RESOLUTION NO. 70R-535
A RESOLUTIO~ OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM GRANTING CONDITIONAL USE
PERMIT NO. 1204
WHEREAS, the City Planning Commission of the City of
Anaheim did receive an application for a conditional use permit
from Pacific Outdoor Advertising Company, as agent for Mark
and Don Jenkins, owners of the following described property:
All that certain land situated in the state of California,
County of Orange, described as follows:
That portion of Lot 4 of the Travis Tract, as shown on a
Map recorded in Book 5, page 120 of Miscellaneous Records
of Los Angeles County, California, described as follows:
Beginning at the intersection of the center line of Douglass
street, as conveyed to the County of Orange by deed recorded
October 7, 1926 in Book 682, page 109 of Deeds, records of
Orange County, California, with the center line of Struck
Avenue; thence North 00 04' 3011 West, along the center
line of Douglass Avenue, 400.02 feet to the Southwest cor-
ner of the land conveyed to M. B. Mora and others by deed
recorded February 26, 1960 in Book 5118, page 258 of Official
Records; thence South 890 32' 1011 East along the South line
of said land 504.91 feet to the Westerly line of the 70.00
foot easement conveyed to the Orange County Flood Control
District by deed recorded February 6, 1939 in Book 978, page
432 of Official Records; thence South 180 08' 50" West along
said Westerly line to said center line of Struck Avenue;
thence North 890 32' 10" West along said center line 373.62
feet to the point of beginning.
EXCEPT THEREFROM that portion deeded to the County of Orange
by Deed recorded December 21, 1965 in Book 7780 page 605 of
Official Records.
ALSO EXCEPT THEREFROM that portion deeded ~o Texaco Inc., a
Delaware corporation, by Deed recorded June 28, 1966 in
Book 7973 page 54 of Official Records.

AND WHEREAS, the City Planning Commission did. hold a
public hearing at the City Hall in the City o~ Anaheim upon
said application on ~eptember 2l ,19 70 , notices of '
which said public hear ng were duly given as required by law
and the provisions of Title 18, Chapter 18.76 of the Anaheim
MUnicipal Code; and
WHEREAS, said Commission, after due inspection, in-
vestigation and studies made by itself and in its behalf and
after due consideration of all evidence and reports offered at
said hearing did adopt its Resolution No. PC70-l73 Series

WHEREAS, thereafter within twenty-two (22) days from
the date of the adoption of said resolution, a written appeal
was filed with the City Council protesting the action of the
City Planning Commission in denying said conditional
use permit and said appeal was set for public hearing on
November 10 , 19 70 , at the City Hall, in the City of
Anaheim, and notices of such public hearing were duly given as
required by law and the provisions of Title 18, Chapter 18.76
of the Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such hear-
ing and did give all persons interested therein an opportunity
to be heard and did receive evidence and reports; and
WHEREAS, the City Council finds, after careful con-
sideration of the recommendations of the City Planning Commis-
sion and all evidence and reports offered at said hearing, that:
1. The proposed use is properly one for which a
conditional use permit is authorized by the
Anaheim Municipal Code.
2. The proposed use will not adversely affect the
adjoining land uses and the growth and development
of the area in which it is proposed to be located.
3. The size and shape of the site proposed for the
use is adequate to allow the full development of
the proposed use in a manner not detrimental to
the particular area nor to the peace, health,
safety and general welfare.
4. The traffic generated by the proposed use will not
impose an undue burden upon the streets and high-
ways designed and improved to carry the traffic in
the area.
5. The granting of the conditional use permit under
the conditions imposed will not be detrimental to
the peace, health, safety and general welfare of
the citizens of the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the action of the City Planning Commis-
sion in denying said conditional use permit be, and the
same is hereby r~vised , and that Conditional Use Permit
No. 1204 be, and the same is hereby, granted permitting
the establishment of a billboard on the aforedescribed property
with waivers of the following Anaheim Municipal Code requirements:
SECTION 18.64.050(2-b)
Minimum required structural
setbacks. (50 feet required;
3 feet proposed).
SECTION 18.63.050(c-l) Maximum permitted billboard
height. (36 feet permitted;
50 feet proposed).
That said Conditional Use Permit is hereby granted for a period
of one year, subject to review by the City Council at the end
of one year, with the stipulation that upon any other use of the
property the sign would be removed on 30 days' notice, and further
subject to the following conditions:
1. That subject property shall be developed substantially
in accordance with plans and specifications on file
with the City of Anaheim, marked Exhibits Nos. 1 and 2.

2, That adequate clearance of existing electrical lines
shall be provided as required by the Electrical
Division, Department of Public utilities, and the State
of California G.O. 95.
The City Council hereby reserves the right to revoke
such Conditional Use Permit for good cause or failure of said
owners, their heirs, successors or assigns to comply with the
Anaheim Municipal Code and regulations and the conditions herein.
THE FOREGOING RESOLUTION is approved and signed by me
this 10th day of November, 1970
