RESOLUTION NO. 70R-46l
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF AN~[M GRANTING CONDITIONAL USE
PERMIT NO. ~~96
WHEREAS. the City Planning Commission of the City of
Anaheim did receive an application for a conditional use permit
from Mariam C. Vierra, 1232 South Brookhurst, Anaheim, California
and ponderosa Homes, 4570 Campus Drive, Suite 10, Newport Beach,
California to permit the establishment of a child day care center
for use of the tenants only on the following described property
situated in the City of Anaheim, County of Orange, State of
California, to wit:
That portion of the northwest quarter of the northwest
quarter of Section 20, Township 4 South, Range 10 West, in
the Rancho Los Coyotes, City of Anaheim, County of Orange,
State of California, as said section is shown on a map
recorded in Book 51 page 10 of Miscellaneous Maps, in the
office of the County Recorder of said County, described as
follows:
Beginning at a point on the west line of the northwest
quarter of said Section 20 south 942.60 feet from the north-
west corner of said Section 20, said point being north
10.00 feet from the southwest corner of that certain 14.46
acre parcel of land conveyed to Lucy Frances Ball by deed
recorded June 16, 1897 in book 32 page 68 of Deeds, records
of Orange CountYi thence North 462.80 feet along said west
line to the northwest corner of said 14.46 acre parcel;
thence east 1332.30 feet along the north line of said 14.46
acre parcel to the northeast corner of said 14.46 acre par-
cel; thence Soath 222.80 feet along the east line of said
14.46 acre parcel; thence west 550.94 feet parallel with
the north line of said 14.46 acre parcel thence south 240.00
feet parallel with the east line of said 14.46 acre parcel
to a point north 10.00 feet from the south line of said 14.46
acre parcel; thence west 780.66 feet, parallel with said
south line to the point of beginning.
Except that portion thereof, if any, included within the
Kellogg Homestead Tract, as per map recorded in book 8
page 51 of said Miscellaneous Maps.

AND WHEREAS, the City Planning Commission did-hold a
public hearing at the City Hall in the City ot Anaheim upon
said application on Auqust 24 . 19 70 ,notices of
which said public he.ring were duly given as required by law
and the provisions of Title 18, Chapter 18.76 of the Anaheim
MUnicipal Code; and
WHEREAS, sa1d Commission. after due inspection, in-
vestigation and studies made by itself and in its behalf and
after due consideration of all evidence and reports offered at
said hearing did adopt its Resolution ~o. ?r70-1~~ Series

WHEREAS, thereafter, within twenty-two (22) days from
the date of the adoption of said resolution, the City Council
did elect, upon its own motion, to review the action of the
City Planning Commission in ~rantina said conditional use
permit and did thereupon fix t e 22n~ day of ~,
19~, as the time and the Council hamber in theCit~
o~City of Anaheim as the place for a public hearing upon
said conditional use permit, and notices of such public hearing
were duly given as required by law and the provisions of Title
18, Chapter 18.76 of the Anaheim MUnicipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such hear-
ing and did give all persons interested therein an opportunity
to be heard and did receive evidence and reports; and
WHEREAS, the City Council finds, after careful conside-
ration of the recommendations of the City Planning Commission
and all evidence and reports offered at said hearing, that:

The proposed use is properly one for which a
conditional use permit is authorized by the
Anaheim MUnicipal Code.
The proposed use will not adversely affect the
adjoining land uses and the growth and development
of the area in which it is proposed to-be located.
The size and shape of the site proposed .for the
use is adequate to allow the full development of
the proposed use in a manner not detrimental" to the
particular area nor to the peace, health, safety
and general welfare.
The traffic generated by the proposed use will not
impose an undue burden upon the streets and high-
ways designed and improved to carry the traffic in
the area.

The granting of the conditional use permit under
the conditions imposed will not be detrimental to
the peace, health, safety and general we.1fare of
the citizens of the City of Anaheim.
NOW, THEREfORE, BE IT RESOLVED by the City Council of
the City of Anaheim tbat the action of the City Planning Com-
mission SJlrnH ~ said conditional use permit be, and
the same is ereb --W1sta i Q-~a , and that Conditional Use
Permit No.. 1196 be, and the same is hereby, granted
permitting the establishment of a child day care center for the
use of tenants only on the property hereinbefore described sub-
ject to the following conditions:

1. That this conditional use permit is granted subject
to the completion of Reclassification No. 70-71-9.
2. That subject property shall be developed substantially
in accordance with plans and specifications on file
with the City of Anaheim, marked Exhibit No.1.
The City Council hereby reserves the right to revoke
such Conditional Use Permit for good cause or failure of said
owners, their heirs, successors or assigns to comply with the
Anaheim Municipal Code and regulations and the conditions herein.
