70R-320 RESOLUTION NO. 70R-320 A RESOLU~ION OF THE CITY COUNCIL OF THE CITY OF ANAHE~M DENYING VARIANCE NO. 2178. WHEREAS, the City Planning Commission of the City of Anaheim did receiv~ a petition for zoning variance from William D. Richardson, San~a Ana, as agent for Decon Corporation, Santa Ana, owner of cert~in real property situated in the City of Anaheim County of drange, State of California, described as follows: All that certctiin land situated in the State of California, County of Orange, City of Anaheim, described as follows: Those portions of Lots 4,5, and 6 of the J.D. Taylor Tract, as shown on a ~ap recorded in book 36, pages 58 to 60, inclusive of ~iscellaneous Records, records of Los Angeles County, Califo~nia, together with the Northerly half of Glen Avenue adooining said Lots on the South and abandoned by Resolution Of the Board of Supervisors of Orange County, California, on March 8, 1907 entered in Minute Book 7, page 58 and that po~tion of Old Jefferson Street vacated and abandoned by Resolution No. 69R-700, a certified copy of which was recorded December 15, 1969 in book 9164, page 550 of Official Records records of said Orange County, described as follows: Beginning at the intersection of the Northeasterly line of Jefferson Street with the Southerly line of Batavia Street as shown on a Map filed in State Highway Map book 6, pages 25 and 26, rec~rds of said Orange County, said Northeasterly line being the Northeasterly line of Tract No. 4643, as shown on a map recorded in book 195, pages 35, 36 and 37 of Miscellaneous ~aps records of said Orange County; thence Southerly alon, said Northeasterly line of Jefferson Street, being a curve concave Southwesterly having a radius of 1250.00 feet, through a central angle of 100 27' 53" an arc distance of 22$.31 feet; thence radial to said curve South 630 38' 53" West to the Westerly line of said Lot 5; thence Southerly alon~ said Westerly line to the centerline of said Glen Avenue; thence Easterly along said centerline 725.76 feet to the Northwesterly corner of the land described in deed to the State of California recorded August 22, 1968 in book 8698, page 564 of Official Records of said Orange County; thence North 430 31' 1411 West 169.31 feet; thence North 370 23' 07" West 105.78 feet; thence North 430 59' 29" West 199.10 feet to the Eaaterly terminus of that certain course shown as IISouth 820 06' 19" West, 85.26 feetll in the Southerly line of Parcel 2 of ReI - 637 on said State Highway Map; thence along said Southerly line South 82" 06' 19" West 85.26 feet, South 560 53' 27" West 67.39 feet and South 820 25' 05" West 395.79 feet to the point of beginning. Excepting from a portion of said land all oil oil rights, minerals, mineral rights, natural gas, natural gas rights, and other hydrocarbons, by whatsoever name known, that may be within or under the parcel of land herein described, without, however, the right ever to drill, dig or mine through the surface of said land, therefor, or otherwise develop same in such manner as to endanger the safety of any -1- highway that ~ay be constructed on the lands herein described, as reserved in the deed from Bryan L. Berkley and others to State of Cali~ornia, filed in the office of the Registrar of Titles of Orange County, California, March 19, 1953 as Document No. 26916. AND WHER&AS, the City Planning Commission did hold a public hearing at ~he City Hall in the City of Anaheim on June 2, 1970, notice of wh~ch said public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said he~ing, did adopt Resolution No. PC 70-85 denying said variance; and WHEREAS, thereafter within twenty-two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its, own motion, to review the action taken by the City Planning Commi~sion in denying said variance and did set a public hearing thereon to be held on the 30th day of June, 1970, at 1:30 o'clock P.M. in the City Hall in the City of Anaheim, and notice of such public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municip~l Code; and WHEREAS, the City Council does find that: 1. There is no substantial property right possessed by other ~roperty in the same vicinity and zone and denied the suboect property. 2. It appear~ that the subject property can be adequately developed and used under the present zone. NOW, THE~ORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commis- sion denying said v~riance be and the same is hereby sustained.
