VARIANCE NO. 1021: Detailed plans of proposed motel to be known as the
Charterhouse, were submitted by Mro Leo Freedman, and compared by the City
Council with the original plans filedo It was noted that the plans differed,
inasmuch as parking was shown in the 20 foot area designated for landscapingo
It was determined by the City Council that this 20 foot landscaping
area should be maintained as shown on the original planso

This Variance would have normally expired February 28, 1959, and
resulting from reports made on the progress of this development, Councilman
Coons moved that it be the finding of the City Council that substantial work
was done on this Application prior to February 28, 1959, that the revisions
have been made at the request of the City, which has delayed the starting of
the projecto Councilman Fry seconded the motiono MOTION CARRIED.
Councilman Pearson moved that the plans as presented. be approved,
with the exception of the one tier of parking, which is to be a landscaped
area as originally agreed too Councilman Coons seconded the motiono MOTION

Petition of protest containing 10 signatures of residents in the
2100 block on West Ball Road~ was submittedo
Correspondence dated December 29, 1959 from Father Hugh OGConnor,
Pastor'} Sto Justin Martyr Church, was submitted and read~ protesting the
granting of the special use permit3 and stating his reasons therefore
Plot plan of proposed hospital~ together with pictures of similar
hospitals, were submitted and reviewed by the City Councilo
The Mayor asked if anyone wished to address the Councilo
Mru Harry Knisely, Attorney representing the Applicant, was presento
Mro George Harris, Attorney representing Mro and Mrso Liptak,
Donald Frank, Harlan Eakens and Billy Jones~ was present and addressed the
Council in opposition to the granting of the special use permito He advised
that this operation was intended to be an animal hospital, not a clinic for
out patient treatment" He referred to the noise resulting from such an
operation, the possibility of bringing in a rabid dog~ and deterioration of
land values by permitting such useo
Mro Harris also advised that a sale for one of the adjacent properties
was lost when this use was approved by the City Planning Commissiono With
the apartments being built in this section, he called attention to the fact
that this area was destined to be heavy residentialo
Mro Harry Knisely~ Attorney representing the Applicant, addressed
the Council in rebuttal to remarks made by Mro Harriso He felt that to compare
the institution at La Palma and Euclid as a clinic~ not a hospital, had little
significanceo Regarding the noise, he advised that the proposed building
would have no windows and no outside runs3 and would be sound proof and odor
proofo Regarding deterioration of land values, he referred to the rising
land values near the La Palma and Euclid hospitalo He asked that the Council
TIote the pictures presented and advised that these installations were in R-3
areas and on main arteries, and one, even next to a restauranto He also
called attention to the present zoning i.n the immediate vicinity of the
proposed hospitalo
Dro Kopj.t addressed the Council, advising that he presently worked
in a sound proof hospi ta 1; -that the dogs are kept in a room where there are
no windows and there are three doors to any outside door, and as result, there
is no noise to be heard outsideo Regarding a health menace and rabid dogs,
he felt they actually served the public in providing for them during observationo
He stated that with modern anesthetics and tranquilizing drugs, there is no
problem of screaming pets in agony, neither is there a fly problem with modern
sanitation, nor attraction to other dogs in the areao A hospital in this
location is necessary to serve the people, as there isn~t one within three
mileso
The Mayor asked if anyone else wished to address the Council, there

Mrso Donald Frank, 8872 Lindsey Street~ addressed the Council, calling
attention to the problem of bringing pets into the hospitalo

his property, resulting from action taken by the City Planning Commission in

Dru Kopit advised that there was no problem in bringing pets into
the hospital, that cars can drive to within five feet of the door, and if
assistance is needed~ it is provided a
Councilman Coons felt that the lost sale of the property would not
necessarily establish the fact of deterioration of land va1ues~ as the use of
the proposed purchaser mi.ght not have been compatible to this use, and he
might not have purchased the property at any priceo
RESOLUTION NOo 57218 Councilman Pearson felt there was no danger in thi.s
operation; that his only interest is the right location, and in his opinion~

He advised that the required bond had been posted and necessary fees paid,
and recommended the approval of said mapa
Mr" Frederick Pack addressed the Council ~ agreeIng to ,stipulate by
deed restrictions9 after the tract map is recorded, to require plans of
development to be approved by the City Councilo He advised of a letter to
come before the City Council at their next meeting concerning the buildings
on the southerly lots, the requirement of the City Council that only half of
the bJildings be two story" and requested reconsideration to allow two=story

TRACT NOo 3396~ Mro Ray Swentek requested permission to address the Council
and advised that due to emergencY3 he had been unable to attend the last
Council meeting when the matter of requiring a fence was consideredo He
referred to commttments m,3,de by him prior to the effective date of the new
R=3 regulations and advised that plans had been in the Building Department
for p13n check prior to the effective date of this ordinanceo He related
other steps taken by him and requested that the order requiring the fence
be rescindedo
The City Council felt that further investigation should be made
and Mr0 Swentex wa~ requested to bring all facts to Mro Turner, so that
he could readvise the Counc 1 January 5, 19600
JlgSOLUTION OF CONDOLENCE~ The following Resolution of Condolence was offered
bv Councilman Frv and unanimously adopted by the City Council~
RESOLUTION OF CONDOLENCE
WHEREAS, the City Council of the City of Anaheim has been informed
of the untimely death of our esteemed friend, JOHN Jo DWYER; and
WHEREAS, John Ju Dwyer 9 Anaheim Pioneer, was well known for the
up building of this community and his interest in civic affairs, as well as
his long and important assoc ation with the citrus industry and water problems
of Orange County; and
WHEREAS, among his many generous contributions to our C1V1C welfare,
he gave to the people of Arnheim the present permanent home of the Anaheim
Chapter of the American Red Cross9 and through the Daughters of the American
Revolution donated the Mother Colony House; and
WHEREAS, he conscientiously served this community as a member of the
Anaheim Board of Trustees from 1916 to 1918~ and as Chairman of the Board from
1918 to 1920;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Anaheim~ that it deeply mourns the death of JOHN Jo DWYER~ and on behalf of
the people of Anaheim, extends sincere sympathy to his wife, Mrso Lera Mae
Dwyer~3.nd to other members of hi.s familyo
BE IT FURTHER RESOLVED, that this resolution be spread upon the
minutes of the City Council, and a copy thereof be forwarded to Mrso Dwyer 0
