proposed motel to be known as the
Charterhouse, were submitted by Mro Leo Freedman, and compared by the City
Council with the original plans filedo It was noted that the plans differed,
inasmuch as parking was shown in the 20 foot area designated for landscapingo
It was determined by the City Council that this 20 foot landscaping
area should be maintained as shown on the original planso
This Variance would have normally expired February 28, 1959, and
resulting from reports made on the progress of this development, Councilman
Coons moved that it be the finoing of the City Council that substantial work
was done on this Application prior to February 28, 1959, that the revisions
have been made at the request of the City, which has delayed the starting of
the projecto Councilman Fry s~conded the motiono MOTION CARRIED.
Councilman Pearson moved that the plans as presented be approved,
with the exception of the one tier of parking, which is to be a landscaped
area as originally agreed too Councilman Coons seconded the motiono MOTION
