A RESOLU~ION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM dENYING VARIANCE NO. 2176.
WHEREAS, 'the City Planning Commission of the City of
Anaheim did receiv~ a petition for zoning variance from Modular
Technology, Inc., ~s agent for Raymond DinkIer, owner of certain
real property situ~ted in the City of Anaheim, County of Orange,
State of Californi~, described as follows:
PARCEL 1:
Those portion~ of the fractional northwest quarter of
Section 7, in !Township 4 South, Range 9 West, San
Bernardino Ba~e Meridian, in the City of Anaheim,
County of Ora~ge, State of California, described as
follows:
Beginning at 'Uhe northwest corner of said Section 7. thence
easterly alon~ the north line of said Section, 277.A6 feet,
more or less ,to the westerly line of Lot 22 in Block K
of the Kraeme~ Tract, as shown on a map thereof recorded
in Book 12, p~ge 87, Miscellaneous Records of Los Angeles
County, California, and also shown on a map of the Golden
State Tract, ~ecorded in Book 4, pages 66 and 67, Mis-
cellaneous Maps, records of said Orange County; thence South
610 15' East along said last described line, 778.80 feet
to the southw~st corner of said Lot 22; thence South 870
52' West 251.71 feet to the northwest corner of land
described in negistrar's Certificate of Title No. 10,466;
thence South 00 14' West along the west line of said land
697.95 feet to the southwest corner of said land described
in Registrar'S Certificate of Title No. 10,466; thence South
890 48' West to a point in the west line of said Section 7,
which is distant northerly, measured along said west line,
1576.70 feet trom the east and west centerline of said
Section 7; thence North 1063.30 feet, more or less, to the
point of beginning;
EXCEPT THAT PORTION DESCRIBED AS FOLLOWS:
Beginning at the intersection of the north line of said
Section 7; with the southwesterly line of Lot 22 in Block
K of the Kraemer Tract, as shown on a map thereof recorded
in Book 12, p$.ge 87, Miscellaneous Records of Los Angeles
County, Calif~rnia, said Lot 22 includes for this descrip-
tion, a tract o~ land shown on a map o~ the Golden State
Tract, as shown on a map thereof recorded in Book 4, pages
66 and 67, Mi$cellaneous Maps, records of said Orange County,
as bein~ appl"d>ximately gO feet wid~, along the southwesterly
side of said Lot 22; thence from said point of beginning
along said southwesterly line of Lot 22, South 610 04' 14"
East 173.33 feet; thence northwesterly, from a tangent
which bears North 670 32' 36" West along a curve concave
northeasterly 1 having a radius of 4871. 00 feet , through an
angle of 20 2ts' 12", an arc distance of 209.99 feet to the
intersection thereof with the north line of said Section 7;

pages 66 and 617, Miscellaneous Maps, records of Orange
County, in thei City of Anaheim, County of Orange, State of
California, delscribed as follows:
Beginning at tlhe westerly corner of Lot 4 in Block 23 of
the Golden St~te Tract~ thence easterly along the northerly
line of said ~ot, 229.q feet; thence South 00 13' East
159.90 feet to a point on the southerly line of said lot
which is dist~t 262.8 feet southeasterly measured along
the southweste!rly line of said lot from the westerly corner
of said lot, siaid point also being the most northerly corner
of that certatn triangular tract of land excepted from
description in Registrar's Certificate of Title No. 1023;
thence contin~ing South 00 13' East 141 feet to the south-
west corner ot said triangular tract; thence North 890 50'
West along the westerly prolongation of the southerly line
of said triangJular tract, 7.55 feet, more or less, to an
intersection with a line parallel with and distant 1331.32
feet East of the west line of Section 7, Township 4 South,
Range 9 West, San Bernardino Base and Meridian; thence South
00 01' West along said parallel line 459.80 feet to a point
in the northerly line of the 248.50-foot parcel of land
excepted from the description in parcel 2in Registrar's
Certificate of Title No. 98.54; thence South 890 !t8' West
along the northerly line of said excepted 248.50-foot parcel,
603.73 feet; thence North 00 14' East 697.95 feet; thence
North 870 52' East 251. 71 feet to the southwest corner of
Lot 22 in Blook K of the Kraemer Tract, as shown on a map
recorded in Book 12, page 87 of Miscellaneous Records of
Los Angeles Cqunty, California, as said southwest corner is
described in Registrar's Certificate of Title No. 9854; thence
easterly along the southerly line of said lot, 132 feet to
the point of beginning.
Excepting therefrom any portion thereof lying within
Riverside Freeway, as described in an instrument recorded
June 11, 1964 in Book No. 7083, page 32, Official Records,
and other instruments of record deeded to the State of
California for freeway purposes.
AND WHE~AS, the City Planning Commission did hold a
public hearing at ~he City Hall in the City of Anaheim on June
15, 1970, notice of which said public hearing was duly given as
required by law and the provisions of Title 18, Chapter 18.76 of
the Anaheim Municipal Code; and
WHEREAS, said City Planning Commission after due inspec-
tion, investigatiort and studies made by itself and in its behalf,

and after due cons!deration of all evidence and reports offered
at said hearing, did adopt Resolution No. PC 70-97 denying said
variance; and
WHEREAS, thereafter within twenty-two (22) days from
the date of the adqption of said resolution. the City Council
did elect J upon it~ own motion. to review the action taken by the
City Planning Comm~ssion in denying said variance and did set a
public hearing the*eon to be held on the 30th day of June, 1970,
at 7:00 o'clock P.M. in the City Hall in the City of Anaheim, and
notice of such public hearing was duly given as required by law
and the provisions of Title 18, Chapter 18.76 of the Anaheim
Municipal Code; and
WHEREAS, the City Council does find that:
1. There is no substantial property right possessed
by other iproperty in the same vicinity and zone
and denied the subject property.
2. It appea~s that the subject property can be
adequate1y developed and used under the present
zone.
NOW. THEijEFORE J BE IT RESOLVED by the City Council of
the City of Anaheina that the action of the City Planning
Commission in deny:ffng said variance bet and the same is hereby,
sustained.
THE FOREGOiNG RESOLUTION is approved and signed by me this
