RESOLUTION NO. 70R-574
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM DENYING CONDITIONAL USE PERMIT
NO. 1202.
WHEREAS, the City Planning Commission of the City of
Anaheim did receive a request for a Conditional Use Permit from
Bernardo Yorba, et aI, 5440 Santa Ana Canyon Road, Anaheim,
California, 92806, owner; Calprop Corp., 1900 Avenue of the
Stars, Suite 1400, Los Angeles, California, agent, to establish
a planned residential development with waiver of maximum build-
ing height within 150 feet of a R-A (Portion A only) on the
following described property situated in the City of Anaheim,
County of Orange, State of California, to wit:
PORTION A:
A portion of Tract 936 per Book 30, Pages 1 and 2,
Miscellaneous Maps in the City of Anaheim, County of
Orange, State of California, more particularly described
as follows:
Beginning at the southeast corner of said Tract 936;
thence along the southerly line of said Tract 936, North
890 12' 45" West, 1944.66 feet to the southeast corner of
Lot 3 of said Tract 936; thence along the easterly line
of said Lot 3, North 00 36' 15" East, 250.00 feet; thence
North 380 04' 28" East, 328.69 feet; thence North 00 36'
15" East, 815.06 feet; thence North 890 23' 45" East,
236.86 feet to a point on a tangent curve, concave to
the north, having a radius of 500.00 feet; thence easterly
and northerly along said curve, through a central angle
of 360 53' 45", an arc length of 321.98 feet to a point
on a tangent line; thence along said line, North 520 30'

along said curve through a central angle of 120 33' 39"
an arc length of 73.44 feet to a point on a non-tangent
line, said line being the easterly line of Lot 6 of said
tract, a radial through said point bears South 290 55' 41"

parallel to and 1224.98 feet from the southerly line of

corner of said lot; thence North 890 23' 45" East, 636.63
feet; thence South 00 36' 15" West, 815.06 feet; thence
South 380 04' 28" West, 328.69 feet to a point on the
easterly line of said Lot 3, said point bearing North 00
36' 15" East, 250.00 feet from the Point of Beginning;
thence South 00 36' 15" West, 250.00 feet to the Point
of Beginning.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon said
request on September 10, 1970 and continued to October 5, 1970
and October 19, 1970, notices of which said public hearing were
duly given as required by law and the provisions of Title 18,
Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, said Commission, after due inspection, inves-
tigation and studies made by itself and in its behalf and after
due consideration of all evidence and reports offered at said
hearing, did adopt its Resolution No. PC 70-187 denying Conditional
Use Permit No. 1202; and
WHEREAS, thereafter, within twenty-two (22) days from
the date of the adoption of said resolution, a written appeal
was filed with the City Council protesting the action of the
City Planning Commission in denying said Conditional Use Permit
and said appeal was set for public hearing on November 17, 1970
and continued to December 1, 1970, at the City Hall, in the City
of Anaheim, and notices of such public hearing were duly given
as required by law and the providions of Title 18, Chapter 18.76
of the Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such hearing
and did give all persons interested therein an opportunity to be
heard and did receive evidence and reports; and

WHEREAS, the City Council does find, after careful
consideration of the recommendations of the City Planning
Commission and all evidence and reports offered at said hearing,
that Conditional Use Permit No. 1202 should be denied.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the action of the City Planning Com-
mission denying Conditional Use Permit No. 1202 be, and the same
is hereby sustained, and that the request of Bernardo Yorba, et
al, owners; Calprop Corp, agent, is hereby denied.
THE FOREGOING RESOLUTION is approved and signed by me
this 1st day of December, 1970.
