A RESOLUTJON OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM ACCEPTING A SEALED PROPOSAL AND
AWARDING A CONTRACT TO THE LOWEST RESPONSIBLE
BIDDER FOR THE FURNISHING TO THE CITY OF
ANAHEIM or CAST IRON WATER PIPE AND FITTINGS.
WHEREAS, the City Council of the City of Anaheim did
cause to be publish~d in a newspaper of general circulation,
printed, published and circulated in the City of Anaheim, to
wit: The Anaheim BUlletin, on March 19th and 26th, 1970, a
notice inviting sealed proposals for the furnishing to the
City of Anaheim, in approximate quantities, of the following
cast iron water pipe and fittings:
ITEM I 1,000 feet of 4 inch cast iron pipe
ITEt4: II 3,000 feet of 6 inch cast iron pipe
ITEtvI III 6,000 feet of 8 inch cast iron pipe
ITEM IV 7,000 feet of 10 inch cast iron pipe
ITEM V 7,000 feet of 12 inch cast iron pipe
ITEM VI 30,000 pounds of Tyton Joint Fittings
ITE~1. VII 20,000 pounds of regular fittings,
caulk type
AND WHEREAS, said notice did provide that said pipe
and fittings shall be in accordance with "Specifications for
Cast Iron Water Pipe, Series of 1970 - City of Anaheim"; and
WHEREAS, such notice inviting proposals for said
cast iron water pipe and fittings did provide that said sealed
proposals would be received by the City of Anaheim at the Office
of the City Clerk of said City up to the hour of 2:00 o'clock
P.M. on April 2, 1970, for the furnishing to said City of said
water pipe and fittings; and
WHEREAS, the City Clerk of the City of Anaheim did
receive sealed proposals prior to 2:00 o'clock P.M. on April 2,
1970, for the furnishing of said cast iron water pipe and
fittings, which proposals were opened on said date in public,
in the City Council Chambers in the City Hall, in the City of
Anaheim, by the City Clerk and the purchasing Agent, and duly
tabulated by the Purchasing Agent and the result thereof reported
to the City Council at its next regular meeting, for action
thereon by said city Council. That sealed proposals were re-
ceived from the following persons, firms or corporations in the
amounts set forth:

AND, WHERBAS, the City Council does find that the
sealed proposal of the PACIFIC STATES CAST IRON PIPE COMPANY,
6399 Wilshire Boulevard, Room 401, Los Angeles, California,
90048, is the lowest responsible bid for the furnishing of
cast iron water pipe and fittings specified in Items I, II, III,
IV, V, VI and VII of the notice inviting sealed proposals and
in accordance with the specifications set forth in said notice
inviting sealed proposals, and that said proposal of Pacific
States Cast Iron Pipe Company should be accepted and a contract
awarded to said company for furnishing said pipe and fittings
to the City of Anaheim.
NOW, THEREFORE, BE IT P~SOLVED by the City Council of
the City of Anaheim that said proposal submitted by the Pacific
States Cast Iron Pipe Company for the furnishing of cast iron
water pipe and fittings, as specified in the notice inviting
sealed proposals therefor and in accordance with and conformity
to ilSpecifications for Cast Iron Water Pipe, Series of 1970 -
City of Anaheim," be, and the same is hereby, accepted and that
a contract for the furnishing of said water pipe and fittings be,
and the same is hereby, awarded to said Pacific States Cast
Iron Pipe Company; and
BE IT FURTHER RESOLVED that the award of a contract to
said Pacific States Cast Iron Pipe Company is declared to be
for the approximate quantities set forth in the notice inviting
sealed proposals and that the actual amounts required by the
City may be substantially more or less than these amounts; and
BE IT FURTHER RESOLVED that said Pacific States Cast
Iron Pipe Company be, and it is hereby required to execute, a
contract, in required form satisfactory to the City of Anaheim and
upon the terms and conditions specified in the notice inviting
sealed proposals and the proposal submitted by it, and in accord-
ance with the specifications for cast iron water pipe and fittings
as set forth in said notice invitinq sealed proposals for the
furnishing of said cast iron water pipe and fittings hereinabove
more particularly set forth, in all required lengths, at the
prices as follows:

AND BE IT FURTHER RESOLVED by the City Council of the
City of Anaheim that said bid be, and the same is hereby accepted
and said contract awarded for the above prices for said cast iron
pipe and fittings, f.O.B. Anaheim, sales tax included, said pipe
and fittings to be delivered as required by the City of Anaheim
during a period not' exceeding 12 months from date of contract.
BE IT FURTHER RESOLVED that the Mayor and the City
Clerk of the City of Anaheim be, and they are hereby, authorized
and directed to execute for and on behalf of the City of Anaheim
with said Pacific States Cast Iron Pipe Company a written contract
for the furnishing of said cast iron water pipe and fittings
hereinabove set forth and in accordance with the "Specifications
for Cast Iron Water Pipe, Series of 1970 - City of Anaheim," the
notice inviting sealed proposals and the terms of this resolution
and the contract approved by the City Attorney of the City of
Anaheim; and
BE IT FUR~HER RESOLVED that said contract shall contain
a provision that sh~uld said Pacific States Cast Iron Pipe
Company fail or neglect to furnish said cast iron pipe and/or
fittings in accordance with said specifications and the sealed
proposal submitted by it and accepted by the City as herein
specified, it shall, in addition to any other penalties provided
in the contract documents, be liable to the City of Anaheim for
all loss or damages that the latter may suffer on account thereof.
THE FOREGOING RESOLUTION is approved and signed by me
this 7th day of April, 1970.
